HomeMy WebLinkAboutResolution 2019-52 Approving Comlink Findings of Facts for Rezoning Legal RevisedCity of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2019-52 Motion By: Schultz Seconded By: Keefe July 25, 2019 APPROVING FINDINGS OF FACT FOR REZONING FOR PROPERTY LOCATED AT 23405 COUNTY ROAD 10 (PID 18-119-23-12-0001) (CITY FILE 19-011) WHEREAS, Comlink Midwest ("the applicant") has requested approval to rezone land on 16.54 acres legally described as follows. That part of the Northwest Quarter of the Northeast Quarter of Section 18, Township 119, Range 23, Hennepin County, Minnesota, described as follows: Beginning at a point on the West line of the Northeast Quarter of said Section 18 distant 638.8 feet South from the Northwest corner of said Northeast Quarter; thence North along said West line 259.3 feet to a point 379.5 feet South from the Northwest corner of said Northeast Quarter; thence East, parallel with the North line of said Northeast Quarter, a distance of 128.75 feet; thence North, parallel with said West line, a distance of 239.25 feet; thence Vest, parallel with said North line, a distance of 36 feet; thence North, parallel with said Vest line, a distance of 8.25 feet; thence East, parallel with said North line, a distance of 212.25 feet; thence North, parallel with said West line, 132 feet to said North line; thence East along said North line to the. Northeast corner of said Northwest Quarter of the Northeast Quarter; thence South along the East line of said Northwest Quarter of the Northeast Quarter a distance of 638.8 feet; thence West to the point of beginning. Subject to an easement for Hennepin County State Aid Highway No. 10 over the most northerly line of the above -described land as shown in Hennepin County Plat No. 8, Book 71 of Hennepin County Records, page 3867013, Subject to an easement for Hennepin County State Aid Highway No. 19 over the most westerly line of the above -described land as shown in Hennepin County Highway Plat No. 39, County Recorder Document No. 4855886; Subject to an easement as contained in Document No. A 8660089 filed September 23, 2005 in favor of County of Hennepin, granting easements for highway, trail, drainage and utility purposes; WHEREAS, the applicant has requested a rezoning from Transitional Rural Commercial (TCR) and Rural Residential (RR) to Rural Commercial (CR); and WHEREAS, the entire property is guided Rural Service/Commercial in the 2040 Comprehensive Plan: and WHEREAS, the TCR zoning is a holding zoning until development is proposed: and WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval, and NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does support the request of Comlink Page 1 of 2
