CITY OF CORCORAN City Council Meeting Minutes December 21, 2020 - 7:00 pm The Corcoran City Council met on December 21, 2020, in Corcoran, Minnesota. Pursuant to Minnesota Statute Section 13D.021 and due to the COVID-19 pandemic, the City Council meeting was held remotely through electronic means using the audio and video conferencing platform Zoom. Mayor Thomas was present at City Hall and present via telephonic or other electronic means were Councilor Bottema, Councilor Lother, Council Nichols, and Councilor Schultz. Also present were City Administrator Martens and Administrative Services Director Beise. Director of Public Safety Gottschalk and Public Works Director Mattson were present via telephonic or other electronic means. 1. Pledge of Allegiance Mayor Thomas invited all in attendance to rise and join in the Pledge of Allegiance. 2. Call to Order / Roll Call Mayor Thomas called the meeting to order at 7:00 pm. 3. Agenda Approval City Administrator Martens noted addition of Item 9d. Liability Coverage Waiver. MOTION: made by Lother, seconded by Bottema to approve the agenda as modified. Voting Aye by Roll Call Vote: Thomas, Bottema, Lother, Nichols, and Schultz (Motion carried 5:0) 4. Commission Representatives Mayor Thomas noted Planning Commission Vehrenkamp and Parks was present, and Trails Commissioner Meister was excused. 5. Open Forum (Public Comment Opportunity) Mayor Thomas invited residents to communicate telephonically during the Open Forum discussion for items not included on the agenda. Administrative Services Director Beise explained the instructions to participate in the meeting via the Zoom video format and reviewed instructions for participation in the meeting through telephone or computer. Dean Vehrenkamp, 9310 Bechtold Road, addressed Council regarding 22080 Bass Lake Road, and construction of new structures recently built located at the property. City Administrator Martens noted staff will review and respond to Mr. Vehrenkamp’s inquiry. 6. Consent Agenda a. Draft Minutes of December 10, 2020 Council Meeting b. Financial Claims c. 2021 Polling Place Locations d. Resignation – Paul Moretto, Planner e. Pay Request #1; Change Order #1 – City Hall Remodel f. Re-zoning to Rural Commercial from Transitional Rural Commercial – 23240 County Road 30 g. Final Plat for Kariniemi Addition h. Job Offer – Maintenance Worker Council requested item 6c., 6f., and 6g., be discussed further. MOTION: made by Nichols, seconded by Schultz to approve the consent agenda items 6a., 6b., 6d., 6e., and 6h. Voting Aye by Roll Call Vote: Thomas, Bottema, Lother, Nichols, and Schultz (Motion carried 5:0) Council reviewed item 6c. 2021 Polling Place Locations and thanked St. Thomas the Apostle Church and Hope Lutheran Church for participating as an election polling place. MOTION: made by Schultz, seconded by Bottema to approve item 6c. Polling Place Locations. 2 Voting Aye by Roll Call Vote: Thomas, Bottema, Lother, Nichols, and Schultz (Motion carried 5:0) Council discussed item 6f. Rezoning of Rural Commercial from Transitional Rural Commercial – 23240 County Road 30 and noted some of the factors Council must consider in rezoning properties and impacts rezoning causes to surrounding properties. Council discussed deferring the item to a future Council meeting and including specific site plans before rezoning. Council reviewed the current zoning of the property directly across the street from 23240 County Road 30. City Planner Lindahl noted an initial conversation with the applicant and City Engineer, for the continued planned development of the site, the existing CUP, and the conversion of an existing house into an office requiring rezoning of the property. City Planner also noted this rezoning request is part 1 of the master development plan submitted by applicant. City Planner Lindahl explained the rural commercial district existing today will remain the same until development is proposed, and once development is initiated, as outlined in the Comprehensive Plan the City would rezone some properties to rural commercial. City Planner Lindahl noted the property south of County Road 30 has already been rezoned to rural commercial. City Planner Lindahl noted the existing CUP remains unchanged, with no outside parking or storage allowed. City Planner Lindahl explained the rezoning allows applicant to apply for a building permit to convert the home to an office. City Planner Lindahl also noted the rezoning does allow applicant to apply for a CUP permit in a broader use more in line with other uses in the rural commercial use category. Council discussed negotiation and seeing site plans prior to rezoning. Council discussed current ordinances and denying application would necessitate a moratorium on all building applications. Council discussed notification to impacted properties. MOTION: made by Schultz, seconded by Bottema to approve item 6f. Rezoning of Rural Commercial from Transitional Rural Commercial – 23240 County Road 30, as presented. Voting Aye by Roll Call Vote: Thomas, Bottema, Lother, and Schultz Nay: Nichols (Motion carried 4:1) Council reviewed item 6g. Final Plat for Kariniemi Addition and discussed the proposed plan and adequate fire access to the third property on the plat. Council discussed the issue of private drives and if item should be reviewed in the preliminary plat stage. City Administrator Martens reviewed fire department processes regarding private drives and accessing most of the properties with fire trucks in Corcoran will not allow for the ability to have fire trucks side by side to fight a fire, and noted most rural driveways in Corcoran are similar. City Planner Lindahl also noted the plat meets the fire and city requirements and the departments utilizing water trucks that move in and out and refill when a fire occurs. Council discussed an issue with water drainage and culvert issues at the third property driveway. MOTION: made by Schultz, seconded by Thomas to approve item 6g. Final Plat for Kariniemi Addition. Council discussed the possibility of the engineers being wrong about drainage and who is responsible for that liability. City Administrator Martens noted culverts do freeze and the City has easements for the City to assist with releasing the blocked culvert. Council discussed the use of transfer process regarding building rights and buildable land, and would like to place a formal request to review buildable rights ordinances in 2021 and requested a review of the noise ordinance. Council asked for clarification of development rights and how the ordinance works. City Planner Lindahl used an example of a merger of parcel A and B, and then parcel is subdivided, and upon the merger, the building rights, are merged and then redistributed into the single parcel. Council asked if the preliminary plat differs from the final plat. City Planner Lindahl noted septic system plans from Hennepin County have been completed and the HOA documents are completed at the final plat phase. Council indicated denial of preliminary plat is limited by Council. Council inquired about vacating easements and Public Hearing. City Planner Lindahl responded the easement is an existing easement over the wetlands and exists from the original plat, and is vacated so there is not a double easement on the property. Unfinished Business No planning business was heard. 9. New Business (Public Comment Opportunity) Mayor Thomas invited residents to communicate telephonically during the Public Comment Opportunity. Administrative Services Director Beise explained the instructions to participate in the meeting via the Zoom video format and reviewed instructions for participation in the meeting through telephone or computer. No residents participated in the Public Comment Opportunity. a. 2021 Fee Schedule City Administrator Martens presented the 2021 Fee Schedule with amendments and updates. Council requested a review of fee schedules and noted an example of the window fee. MOTION: made by Schultz, seconded by Lother to approve Ordinance 2020-414 Adopting 2021 Fee Schedule. Voting Aye by Roll Call Vote: Thomas, Bottema, Lother, Nichols, and Schultz (Motion carried 5:0) b. 2021 Water and Sanitary Sewer Budgets City Administrator Martens reviewed the proposed 2021 Water and Sanitary Sewer Budget and noted expenditure and revenue projections and difference of budgets within years, and noted the budget is based on the long-term budget by the City. MOTION: made by Bottema, seconded by Schultz to approve Resolution 2020-100 Adopting Water and Sanitary Sewer Budgets as presented. Voting Aye by Roll Call Vote: Thomas, Bottema, Lother, Nichols, and Schultz (Motion carried 5:0) c. 2020 Year in Review City Administrator Martens reviewed the highlights of the year in 2020, noting all of the regular business, in addition to working in COVID related conditions, and growth in the City in challenging year. City Administrator Martens thanked Council for all of their work within this challenging year. d. Liability Coverage Waiver Administrative Services Director Beise outlined municipal tort liability coverages. City Administrator Martens noted it is typical for cities to limit financial exposure. Council discussed an example of what municipal tort liability coverage may look like. MOTION: made by Schultz, seconded by Nichols to decline waiving monetary limits on municipal tort liability established by Minnesota Statute 466.04 and authorize the Mayor to sign the liability coverage waiver form. Voting Aye by Roll Call Vote: Thomas, Bottema, Lother, Nichols, and Schultz (Motion carried 5:0) 10. Staff Reports a. Active Corcoran Planning Applications Council received reports as presented. b. Pandemic Response Update City Administrator Martens reviewed staff operations and work completed over the past months through the pandemic. 11. Presentations/Recognitions a. Resolution Honoring Brian Lother Mayor Thomas read Resolution 2020-101 Honoring Brian Lother aloud. Council thanked Councilmember Lother for his dedicated service to the City of Corcoran and residents. MOTION: made by Nichols, seconded by Schultz to adopt Resolution 2020-101 Honoring Councilmember Brian Lother. Voting Aye by Roll Call Vote: Thomas, Bottema, Nichols, and Schultz Abstain: Lother (Motion carried 4:0:1) b. Resolution Honoring Mayor Ron Thomas 4 Councilmember Bottema read Resolution 2020-102 Honoring Ron Thomas aloud. Council thanked Mayor Thomas for his long-standing commitment and dedication on the Council and as Mayor to the City of Corcoran and residents. Mayor Thomas thanked staff and Council for all of their continued effort, work and commitment to the residents of the City of Corcoran. MOTION: made by Lother, seconded by Schultz to adopt Resolution 2020-102 Honoring Mayor Ron Thomas. Voting Aye by Roll Call Vote: Bottema, Lother, Nichols, and Schultz Abstain: Thomas (Motion carried 4:0:1) 12. Closed Session a. City Administrator Performance Evaluation Mayor Thomas stated “Under the authority of Minn. Stat. 13D.05 subd. 1(d), 3(a) the City is permitted to close a meeting to evaluate the performance of an individual who is subject to its authority. The City Council is going into closed session to evaluate the performance of the City Administrator.” Mayor Thomas recessed the Council meeting at 8:03 pm. Mayor Thomas reconvened the Council meeting at 8:51 pm. Mayor Thomas stated, “In the closed session the City Council evaluated the performance of the City Administrator. The City Council found the City Administrator’s performance to be very good. Also, in the closed session the City Council discussed the compensation of the City Administrator.” MOTION: Made by Nichols, seconded by Bottema to increase the 2021 Salary of the City Administrator by 2.75 percent which is the same rate for all City employees. Council noted the work City Administrator Martens has accomplished for the City of Corcoran and for C ouncil. Council noted the proposed increase was a higher than 2.75 percent, however, City Administrator Martens declined the additional increase. We will audit the financial statements of the governmental activities, the business-type activities, each major fund and the aggregate remaining fund information, including the related notes to the financial statements, which collectively comprise the basic financial statements of the City as of and for the year ended December 31, 2020. If, for any reason, we are unable to complete the audit or are unable to form or have not formed opinions, we may decline to express opinions or may withdraw from this engagement. Audit Procedures-General An audit includes examining, on a test basis, evidence supporting the amounts and disclosures in the financial statements; therefore, our audit will involve judgment about the number of transactions to be examined and the areas to be tested. An audit also includes evaluating the appropriateness of accounting policies used and the reasonableness of significant accounting estimates made by management, as well as evaluating the overall presentation of the financial statements. Our preparation of the trial balance will be limited to formatting information in the general ledger into a working trial balance. We will also use the financial statements to complete the Office of the State Auditors' Reporting Forms. We will accumulate capital asset information and calculate the depreciation based on lives and methods determined by management. We will also assist with entries to convert from the modified accrual basis of accounting to the full accrual basis of accounting for long-term assets, long-term liabilities, and related deferred inflows of resources, deferred outflows of resources, revenues and expenses from information provided by management. We will also assist with year end accrual entries from information provided by management. Management Responsibilities Management is responsible for designing, implementing and maintaining effective internal controls relevant to the preparation and fair presentation of financial statements that are free from material misstatement, whether due to fraud or error, including monitoring ongoing activities; for the selection and application of accounting principles; and for the preparation and fair presentation of the financial statements in conformity with U.S. generally accepted accounting principles. Management is also responsible for making all financial records and related information available to us and for the accuracy and completeness of that information. To receive one (1) paper report, you will be charged $150 for a set-up fee. Additional paper copies will be charged at the rate of $50 per report. You may also be billed for travel and other out-of-pocket costs such as report production, typing, postage, etc. if not included in the fee listed above. The fee is based on anticipated cooperation from your personnel and the assumption that unexpected circumstances will not be encountered during the engagement. If significant additional time is necessary, we will discuss it with you and arrive at a new fee before we incur the additional costs. Our invoices for these fees will be rendered each month as work progresses and are payable on presentation. Amounts not paid within 30 days from the invoice date will be subject to a late payment charge of .66 percent per month (8 percent per year). If for any reason the account is turned over to collections, additional fees will be added to cover collections cost. In accordance with our Firm policies, work may be suspended if your account becomes 60 days or more overdue and may not be resumed until your account is paid in full. We will agree on a mediator, but if we cannot, either of us may apply to a court having personal jurisdiction over the parties for appointment of a mediator. We will share the mediator’s fees and expenses equally, but otherwise will bear our own attorneys’ fees and mediation cost. Participation in such mediation shall be a condition to either of us initiating litigation. In order to allow time for the mediation, any applicable statute of limitations shall be tolled for a period not to exceed 120 days from the date either of us first requests in writing to mediate the dispute. The mediation shall be confidential in all respects, as allowed or required by law, except our final settlement positions at mediation shall be admissible in litigation solely to determine the prevailing party’s identify for purposes of the award of attorneys’ fees. In the event you fail to make a payment for services or to reimburse for costs advanced by the Firm on your behalf, the Firm reserves the right to take all legally permissible action, including commencement of litigation in lieu of mediation, and shall have the right to collect its costs, including reasonable attorney’s fees, incurred in any such collection or litigation activities. Should the City of Corcoran desire to employ the Firm’s partner(s) or employee(s) involved in the performance of any audit, review or attest service for or relating to the City at any time during the then current fiscal year of the City up to and including the date of the audit report for that year, or in the twelve months preceding the audit report date for the immediately preceding year, it must have the written consent of the Firm to enter into an employment contract with the Firm partner or employee. Should the Firm agree to such arrangement, the agreement will include a payment equal to 200% of the partner or employee’s current annual salary. Professional and certain regulatory standards require us to be independent, in both fact and appearance, with respect to the City in the performance of our services. The City shall not, during the term of this agreement and for the twelve months following its termination for any reason, without the prior written consent of the Firm, solicit for employment, or hire any current or former partner or professional employee of the Firm, or any affiliate thereof, if such partner or professional employee has been involved in the performance of any audit, review, or attest service for or relating to the City at any time during the then current fiscal year of the City up to and including the date of the audit report for that year, or in the twelve months preceding the audit report date for the immediately preceding year. In connection with this engagement, we may communicate with you or others via email transmission. As emails can be intercepted and read, disclosed, or otherwise used or communicated by an unintended third party, or may not be delivered to each of the parties to whom they are directed and only to such parties, we cannot guarantee or warrant that emails from us will be properly delivered and read only by the addressee. The criminal prosecution services include the prosecution of petty misdemeanors, misdemeanors and gross misdemeanors as they occur; review and preparation of criminal complaints and consultation and advice with officers and police administration. Areas of oversight include right-of-way management, building permit processes, stormwater compliance, and asset tracking. The Construction Services Coordinator serves as a primary contact for property owners, developers, and other agencies interested in pursuing construction related activities. Scope of Impact: The Construction Services Coordinator works under the supervision of the Public Works Director and is expected to perform assigned duties without a need for significant work direction on daily tasks. Areas that require clarification of intent or interpretations that may establish a precedent are presented to the proper authority for a determination. The position’s supervisory responsibilities include oversight and work direction to the contract Building Official, contract construction field staff, and seasonal workers (assisting in asset management data collection). Council Meeting: January 14, 2021 Prepared By: Brad Martens Topic: City Council Goal Setting Work Session Action Required: Direction Summary: Annually the City Council typically holds a goal setting work session to provide staff direction on the priorities of the City. At the direction of Council, staff has looked into available times and recommends the following two sessions for City Council goal setting: • Session #1: Wednesday, January 20, 2021 – 4:00 pm – 7:00 pm • Session #2: Wednesday, February 3, 2021 – 4:00 pm – 7:00 pm In order to be as productive as possible, staff recommends hiring the services of a facilitator to assist in the discussions. Staff recommends continuing with Phil Kern who is the City Administrator for the City of Delano. Phil assisted the Council in 2020 and has experience assisting several city councils in goal setting initiatives. Staff has obtained a proposal from Mr. Kern in the amount of $2,600. In 2020, the amount was $2,300, however that was for one session rather than two. In addition to the schedule and recommended facilitator, staff also requests direction on the following items: • Virtual or in-person event o Legislative meetings are not subject to the same family maximums so an in- person meeting is allowed if mitigating factors can be implemented such as social distancing. While City Hall does not have a large enough space available, the Public Works facility would work to host the meeting. A virtual meeting is also an option. • Attendees o Invited attendees should include the City Administrator and Department Heads. Staff is also interested on whether or not commissioners should be invited. The COVID-19 pandemic does make this challenging. If commissioners are requested to be invited, perhaps it could be limited to the chair and vice-chair of each commission. o These sessions are open to the public to attend. Staff will make ready a distanced seating area should individuals wish to attend the public meeting. • Recording options o At minimum the meeting is required to be audio recorded. Staff does have access to a video camera. Council should direct staff on whether or not a video recording should take place. • Food o The proposed work sessions are over the typical dinner time and most members will be coming form work. In the past, the City has provided boxed lunches for participants. Council should direct staff whether or not to coordinate boxed lunches. Page 2 Previously adopted items are attached to this report. I enjoyed the opportunity to work with your team in 2020 and would look forward to assisting again in 2021. As you’re well aware, dedicating time to strategic planning and organizational development is an important step in developing and maintaining excellence. These activities are important for both newly-forming and well-established teams. I have outlined a process below that would allow the Council and staff leadership the opportunity to discuss roles and responsibilities, create norms, and establish strategies and goals to guide the city in the coming years. I understand your governing body has changed as a result of the November elections, and while we can use the work completed in 2020 as a guide, this is an excellent time for the new leadership team to discuss how it will conduct business and the direction it wishes to go. With this proposal, I am outlining a two-session process for the City Council and key staff leadership. Most often, communities I have worked with have chosen to break up this time into two sessions. This proposal is designed in that fashion, with two three-hour sessions.. 1. Background information - the 2020 Strategic Planning summary will be provided to participants for review and reference. 2. Strategic Planning Session 1 – This session will be focused on organizational development and discussion about the current state of the community and organization. The outcomes that can be expected would be an outline of roles and responsibilities, a statement of organizational values, and an initial assessment of strengths, weaknesses, and opportunities that will be used in the following session. 3. Strategic Planning Session 2 – This session will review outcomes from the first session and build consensus around the updated core strategies and finalizing the strategic objectives. Once complete, we will focus on the development of a short-term (1-2 year) workplan. The fee for facilitation services to complete this process is $2,600. Facilitation services will include preparation of agenda and materials for the session. All materials will be provided to the City Administrator electronically at least three working days prior to the session. Additionally, a final report containing the outcomes of the session will be provided electronically no later than seven days after the completion of the session. The City shall be responsible for providing the necessary copies of materials for participants and any requested by members of the public. Participate in Three Rivers Trail Planning. 2. Conduct feasibility report for county trail planning in SE Corcoran. 3. Complete phasing plan for City central parks. 4. Work with outside groups to identify innovative recreational opportunities. 5. Complete detailed planning of Bellwether Park. 6. Accommodate future multi-seasonal and multi-use trail corridors in project and new development planning. Action Steps 1. Select preferred route for the Diamond Lake Regional Trail Corridor through Corcoran. 2. Obtain quotes to complete a feasibility study for trails along County Roads in southeast Corcoran. 3. Present a phase 1 plan to the Parks and Trails Commission and City Council. 4. Parks and Trails Commission to recommend the timeline for the installation of the boardwalk and consider further improvements prior to additional land acquisition. 5. Parks and Trails Commission to recommend the types of uses allowed in City Trails; Council to establish policy. 6. Consider establishing incentives in policies to promote retention of existing natural resources in development. Core Strategy Maintain excellence in safety and security for our community. Develop policy to allow the creative use of site planning or PUDs that provide flexibility for development containing affordable housing, such as a reduction in lot size, setbacks, street width, floor area, and parking requirements. 2. Explore the suitability of various housing finance options and the housing needs they are meant to address. 3. Staff to work with internet providers to understand actual internet availability throughout the City; staff to present options to the Council to increase internet capacity. Complete test well and purchase site for well and treatment facility if test results are favorable; locate site for water tower; City Council to consider proceeding with the well and treatment facility project. 2.
