APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR "REFUGE AT RUSH
CREEK" FOR RAINS PROPERTIES, LLC ON THE 62.7-ACRE SITE AT (PID 03-119-23-13-
WHEREAS, Rains Properties, LLC ("the applicant") has requesfied approval of a final plat for 14
single family homes on a 62.7-acre parcel legally described as:
Outlot A, Fehn Meadows, according to the recorded plat thereof, Hennepin County,
Minnesota.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that it should and hereby does approve the request for a final plat,
subject to the following conditions:
FURTHER, that the development contract for said plat shall be completed by city staff and the
Mayor and that the City Administrator be authorized to execute the development contract on
behalf of the City; and
FURTHER, that the following conditions be met prior to release of the final plat for recording
with the County:
1. A final plat is approved for 14 lots for Refuge at Rush Creek, in accordance with the
plans and application received by the City On JUIy 177 2018 and revisions received
August 3, 2018 and August 22, 2018, except as amended by this resolution.
2. Approval is contingent upon City Council approval of the final PUD development plan.
3. The development contract must be executed by the developer and the City and must be
filed with the final plat.
4. Park dedication shall be as required by Resolution 2018-71.
FURTHER, that the following conditions be met prior to issuance of building permits:
1. All drainage and utility easements shall be staked, surveyed and properly recorded prior
to beginning any work on site.
2. Wetland buffer monument signs must be purchased from the city and installed as shown
on the plans.
3. The applicant must file the final plat at Hennepin County within 2 years of the date of
approval or the approval shall expire.

4. The applicant must record the approving resolutions and associated documents at
Hennepin County and provide proof of recording to the City.
5. The applicant shall provide proof of recording the final plat and related documents at
Hennepin County.
6. The applicant shall provide the approved preliminary and final plat drawings to the City in
an electronic (AutoCAD) format.
FURTHER, that the following conditions be met prior to release of remaining escrow:
1. Lot corner monuments shall be installed as required by fihe Subdivision Ordinance. As
part of the development contract financial guarantee shall be required to ensure
installation per city requirements.
