APPROVING FINAL PLANNED UNIT DEVELOPMENT (PUD) PLAN FOR "REFUGE AT
RUSH CREEK" FOR RAINS PROPERTIES, LLC ON THE 62.7-ACRE SITE AT (PID 03-119-
23-13-0002) (CITY FILE 18-028)
WHEREAS, Rains Properties, LLC ("fihe applicant") has requested approval of a final PUD
development plan for 14 single family homes on a 62.7-acre parcel legally described as:
Outlot A, Fehn Meadows, according to the recorded plat thereof, Hennepin County,
Minnesota.

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that it should and hereby does approve the request for a final PUD
development plan, subject to the following findings and conditions:
1. A final PUD development plan is approved to allow the creation of 14 lots for single family
homes, in accordance with the application materials and plans received by the City on
July 17, 2018 and revisions received August 3, 2018 and August 22, 2018, except as
amended by this resolution.
2. Approval is contingent upon City Council approval of the final plat.
3. The rezoning approved by Ordinance No. 2018-368 on June 28, 2018 shall t
upon adoption of this resolution adopting the final PUD development plan.

1. The development contract must be executed by the developer and the City and must be
filed with the final plat.
2. The developer shall comply with all conditions of final plat approval (Resolution 2018-72).
3. The applicant shall comply with all conditions in the City Engineer's memo dated August
28, 2018.
4. The approval is subject to the review and approval by the Elm Creek Watershed
Management Commission. The applicant shall comply with any conditions of approval
from the watershed.
5. The applicant shall address the comments in the Hennepin County memo dated May 23,
2018.

6. Park dedication shall be cash in lieu of land in the amount of $557580.00 (14 new lots x
$3,970.00 per lot). The park dedication fee is subject to the fee schedule in place at the
time the final plat is released for filing.
7. Parking shall be permitted on one side of the local streets and shall be signed in
accordance with city standards.
8. The HOA documents must be approved by the City Attorney and recorded at Hennepin
County. The documents must note that the HOA is responsible for the maintenance of all
permanent open space and preservation areas in perpetuity.
9. A street lighting plan shall be provided for review by staff. Street lights shall be inst
all intersections and at other locations, as required by the City Engineer.
FURTHER, that the following conditions be met prior to issuance of building permits:
1. The applicant must record the approving resolutions and associated documents at
Hennepin County and provide proof of recording to the City.
2. The applicant shall provide proof of recording the final plat and related documents at
Hennepin County.
3. The applicant shall provide the approved preliminary and final plan drawings to the City
in an electronic (AutoCAD) format.
