The City of Corcoran will provide high quality public services in a cost effective, responsible, and professional manner in order to create a preferred environment to live, work, play, and conduct business. MISSION STATEMENT The City of Corcoran will become a vibrant community focused around a thriving Town Center while preserving its natural character and agricultural roots. In order to achieve this vision, the City will seek to work with partners to accomplish the following outcomes: A variety of housing options for all ages and stages of life existing in cohesion with the natural environment. A well connected parks and trails system with options for year-round recreation and opportunities for residents to connect with nature. A safe and clean community where residents can be proud to live, work, and play. A variety of high quality schools are available to residents and work in cohesion with the City’s vision. A variety of commercial and industrial businesses exist to provide for most services and jobs for the community. ADOPTED MARCH 8, 2018 VALUES STATEMENT ADOPTED JANUARY 24, 2019 ACTION STEPS The City of Corcoran has identified the following action steps for 2019: Develop a master plan, finance plan, and select amenities for City Park. Develop a needs assessment, action plan, and finance plan for fire service. Complete the update to the southeast district and town center plan; complete a stormwater management plan for the town center. Decide on request for contribution to the Dayton Parkway Interchange project. Develop a low cost option to pave gravel roads; establish criteria to select roads for paving; push legislative priorities which includes street funding options. Identify all existing easements/right-of-way the City has obtained for trails, etc. Complete a feasibility study for trails along selected County Roads. Identify preferred snowmobile routes. Evaluate staffing and space needs for public safety. Evaluate the need for a City Planner. Complete studies needed for water system options. Investigate options to reduce the use of salt/chloride; apply for funding to complete an additional sub watershed assessment. Provide an update on the existing crime/drug action plan; create a new plan for next steps. Execute code enforcement plan. Consider updates to the Open Space and Preservation ordinance and other ordinances to establish incentives for protecting/preserving the natural environment through development. Review compost site options. CITY OF CORCORAN City Council Meeting Minutes March 12, 2020 - 7:00 pm The Corcoran City Council met on March 12, 2020, at City Hall in Corcoran, Minnesota. Present were Mayor Thomas, Councilor Schultz, Councilor Bottema, Councilor Dejewski, and Councilor Anderson. Also present were City Administrator Martens, Administrative Services Director Beise, Public Works Director Mattson, Public Works Superintendent Meister, and Lieutenant Burns. 1.Call to Order / Roll Call Mayor Thomas called the meeting to order at 7:00 pm. 2.Pledge of Allegiance Mayor Thomas invited all in attendance to rise and join in the Pledge of Allegiance. 3.Agenda Approval City Administrator Martens stated there is an additional claim in item 7b. Financial Claims, removal of item 10c. Maintenance Worker Job Offer from the Consent Agenda, and an addition of 10f. Organizational Response to COVID-19, under New Business. City Administrator Martens will give a brief update to information relating to item 10f. MOTION: made by Anderson, seconded by Dejewski to approve the agenda as modified. Voting Aye: Thomas, Anderson, Bottema, Dejewski, and Schultz (Motion carried 5:0) 4.Commission Representatives Mayor Thomas noted Planning Commission Shoulak and Parks and Trails Commissioner Meister were present. Mayor Thomas invited the Commissioners to speak on items related to their respective commissions. 5.Open Forum Meredith Wu, 4695 Cain Road, addressed Council and commented on item 6a. Planning Commission Annual Report and 2020 Priorities regarding making room for nature preservation, tree cover, and stated her opinion that new trees do not have same benefits of established trees, and do not represent equal replacement. Ms. Wu addressed concern of decline of green cover as a global issue and asked Council to reflect how the City reviews tree status in new developments. Ms. Wu requested additional effort from the Planning Commission, City Council and residents to preserve Corcoran’s rural character. De Sicora, 6410 Elm Street, addressed items discussed from a prior meeting regarding an article on development moratoriums and stated she would like additional information on the item. Ms. Sicora digressed to the 2030 Comprehensive Plan and Lennar Homes regarding additional homes within the development. Ms. Sicora stated she would like the developer to leave the aesthetics of the current neighborhood when construction of new homes begins. Council stated support and execution of the current comprehensive plan. 6.Presentations/Recognitions a.Planning Commission Annual Report and 2020 Priorities Commissioner Shoulak addressed the Council and highlighted some of the Planning Commission accomplishments in 2019. Commissioner Shoulak reviewed Planning Commission priorities for 2020 which include adopting ordinance amendments related to the 2040 Comprehensive Plan, a tree preservation policy, and guidelines for fertilizer use by the City. Council questioned if Elm Creek Watershed District offers guidance or has a policy regarding use of fertilizer treatments. Public Works Director Mattson indicated Elm Creek Watershed District does not currently have an adopted policy. Council discussed tree preservation policy challenges and the impact of a tree preservation policy to landowners and future housing developments. City Administrator Martens stated the commission annual report is to provide Council with information on the intended Agenda Item 7a. 2 direction and priorities of each commission. Council discussed Planning Commission goals regarding tree preservation with Planning Commissioner Wu. Council consensus was for the Planning Commission to proceed with providing information to Council on the submitted priorities. b. Parks and Trails Commission Annual Report and 2020 Priorities Parks and Trails Commissioner Meister addressed Council and highlighted accomplishments in 2019. Parks and Trails Commissioner Meister outlined commission priorities for 2020 and included installation of benches, planting native wildflowers, and tree replacement within the Wildflower Park boundaries; begin reviewing budget and timelines of for Phase 1 of the Corcoran City Park; evaluation of open space park areas in the Ravinia neighborhood; and determine the City of Corcoran’s and Three Rivers Park District’s Diamond Lake Regional Trial Corridor expectations. Council and Commissioner Meister discussed additional details on the Diamond Lake Regional Trail Corridor and future growth in Corcoran. Council stated the importance of staying connected with Three Rivers Park District regarding the new corridor. City Administrator Martens noted Parks and Trails Work Session discussion at the February 20, 2020 meeting identified important points and potential routes to present to Council on the Diamond Lake Regional Trail corridor at an upcoming Council meeting. Consent Agenda a. Draft Minutes of the February 27, 2020 Council Meeting b. Financial Claims c. Charitable Gambling Resolution 2020-16 – Stanchion d. NE Trunk Sewer Improvements – Pay Request #9 MOTION: made by Bottema, seconded by Schultz to approve the Consent Agenda as presented. New Business a. 2020-2021 Capital Improvement Plan City Administrator Martens presented the 2020-2021 Capital Improvement Plan (CIP) and discussed the rational of every other year bonding funds process which reduces the bond issuance cost. City Administrator noted the City works on utilizing cash from the annual levy to reduce the need to bond. Administrative Services Director Beise presented costs and needs for new administration accounting software, and how the software supports and integrates with current software utilized. Council and staff discussed yearly software dues after the initial purchase. Lieutenant Burns presented costs for public safety software in 2020 and 2021 respectively , and includes vehicles, squad car cameras, body cameras, and protective equipment. Lieutenant Burns outlined the interface system relating to outdoor sirens and an emergency citywide access system . Council questioned if Corcoran currently has a Community Service Officer vehicle and discussed re-purposing of squad vehicles. Council and staff discussed repurposing of squad cards and how the determination is made regarding vehicle value. Public Works Director Mattson outlined large equipment needs in 2020 and includes a trailer; a mower, which Corcoran received a partial grant for; a tandem axle dump truck; a 4,000 gallon water truck; a brush mower; and various trail maintenance equipment needed for new development parks and trails maintenance. Public Works Director Mattson outlined equipment needs for 2021 and included two trucks with plows; an excavator miscellaneous equipment to be sold as part of the 2021 equipment review. Public Works Superintendent Meister discussed removal of aging equipment from the Schutte storage facility. Council and staff discussed various options of purchasing used small equipment . City Administrator Martens clarified the next steps with approval of the two-year 2020-2021 Capital Improvement Plan and includes authorizing 2020 purchases, bond issuance and timelines, and allowing the early purchase of the 2021 1.5 ton truck with plow because of time restraints in ordering. Council questioned with the approval of bonding, does the process leave our bonding 3 level debt within an appropriate level of a city of Corcoran’s size. City Administrator Martens indicated it is within a healthy bonding level according to other cities the same size as Corcoran. MOTION: made by Bottema, seconded by Dejewski to approve the 2020-2021 Capital Improvement Plan as presented and authorize staff to purchase all 2020 equipment items, as well as the 2021 GMC 1.5 ton pickup truck with plow. Voting Aye: Thomas, Anderson, Bottema, Dejewski, and Schultz (Motion carried 5:0) b. Test Well Authorization Public Works Director Mattson outlined the test well quotes and briefly recapped a summary of progress on the water supply system. Public Works Director Mattson indicated a selected quote proposal for the test well installation totals $49,720. Public Works Director Mattson noted the proposal includes a 6-inch test well which will allow for chemical make-up review, water flow, with eventual conversion into a monitoring well, which is a requirement for the facility, and serves a dual purpose. Public Works Director Mattson noted the next steps would include authorizing a contingent Notice of Award for the test well installation for the NE Corcoran Water Supply Improvements, also contingent on the receipt of the Minnesota Department of Health permit approval, and approve funding through the water utility fund. Council and staff discussed timelines, design of treatment plant, water tower location site, and difference in quote proposals received for the test well installation. MOTION: made by Schultz, seconded by Dejewski to authorize a contingent Notice of Award for the Test Well Installation for the NE Corcoran Water Supply Improvements. Voting Aye: Thomas, Anderson, Bottema, Dejewski, and Schultz (Motion carried 5:0) c. Job Offer – Maintenance Worker; removed from agenda. d. Job Description Approval and Authorization to Begin Recruitment -- Planner City Administrator Martens noted previous discussion regarding fund allocation for the position and a minor change to the position grading. City Administrator Martens reviewed an interview and hire timeline process of March 16 through May 14. Council asked how the position will work with Landform. City Administrator Martens indicated the position would work with Landform on many of the lower level planning functions currently completed by Landform staff or City staff, and also work directly with residents on lower level planning questions. City Administrator Martens also noted any developer driven items would still be managed by Landform. MOTION: made by Dejewski, seconded by Anderson approving the authorization for staff to begin recruitment for the Planner position. Voting Aye: Thomas, Anderson, Bottema, Dejewski, and Schultz (Motion carried 5:0) e. Draft Liquor Ordinance Updates Administrative Services Director Beise reviewed a request received by Shamrock Golf Course to expand liquor licensing requirements to include wine. Administrative Services Director Beise reviewed the proposed changes and direction of Council from a previous Council meeting. Council and staff discussed policy decision changes, legal differences in language, and decisions necessary by Council within the Ordinance. Per Council consensus, staff was directed to proceed with a liquor license ordinance amendment. f. Organizational Response to COVID-19 City Administrator Martens updated Council on emergency management processes the City is adhering to such as following the CDC guidelines, cancelling of all non -essential events and meetings, and monitoring various closings of local City Halls. City Administrator Martens noted the emergency management team is identifying critical City services necessary in the event of reduced services. Council and staff discussed options for Firearm Safety Training and included online classes as an option through the DNR. Council discussed options for staff working from home. Council asked about including options for working from home when discussions resume for the City remodel. 4 11. Closed Session a. Easement Acquisition – 2020 Southeast Watermain Improvements Mayor Thomas stated: “The City Council is going into a closed session to consider an offer for real estate. Under the authority of Minn. Stat. § 13D.05 Subd. 3(c)(3), the City is permitted to close a meeting to consider offers and counteroffers for the purchase or sale of real or personal property. The City Council is now going into closed session to consider an offer for real estate to purchase easements for the proposed 2020 southeast water main improvements; the following properties are the subject of the closed meeting: 7400 County Road 116, 19835 Larkin Road, and PID 35-119-23-11-0001.” Mayor Thomas recessed the Council meeting at 8:37 pm. Mayor Thomas reconvened the Council meeting at 8:49 pm. “In closed session, the City Council discussed an offer for real estate; staff was provided direction.” 12. Hofer through Kendra Lindahl, Landform DATE: March 18, 2020 for the March 26, 2020 City Council Meeting RE: Request for Preliminary Plat, Final Plat and Variances to subdivide the St. Jane Chantel Cemetery (PID 21-119-23-33-0004) (city file no. 20-001) REVIEW DEADLINE: May 30, 2020 1.Application Request Gene Kissner (applicant) is requesting approval of a Preliminary Plat, Final Plat and Variance to subdivide the 3.76-acre St. Jane Chantel parcel owned by Church of St. Thomas the Apostle. The portion north of County Road 50 contains the cemetery and will be retained by the church and Kissners will purchase the portion south of County Road 50. A variance is required as this would create a 1.7-acre lot for the cemetery and 1.2-acre outlot for Kissners that do not meet the minimum lot size requirement for the Rural Residential zoning district. The lot on the south side of County Road 50 will also require a variance to be created without a development right. 2.Planning Commission Review Planning Commission reviewed the preliminary plat and variances at their regularly scheduled meeting on March 5, 2020. Other than the applicant, there was no one present to speak at the public hearing. The Planning Commission voted 4-0 to approve Resolution 2020-18 with minor edits to conditions 4 and 8b. 3. Context Zoning and Land Use The lot is zoned Rural Residential and guided as Rural/Ag Residential on the Comprehensive Plan. The lot is outside of the 2040 MUSA. The land to the north of County Road 50 is St. Jane Chantel cemetery for the Church of St. Thomas the Apostle. The land to the south of County Road 50 has been used in the past by Kissners for agricultural purposes and currently has a gravel driveway and a portable shed that is used as a seasonal produce stand. Kissner Preliminary Plat, Final Plat and Variance (20-001) 2 March 26, 2020 Surrounding Properties The surrounding properties are currently zoned as Rural Residential and guided as Rural/Ag Residential or Agricultural Preserve in the Comprehensive Plan. Parks and Trails The Comprehensive Plan shows an on-road trail along County Road 50. 4. Analysis of Request Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and City Code requirements, as well as City policies. The City Engineer’s comments are incorporated into this staff report, the detailed comments are included in the attached engineering memo and the approval conditions require compliance with the memo. A. Level of City Discretion in Decision-Making The City’s discretion in approving a preliminary and final plat is limited to whether the proposed plat meets the standards outlined in the City’s subdivision ordinance and zoning ordinance. If it meets these standards, the City must approve the preliminary and final plat. The City’s discretion in approving or denying a variance is limited to whether the proposed project meets the standards in the Subdivision Ordinance for a variance. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that the variance standards have been met. B. Consistency with Ordinance Standards Preliminary Plat Lot Size and Standards The proposed subdivision will create one 1.7-acre lot on the north side of County Road 50 (Lot 1, Block 1) and one 1.2-acre outlot on the south side of County Road 50 (Lot 1, Block 2). Since the southern parcel has no development rights, staff recommends that the parcel be platted as an outlot. Both of these lots are under the minimum lot area of two acres. Lot 1, Block 2 would be created without a development right. No lots or outlots can be created without development rights, except in some circumstances outlined in Section 1040.030 Subd. 7(E). This application does not meet the circumstances detailed by the code; therefore a variance is required. The variance is discussed later in the staff report. The portable shed shown on the survey is used by the applicant as a seasonal produce stand. Seasonal produce stands are allowed within the Rural Residential district. These types of stands are common throughout Corcoran and while they do not conform with setback standards, they help support and maintain the rural character of the City. Requiring the applicant to move the produce stand is Kissner Preliminary Plat, Final Plat and Variance (20-001) 3 March 26, 2020 inconsistent with the City goals to preserve rural character. The City should consider addressing this plat to provide only the minimum required easements. Parks and Trails There are no buildable lots being created with this subdivision, therefore, no park dedication is required. Streets and Access No changes are proposed to County Road 50; however the road is currently under a prescriptive easement. Hennepin County would normally require right-of-way dedication, but the County will wait till redevelopment of the property in the future to take the dedication. Hennepin County also notes that the location of the drive-way may need to be reconsidered in the future. No changes are proposed to the cemetery or Kissner accesses. The proposed south parcel has been used by Kissners and has an existing driveway to the applicant’s other properties to the west. A driveway easement and maintenance agreement will be required. The applicant has provided a legal description for the easement and we have included a condition requiring a recordable document to be provided and recorded with the plat. Variance The applicant is requesting a variance from the zoning ordinance to allow two lots to be created that are less than the allowable minimum lot size and to allow a lot to be created without development rights. A variance requires that the applicant show that the following standards have been met. A. That there are practical difficulties in complying with the zoning ordinance. A practical difficulty is created by County Road 50 bisecting the current parcel, which renders the south portion of the parcel unusable for the existing cemetery on the northern side of the parcel. Creating a subdivision with the County Road as the parcel boundary allows the church to sell the south portion to the adjacent landowner that has been using the land. There is no way to subdivide the land and comply with the minimum lot size requirements due to the existing road location. The applicant has indicated that they intend to sell the southern parcel that they are purchasing from the Church with one of the two adjacent parcels that they own (PID 21-119-23-34-0002 and 28-119-23- 21-0001), however, they would like to keep it as a separate parcel for now to keep their options open. The second variance is to create a parcel without development rights. Section 1040.030 Subd. 7(E) of the City Code prohibits the creation of lot or outlots without a development right as Lot 1, Block 1 has used the available development right. The future Lot 1, Block 2 is to be platted as an outlot and is not planned to be developed. The outlot being without a development right is temporary, however, and will eventually be combined with one of the adjacent lots that are conforming and will make the outlot conforming upon the future lot consolidation. Kissner Preliminary Plat, Final Plat and Variance (20-001) 4 March 26, 2020 B. That the conditions upon which a petition for a variation is based are unique to the parcel of land for which the variance is sought and were not created by the landowner. The arrangement of the parcels that led to the south side of the parcel being unusable by the owner is due to the alignment of County Road 50, which is out of the control of the applicant. The alignment of County Road 50 has effectively already functions as two separate parcels that do not meet the minimum lot size. Proposed Lot 1, Block 2 has contained the driveway for the applicant’s lot since the farm was founded, has been farmed for 40 years by the applicant and is unusable by the church. The lot being split by County Road 50 is unique situation. C. That the granting of the variation will not alter the essential character of the locality. There are no proposed changes to the use of the land and no development planned. Approval of the variance will not change how the existing parcel is used and will not be discernable to the general public. The use of the outlot will remain the same and development is not planned, so the outlot being created without a development right will not alter the essential character of the locality and will eventually be absorbed into a conforming lot. D. The proposed variance would be in harmony with the general purposes and intent of the ordinance. The lot will be under the minimum lot size, but there will be no noticeable changes to the land and will still serve the intent of the zoning code of maintaining the character of the Rural Residential zoning. No changes are planned for the land and allowing the applicant to keep proposed Lot 1, Block 2 separate from his currently owned parcels allows the applicant greater flexibility in the future which will allow for the land to remain in harmony with the ordinance. E. The variance is consistent with the Comprehensive Plan. The Comprehensive Plan calls for preservation of the rural character while still allowing for property owners to have options with their land. Allowing the lot to be subdivided allows the owner of the lot to sell off unusable land and leaves the applicant with options with how to use the land in the future. Allowing a small lot without a development right that will eventually be consolidated to a lot that does have development rights will allow the applicant to have options with their land effectively without harming the rural character and allowing for future sale and development of their land. Final Plat The final plat is consistent with the preliminary plat. The final plat should be revised to allow for the signature of the applicant and the landowner (the church), and replat Lot 1, Block 2 as Outlot A. The applicant plans to plat this property with the adjacent property at 23825 Tessmer Road to adjust the common lot line and allow development on the adjacent property. No development is proposed on this property. The applicant has written permission of the current owner of the lot to proceed with the application. 2.Context The existing lot is 38.67 acres. The parcel is agricultural land and does not contain an existing home. There is no development planned on the existing lot. Zoning and Land Use All the lots are zoned Rural Residential and guided as Rural/Ag Residential on the 2040 Comprehensive Plan. All the lots are also outside of the 2040 MUSA. Surrounding Properties The surrounding properties are currently zoned as Rural Residential and guided as Rural/Ag Residential or Agricultural preserve in the 2040 Comprehensive Plan. Natural Characteristics of the Site The lot may have some wetland in the southwest corner and is not in a floodplain according to the 2040 Comprehensive Plan. Analysis of Request Topography and Wetland Waiver The applicant has requested a waiver for the topographic survey and wetland delineation requirements for the site. The site is not being developed at this time, and the applicant has stated that there is no planned development. Section 930.020, Subd. 6(B)2 of the City Code allows the City Council to waive the topography requirements for lots greater than 3 acres and the City Council has previously granted exemptions from the wetland delineation requirements. Staff recommends approval of the topography waiver because no new development is proposed at this time. Next Steps If the waiver request is approved, the applicant will proceed with the plat to facilitate the land swap between the two parcels and plat the western parcel. 4. The grant program has two categories that are awarded in the spring: •Equipment grants (Twice a year – awarded in December and April) o Purpose is to improve playability, provide enhanced training, and promote stronger relationships between local government units and youth sports associations o Awards will be up to $10,000 •Playground grants (Once a year – awarded in spring) o Purpose is to install, replace, or renovate playgrounds o Awards will be up to $25,000 The Parks and Trails Commission was scheduled to discuss the grant application at the March 19, 2020 meeting but was unable to, as it was cancelled do to additional COVID-19 precautions. Staff requested that the Commission provide their feedback on submitting the grant application via email. At this time, three of the six commissioners have encouraged that staff apply for the grant. Currently the attachments are in the draft 2020-2021 CIP. If authorized by the Council, staff would apply for $7,500 in grant funds, leaving $2,588.24 as the remaining City contribution. Financial/Budget: Staff recommends a proposed contribution of $2,588.24 towards the new attachments using the funds allocated in the draft 2020-2021 CIP. If the City receives the grant award it will reduce the amount needed for the attachments. Options: 1.Direct staff to apply for grants as recommended by staff. 2.Direct staff to apply for grants for different equipment. 3.Decline the opportunity. We are looking to purchase these attachments to help maintain trails throughout the city. The City is responsible for increased maintenance on 4-5 new miles of trails following a large number of plats that came in within the last couple years. This a a new responsibility for Corcoran and the requested equipment is needed to ensure our ability to provide year-round recreation opportunities. These trails have the potential to be used by upwards of 1,400 children in the City of Corcoran along with their families (parents, grandparents, etc.). The City is requesting grant funds to cover $7,500 of the total cost of the two attachments with the City covering the remaining $2,588.24. By keeping the trails in good condition, it would attract families across the metro to come to Corcoran’s trails to walk, jog, bike, etc. We are excited for this possible opportunity to increase the number of families that get out into nature here in northwest Hennepin County. Council Meeting: March 26, 2020 Prepared By: Jessica Beise Topic: Ordinance Amendment – Alcoholic Beverages Action Required: Approval Summary: In October staff reviewed with Council a request to change the liquor ordinance and options to amend the ordinance. Per the conversation at the October 1 0, 2019 meeting, staff drafted an ordinance amendment to allow for a wine license, clarifying penalties/revocation, and make clerical changes. The draft was discussed at the March 12, 2020 meeting. The attached ordinance is largely unchanged from the March 12 th draft except for two clerical errors that were provided by Councilmembers. Per the conversation in October, staff did not make changes to the zoning ordinance to allow for or make a conditional use for breweries, taprooms, and mirco-distilleries. Staff would anticipate making additional changes to the liquor ordinance if the City could like to amend the ordinance to allow additional liquor related businesses in the zoning ordinance. Staff recommends adopting the ordinance as presented and adopting a summary ordinance for publication. Financial/Budget: With the creation of a wine license, a fee schedule amendment will be proposed based on the original discussion from October 2019. The provisions of Minnesota Statute 340A, as amended, with reference to the definition of terms, applications for license, granting of license, conditions of license, restrictions on consumption, provisions on sales, conditions of bonds of licenses, hours of sale and all other matters pertaining to the retail sale, distribution and consumption of intoxicating liquor and 3.2 malt liquor are hereby adopted. 110.02: LICENSE REQUIRED. No person, except wholesalers or manufacturers to the extent authorized under state license, shall directly or indirectly deal in, sell or keep for sale any intoxicating liquor or 3.2 malt liquor without first having received a license to do so as provided in this chapter. Licenses shall be of three kinds: “On-Sale”, “Off-Sale”, and “Temporary on-sale”, and “On-Sale Wine”. a. “On-sale” licenses shall be granted only to hotels with restaurant accommodations, clubs, restaurants and/or exclusive liquor stores and shall permit the consumption of liquor on the premises only. b. “Off-sale” licenses shall be issued to either the holder of an on-sale liquor license and/or exclusive liquor store, or stores appropriate for the sales of 3.2 malt liquor and shall permit off sales of liquor only. c. “Temporary on-sale” licenses shall be granted only to (1) a club or charitable, religious, or other nonprofit organization in existence for at least three years, (2) a political committee registered under Minnesota Statute 10A.14, or (3) a state university, and shall be granted only in connection with a social event within the municipality sponsored by the licensee. Such licenses shall not authorize the on-sale of intoxicating liquor for more than four consecutive days and must be in compliance with all provisions of Minnesota Statute 340A.404. A “Temporary on-sale” license may allow the licensee to contract for intoxicating liquor or 3.2 malt liquor catering services with the holder of a full-year on-sale intoxicating liquor license issued by any municipality. All “Temporary on-sale” licenses must be approved by the commissioner of public safety. 1. The City Council may issue a “Temporary on-sale” license to a brewer who manufactures fewer than 3,500 barrels of malt liquor in a year in connection with a social event within the city, sponsored by the brewer. The terms and conditions specified for temporary licenses under paragraph “c” above shall apply to a license issued under this City of Corcoran March 26, 2020 County of Hennepin State of Minnesota ORDINANCE NO. 2020-401 paragraph, except that the requirements of Minnesota Statute 340A.409, subdivisions 1 to 3a, (“Liability Insurance”), shall apply to the license. d. On-sale wine licenses, with the approval of the Commissioner of Public Safety to: theaters, restaurants that have facilities for seating at least 25 guests at one time and meet the criteria of Minn. Stat. § 340A.404, subd. 5, as it may be amended from time to time, and which meet the definition of restaurant in section 3; to licensed bed and breakfast facilities which meet the criteria in Minn. Stat. § 340A.4011, subd. 1, as it may be amended from time to time and to theaters that meet the criteria of Minn. Stat. § 340A.404, subd. 1(b) as it may be amended from time to time. The fee for an on-sale wine license established by the Council under the provisions of Section 10 of this ordinance, shall not exceed one-half of the license fee charged for an on- sale intoxicating liquor license. The holder of an on-sale wine license who also holds an on-sale 3.2 percent malt liquor license is authorized to sell malt liquor with a content over 3.2 percent (strong beer) without an additional license. 110.03: APPLICATION AND FEES. A. Application Process 1. Every application for a license to sell intoxicating liquor or 3.2 malt liquor shall be verified and filed with the City Clerk-Treasurer. It shall state the name of the applicant, his or her age, representations as to his or her character, with the reference as may be required to citizenship, the organization in connection with which the proposed license will operate and its location, whether the applicant is owner and operator of the business, how he or she has been in that business at that place, define the premises for which activities shall take place, and other information as the Council may require from time to time. In addition to containing the information, each application for a license shall be in the form prescribed by the Department of Public Safety. No person shall make a false statement in an application. 2. Each application for an “off-sale” and “on-sale” license, as well as an application for a “temporary on-sale” license pursuant to section 110.02(c)(1), shall be accompanied by proof of a liability insurance policy, and the liability insurance policies shall be approved as to form by the City Attorney. The operation of such an intoxicating liquor business without having on file at a time with the municipality an insurance policy shall be grounds for an immediate revocation of the license. 3. Each application for a license shall be accompanied by receipt from the City Clerk-Treasurer for payment in full of the required fee for the license. All fees shall be paid in the general fund of the municipality. Upon rejection any application for a license, the Treasurer shall refund the amount paid. 4. Each application for an on-sale intoxicating liquor license shall be accompanied by a site plan, drawn to scale. The site plan must contain the following information: (a) a legal description of the property upon which the proposed licensed premises is situated; (b) a plot plan; (c) the exact location on the property of the licensed premises, all customer and employee parking areas, all accesses onto the property, all entrances into the premises, and all outdoor serving areas; (d) a floor plan of the licensed premises. 65. All full-year “on-sale” and “off-sale” licenses shall expire on the last day of June of each year. Each license shall be issued for a period of one year, except that if a portion of the license City of Corcoran March 26, 2020 County of Hennepin State of Minnesota ORDINANCE NO. 2020-401 year has elapsed when the application is made, a license may be issued for the remainder of the year for a pro rata fee. In computing the fee, any unexpired fraction of a month shall be counted as one month. “Temporary on-sale” licenses shall expire on the date specified in the license. “Temporary on-sale” licenses shall not authorize on-sales for more than four consecutive days not to exceed more than 12 days in a year. 65. The annual fees for “on-sale” and “off-sale” intoxicating and 3.2 malt liquor licenses and the fees for “temporary on-sale” licenses shall be set by resolution from time to time by the City Council. “ 76. If a refund for full-year “on-sale” or “off-sale” liquor license fees is sought within six months of the license year, half of the fee paid shall be refunded. After a license has been in effect for six months, no portion of the license fee shall be refunded. No refunds shall be granted on approved temporary on-sale licenses. 110.04: GRANTING LICENSES; INELIGIBILITY. The City Council shall investigate all facts set out in the application. At the time of making an initial application, or renewal application, or request for a corporate officer/partner, the applicant shall, in writing, authorize the Police Department to investigate all facts set out in the application and complet e a personal background and criminal record check on the applicant and corporate officer/partner. The applicant shall further authorize the Police Department to release information received from such investigation to the Council. Should the Council deny th e applicant's request for a license due, partially or solely, to the applicant's prior conviction of a crime, the Council shall notify the applicant of the grounds and reasons for the denial; the applicable complaint and grievance procedure as set forth in Minnesota Statutes, Section 364.06; the earliest date the applicant may reapply for a license; and that all competent evidence of rehabilitation will be considered upon reapplication. Opportunity shall be given to any person to be heard for or against the granting of the license. After the investigation and hearing, the City Council shall grant or refuse the application in its discretion. No "off-sale" license shall become effective until it, together with the bond furnished by the applicant, has been approved by the Department of Public Safety. Each license shall be issued to the applicant only. Each license shall be issued only for the premises described in the application. No license may be transferred to another person or to another place without the approval of the City Council. No license shall be issued for any place or for any organization ineligible for a license under state law. No license shall be granted for operation on any premise on which taxes, assessments or other financial claims of the city are delinquent and unpaid. No person shall be granted to or held by any person made ineligible for a license by state law. 110.05: CONDITIONS OF LICENSES. City of Corcoran March 26, 2020 County of Hennepin State of Minnesota ORDINANCE NO. 2020-401 Every license shall be granted subject to the conditions in the following divisions and all other provisions of this chapter and of any other applicable ordinance of the city or state law. Every licensee shall be responsible for the conduct on his or her licensed premises and the conditions of sobriety and order in it and on adjacent property. No person or persons to whom a liquor license is issued shall allow or permit the consumption or use of intoxicating liquor or 3.2 malt liquor in any off-street parking area connected with or a part of the land area of the licensed premises. No sale of an alcoholic beverage shall be made to anyone on credit. Any peace officer, health officer or any properly designated officer or employee of the city shall have the unqualified right to enter, inspect and search the premises of the licensee during business hours without a warrant. No licensee shall permit any person, other than an employee engaged in bona fide duties in connection with the licensed premises, to occupy or remain in any part of the licensed premises or in any off-street parking area connected with or a part of the land area of the licensed premises between the hours of 2:30 a.m. and 8:00 a.m. It shall be unlawful for a person under the age of 21 years of age to enter an establishment licensed for the sale alcoholic beverages for the purpose of purchasing, having served or delivered any alcoholic beverage. Notwithstanding the above, a person 18, 19 or 20 years old may enter an establishment licensed for the sale of alcoholic beverages for the following reasons: a. To perform work for the establishment, including the serving of alcoholic beverages; b. Consume meals; and c. Attend social functions that are held in a portion of the establishment where alcoholic beverages are not sold. All licenses hereunder shall provide proof of liability insurance to cover all claims allowed under Minnesota Statute 340A.801 (dram shop). No minor shall misrepresent his or her age for the purpose of obtaining an alcoholic beverage. No personnel shall induce a minor to purchase or procure an alcoholic beverage. No person shall mix or prepare an alcoholic beverage for consumption in any public place or place of business, licensed to sell liquor “Off-sale” and no person shall consume an alcoholic beverage in any such place. No alcoholic beverage shall be sold or consumed on a public highway or in an automobile. No person shall consume or use an alcoholic beverage in any off-site parking area connected with or a part of the land area of a licensed premises that has been issued a license permitting the sale of alcoholic beverages. Off-street parking areas shall be construed to include roads adjacent to the area. City of Corcoran March 26, 2020 County of Hennepin State of Minnesota ORDINANCE NO. 2020-401 No person, other than an employee engaged in bona fide duties in connection with a premises which been issued a license permitting the sale of alcoholic beverages, shall occupy or remain in any part of the licensed premises between the hours of 2:30 a.m. and 8:00 a.m. Licensed premises shall include off-street parking areas and roads adjacent to same. Penalty, see § 10.99. 110.06: REVOCATION. Suspension and Revocation The Council may suspend or revoke any liquor license in violation of any provision or condition of this chapter or any state law regulating the sale of intoxicating liquor and shall revoke the license if the licensee willfully violates any provision of Minnesota Statute 340A. Except in the case of suspension, a hearing or revocation, a written notice to the grantee and a public hearing shall precede revocation or suspension by the Council. The notice shall give at least eight days' notice of the time and place of the hearing and shall state the nature of the charges against the licensee. The Council may, without any advance notice, suspend any license pending a hearing or revocation for a period of not exceeding 30 days. (A) The Council shall either suspend for a period not to exceed 60 days or revoke any liquor license upon finding that the licensee has failed to comply with any applicable statute, regulation, or provision of this ordinance relating to liquor. Except in cases of lapse of proof of financial responsibility, no suspension or revocation shall take effect until the licensee has been afforded an opportunity for a hearing pursuant to the Administrative Procedures Act, Minn. Stat. §§ 14.57 to 14.70, as it may be amended from time to time. The Council may act as the hearing body under that act, or it may contract with the Office of Hearing Examiners for a hearing officer. (B) The following are the minimum periods of suspension or revocation which shall be imposed by the Council for violations of the provisions of this ordinance or Minn. Stat. Ch. 340A, as it may be amended from time to time or any rules promulgated under that chapter as they may be amended from time to time: (1) For commission of a felony related to the licensed activity, sale of alcoholic beverages while the license is under suspension, sale of intoxicating liquor where the only license is for 3.2 percent malt liquor, or violation of Section 4, the license shall be revoked. (2) The license shall be suspended by the Council after a finding under division (A) that the licensee has failed to comply with any applicable statute, rule, or provision of this ordinance for at least the minimum periods as follows: (a) For the first violation within any three-year period, at least one day suspension in addition to any criminal or civil penalties which may be imposed. (b) For a second violation within any three-year period, at least three consecutive days suspension in addition to any criminal or civil penalties which may be imposed. (c) For the third violation within any three-year period, at least seven consecutive days suspension in addition to any criminal or civil penalties which may be imposed. City of Corcoran March 26, 2020 County of Hennepin State of Minnesota ORDINANCE NO. 2020-401 (d) For a fourth violation within any three-year period, the license shall be revoked. (3) The Council shall select the day or days during which the license will be suspended. (C) Lapse of required proof of financial responsibility shall effect an immediate suspension of any license issued pursuant to this ordinance or state law without further action of the Council. Notice of cancellation or lapse of a current liquor liability policy shall also constitute notice to the licensee of the impending suspension of the license. The holder of a license who has received notice of lapse of required insurance or of suspension or revocation of a license may request a hearing thereon and, if a request is made in writing to the Clerk, a hearing before the Council shall be granted within ten days. Any suspension under this division (B) shall continue until the Council determines that the financial responsibility requirements of state law and this ordinance have again been met. (D) The provisions of Section 110:11 pertaining to administrative penalty may be imposed in addition to or in lieu of any suspension or revocation under this ordinance. 110.07: SUNDAY SALE REGULATIONS. “Sunday sale“ licenses shall permit the sale and consumption of intoxicating liquors on the licensed premises only and between the hours of 8:00 a.m. on Sundays and 2:00 a.m. on Mondays in conjunction with the serving of food, but no liquor shall be served on Sundays other than to persons who are seated at tables in those types of hotels or restaurants which qualify for the “Sunday sale” license. Every person desiring a “Sunday sale” license shall file a verified application therefore in writing with the Clerk Treasurer of the municipality in the form prescribed by the Department of Public Safety and, with additional information as the City Council may require. The annual fee for a “Sunday sale” license shall be set by resolution from time to time by the City Council. “Sunday Sale” licenses may be revoked by the Council, for cause, in the same manner as for the revocation of ”on-sale” licenses. 110.08: HOURS AND DAYS OF SALE. The sale of intoxicating liquor and 3.2% malt liquor for consumption on the licensed premises, as allowed in Minn. Stat. §340A.504 is modified and limited as follows: a) The sale of intoxicating liquor and 3.2% malt liquor until 2:00am shall be permitted only on Friday, Saturday and Sunday. Sunday sales under Minn. Stat. §340A.504, subd. 3, shall also be permitted. b) A licensee may apply to the city for a special event permit authorizing the sale of intoxicating liquor or 3.2% malt liquor until 2:00 a.m. for days other than permitted in subdivision a) above. The application shall be made to the Chief of Police or, in his absence, the City Administrator. City of Corcoran March 26, 2020 County of Hennepin State of Minnesota ORDINANCE NO. 2020-401 c) A licensee shall obtain the permit required of Minn. Stat. §340A.504, subd. 7 prior to selling intoxicating liquor or 3.2% malt liquor past 1:00am. 110.09: VACATION OF PREMISES. People may occupy the licensed premises until 2:30 a.m. on those days that the sale of intoxicating liquor and 3.2% malt liquor is permitted until 2:00 a.m. 110.10: ADDITIONAL FEES. License fees for those establishments exercising the right to remain open until 2:00 a.m. shall be increased by an amount necessary to cover all additional costs of law enforcement and administration associated with the longer hours. Such additional fees shall be as determined by resolution of the council, from time to time. 110.11: PENALTIES Any person violating the provisions of this ordinance or Minn. Stat. Ch. 340A as it may be amended from time to time or any rules promulgated under that chapter as they may be amended from time to time is guilty of a misdemeanor or guilty of applicable penalty under Minn. Stat. Ch. 340A and upon conviction shall be punished as provided by law. (A) The Council shall impose a civil penalty of up to $2,000 for each violation of Minn. Stat. Ch. 340A, as it may be amended from time to time, and of this ordinance. Conviction of a violation in a court of law is not required in order for the Council to impose the civil penalty. Any criminal action to enforce this chapter shall not preclude the Council from imposing the civil penalties hear in or taking other action up to and including revocation of the license. A hearing under the Administrative Procedures Act, Minn. Stat. §§ 14.57 to 14.70, as it may be amended from time to time, is not required before the penalty is imposed, but the Council shall provide an opportunity to a hearing on the proposed violation and the proposed penalty and hear any person who wishes to speak. Non- payment of the penalty is grounds for suspension or revocation of the license. The following is the minimum schedule of presumptive civil penalties which must be imposed in addition to any suspension unless the license is revoked: (1) For the first violation within any three-year period, $500. (2) For the second violation within any three-year period, $1,000. (3) For the third and subsequent violations within any three-year period, $2,000. (C) The term “violation” as used in Section 23 includes any and all violations of the provisions in this section, or of Minn. Stat. Ch. 340A, as it may be amended from time to time or any rules promulgated under that chapter as they may be amended from time to time. The number of violations shall be determined on the basis of the history of violations for the preceding three-year period. Revocation shall occur within 60 days following a finding of a violation for which revocation is imposed. In the past the City has requested bids for the rental of the land for farming purposes. Staff sent bidding information to ten previous bidders and advertised for bids in the Crow River News and with the League of Minnesota Cities. Staff received two bids for the rental of 48 tillable acres. Bids were opened at 10am on Monday February 12th, 2018. Bids ranged from $51.00 per acre up to $141.00 per acre for the parcels. Council should review the bids and award the contracts to the highest bidder. Financial/Budget: For 2020 and 2021 the land will be rented for $141.00 per acres for the 27 acre parcel and for the 22 acre parcel. The land rented for $180.00 and $160.00 per acre in 2018 and 2019. Hofer through Kendra Lindahl, Landform DATE: March 18, 2020 for the March 26, 2020 City Council Meeting RE: Final PUD Development Plan and Final Plat for “Bellwether 4nd Addition” (Outlot D, Bellwether 2nd Addition) (city file no. 20-002) REVIEW DEADLINE: May 29, 2020 1.Application Request Pulte Homes of Minnesota, LLC (applicant) has submitted a request for approval of a Final Plat and Final PUD plan application for “Bellwether 4th Addition”, a residential development of 74 new single- family homes and one outlot on 45.49 acres of property. 2.Planning Commission Review Planning Commission reviewed the Final PUD plan at their regularly scheduled meeting on March 5, 2020. Other than the applicant, there was no one present to speak at the public hearing. Planning Commission asked the size of Outlot A since grading will be allowed with the approval of the Final PUD Development Plan. Outlot A is 29.49 acres. Planning Commission voted 4-0 to recommend approval of the final PUD plan. 3. Context Background On June 28, 2018 the City approved rezoning the property to Planned Unit Development (PUD), a preliminary plat and a preliminary PUD plan. The approvals were subject to several conditions which the developer is working to address. On October 11, 2018 the City approved the Final Plat and Final PUD Development plan for the first phase of Bellwether which included 78 single family homes and six outlots. On April 25, 2019 the City approved the Final Plat for Bellwether 2nd Addition and the Final PUD for the 2nd and 3rd phases On October 26, 2019 the City approved the Final Plat for Bellwether 3rd Addition. The plat for the 3rd Addition cannot be recorded until the street and utility improvements on the realigned Stieg Road are completed, but some grading work in the 3rd Addition was required to facilitate these improvements. This is the fourth of five/six planned phases. Bellwether Final PUD Plan (20-002) 2 March 26, 2020 4. Analysis of Request Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and City Code requirements, as well as City policies. The City Engineer’s comments are incorporated into this staff report, the detailed comments are included in the attached engineering memo and the approval conditions require compliance with the memo. A. Level of City Discretion in Decision-Making The City’s discretion in approving a final PUD is limited to whether the proposed plan is in substantial conformance with the preliminary PUD development plan. If it meets these standards, the City must approve the final PUD development plan. The City’s discretion in approving a final plat is limited to whether the proposed plat meets the standards outlined in the City’s subdivision and zoning ordinance. If it meets these standards, the City must approve the final plat. B. Consistency with Ordinance Standards Final PUD Development Plan Staff has reviewed the application for consistency with the approved preliminary plans, as well as City policies. Staff finds that the final PUD development plan is generally consistent with the approved preliminary plans. The applicant has submitted a plan for the fourth phase of the proposed development which includes 74 new single-family homes one outlot. All the homes proposed in this development will be single- family homes constructed for active adults. The Bellwether (formerly Encore) development is part of the Del Webb development brand, which is an age-restricted community that provides a wide range of property management services and recreational amenities to its residents. The properties are managed by a homeowner’s association that provides yard and snow maintenance and are restricted by covenants that require at least one person in the household to be 55 or older. No children are allowed to live in the community. The community is served by a recreational community center. Lot Size and Setbacks The applicant is showing lot sizes and setbacks that are generally consistent with the preliminary plat and preliminary PUD development plan, which allowed 44-foot wide lots (measured at the setback). The final plat is consistent with those approvals. The site plan should be revised to show a minimum 22-foot driveways for all garages that do not overlap into sidewalks, drives or streets. Additionally, the applicant should provide details of the driveway, house pads, and setbacks as part of their final PUD Plan application that demonstrate compliance with the approved PUD standards, as required in Condition 17 of Resolution 2018-48. Bellwether Final PUD Plan (20-002) 3 March 26, 2020 Architecture The applicant has three widths of homes (34-foot, 45-foot, and 50-foot wide homes) that have the option of being finished with five different architectural styles (Prairie, Heartland, Craftsman, Northern Craftsman, and Euro Country). All homes in this phase will be the 34-foot wide homes. The 34-foot wide homes have three floor plan options and up to 9 different exterior elevations. Architectural exhibits and elevations have previously been approved to comply with Condition 21 of Resolution 2018-48. All homes in this phase must comply with these architectural requirements. Homeowners Association A homeowner’s association (HOA) will maintain all common ownership areas of the development, including the open space areas, development signage and cul-de-sac/island plantings. Condition 22 of Resolution 2018-48 requires that a draft of the HOA documents be submitted for City review and approval with the final plat application for all phases. Staff has included a condition that final approval of the PUD development plan and final plat are contingent on the applicant providing amended copies of the Declaration of Covenants and Homeowners Association Documents to the City for review and approval prior to release of the final plat for recording. Landscaping The applicant has provided a final tree preservation plan that conforms to the preliminary development plan. Section 1060.070 of the Zoning Ordinance requires one overstory tree for each single-family home and a variety of landscaping along the perimeter of the site, along the streets, within the private park and adjacent to wetlands. Plans show plantings at sizes and percentages that comply with ordinance requirements. The plan shows overstory trees along each of the public streets in the right-of-way. The even spacing and location of the trees creates a desirable tree canopy along the roads. At the time of preliminary PUD approval trees were required to be in the property owner’s yard. Policy now allows for trees in the right-of-way for the 80-foot and the 60-foot rights-of-way (where there is room for the public infrastructure and the trees) but will require that trees be placed outside of the right-of-way in the 50- foot rights-of-way. These trees outside of the right-of-way must be planted prior to issuance of a certificate of occupancy for the adjacent home. Mail Delivery Centralized mailbox locations should be shown on the landscape plans. The US Postal Service must approve the location of mailboxes. The applicant will need to provide proof of the approved location to the City. Signage Original approvals granted approval for signage at the main entrance and the secondary entrance off Stieg Road. No signs are proposed for this addition. Bellwether Final PUD Plan (20-002) 4 March 26, 2020 Streets The street layout and design are consistent with preliminary approvals. Condition 29 of Resolution 2018-48 notes that the HOA is required to maintain all common lots, cul-de-sac landscaping, and ponds. Staff notes that the developer is required to maintain all common areas including boulevard plantings and will be required to enter into a maintenance agreement with the City. Street names provided generally comply with the City’s approved Street Map. Preliminary approvals indicated 102nd Place would be extended and Ironwood Lane and 103rd Avenue would be established in this addition and the final plans are consistent with this. A temporary easement is in place at the intersection of 102nd Place and Ironwood Lane, but will be vacated automatically with the platting of this addition as 102nd Place is extended. The applicant has submitted plans that do not show a required temporary cul-de- sac and a hammerhead turnarounds. Section 945.020, Subd. 19 requires temporary cul-de-sacs or hammerhead turnarounds until future connections are constructed. The graphic to the right indicates where an additional temporary cul-de-sac (red circle) and a hammerhead turnaround are required (blue circle). All other roads comply with City standards. Staff is including a condition that the applicant provide temporary easement exhibits for the turnarounds. They will be required to file these easements at Hennepin County. The applicant shall also be required to install barricades and signage to indicate a future road connection, consistent with Section 945.010, Subd.19. The plans indicate that barricades will be located off site. Currently the plans show grading on the property to the west at the end of 103rd Avenue. The applicant must either obtain an easement from the affected land owner or revise plans to eliminate the impact. The applicant will be required to comply with the conditions in the City Engineer’s memo dated February 24, 2020. Utilities Municipal sewer and water are available to serve the site. The applicant will be required to comply with the conditions in the City Engineer’s memo dated February 24, 2020. Bellwether Final PUD Plan (20-002) 5 March 26, 2020 Wetlands The final plans shows several wetlands. The wetland buffers and buffer setbacks provided are consistent with the preliminary plat. Section 1050.010, Subd. 7 requires that monuments be installed at each lot line where it crosses a wetland buffer, and where needed to indicate the contour of the buffer, with a maximum spacing of 200 feet of wetland edge. Plans generally comply with this requirement, but plans should be revised to show additional the additional missing wetland monuments as shown. The applicant shall be required to comply with any additional buffer requirements identified by ECWMC. The City and ECWMC have different wetland buffer and setback requirements. The applicant must show compliance with the most restrictive standard. The applicant has indicated that multiple wetlands will be filled. The applicant will have to comply with the Minnesota Wetland Conservation Act and details in the City Engineer’s memo dated February 24, 2020. Floodplain The plans show that there are lots located within a 100- year flood plain (Zone A on the FEMA Floodplain map), which is represented as a dashed red line on the plans. Areas within Zone A that do not have a delineated floodway are classified as being in the General Floodplain District. Section 1050.030 of the Zoning Ordinance provides standards for properties within the Floodplain. The applicant will need to work with City staff to apply for a FEMA map change on any future phases with structures in the flood plain that require fill or mitigation. Storm Water Management This phase includes construction of three new stormwater management ponds. A stormwater maintenance agreement must be prepared for each pond, submitted for review and approval by staff and will be required to be recorded with the final plat. Bellwether Final PUD Plan (20-002) 6 March 26, 2020 The developer has provided 10-foot drainage and utility easements along the front and rear lot lines and five-foot drainage and utility easements along the side lot lines for the single-family lots. This is consistent with the engineering design standards. The applicant will be required to comply with the conditions in the City Engineer’s memo dated February 24, 2020. Grading The applicant is requesting approval to grade the area south of the 4th Addition to help balance the site. Typically, the City does not allow grading to extend beyond the limits of the plat, but has allowed this work to occur in the past when required to balance the soil on site. Staff supports the request for grading provided the grading plan is modified to create a transition to a generally flat area for the future neighborhood park. The applicant will be required to comply with the conditions in the City Engineer’s memo dated February 24, 2020. Lighting The applicant has submitted a lighting plan that shows lighting locations. The lights generally are located on the sidewalk side of the street with one exception at the intersection of 102nd Place and 103rd Avenue. Staff has included a condition that the applicant continue to work with staff to finalize streetlight locations. This phase will include the same lighting fixtures used in the previous phase which conform to City lighting requirements. Staff has included a condition that lighting complies with the lighting requirements of Section 1060.040 of the Zoning Ordinance and are generally located on the sidewalk side of the street. Parks, Trails and Open Space Park dedication for Bellwether was calculated for the entire development. No park dedication is required for this phase. On-road trails are proposed for this phase of the PUD final development plan; however, only off-road trail areas shown in the Comprehensive Plan count toward park dedication requirements. When Outlot A is platted in a future phase, the trail easements will be dedicated and will be counted toward the park dedication requirement. Additional park dedication will be considered as they are proposed with future phases. To calculate the total contribution to park dedication for each phase of development when dedication is proposed, a park and trail easement exhibit with gross and net acreage calculations will be required. Final Plat The applicant is requesting approval of a final PUD development plan for 74 single-family residential home lots and one outlot. Bellwether Final PUD Plan (20-002) 7 March 26, 2020 If the phase is approved, it would bring the total number of platted lots to 231 out of 398 total lots. The applicant will be providing final PUD plans and final plats for additional phases of the development in the future. The final plat is consistent with the approved preliminary plat. Development Phasing The developer plans to develop this project in five to six phases. The developer began work in the fall of 2018 and expects completion of the development by 2024. Timing will be contingent upon extension of public infrastructure. The phasing plan may be modified at each stage to better correspond with public improvements. Conclusion Staff finds that the proposed plan is generally consistent with the Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance, and preliminary PUD approvals. The staff report noted the outstanding issues that must be addressed, and we have included conditions in the attached resolutions to address these issues. 5. A final plat is approved to allow the creation of 74 lots for new single-family homes and one outlot in accordance with the application materials and plans received by the City on January 22, 2020, and additional information received January 30, 2020, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the final PUD development plan and development contract. 3. Approval is contingent upon City Council approval of the easement vacation of Outlot D, Bellwether 2nd Addition. 4. The development contract must be executed by the developer and the City and must be filed with the final plat. 5. Development is subject to all conditions of the “Encore” (now Bellwether) preliminary plat and all amendments. 6. The developer must submit a final plat for each future phase of development. No final approvals are granted at this time for phases of development. 7. Park dedication is based on the development of the entire Bellwether and shall be land dedication at the time of final plat for the phases that include public park dedication, as outlined in the PUD approvals. No park dedication is provided in this phase. 8. The applicant shall comply with all requirements of the City Engineer’s memo, dated February 24, 2020. The applicant must file the final plat for phase 4 at Hennepin County within 2 years of the date of approval or the approval shall expire. 12. The following documents must be approved by the City Attorney and recorded at Hennepin County: a. Stormwater Maintenance Agreement b. Temporary Turnaround Easements c. Maintenance and Encroachment agreements for landscaping in the public right- of-way. 13. Record the approving resolutions and associated documents at Hennepin County and provide proof of recording to the City. 14. The applicant shall provide proof of recording the final plat and related documents at Hennepin County. 15. The applicant shall provide the approved preliminary and final plat drawings to the City in an electronic (AutoCAD) format. A final PUD plan is approved to allow the creation of 74 lots for new single-family homes and one outlot in accordance with the application materials and plans received by the City on January 22, 2020 and revisions received on January 30, 2020 except as amended by this resolution. a. Home construction and street construction shall only be permitted on platted lots. b. Grading work may be allowed on outlots as permitted by the City Engineer. However, home and street construction shall not be permitted in these areas until they are platted as lots in a future plat. 2. Approval is contingent upon City Council approval of the final plat and development contract. 3. The development shall be subject to all conditions of the “Encore” preliminary PUD development plan approval and all amendments. 4. The development is subject to Elm Creek Watershed Management Commission review and approval. 5. The applicant shall comply with all conditions in the City Engineer’s memo dated February 24, 2020. 6. Park dedication is based on the development of the entire Bellwether site approved under the preliminary PUD and shall be the equivalent of 21.98 acres. No park dedication is provided in this phase. The final locations must be inspected and approved by City staff. d. Monuments and signs shall be installed prior to approval of the building permit. 8. The development shall comply with the City’s requirements regarding fire access, fire protection and fire flow calculations, the location of fire hydrants, fire department connections and fire lane signage. 9. Final copies of the amended Declaration of Covenants and Homeowners Association Documents shall be submitted for review and approval. 10. Lighting should comply with the lighting requirements of Section 1060.040 of the Zoning Ordinance and generally be located on the sidewalk side of the street. a. The applicant should work with staff to finalize street light locations. 13. The plans show centralized mailbox locations. These mailbox locations shall be approved by the US Postal Service and proof of the approved locations shall be provided to the City, prior to issuance of building permits. 14. The developer shall work with City staff to apply for a FEMA map change for the areas that require fill or mitigation. 15. This is an amendment to the Bellwether Development Contract dated October 16, 2018. 1. REQUEST FOR PLAT APPROVAL. The Developer has asked the City to approve a plat for Bellwether 4th Addition (referred to in this Contract as the "plat"). The land is situated in the County of Hennepin, State of Minnesota, and is legally described in Exhibit A. 2. CONDITIONS OF PLAT APPROVAL. The Developer shall enter into this Contract, furnish the security required by it, and record the plat upon City approval with the County Recorder or Registrar of Titles. 3. RIGHT TO PROCEED. Unless separate written approval has been given by the City, within the plat or land to be platted, the Developer may not grade or otherwise disturb the earth, remove trees, construct sewer lines, water lines, streets, utilities, public or private improvements, or any buildings until all the following conditions have been satisfied: 1) this agreement has been fully executed by both parties and filed with the City Clerk, 2) the necessary security has been received by the City, 3) the plat, development contract and other associated documents have been recorded with the Hennepin County Recorder's Office and proof of recording has been provided to the City, and 4) the City has issued written notice that all conditions have been satisfied and that the Developer may proceed. However, the Developer may be allowed to begin grading the site when items 1, 2 and 4 of the previous sentence have been satisfied. 4. PHASED DEVELOPMENT. If the plat is a phase of a multi-phased preliminary plat, the City may refuse to approve final plats of subsequent phases if the Developer has failed to fulfill all obligations in this Contract and the failure has not been remedied. Development of subsequent phases may not proceed until Development Contracts for such phases are approved by the City. Park charges and area charges for sewer and water referred to in this Contract are not being imposed on outlots, if any, in the plat that - 2 – are designated in an approved preliminary plat for future subdivision into lots and blocks. Such charges will be calculated and imposed when the outlots are final platted into lots and blocks. 5. PRELIMINARY PLAT STATUS. If the plat is a phase of a multi-phased preliminary plat, the preliminary plat approval for all phases not final platted shall lapse and be void unless final platted into lots and blocks, not outlots, within two (2) years after preliminary plat approval. 6. CHANGES IN OFFICIAL CONTROLS. For two (2) years from the date of this Contract, no amendments to the City's Comprehensive Plan or official controls shall apply to or affect the use, development density, lot size, lot layout or dedications of the approved final plat unless required by state or federal law or agreed to in writing by the City and the Developer. Thereafter, notwithstanding anything in this Contract to the contrary, to the full extent permitted by state law, the City may require compliance with any amendments to the City's Comprehensive Plan, official controls, platting or dedication requirements enacted after the date of this Contract. 7. DEVELOPMENT PLANS. The plat shall be developed in accordance with the following plans. The plans shall not be attached to this Contract. If the plans vary from the written terms of this Contract, the written terms shall control. The plans are: Exhibit A – Legal Description Plan A – Final Plat, dated 1/22/2020 Plan B – Final Grading Plan, dated 1/22/2020 Plan C – Final Erosion Control Plan, dated 1/22/2020 Plan D – Final Tree Preservation and Reforestation Plan, dated 1/30/2020 Plan E – Final Lighting Plan, 1/22/2020 Plan F – Final Street Tree Landscape Plan - S, dated 1/22/2020 Plan G – Final Sanitary & Watermain Plan, dated 1/22/2020 Plan H – Final Storm Sewer Plan, dated 1/22/2020 8. IMPROVEMENTS. The Developer shall install and pay for all of the following improvements: • Streets • Sanitary Sewer • Watermain • Surface Water Facilities (pipe, ponds, rain gardens, etc.) • Grading and Erosion Control • Sidewalks/Trails • Street Lighting • Underground Utilities • Street Signs and Traffic Control Signs • Landscaping Required by Section 1060 of the Zoning Ordinance • Tree Preservation • Wetland Mitigation and Buffers • Monuments Required by Minnesota Statutes • Miscellaneous Facilities - 3 – The Developer shall submit plans and specifications which have been prepared by a competent registered professional engineer to the City for approval by the city engineer or designee. The Developer shall instruct its engineer to provide full-time field inspection personnel in order for the Developer's engineer to be able to certify that the construction work meets the approved City standards as a condition of City acceptance. In addition, the City may, at the City's discretion and at the Developer's expense, have one or more City inspectors and a soil engineer inspect the work on a full or part-time basis. The Developer, its contractors and subcontractors, shall follow all instructions received from the City's inspectors. The Developer and/or the Developer’s engineer shall provide for on-site project management. The Developer's engineer is responsible for design changes and contract administration between the Developer and the Developer's contractor. The Developer or his or her engineer shall schedule a pre-construction meeting at a mutually agreeable time at City Hall with all parties concerned, including the City staff, to review the program for the construction work. All labor and work shall be done and performed in the best and most workmanlike manner and in strict conformance with the approved plans and specifications. No deviations from the approved plans and specifications will be permitted unless approved in writing by the city engineer or designee. The Developer agrees to furnish to the City a list of contractors being considered for retention by the Developer for the performance of the work required by the contract. The Developer shall not do any work or furnish any materials not covered by the plans and specifications and special conditions of this contract, for which reimbursement is expected from the City, unless such work is first approved in writing by the city engineer or designee. The Developer shall be responsible for construction of all improvements in conformance with the approved plans and specs. 9. OFF-SITE IMPROVEMENTS. The Bellwether Master Development Contract, included a stormwater impact in the amount of $100,000 for off-site improvements for conveyance, flood plain analysis and potential downstream mitigation due when Phase 2 or 3 was platted. When the City identifies the need and cost, the City will reduce the letter of credit accordingly and require the developer to provide cash escrow. The City will defer collecting it till a later phase when the design is complete. 10. CONTRACTORS/SUBCONTRACTORS. City Council members, City employees, and City Planning Commission members, and corporations, partnerships, and other entities in which such individuals have greater than a 25% ownership interest or in which they are an officer or director may not act as contractors or subcontractors for the public improvements identified in Paragraph 8 above. 11. PERMITS. The Developer shall obtain or require its contractors and subcontractors to obtain all necessary permits, including but not limited to: • Minnesota Department of Health for Watermains/Wells • NPDES Permits • MPCA for Sanitary Sewer and Hazardous Material Removal and Disposal • DNR for Dewatering and Work in Protected Waters • City of Corcoran for Building Permits and Building Demolition • MCES for Sanitary Sewer Connections • Watershed Permits - 4 – 12. TIME OF PERFORMANCE. The Developer shall install all required public improvements in this phase by October 31, 2020, with the exception of the final wear course of asphalt on streets. The City will not accept new public streets in Bellwether 4th Addition until 80% of the homes in phase I have received a certificate of occupancy and the streets have weathered a full winter season. Final wear course placement outside of this time frame must have the written approval of the City Engineer. The Developer may, however, request an extension of time from the City. If an extension is granted, it shall be conditioned upon updating the security posted by the Developer to reflect cost increases and the extended completion date. 13. LICENSE. The Developer hereby grants the City, its agents, employees, officers and contractors a license to enter the plat to perform all work and inspections deemed appropriate by the City in conjunction with plat development. 14. CONSTRUCTION ACCESS. Construction traffic access and egress for grading, public utility construction, and street construction is restricted to access the subdivision via internal development or Stieg Road to and from CSAH 101 with no unloading on Stieg Road. No construction traffic is permitted on other adjacent local streets. 15. GRADING PLAN. The plat shall be graded in accordance with the approved grading and erosion control plan, Plan "B" and Plan “C”. The plan shall conform to City of Corcoran Engineering Design Standards. 16. EROSION CONTROL. Prior to initiating site grading, the erosion control plan, Plan C, shall be implemented by the Developer and inspected and approved by the City. Erosion control practices must comply with the Minnesota Pollution Control Agency’s Best Management Practices. The City may impose additional erosion control requirements if they would be beneficial. All erosion control shall comply with Section 950 (Erosion Control) of the Corcoran City Code and the Corcoran Engineering Design Standards. No development, utility or street construction will be allowed and no building permits will be issued unless the plat is in full compliance with the approved erosion control plan. 17. STREET MAINTENANCE DURING CONSTRUCTION. The Developer shall be responsible for all street maintenance until the streets are accepted by the City. Warning signs shall be placed when hazards develop in streets to prevent the public from traveling on the same and to direct attention to detours. If and when streets become impassable, such streets shall be barricaded and closed. In the event residences are occupied prior to completing streets, the Developer shall maintain a smooth surface and provide proper surface drainage to ensure that the streets are passable to traffic and emergency vehicles. The Developer shall be responsible for keeping streets within and without the subdivision swept clean of dirt and debris that may spill, track, or wash onto the street from Developer’s operation. 18. OWNERSHIP OF IMPROVEMENTS. Upon completion of the work and construction required by this Contract and acceptance of the work by the City, the improvements lying within public easements or right-of-way shall become City property. Prior to acceptance of the improvements by the City, the Developer must furnish the following affidavits: • Contractor’s Certificate • Engineer’s Certificate • Land Surveyor’s Certificate - 5 – 19. PARK DEDICATION. Park dedication for the Bellwether development will be satisfied through the contribution of land, construction of the private amenity center and associated improvements, trail easements, pavement of trails and construction of the boardwalk. No land dedication is required or provided for parks in this phase of development. 20. WATERMAIN / STORAGE TRUNK LINE AREA CHARGE (TLAC). This plat is subject to a watermain/storage trunk line area charge (TLAC). The charge is calculated as follows: 14.53 net acres (based on pre-developable area) $6,246.00 per acre = $90,754.38 for Bellwether 4th Addition. Future phases shall be cash with the final plat for each future phase subject to the then-current rates. 21. WATER CONNECTION CHARGE. This plat is subject to a water connection charge calculated as follows: 74 units x $2,591.00 per unit = $191,734.00. The fees shall be paid at the time of building permit. Future development shall be cash at the time of issuance of each building permit at the then- current rates. The developer will be responsible for payment of the then-current water connection charge set by the City of Maple Grove. 22. SANITARY SEWER TRUNK LINE AREA CHARGE (TLAC). The City will not collect the Sanitary Sewer TLAC for this project because the cost of installing an over-sized trunk sewer pipe from the metering station is in excess of the fees that would have been generated by the TLAC. Therefore, no pre-developable area acre trunk fees are required. The developer will be responsible for payment of the then-current SAC fee set by the Metropolitan Council. 23. SANITARY SEWER CONNECTION CHARGE. This plat is subject to a sanitary sewer connection charge calculated as follows: 74 units x $1,195.00 per unit = $87,468.00. The fees shall be paid at the time of building permit. Future development shall be cash at the time of issuance of each building permit at the then-current rates. 24. BUILDING PERMITS/CERTIFICATES OF OCCUPANCY. A. Curbing, and one lift of asphalt shall be installed on all public and private streets prior to issuance of any certificate of occupancy, except one model home on a lot acceptable to the City Planner may be issued a certificate of occupancy if needed for the Parade of Homes. B. The Developer shall comply with the City of Corcoran Engineering Design Standards. C. Prior to issuance of building permits, wetland buffer monuments shall be placed in accordance with the City’s zoning ordinance. Specifications for the monuments are available from the City Planner. D. Failure to fulfill any of the terms of this Contract by the Developer, including nonpayment of billings from the City, shall be grounds for denial of building permits, including lots sold to third parties, and the halting of all work in the plat. E. If building permits are issued prior to the acceptance of public improvements, the Developer assumes all liability and costs resulting in delays in completion of public improvements and - 6 – damage to public improvements caused by the City, Developer, their contractors, subcontractors, materialmen, employees, agents, or third parties. No sewer and water connection permits may be issued until the streets needed for access have been paved with a bituminous surface and the utilities are tested and approved by the City Engineer. 25. STREET REGULATORY SIGNS/TRAFFIC CONTROL SIGNS. Street name signs shall be installed by the Developer in accordance with the City of Corcoran Engineering Design Standards. The Developer shall install traffic control signs in accordance with the plan approved by the City Engineer and Minnesota Manual on Uniform Traffic Control Devices. All signs must be installed prior to final building inspection approval or earlier if necessary as determined by the City Engineer. 26. STREET LIGHT INSTALLATION AND OPERATION COSTS. The developer shall pay for and install all street lights. The street light shall be of a design approved by the City. The developer shall be responsible for street light operation and maintenance costs until such time as the City accepts the public street where the streetlights are located. After the acceptance the City shall be responsible for all costs, subject to the street lighting policy. The costs of operation are dependent upon the operation costs for Wright Hennepin Electric under contract franchise with the City of Corcoran. 27. RESPONSIBILITY FOR COSTS. A. Except as otherwise specified herein, the Developer shall pay all costs incurred by it or the City in conjunction with the development of the plat, including but not limited to legal, planning, engineering and inspection expenses incurred in connection with approval and acceptance of the plat, the preparation of this Contract, review of construction plans and documents, and all costs and expenses incurred by the City in monitoring and inspecting development of the plat. The City may require Developer to post funds in an escrow account, at its discretion. In the event the cash escrow amount is insufficient, Developer shall post additional escrow funds as determined by the City Planner within ten (10) days of written demand. Failure to make payment of the additional escrow amount shall permit the City to supplement those amounts from any other sureties posted by Developer. B. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. C. The Developer shall reimburse the City for costs incurred in the enforcement of this Contract, including engineering and attorneys' fees. D. The Developer shall pay, or cause to be paid when due, and in any event before any penalty is attached, all special assessments referred to in this contract. This is a personal obligation of the Developer and shall continue in full force and effect even if the Developer sells one or more lots, the entire plat, or any part of it. - 7 – E. The Developer shall pay in full all bills submitted to it by the City for obligations incurred under this Contract within thirty (30) days after receipt. Bills not paid within thirty (30) days shall accrue interest at the rate of eight percent (8%) per year. F. In addition to the charges and special assessments referred to herein, other charges and special assessments may be imposed such as but not limited to sewer availability charges ("SAC"), City water connection charges, City sewer connection charges, and building permit fees. 28. SPECIAL PROVISIONS. The following special provisions shall apply to plat development: A. Compliance with the conditions of the original approvals, PUD Amendments, including the PUD Final Development Plan (Resolution 2020-25) and Final Plat approval (Resolution 2020- 24). B. Before the City signs the final plat, the Developer shall convey the Park to the City by warranty deed, free and clear of any and all encumbrances. Before the City signs the final plat, the developer shall convey the required trail easements to the City in a form satisfactory to the City C. The Developer shall install a temporary turnaround on the west end of 102nd Place until it is extended to the west with the fifth phase of the Bellwether development. Before the City signs the final plat, the Developer shall furnish the City an appropriately executed temporary turnaround easement, in recordable form. D. The Developer shall install a temporary turnaround on the east end of 103nd Avenue until it is extended to the east with the future development. Before the City signs the final plat, the Developer shall furnish the City an appropriately executed temporary turnaround easement, in recordable form. E. The Developer shall install a temporary turnaround on the west end of 103nd Avenue until it is extended to the south with future development. Before the City signs the final plat, the Developer shall furnish the City an appropriately executed temporary turnaround easement, in recordable form. F. The Developer shall post a $7,400.00 security for the final placement of interior subdivision iron monuments at property corners. The security was calculated as follows: 74 lots at $100.00 per lot. The security will be held by the City until the Developer's land surveyor certifies that all irons have been set following site grading and utility and street construction. In addition, the certificate of survey must also include a certification that all irons for a specific lot have either been found or set prior to the issuance of a building permit for that lot. G. The Developer must obtain a sign permit from the City Building Official prior to installation of any subdivision identification signs. H. The Developer shall supply a complete set of the approved construction plans in an AutoCAD.DWG electronic file format before the preconstruction conference. I. The Developer shall include the “City of Corcoran’s Standard Detail Specifications” (all applicable sections) in the contract documents of their improvement project. - 8 – 29. MISCELLANEOUS. A. The Developer may not assign this Contract without the written permission of the City Council. The Developer's obligation hereunder shall continue in full force and effect even if the Developer sells one or more lots, the entire plat, or any part of it. Notwithstanding anything herein to the contrary, in conjunction with a sale of the entire land, the Developer may, without the consent of the City, assign this Contract to a limited liability company or other entity in which the Developer or an affiliate thereof has a controlling membership or other controlling ownership interest, provided that such assignee assumes in writing the obligations of Developer under this Contract. B. Certain retaining walls will require a Building Permit. Retaining walls that require a building permit shall be constructed in accordance with plans and specifications prepared by a structural or geotechnical engineer licensed by the State of Minnesota. Following construction, a certification signed by the design engineer shall be filed with the Building Official evidencing that the retaining wall was constructed in accordance with the approved plans and specifications. All retaining walls identified on the development plans or by special conditions referred to in this Contract shall be constructed before any other building permit is issued for a lot on which a retaining wall is required to be built. C. Appropriate legal documents including, but not limited to, those regarding Homeowner Association documents, conservation easements, covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. D. Developer shall take out and maintain or cause to be taken out and maintained until six (6) months after the City has accepted the public improvements, public liability and property damage insurance covering personal injury, including death, and claims for property damage which may arise out of Developer's work or the work of its subcontractors or by one directly or indirectly employed by any of them. Limits for bodily injury and death shall be not less than $500,000 for one person and $1,000,000 for each occurrence; limits for property damage shall be not less than $200,000 for each occurrence; or a combination single limit policy of $1,000,000 or more. The City shall be named as an additional insured on the policy, and the Developer shall file with the City a certificate evidencing coverage prior to the City signing the plat. The certificate shall provide that the City must be given thirty (30) days advance written notice of the cancellation of the insurance. The insurance shall be primary and non-contributory as to any policy maintained by the City. E. Third parties shall have no recourse against the City under this Contract. F. If any portion, section, subsection, sentence, clause, paragraph, or phrase of this Contract is for any reason held invalid, such decision shall not affect the validity of the remaining portion of this Contract. G. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this Contract. To be binding, amendments or waivers shall be in writing, signed by the parties and approved by written resolution of the City Council. The City's failure to promptly take legal action to enforce this Contract shall not be a waiver or release. - 9 – H. This Contract shall run with the land and may be recorded against the title to the property. The Developer covenants with the City, its successors and assigns, that the Developer has fee title to the property being final platted and/or has obtained consents to this Contract, in the form attached hereto, from all parties who have an interest in the property; that there are no unrecorded interests in the property being final platted; and that the Developer will indemnify and hold the City harmless for failure to fulfill any of the foregoing covenants. I. Each right, power or remedy herein conferred upon the City is cumulative and in addition to every other right, power or remedy, express or implied, now or hereafter arising, available to City, at law or in equity, or under any other agreement, and each and every right, power and remedy herein set forth or otherwise so existing may be exercised from time to time as often and in such order as may be deemed expedient by the City and shall not be a waiver of the right to exercise at any time thereafter any other right, power or remedy. J. The Developer represents to the City that the plat complies with all city, county, metropolitan, state, and federal laws and regulations, including but not limited to: subdivision ordinances, zoning ordinances, and environmental regulations. If the City determines that the plat does not comply, the City may, at its option, refuse to allow construction or development work in the plat until the Developer does comply. Upon the City’s demand, the Developer shall cease work until there is compliance. 30. DEVELOPER’S DEFAULT. In the event of default by the Developer as to any of the work to be performed by it hereunder, the City may, at its option, perform the work and the Developer shall promptly reimburse the City for any expense incurred by the City, provided the Developer, except in an emergency as determined by the City, is first given notice of the work in default, not less than 48 hours in advance. This contract is a license for the City to act, and it shall not be necessary for the City to seek a court order for permission to enter the land. When the City does any such work, the City may, in addition to its other remedies, assess the cost in whole or in part. 31. WARRANTY/PERFORMANCE GUARANTEE. The Developer warrants all improvements required to be constructed by it pursuant to this Contract against poor material and faulty workmanship. The Developer shall submit either 1) a warranty/maintenance bond for 100% of the cost of the improvement, or 2) a letter of credit or performance bond for twenty-five percent (25%) of the amount of the original cost of the improvements. A. The required warranty period for materials and workmanship for the utility contractor installing public sewer and water mains shall be two (2) years from the date of final written City acceptance of the work. B. The required warranty period for all work relating to street construction, including concrete curb and gutter, sidewalks and trails, materials and equipment shall be subject to one (1) year from the date of final written acceptance, unless the wearing course is placed during the same construction season as the bituminous base course. In those instances, the subdivider shall guarantee all work, including street construction, concrete curb and gutter, sidewalks and trails, material and equipment for a period of two (2) years from the date of final written City acceptance of the work. - 10 – C. The required warranty period for sod, trees, and landscaping is one full growing season following installation. Following construction, a certification signed by the design landscape architect shall be filed with the City evidencing that the sod, trees, and landscaping was installed in accordance with the approved plans and specifications. 32. SUMMARY OF SECURITY REQUIREMENTS. To guarantee compliance with the terms of this contract, payment of special assessments, payment of the costs of all public improvements, and construction of all public improvements, the Developer shall furnish the City with a letter of credit, in a form acceptable to the City, from a bank, cash escrow or a combination cash escrow and Letter of Credit ("security") for $2,781,431.91 which represents 100 percent of the estimated cost of the Improvements. The letter of credit shall include an automatic renewal clause. The letter of credit shall guarantee to the City the construction and satisfactory completion of all items to be completed by the developer; that the letter of credit shall be reduced from time to time as work is performed and accepted in a satisfactory manner; that the city engineer may reduce the letter of credit to the amount reasonably estimated by the City engineer to be necessary to cover the remaining construction obligations; however, the letter of credit shall not be reduced below the amount estimated by the City to cover all obligations of development including payment of costs and expenses incurred by the City for legal, engineering, planning and any other costs until a maintenance bond for period of one year, satisfactory to the city attorney and the city engineer has been provided by the developer or its subcontractor. If the security is drawn down, the proceeds shall be used to cure the default. Upon receipt of proof satisfactory to the city engineer or designee that work has been completed and financial obligations to the City have been satisfied, with city engineer or designee approval the security may be reduced from time to time by 75% of the financial obligations that have been satisfied. Twenty-five percent (25%) of the amounts certified by the Developer's engineer shall be retained as security until: (1) all improvements have been completed; (2) - 12 – iron monuments for lot corners have been installed; (3) all financial obligations to the City satisfied; (4) the required "record" plans have been received by the City; (5) a warranty security is provided; and (6) the public improvements are accepted by the City. 34. Council Meeting: March 26, 2020 Prepared By: Brad Martens Topic: Corridor Planning Grant Application Action Required: Approval Summary : Hennepin County is requesting applications for corridor planning grants which are due April 1, 2020. The purpose of the grant is to fund projects that meet the following goals: • Enhance the tax base • Stimulate economic development and job growth • Strengthen and connect places and people • Innovate and advance sustainability • Lead collaborative planning and implementation Staff has discussed potential grant applications with the County and is recommending authorization to seek funds to update the northeast district design guidelines. Development pressure in northeast Corcoran is increasing and infrastructure improvements including the Dayton Parkway Interchange and the 610 extension are planned or taking place. The initial district design guidelines were adopted in 2004 and are included in the zoning ordinance. The City took part in a similar project to update the southeast district design guidelines, this effort significantly expanded the planning of that district and has been extremely helpful in planning for development. Staff envisions a similar result from this project. Staff is in the process of drafting the application and hopes to provide it to the Council in advance of the March 26th meeting. Financial/Budget: The maximum grant application is for $50,000 and requires a 10% match for communities with populations over 5,000. Staff is requesting authorization to request the entire $50,000 amount and to allocate up to $5,000 from the 2020 budget as a match. Funds would be allocated from the professional services budget under planning and zoning. There is a potential that this would result in that line item going over budget however staff feels it is a worthy use of those funds. Options: 1. Authorize staff to apply for corridor planning grant funds to update the northeast district design guidelines and use of associated matching funds from the 2020 budget; authorize the Mayor to submit a letter of support for the project on behalf of the City Council. 2. Decline the opportunity to apply for grant funds. Deadline: April 1, 2020 Eligible Applicants: Municipal governments, park districts, watershed districts, and other public agencies Funds Available: Up to $50,000 on a matching basis Use of Funds Examples of eligible planning activities include: • Land use or small area planning involving an intensification of uses and/or employment opportunities • Infrastructure planning and conceptual designs, including pedestrian and bike connections and public realm improvements • Redevelopment feasibility or market analyses (site specific projects will be considered) Other types of plans and studies may also be considered, provided outcomes meet program goals. Ineligible activities include: • Local government staff time • Capital costs and equipment Resources Funding is available to support up to $200,000 in planning projects in 2020. • Maximum funds per project is $50,000 • A monetary (not in-kind) match is expected, based on population under the local authority’s jurisdiction: o 50% match if population more than 40,000 o 25% match if population more than 15,000 o 10% match if population more than 5,000 o 0% match if population less than 5,000 • Consideration will be given if financial constraints affect ability to meet this match. Please note in application. 2020 Community Works Corridor Planning Page 2 Background The Hennepin County Community Works program was established more than 25 years ago as a cross-jurisdictional program that addresses areas with declining tax base through coordinated public investments in corridor-scale infrastructure, natural systems, and redevelopment. The Community Works program has five primary goals: • Enhance the tax base • Stimulate economic development and job growth • Strengthen and connect places and people • Innovate and advance sustainability • Lead collaborative planning and implementation Community Works is a leader in supporting partnerships in planning, redevelopment, and infrastructure investment and has funded both large, multi-phase infrastructure investments (such as the Midtown Greenway and Southwest LRT Community Works projects) and smaller one-time planning studies through the Corridor Planning program. Project Evaluation Applications will be evaluated on the extent to which the proposed activities: 1) Advance one or more of the Community Works’ program goals (see above) 2) Generate measurable, positive impacts commensurate with the public investment 3) Reduce disparities and address equity 4) Demonstrate local commitment to implement Proposals may accomplish these goals by: • Creating and increasing access to high-quality jobs, housing, and transportation • Promoting equitable development, sustainable wealth creation and economic inclusion • Developing relationships with local community and cultural organizations • Demonstrating equitable community engagement with historically disadvantaged and underrepresented groups including immigrant, African-American, Indigenous, LGBT, and differently-abled communities • Improving community resilience to climate change • Promoting a more active, healthy community through pedestrian and bike planning Application Process Application packet should include the following items: • 2020 Community Works Corridor Planning cover page • 2020 Community Works Corridor Planning application (2 pages maximum) • Map(s) of project area • Letters or resolutions of support (recommended) • Finalize submission on the Supplier Portal 2020 Community Works Corridor Planning Page 3 Applications must be submitted through the Hennepin County Supplier Portal. Potential applicants are strongly encouraged to review projects with Mr. Hood prior to application submittal. Proposals will be competitively reviewed, with notice of funding recommendations anticipated by May. Projects must begin no later than September 1, 2020 and be completed within 12 to 18 months. Applications will be reviewed by a committee consisting of Hennepin County Community Works staff and additional reviewers as deemed necessary to thoroughly evaluate applications. Funds are anticipated to be available for eligible expenditures incurred after final contracts are executed. Contracting and Reporting Hennepin County will contract directly with consultants for the portion of the proposed work covered under the award. Applicants will contract separately for the portion of the work covered by its funds. Hennepin County prefers consulting firms to be selected from Hennepin County’s pre-approved Consulting Services Program and through a competitive RFP process, but exceptions can be made for unique circumstances. Receiving funds through this program does not guarantee that future capital funding will be made available. Please contact Mr. Hood with questions. Hennepin County requires all awarded projects to include a final report summarizing the process, outcomes, and impacts of the completed work and a memorandum detailing feedback on how to improve the Corridor Planning program and application process. Hennepin County is obligated to follow the Minnesota Data Practices Act, which means that applications will likely be public data after the evaluation and selection process. A statement identifying data as copyrighted or otherwise protected does not prevent public access to the data contained in the response if such data does not qualify as trade secret data. Hennepin County is not obligated to pay any costs incurred in the preparation of an application. APPENDIX A (Design Guidelines) Page A-12 October 25, 2018 District Design Guidelines Descriptions and Recommendations for District Specific Design Standards District Plan follows: NORTHEAST DISTRICT DESIGN GUIDELINES At one of the major entrances to the City of Corcoran, the Northeast District Plan establishes a gateway to the community that reflects the City’s rural character. The plan offers opportunities for expanded tax base, jobs and services by taking advantage of Maple Grove’s nearby higher density development. The primary entry into the Northeast District is County Road 30, where a mixed-use PUD (planned unit development) will combine a mix of low and medium density residential with mixed-use commercial, including neighborhood retail, service retail, commercial and office uses. The edge of the district along County Road 101 is planned primarily for high quality business parks, with some destination commercial or retail uses closer to the County Road 30 intersection. General Site Development • The commercial area along County Road 101 should be designed as high quality business parks, with appropriate office, commercial and light industrial uses. • Retail uses should be limited to the commercial area indicated near the County Road 101 and 30 intersection or included within the County Road 30 mixed-use PUD area. • Within the PUD, residential development should provide for life-cycle housing for empty nesters, retirees, and first-time home buyers with a range of housing types (condominiums, townhouses, and single-family attached) and densities. Streets, Trails, Parks and Public Amenities • County Road 30 is a major entry point into the City of Corcoran, which warrants a unique design treatment as it meets County Road 101; this intersection should be developed as a “gateway” with significant landscaped open space and appropriate entry elements; the design should express the unique character of Corcoran. • County Road 30 from County Road 116 to County Road 101 should be developed as a green corridor with landscaped setback, center boulevard and other enhancements that will express a sense of entry while maintaining an open, rural road character. • Enhancements at the intersection of County Roads 116 and 30 should be designed similar to major County Road 116 intersections in the downtown and southeast district. APPENDIX A (Design Guidelines) Page A-13 October 25, 2018 • The County Road 116 rural greenway should continue north through this district, with trail connections to new civic or community spaces as well as retail or destination uses within the PUD. • Mixed commercial-retail within the PUD should be designed around public or common areas that are linked by trails or sidewalks. The design should also include sidewalks and trails to connect neighborhood retail and public spaces to the adjacent residential neighborhoods. • Mixed-use and new residential development within the PUD should include a designated neighborhood park in addition to natural open space (woods, wetlands, meadows, etc.). • The planned extension of County Road 117 to County Road101 should be planned and designed in a way that is sensitive to existing residential uses in that area. Direct access for new developments should be limited on County Roads 101, 116 and 30. Future plans for access on these roads should balance traffic demand and future development. Gene Kissner is requesting approval of a Preliminary Plat, Final Plat and Variance to subdivide the 3.76-acre St. Jane Chantel parcel owned by Church of St. Thomas the Apostle. The portion north of County Road 50 contains the cemetery and will be retained by the church and Kissners will purchase the portion south of County Road 50. The Planning Commission held a public hearing on March 5th and recommended approval. Council is expected to take action on March 26th. 2.Bellwether 4th Final Plat and Final PUD (city file no.20-002). Pulte Homes of Minnesota, LLC (applicant) has submitted a request for approval of a Final Plat and Final PUD plan application for “Bellwether 4th Addition”, a residential development of 74 new single-family homes and one outlot on 45.49 acres of property. The Planning Commission reviewed on March 5th and recommended approval. Council is expected to take action on March 26th. 3.Zoning Map Changes (city file no. 20-003). Minnesota statues require cities to update their zoning map to bring it into compliance with the comprehensive plan within 9 months of adoption. The 2040 Comprehensive Plan was adopted in November and these map amendments will ensure consistency. The Planning Commission held a public hearing on March 5th and recommended approval. Council is expected to take action on March 26th. 4.Park Dedication Ordinance Update (city file no. 20-004). The park dedication fees are based on the comprehensive plan. The 2040 Comprehensive Plan was adopted in November and included some changes that require us to reevaluate our park dedication fee formula and make some minor edits to the ordinance. The Planning Commission is expected to hold a public hearing on April 2nd , the Parks Commission will review on April 16th and Council action is expected on April 23rd. 5.Tessmer Topo/Wetland Waiver (PID 07-119-23-21-0002) (city file no.20-007). The applicant is requesting a waiver of the topography and wetland delineation requirements for this parcel. This parcel will be platted with the property to the west for a small division, but no development is proposed for this parcel. The application is scheduled for Council review on March 26th. 6.Corcoran Self Storage PUD Amendment (city file no. 20-009). The applicant is requesting an amendment to the phasing plan for the project. Staff is currently reviewing the application for completeness, but it appears that the request may be administratively approved. Agenda Item 11a. MEMORANDUM 2 7. Vollrath request for Ag Preserve designation and initiate expiration for 42.09 acres of land south of County Road 50 (PID 29-119-23-24-0001) (City File 20-010). The item is scheduled for Council action on March 26th. Also, there are several projects that have been approved, but are still not filed and closed out: 1. Corcoran Business Park (City file 06-005). The City Council granted a one-year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. Staff has spoken to the applicant and will schedule a meeting when more information is available on the Loretto sewer project. 2. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (City file 12-002). Hope Ministries submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. The letter of credit for site improvements has been released, but we are holding the escrow pending completion of the approved landscaping. The applicant has indicated that they are considering a site plan amendment application to modify the approved plans. Staff met again with Pastor Brian Lother in July 2017 to discuss the outstanding issues and future expansion plans on the property. 3. *Sawgrass Preliminary Plat, Preliminary PUD Development Plan and Rezoning for Schendel property at 20400 County Road 10 (City file 14-027). The City Council approved the request on December 11, 2014 and granted the applicant 2 years to apply for the final plat and final PUD development plan. Peachtree Partners did not buy the property, but a different developer could still proceed with the approved plan. Several extensions have been approved. The landowner is requesting another extension to the preliminary plat approval, which was previously granted extensions that expire in February. M/I Homes is proposing to take over the project with a few amendments to the proposed plan. Council is expected to review the request at the February 27th meeting. 4. Commercial Door Addition at 7670 Commerce Street (City file 15-010). The City received an application for approval of a building addition, which required a conditional use permit, interim use permit, variance and site plan approval. The project was reviewed at a public hearing at the June 4th Planning Commission meeting and was approved by the City Council on June 25th. The required landscaping will be finalized and constructed after the downtown infrastructure project is completed. The City will release the remaining escrow when the planting is completed. Staff is working with the landowner to complete the outstanding items. 5. Comlink Midwest Site Plan, CUP, Variance and Rezoning at 23405 CR 10 (City file 19-011). The request is to allow construction of a contractor’s yard in the Rural Commercial (CR) district over 3-5 years. Phase 1 is for the 20,000 square foot Utility Construction building. This item was reviewed at a public hearing at the July 9th Planning Commission and Council approved on July 25th meeting. The approval included changes to the building architecture were approved by the Council at the August 22nd meeting. 6. Bellwether 3rd Addition Final Plat and Easement Vacation (City File 19-017). This final plat is for 29 lots north of the new Stieg Road. The PUD final plat for this area we approved as part of city file 19-002, but this plat approval was deferred until the Stieg Road alignment is completed. The application was approved by the City Council September 26th. The final plat has been released for filing. 7. Wessel Property PUD Sketch Plan and EAW for 22020 Hackamore Road (PID 35-119-23-43-0001, 35-119-23-44-0001, 35-119-23-11-0001 and 35-119-23-12-0002) (City File 19-018). The sketch plan was reviewed by the Council on September 26th and staff was directed to begin the Environmental Assessment Worksheet. The EAW was acted on by the Council in January 2020. 8. Savoie Minor Subdivision at 21801 Homestead Trail (City file 19-021). This two-lot subdivision is was approved by the Council on October 24th. The council had previously approved this subdivision, but the applicant let it expire and an extension was approved. MEMORANDUM 3 9. Ravinia 14th Final Plat and Final PUD (City file 19-022). Lennar submitted a request for approval of a final plat and final PUD development plan for “Ravinia 14th Addition” to allow 33 single-family detached home lots and four outlots. The item was postponed from the December 5th Planning Commission review to January 2nd due to lack of quorum. The Planning Commission recommended approval on January 2nd and Council approved the item on January 23rd. 10. Sketch Plan for “Nelson International” at 10409 County Road 101 (city file 19-023). The applicant submitted a sketch plan for an approximately 33,000-sq. ft. truck sales/repair operation. The Council reviewed this item on January 23rd. 11. *Annual Ordinance Codification (city file no. 20-005).
