HomeMy WebLinkAboutResolution 2020-98 Approving Findings of Fact Scherber and KohnenCity of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2020-9Z$ Motion By: Schultz Seconded By: Bottema December 2 1, 2020 APPROVING FINDINGS OF FACT FOR REZONING FOR PROPERTY LOCATED AT 23240 COUNTY ROAD 30 (PID 07-119-23-13-0003) (CITY FILE 20-040) WHEREAS, Missy and Trevor Scherber and Linda Kohnen ("the applicant") have requested approval to rezone land on 9.45 acres legally described as follows: WHEREAS, the applicant has requested a rezoning from Transitional Rural Commercial (TCR) to Rural Commercial (CR); and WHEREAS, the entire property is guided Rural Service/Commercial in the 2040 Comprehensive Plan: and WHEREAS, the TCR zoning is a holding zoning until development is proposed: and WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval, and NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does support the request of Missy and Trevor Scherber and Linda Kohnen for the reclassification of the property to CR, based on the following findings and conditions: 1. The rezoning is consistent with the 2040 Comprehensive Plan, which shows a land use designation of Rural Service/Commercial for this parcel. 2. The proposed action has been considered in relation to the specific policies and provisions of and � including public fac will allow the propE which designates t as been found to be consistent with the City Comprehensive Plan, ilities and capital improvement plans. The proposed action meets the purpose and intent of the Rural Commercial zoning district, which is intended "to provide a mix of neighborhood commercial uses and rural industrial, such as contractor's yards and similar uses that do not require municipal water or sanitary sewer services." 4. There is adequate infrastructure available to serve the proposed action. 5. The surrounding districts are all used and guided for Rural Commercial and Rural Residential and are compatible with the rural commercial use proposed. The properties adjacent to the intersection of County Road 10 and County Road 19 are particularly well suited for rural commercial uses and the Rural Commercial district maintains adequate buffer standards to ensure that commercial uses do not negatively affect surrounding residential uses. Further, the surrounding Rural Residential Districts contain large lot sizes and provide for adequate buffers between residential and rural commercial uses. Page 1 of 3
