HomeMy WebLinkAboutResolution 2020-97 Approving Final Plat KariniemiCity of Corcoran County of Hennepin State of Minnesota Motion By: Schultz Seconded By: Thomas December 21, 2020 APPROVING FINAL PLAT FOR KARINIEMI ADDITION FOR NATE KARINIEMI ON THE 52.8-ACRE SITE AT 6780 ROLLING HILLS ROAD AND 6855 WILLOW DRIVE (PID 33-119- 23-22-0004 AND 33A 19-23-21-0001) (CITY FILE 20-036) WHEREAS, Nate Kariniemi ("fi create 2 lots fr described as: om an existing 1 Parcel 1: Lot 3, Block recorded plat 1 th ereof. 2 he applicant") has requested approval of a preliminary plat to .8-acre parcel and plat an existing 40-acre parcel legally Parcel 2: The Northeast Quarter of the Northwest Quarter of Section 35, Township 119, Range 23, Hennepin County, Minnesota. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for a final plat, subject to the following conditions: 1. A final plat is approved to allow the creation. of four lots, in accordance with the application materials and plans received by the City on September 18, 2020 and revisions received September 28, 2020 and November 20, 2020, except as amended by this resolution. 2. Approval of the final plat is contingent upon approval of the easement vacation. 3. The applicant shall comply with all conditions in the City Engineer's memo dated December 15, 2020. 4. Lot 4 has one existing home and one development right remaining. Lots 1-3 have no development rights remaining. 5. The lots are subject to the following setbacks for the principal structure: a. Front yard (measured from private drive easement or public street) — 50 feet b. Side yard — 25 feet c. Rear Yard — 25 feet 6. Plans must be revised to show Lot 4 on all plan sheets and to include existing conditions. 7. The preliminary plat must be revised to show final easement locations. 8. The cost estimate must be revised to include landscaping costs and wetland buffer seeding. The Site Improvement Performance Agreement (SIPA) will be updated by staff to reflect these costs prior to execution. 10. Prior to release of the final plat for recording: a. The SIPA must be executed. b. The financial guarantees noted in the SIPA must be provided. c. The easement vacafiion must be approved by the City Council. d. The applicant must comply with all wetland buffer requirements for all four lots: i. Plans must be revised fio dimension the overlap of the wetland buffers on Lot 3 into the existing trail easement. ii. Plans must be revised to show wetland buffer setback and wetland buffer signs for Lot 4. The driveway must be located outside of the wetland buffer area. The wetland buffer may be reduced next to the driveway and the wetland buffer signs shall be located adjacent to the driveway. iii. A Wetland buffer planting plan and maintenance plan must be submitted for review and approval. The HOA shall be responsible for maintenance of the wetland buffers in accordance with these plans. iv. Wetland buffer monuments shall be installed on all four lots prior to issuance of building permit. v. The developer must install the wetland buffer plantings prior to issuance of certificate of occupancy for any of the lots. e. Drainage and utility easements must be provided over all wetlands, wetland buffers and ponds. f. Drainage and utility easements must be provided over the floodplain on Lots 1-3. However, since the existing improvements on Lot 4 are located in the floodplain, the City will not require the easements to be provided at this time. i. Easements over the floodplain on Lot 4 will be required prior to any subdivision of Lot 4. ii. No grading or other improvements will be permitted in the floodplain, except as approved by the City as outlined in Section 1050.030 of Zoning Ordinance. g. The applicant must provide a copy of the existing driveway easement for the proposed Lot 4. Should the existing driveway easement or home overlap with any easements an encroachment agreement will be needed. Page 2 of 4 City of Corcoran County of Hennepin State of Minnesota December 21, 2020 h. The developer is required fio create a Homeowners Association (HOA) for maintenance of the private drive. The applicant shall provide copies of the final HOA documents/covenants for City review as part of the final plat application. I. The HOA documents shall ensure that the private drive remain "private" in perpetuity. ii. The HOA documents shall require mandatory participation of all homeowners that have access via the private drive and shall include the requirement for creation of a fund to address maintenance, drainage and snow removal on the private drive.
