The City of Corcoran will provide high quality public services in a cost effective, responsible, and professional manner in order to create a preferred environment to live, work, play, and conduct business. MISSION STATEMENT The City of Corcoran will become a vibrant community focused around a thriving Town Center while preserving its natural character and agricultural roots. In order to achieve this vision, the City will seek to work with partners to accomplish the following outcomes: A variety of housing options for all ages and stages of life existing in cohesion with the natural environment. A well connected parks and trails system with options for year-round recreation and opportunities for residents to connect with nature. A safe and clean community where residents can be proud to live, work, and play. A variety of high quality schools are available to residents and work in cohesion with the City’s vision. A variety of commercial and industrial businesses exist to provide for most services and jobs for the community. A D O P T E D M A R C H 8 , 2 0 1 8 VALUES STATEMENT A D O P T E D J A N U A R Y 2 4 , 2 0 1 9 ACTION STEPS The City of Corcoran has identified the following action steps for 2019: Develop a master plan, finance plan, and select amenities for City Park. Develop a needs assessment, action plan, and finance plan for fire service. Complete the update to the southeast district and town center plan; complete a stormwater management plan for the town center. Decide on request for contribution to the Dayton Parkway Interchange project. Develop a low cost option to pave gravel roads; establish criteria to select roads for paving; push legislative priorities which includes street funding options. Identify all existing easements/right-of-way the City has obtained for trails, etc. Complete a feasibility study for trails along selected County Roads. Identify preferred snowmobile routes. Evaluate staffing and space needs for public safety. Evaluate the need for a City Planner. Complete studies needed for water system options. Investigate options to reduce the use of salt/chloride; apply for funding to complete an additional sub watershed assessment. Provide an update on the existing crime/drug action plan; create a new plan for next steps. Execute code enforcement plan. Consider updates to the Open Space and Preservation ordinance and other ordinances to establish incentives for protecting/preserving the natural environment through development. Present were Mayor Thomas, Councilor Bottema, Councilor Dejewski, Councilor Keefe and Councilor Schultz. Also present were City Administrator Martens, City Administrative Services Director Beise, and Director of Public Safety Gottschalk. 1.Call to Order / Roll Call Mayor Thomas called the work session to order at 6:01 pm. 2.2020 Draft Budget Work Session City Administrator Martens outlined the focus of the work session, understanding budget and levy goals. Council inquired about the city-wide tax capacity increase and how the tax capacity compared regarding new home construction versus existing homes and asked staff provide that information. Council discussed not wanting to increase the tax rate. Council discussed the recreation coordinator and the CSO positions. Council asked if there would be a need for an additional vehicle for the CSO position. Director of Public Safety indicated eventually there would be a need, but a retired police vehicle could work in that capacity. City Administrator Martens reviewed the projected tax impacts with a flat tax rate and a two percent valuation increase. City Administrator Martens further expanded reducing the tax rate by 1 percent equates to a reduction of $100,000. Council discussed new developments the tax impact. Council further discussed the recreation coordinator and continued growth of the City. Council gave staff direction to find budget savings to reduce the levy in order to maintain or reduce the current tax rate. 3.Adjournment MOTION: made by Keefe, seconded by Schultz to adjourn. CITY OF CORCORAN City Council Meeting Minutes August 8, 2019 - 7:00 pm The Corcoran City Council met on August 8, 2019 at City Hall in Corcoran, Minnesota. Present were Mayor Thomas, Councilor Bottema, Councilor Dejewski, Councilor Keefe, and Councilor Schultz. Also present were City Administrator Martens, Administrative Services Director Beise, and Director of Public Safety Gottschalk. 1.Call to Order / Roll Call Mayor Thomas called the meeting to order at 7:03 pm. 2.Pledge of Allegiance Mayor Thomas invited all in attendance to rise and join in the Pledge of Allegiance. 3.Agenda Approval MOTION: made by Dejewski, seconded by Keefe to approve the agenda as presented. Voting Aye: Thomas, Bottema, Dejewski, Keefe, and Schultz (Motion carried 5:0) 4.Commission Representatives Mayor Thomas noted Planning Commissioner Shoulak notified Council he would not be in attendance; Parks and Trails Commissioner Christenson was in attendance and Mayor Thomas invited him to speak on commission related items. 5.Open Forum Becky Jones, 7800 Maple Hill Road D17, addressed the Council on concerns with code enforcement on a neighboring lot. Ms. Jones asked for clarification on code enforcement actions. Council explained the process can be lengthy if the party issued the citation does not work with the City, however the City is making progress, and appreciates her expression of the issue addressed. Council and staff explained briefly the recent update of code compliance ordinances, the next steps in working with the park owner, the legal processes, and that staff will follow up with her specifically. 6.Presentations/Recognitions No presentations or recognitions were heard. 7.Consent Agenda a.Draft Minutes of July 25, 2019 Council Meeting b.Draft Minutes of July 25, 2019 Council Work Session Meeting c.Financial Claims d.Bridge Inspections – Hennepin County Agreement e.Pay Request #7 – NE Truck Sewer Improvements f.Waiver Request for Amplified Sound at 9200 County Road 116 g.Waiver Request for Amplified Sound at 10135 Ebert Road MOTION: made by Schultz, seconded by Bottema to approve consent agenda as presented. Voting Aye: Thomas, Bottema, Dejewski, Keefe, and Schultz (Motion carried 5:0) Council mentioned an appreciation for the amplified sound permits coming in early for review. Council and staff discussed redacting personal information from the amplified sound permit applications. 8.Planning Business 7b. 2 No planning business was presented. 9. Unfinished Business a. Draft 2020 Budget City Administrator Martens indicated no further direction is needed by Councilregarding the draft 2020 budget. 10. New Business a. Campaign Sign Enforcement Policy City Administrator Martens briefly outlined the current campaign sign enforcement policy, and the proposed campaign sign enforcement policy. City Administrator Martens discussed the challenges the City faced with the current policy including enforcement of signs placed where the right of way is not platted within the City and only enforcing City Council candidate signs. City Administrator Martens recapped the proposed sign enforcement policy and potential changes include establishing set distance from edge of road in sign placement; weekly sweeps during campaign periods and responding quickly to complaints on signs; removing campaign signs without notification; and applying the sign policy to any office, not just restricted to City Council campaign signs. Council discussed the proposed sign enforcement policy, specifically including or not including the address and phone number on the sign; notifying the owner of sign removal after the sign has been removed; and holding the sign for a specific amount of time after election cycle has ended. Council debated the importance of signs for information purposes but also the importance of where signs are placed, and how advertising signs are currently placed all over the City. Council further discussed the resident confusion over where the signs are placed regarding resident properties. Council discussed a 15 foot distance from the road way edge for signs, the length of time the City holds onto signs after the election, and include or maintain site triangle regarding sign placement. Council further discussed enforcement and if weekly sweeps should occur. City Administrator Martens noted having a consistent policy is important to allow candidates to understand expectations and staff to understand enforcement. Council discussed the challenges for staff when some signs are removed and others are not. Council discussed allowing campaign signs four weeks prior to election, with no campaign signs taken down during the election cycle, and at the end of the election cycle, any remaining campaign signs would be taken down and held for specific amount of time before they are destroyed. MOTION: made by Dejewski, to not enforce campaign election signs four weeks before the election, unless there is a safety issue. Council and staff discussed when voting begins and timing of sign enforcement. (Motion failed, lack of second) MOTION: made by Keefe, seconded by Schultz to direct staff to initiate the process to approve the Campaign Sign Enforcement Policy and sign ordinance with modifications to the policy to include a 15 foot distance from road requirement, having the City hold onto campaign signs prior to destruction, include or maintain site triangle with sign placement, and removing the name and address requirement for campaign signs. Voting Aye: Thomas, Keefe, and Schultz Voting Nay: Dejewski Abstaining: Bottema (Motion carried 3:1:0) b. Potential Urban Land Institute Meeting Councilmember Keefe presented to Council on the Urban Land Institute and what the panel can provide to the City Council regarding commercial and industrial development in Corcoran. Council deliberated on organizational biases and how that influences decisions or recommendations. The Council discussed being open to information and discussions. Council requested to see the presentation prior to the evening of the presentation, allowing time for Council to review the sources 3 of data and prepare to ask relevant questions. Per consensus, Council directed staff to schedule a meeting with the Urban Land Institute. 11. Staff Reports No staff reports were presented. 12. 2019 Council Schedule City Administrator Martens reviewed the upcoming council agenda. Council expressed gratitude and appreciation for all the work staff coordinated and put into the Night to Unite events. 13. The contingency is for the developer to provide the city an escrow that covers construction, field compliance testing, and engineering management costs. Bid Results Five bids were received on August 13, 2019 for the Stieg Road Realignment project. Bid results are summarized below and detailed in the attached table. Summary Contractor Total Bid C.S. McCrossan Construction, Inc.$919,210.80 Minnesota Paving & Materials $940,124.78 Northwest Asphalt, Inc. $960,943.80 Valley Paving, Inc $994,315.00 Meyer Contracting, Inc. $1,070,685.25 The low bidder was C.S. McCrossan Construction, Inc. with the bid of $919,210.80. The engineer’s estimate was $999,679.00. C.S. McCrossan Construction, Inc. can perform the work and confirmed that they are comfortable with their bid. Engineer’s Recommendation The cost is competitive, therefore, Wenck recommends that the project be awarded to C.S. Hofer through Kendra Lindahl, Landform DATE: August 14, 2019 for the August 22, 2019 Corcoran City Council Meeting RE: Preliminary Plat, Final Plat, and Variance for the property at 22505 Strehler Rd (PID 20-119-23-14-0001 and PID 20-119-23-11-0001) (City File 19-014) REVIEW DEADLINE: September 14, 2019 1.Description of Request Ebert Construction has submitted a request on behalf of Diann C Strehler Trust for a preliminary plat, a final plat and a variance to create two lots from the existing 118.67-acre parcel. The proposed Lot 2 does not have access to a public road and requires a variance to create a lot that does not meet the minimum frontage (lot width) requirement. The owners have obtained an easement from the Kienitz’s to cross their property to access Strehler Road on the east. 2.Planning Commission Review The Planning Commission reviewed the submittal on August 1, 2019 and recommended approval with a vote of five for and zero against. Only the applicant was present for comment. 3.Parks and Trails Commission Review The Parks and Trails Commission August 15, 2019 meeting was cancelled due to a lack of quorum. Staff reached out to commissioners and they concur with staff and recommend cash-in-lieu of land for the one new lot. 4.Context The existing 118.67-acre lot is unplatted and the applicant has indicated that there is no development currently planned for the property. The north side of the lot that abuts Strehler Road contains eight structures: two houses and six accessory structures related to agricultural uses. The City Council granted a topographic survey and wetland delineation waiver for the property on May 23, 2019 with the condition that any development or future subdivision will require both to be completed (Resolution 2019-42). Item 7h. Strehler Preliminary Plat, Final Plat and Variance (19-014) 2 August 22, 2019 Zoning and Land Use The site is zoned Rural Residential and guided as Rural/Ag Residential on the 2030 and 2040 Comprehensive Plan. The lot is outside of the 2040 MUSA. Surrounding Properties The properties to the south and east are guided Rural/Ag Residential on both the 2030 and 2040 Comprehensive Plan. The properties to the Northwest, North and West are guided Agricultural Preserve on both the 2030 and 2040 Comprehensive Plan. All surrounding properties are zoned Rural Residential. Natural Characteristics of the Site Hennepin County maps and the 2030 and 2040 Comprehensive Plan indicate several potential wetlands throughout the site. The Federal Emergency Management Agency (FEMA) indicated a 100-year flood plain is also present on the property. Parks and Trails The 2030 Parks and Trails Map shows a proposed north/south horseback trail along the border of the proposed Lots 1 and 2 that is not included in the 2040 Parks and Trails Map. Both the 2030 and 2040 Parks and Trails map show a proposed on-road trail along Strehler Road to the north of the site, a proposed off-road trail along the border of proposed Lots 1 and 2 and proposed OSP/Nature Park directly south of the site. 5. Analysis of Request Staff has reviewed the application for consistency with the Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance, and City Code requirements, as well as City policies. The City Engineer’s comments are incorporated into this staff report and included as an attachment. A. Level of City Discretion in Decision-Making The City’s discretion in approving a preliminary and final plat is limited to whether the proposed plat meets the standards outlined in the City’s subdivision ordinance and zoning ordinance. If it meets these standards, the City must approve the final plat. The City’s discretion in approving or denying a variance is limited to whether the proposed project meets the standards in the Subdivision Ordinance for a variance. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that the variance standards have been met. Strehler Preliminary Plat, Final Plat and Variance (19-014) 3 August 22, 2019 B. Consistency with Ordinance Standards Preliminary Plat Lot Size and Standards The subdivision would create one 79.1-acre lot (proposed Lot 1) for the existing farmstead and accessory buildings and one 39.6-acre lot (proposed Lot 2) which currently contains no structures. These proposed lot sizes meet the standards required by the Rural Residential zoning. The subdivision ordinance requires all new lots to have a minimum lot width of 200 feet along a public street. Lot 2 does not meet this requirement, but the applicant has secured an easement along the eastern border of the proposed Lot 2 to gain access to Strehler Road. This easement will require a variance, which is detailed below. The property currently has twelve development rights and the applicant has indicated that eleven will be assigned to Lot 1 (which includes the existing homes) and one to Lot 2. It is staff’s understanding that Lot 2 will be sold for development of a single-family home. Prior to issuance of a building permit, the owner of Lot 2 would be required to provide a full survey with topography and a wetland delineation as well as proposed well and septic locations. While there are existing structures on Lot 1, there is no development planned at this time. Well and Septic Plans show the location of existing well and septic areas for the existing farmstead and the houses. The preliminary plat also shows possible primary and secondary septic locations for future development in Lot 2. Septic locations must be approved by Hennepin County prior to issuance of building permits. Wetlands The 2040 Corcoran Natural Resources Inventory Map, the National Wetlands Inventory and FEMA show the location of wetlands and floodplains present on a large amount of the property. The floodplain extends between Lot 1 and Lot 2. The wetlands in the area largely correspond with the location of the floodplains, but some additional wetlands appear to exist in what would be the south of the proposed Lot 2. The City Engineer and Elm Creek Watershed Management Commission both require an easement over the floodplain. This has been included as a condition of approval. Parks and Trails Park dedication is due for the new Lot 2. Staff recommends cash-in-lieu of land for Lot 2. Lot 1 will not require a park dedication until further development or subdivision happens as it is an existing lot. At that time, the city will require dedication of the trail easement. Strehler Preliminary Plat, Final Plat and Variance (19-014) 4 August 22, 2019 Streets The proposed Lot 1 would retain access off Strehler Road to the North. The preliminary and final plat shows a 33-foot right-of-way for Strehler Road, which is not consistent with the City’s right-of-way standards. The city engineer has provided a memo addressing this and has stated that the 33-foot right-of-way is acceptable as shown by the applicant, however, if Lot 1 subdivides in the future, the city should require the 40-foot collector half right-of-way. Access An existing drive will access the proposed Lot 1. The proposed Lot 2 will not have frontage to a public road. The applicant has secured an easement with the lot to the east of the proposed Lot 2, to provide access to the property from Strehler Road. Variance The applicant is requesting a variance from the subdivision ordinance to allow creation of Lot 2 with zero lot width where a minimum 200-foot lot width (frontage on a public street) is required. Access to Lot 2 is proposed through an easement on the adjacent eastern property that is owned by Donald and Joyce Kienitz. A variance to allow creation of the lot without frontage requires that the applicant show that the following standards have been met. A. That there are practical difficulties in complying with the zoning ordinance. Creating access to proposed Lot 2 faces numerous difficulties. The applicant has indicated that poor soils, possible wetlands, floodplain and a drainage ditch make providing access through the north difficult. The east side of the existing lot has no frontage on Strehler Road and can only access the road through an easement. The landowner was not able to purchase the portion of the Kienitz land west of Strehler Road that if added to Lot 2 would make the lot compliant and was only able to obtain an easement. B. That the conditions upon which a petition for a variation is based are unique to the parcel of land for which the variance is sought and were not created by the landowner. The subject property is unique due to decisions outside the property owners’ control as this is an existing lot of record that does not have frontage on a public street for the east portion of the property. While the parcel could be subdivided to allow access on what is proposed as the eastern border of Lot 1, subdividing the parcel in such a way would create unnecessary complications by reducing the amount of agricultural land available to Lot 1 and incurring significant expenses to construct a road through wetlands, floodplain and across a ditch. Additionally, the applicant tried to purchase the lot upon which the easement has been allowed but was unable to do so. C. That the granting of the variation will not alter the essential character of the locality. The granting of the variance will not alter the essential character of the locality. Currently, the applicant is not planning any development that will affect the proposed variance. If the variance is Strehler Preliminary Plat, Final Plat and Variance (19-014) 5 August 22, 2019 issued to allow the creation of the lot, the additional installation of a driveway will not alter the essential character of the locality. If development were to occur at a future date, a topography and wetland delineation would be required to ensure that the character and natural elements were not negatively changed. The easement is only 33-feet across the Kienitz parcel and it will not be obvious to passing motorists that the lot does not comply with the frontage requirements. D. The proposed variance would be in harmony with the general purposes and intent of the ordinance. The subdivision ordinance serves the purpose of guiding development and land uses in a manner that serves the community. The presence of the easement and road are not something that would indicate the lot as non-conforming to a passerby. E. The variance is consistent with the Comprehensive Plan. The subject property is guided Rural/Ag Residential in the 2040 Comprehensive Plan. Allowing access to the property through this easement will be consistent with the Comprehensive Plan by allowing the property owner to capitalize on the value of the land while preserving the rural experience of the area. Those approvals were granted with conditions through Resolution 2019-53 on July 25, 2019. The Conditional Use permit for exterior materials was approved and the provisions of City Code section 1070.020 were considered to be satisfied, provided that revised elevations were submitted for Council approval with improved architecture as discussed. Condition 4 read as follows: 4.A conditional use permit for exterior materials is approved, based on the finding that the standards in Section 1060.050 of the Zoning Ordinance have been met. This was not a specific City requirement, but it is fairly common practice in other communities. Typically, when the developer comes in to replat the outlot as the next phase of development, they also submit the easement vacation and provide new drainage and utility easements over the new parcels. In this case, due to an oversight from both the developer and the City, the vacation of the easements were not completed with the new plats. The easements are requested to be vacated as new easements have been provided in subsequent phases of Ravinia and the old easements are no longer needed. The easement vacations will be filed with the plats that dedicate the new easements. This 270-acre site includes four properties currently owned by Wessel, Dempsey and McKown. 2.Analysis of Request At this time, staff and the applicant are simply looking for feedback on the transportation concept plan. The applicant will use the transportation feedback from the Council and use it to prepare a Sketch Plan that will be submitted for Council review and comment. Transportation The Comprehensive Plan shows a minor collector street looping through the site to connect County Road 116 to Old Settlers Road. The City Code does not allow homeowners to access directly onto a minor collector street and the location of the existing wetlands limit other access points, which would render much of the site currently owned by Dempsey undevelopable. The City Engineer reviewed the concept plan and alternatives and recommends that the City Council allow a modification of the Comprehensive Plan to shift the minor collector from the location currently shown and plan for a future straight connection along the Horseshoe Trail alignment. This would be a long- term connection as it would require acquisition from existing landowners that are not part of this development. The City should allow Lennar to make the local street connection as shown on the plan and prepare for a future collector street in the modified location. The City Engineer’s memo provides more detailed transportation comments. Next Steps a.The applicant will use Council feedback on the transportation concept to prepare a Sketch Plan that will be submitted for Council review and comment. Agenda Item: 8c. The area west of CR 116 and north of Hackamore/Old Settlers Road is currently being developed with proposed residential uses. As this area continues to develop further to the north and west, the need for adequate collector roadways will increase. As shown in the Comprehensive Plan, an east/west minor collector street is planned for this area as a need between Larkin Road and Hackamore Road. 2.0 Concept Plan The proposed route shown in the Comprehensive Plan connects 66th Avenue N. to Horseshoe Trail by looping to the north before returning to the south at Old Settlers Road. This route was chosen by City during the Comp Plan process in order avoid existing residential properties without full consideration of wetland impacts or roadway design challenges. As more detail is provided through the concept plan process, the route as shown in the Comprehensive Plan impacts development of the Dempsey property by eliminating direct residential access to the minor collector street. The roadway alignment combined with the location of wetlands would severely limit the amount of development that could occur on this property. 3.0 Alternative Alignment An alternative to the looped alignment for the minor collector street is a direct route between CR 116 and Old Settlers Road at 66th Avenue N. The alignment would create a roadway from CR 116 at 66th Avenue N. that extends straight west to Horseshoe Trail and then to Old Settlers Road. This route would potentially impact the backyard areas of approximately four existing properties but would result in the most direct route for the minor collector street. Based on our review, we conclude that a minor collector street is needed in this area to adequately accommodate future development areas to the north and west. On July 24, 2019 the City’s Code Enforcement contractor conducted a site visit from the neighboring property and noted multiple nuisance violations at 10440 Trail Haven Road. A Notice of Violation was sent to the property owner. The property owners, Ken and Kay Moore, made a formal written appeal of the nuisance designation on August 5, 2019. Staff conducted a follow-up visit on August 15, 2019 and confirmed the existence of automobile body part(s) and construction debris (lumber). The following violations to exist on site: 82.04 Subd. 3. Storage Nuisance A. Construction materials, including, but not limited to, piles of dirt, sand, lumber, bricks, concrete blocks or sod, left in the open on property more than 60 days after construction has been completed or a certificate of occupancy has been issued, whichever occurred first. 82.04 Subd. 3. The owner, occupant, or other responsible party has the right to appeal the nuisance designation by submitting a written appeal to the City Clerk: 1) For weed nuisances: within 48 hours of the notice, excluding weekends and holidays; or 2) For all other nuisances: before the compliance date listed above or within seven calendar days of the date of the notice, whichever comes first. If no written appeal is filed within the applicable timeline, the right to appeal the designation shall be deemed to have been waived. 82.06: PENALTY. With the exception of noise violations under this chapter, all violation of this chapter shall be punishable as a misdemeanor under the Minnesota State Statutes and punishable up to the maximum sentence allowed therein. In addition, the City may enforce any provision of this chapter by injunctive action or other appropriate civil remedy. A noise violation of section 82.04 subd. 5 shall constitute a petty misdemeanor, and upon conviction, shall be punishable up to the maximum sentence allowed for a petty misdemeanor offense under Minnesota law. Subd. 1. Generally. Notwithstanding any other provision of this chapter regarding enforcement and in conjunction therewith, any violation of this chapter may be enforced by the enforcement officer or designee providing a notice of violation in an attempt to have the violation voluntarily abated. If the violation continues, the matter may be presented to the City Attorney. The City Attorney is authorized to seek compliance by injunctive action or other appropriate criminal or civil remedy. Subd. 2. Enforcement procedure. A. Whenever the enforcement officer or other designated official determines that a public nuisance is being maintained or exists on the premises in the City, the official shall notify, in writing, the owner of record or occupant of the premises of such fact and order that the nuisance be terminated or abated. If the premises are not occupied, the owner of record is unknown, or if the owner of record or occupant refuses to accept notice, notice of the violation shall be served by posting it on the premises. The notice shall state: 1. The property location of the public nuisance; 2. The nature of the public nuisance, with reference to the appropriate chapter provision; 3. The steps to be taken to abate the nuisance and a reasonable amount of time within which the nuisance is to be abated; 4. If the owner, occupant or other responsible party does not comply with the notice within the time specified, the City may provide for abating the nuisance; 5. The owner, occupant or other responsible party has the right to appeal the designation as a public nuisance by submitting a written appeal to the City Clerk before the date by which abatement must be completed or within seven calendar days after provision of the notice, whichever comes first. Subd. 3. Abatement (Weed Nuisance ONLY) A. Abatement shall be used as the enforcement method for violation of Section 82.04, Subd. 7 (Weed Nuisance). All other violations shall be processed according to the enforcement procedures in Subd. 2 of this Section. B. Upon receiving notice of the probable existence of weeds or tall grass in violation of this subchapter, a person designated by the City Council shall make an inspection and submit a written report regarding the condition. Written notification in the form of a Destruction Order including information contained in within the records of the City Clerk or any other city agency shall be forwarded to the property owner. The notice shall be served in writing by mail or in person to the last known address of the property owner and shall request that within 10 regular business days after the date of notice, the property owner shall remove the designated violation. The owner of record or occupant of the property responsible for the nuisance may request an extension to the abatement deadline by submitting written explanation of how the nuisance will be abated. Staff may grant an extension to the abatement deadline if sufficient reasons were submitted. C. The property owner may appeal by filing written notice of objection with the City Clerk within 48 hours of the notice, excluding weekends and holidays. It is the property owner's responsibility to demonstrate that the matter in question is shrubs, trees, cultivated plants or crops or is not otherwise in violation of this subchapter, and should not be subject to destruction under the subchapter. An appeal by the property owner shall be brought before the City Council and shall be decided by a majority vote of the Council Members in attendance and being at a regularly scheduled or special meeting of the City Council. D. In the event that the property owner fails to comply with the Destruction Order within ten regular business days and has not filed a notice within 48 hours to the City Clerk of an intent to appeal, the city may www.gocanvas.com 4 3F3F73A3-0A52-46F0-B98A-93DC52998E5D employ the services of city employees or outside contractors to remove the weeds to conform to this subchapter by all lawful means. E. The property owner shall be liable for all costs of removal, cutting or destruction of weeds. The property owner is responsible for all collection costs associated with weed destruction, including but not limited to, court costs, attorney's fees and interest on any unpaid amounts incurred by the city. If the city uses municipal employees, it shall set and assign an appropriate per hour rate for employees, equipment, supplies and chemicals that may be used. All sums payable by the property owner are to be paid to the City Clerk and to be deposited in a general fund as compensation for expenses and costs incurred by the city. All sums due and not paid within 30 days of mailed billing notice to the property owner’s last known address shall be certified to the county and assessed against the property, along with interest and a surcharge as set from time to time by City Council resolution or ordinance. Subd. 4. Recovery of costs. A. The owner of the premises on which a nuisance has been abated by the City, or a person who has caused a public nuisance on property not owned by that person, shall be personally liable for the cost to the City of the abatement, including administrative costs. All fees shall be charged against the property as a special tax. Abatement costs shall include the cost of the abatement, the cost of the investigation, such as title searches, inspections and testing, the costs of the notification and filing costs. Subd. 5. Council Meeting: August 22, 2019 Prepared By: Jessica Beise Topic: Election Precinct Boundaries Action Required: Approval Summary: In preparation for the 2020 election, staff is considering changes to polling locations and adding a third precinct. Currently the City has two precincts and two polling locations. With the remodel of the City Hall, a new polling place needs to be considered. Staff has been in contact with St. Thomas and Hope Community Church for alternative polling locations. With an increased population due to residential developments, staff foresees the need for making precinct changes in the near future. Staff is considering making the change in 2019 for the 2020 election as some residents will be voting at a new location due to the polling place change. If changes to precincts are not made for the 2020 election, staff would recommend alterations prior to the 2022 elections. In order to lessen confusion for residents, staff recommends making the change s to the polling place and precincts at the same time. There are no requirements for the precinct size as long as the boundaries do not cross over any County or legislative boundaries. Adding a third precinct will allow for fewer ballots in each precinct. Adding an additional precinct also allows staff to accommodate for growth in eastern Corcoran. Staff anticipates growth will continue to impact boundary changes but would like to limit how often boundary changes are needed. Precinct boundaries must be changed by December 1, 2019 to be in effect for the 2020 elections. Notices for precinct boundary changes have to be posted for 56 days and Hennepin County and the State would be notified of the changes. Working with our GIS technician, staff has proposed new boundaries which allow for growth in the southeast and northeast portions of Corcoran. Attached is the proposed precinct map. Staff is seeking the feedback of the Council on the proposed precincts. If Council is supportive of the precinct changes, staff would draft the formal notice and resolution authorizing the precinct boundary changes and bring back to Council for formal consideration in September. Financial/Budget: The 2020 budget includes funds to manage the three elections with three precincts. Options: 1. Authorize staff to draft the formal notice and resolution authorizing the precinct boundary change to be adopted at a future meeting. 2. Provide feedback to staff amending the proposed precincts. 3. Decline to add an additional precinct. 4. Send back to staff for further review. Recommendation Staff recommends adding an additional precinct prior to the 2020 election. Coupling the precinct change with a polling place change eliminate the need for changes in 2022 and will accommodate future growth. Council Action: 1. Consider a motion to authorize staff to draft the formal notice and resolution authorizing the precinct boundary change to be adopted at a future meeting. Attachments: 1. (PID 0311923310003, 0311923430005, 0311923410002) (City File 18-029). The Council has reviewed and provided feedback to the applicant on a PUD sketch plan. This formal application for an OS&P subdivision is currently incomplete. Upon receipt of the missing items, staff will schedule this request for Council action. 2.Rolling Hills Acres Preliminary Plat at 6730 Rolling Hills Road (City file 19-004). This application for a four-lot subdivision and has been scheduled for a public hearing at the Planning Commission on September 5th and City Council action on September 26th. 3.Comlink Midwest Site Plan, CUP, Variance and Rezoning at 23405 CR 10 (City file 19-011). The request is to allow construction of a contractor’s yard in the Rural Commercial (CR) district over 3-5 years. Phase 1 is for the 20,000 square foot Utility Construction building. This item was reviewed at a public hearing at the July 9th Planning Commission and Council approved on July 25th meeting. The approval included changes to the building architecture that will be brought back for Council approval at the August 22nd meeting. 4.Site Plan and Conditional Use Permit for Lithgow Automotive at 20055 75th Ave N (PID 26-119- 23-11-0037) (City File 19-013). The business currently operates out of Tom Lithgow’s home and has grown to the point where a commercial site is required. The business would move to the existing building and make modification to the site and the building for the auto repair. This item was reviewed at a public hearing at the July 9th Planning Commission and Council approved on July 25th meeting. 5.Ravinia 13th Easement Vacations (City File 19-016). Lennar is requesting easement vacations for outlots that are being platted for Ravinia 12th and 13th Additions. New easements are being provided with new plats. A public hearing is scheduled for the August 22nd City Council meeting. 6.Bellwether 3rd Addition Final Plat (City File 19-017). This final plat is for 29 lots north of the new Stieg Road. The PUD final plat for this area we approved as part of city file 19-002, but this plat approval was deferred until the Stieg Road alignment is completed. The application is currently incomplete. 7.Wessel Property Transportation Plan for 22020 Hackamore Road (PID 35-119-23-43-0001, 35- 119-23-44-0001, 35-119-23-11-0001 and 35-119-23-12-0002) (City File 19-018). The applicant has requested Council review of the transportation plan for this site as the 2040 Comprehensive Plan Agenda Item 11a. MEMORANDUM 2 shows a collector street through the site. This item is scheduled for Council review at the August 22nd meeting. Also, there are several projects that have been approved, but are still not filed and closed out: 1. Corcoran Business Park (City file 06-005). The City Council granted a one-year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. Staff has spoken to the applicant and will schedule a meeting when more information is available on the Loretto sewer project. 2. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (City file 12-002). Hope Ministries submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. The letter of credit for site improvements has been released, but we are holding the escrow pending completion of the approved landscaping. The applicant has indicated that they are considering a site plan amendment application to modify the approved plans. Staff met again with Pastor Brian Lother in July 2017 to discuss the outstanding issues and future expansion plans on the property. 3. Sawgrass Preliminary Plat, Preliminary PUD Development Plan and Rezoning for Schendel property at 20400 County Road 10 (City file 14-027). The City Council approved the request on December 11, 2014 and granted the applicant 2 years to apply for the final plat and final PUD development plan. Peachtree Partners did not buy the property, but a different developer could still proceed with the approved plan. On December 9, 2016, the applicant submitted a written request to extend the approvals for an additional year. Staff recommended that this request be reviewed by the City Council, but adequate time was not provided to place this on a Council agenda prior to expiration. Staff administratively approved an extension until February 28, 2017 so that this request for extension could be considered at the February 23, 2017 Council meeting. At that meeting, the City Council approved a one year extension. The City Council approved another one year extension at the January 25, 2018 meeting. The applicant was granted another extension at the February 28, 2019 Council meeting. 4. Commercial Door Addition at 7670 Commerce Street (City file 15-010) The City received an application for approval of a building addition, which required a conditional use permit, interim use permit, variance and site plan approval. The project was reviewed at a public hearing at the June 4th Planning Commission meeting and was approved b y the City Council on June 25th. The required landscaping will be finalized and constructed after the downtown infrastructure project is completed. The City will release the remaining escrow when the planting is completed. Staff is working with the landowner to complete the outstanding items. 5. 2040 Corcoran Comprehensive Plan (City file 17-001). This year-long process was kicked off with a joint City Council/Commission work session on March 16th followed by three community open houses/events and several commission meetings and Council work sessions. The Parks and Trails Commission reviewed at their March 20th meeting, the Planning Commission held a public hearing on April 5th and on April 26th the City Council approved the 2040 Comprehensive Plan for distribution to adjacent jurisdictions for comment. The adjacent jurisdictions have six months to review and comment and then Corcoran will send to the Metropolitan Council to review for compliance with regional systems. The final draft was approved at the March 14th meeting and submitted to the Metropolitan Council. Staff received an incomplete letter from the Metropolitan Council and met with staff and representatives to resolve the outstanding issues. Staff has revised the plan to address these items and will be resubmitting to the Metropolitan Council for review on August 16th. 6. Natural Resource Protection Ordinance (city file 18-010). The Council directed staff to look at options to preserve trees and natural resources to maintain the rural character of the community in both rural and urban areas. Staff presented for Council review at the May 24th meeting and the Council tabled this item. 7. Meyer Lot Line Adjustment at 10740 Bechtold Road (City File 18-039). The application is currently incomplete. Additional right-of-way is required for the lot line adjustment and this item will be MEMORANDUM 3 scheduled for Council action when deemed complete. Due lack of activity, staff sent the applicant a letter that we would be closing out this file. 8. Rezoning, Preliminary Plat and Preliminary PUD for U.S. Home Corporation (dba Lennar) for “Ravinia 11th Addition” (PID 36-119-23-44-0012) (City File 18-040). Lennar has filed a plat for 15 lots at 6351 CR 101 (the Nichols property) and is proposing to the property to Ravinia. The landowner submitted a sketch plan for Council review in 2017. A public hearing was held on February 7th and the City Council approved on February 28th. 9. Preliminary plat, final plat, and variances for “Dahlheimer Farms” on property located at 20702 County Road 50 (PID 22-119-23-41-0001) (City File 18-041). The Council approved a wetland waiver for a portion of this property in 2018. The applicants are proposing to subdivide the existing farm to create a 5-acre lot for the farmstead and the fields will be platted as an outlot. A public hearing was held on February 7th and the City Council approved on February 28th. 10. Bellwether 2nd Addition Final Plat and Final PUD Development Plan (City file 19-001). The application is for PUD final plan approval for 79 lots and final plat approval of 50 lots. The Planning Commission held a public hearing on April 4th and recommended approval. The City Council approved the request on April 25th. 11. Ravinia 12th Final Plat and PUD Amendment (City file 19-002). The application for final plat would dedicate the remaining right-of-way for Gleason Parkway. The PUD Amendment is a request for a change in unit type. The Planning Commission held a public hearing on April 4th and recommended approval. The City Council approved the request on April 25th. 12. Larkin Road Final Plat (City file 19-003). This is a request for preliminary plat for a two-lot subdivision with a private drive. The item was approved by the Council on April 25th. 13. Ravinia 11th Final Plat and Final PUD Plan (city file 19-005). The request is for 14 lots on the Nichols property. The preliminary approvals were granted on February 28th. The Planning Commission reviewed the item on May 2nd and the City Council approved the request at the May 23rd meeting. 14. Strehler Sketch Plan and Topo/Wetland Waiver at 22505 Strehler Road (city file 19-008). The applicant is requesting Council comments on a potential subdivision to create a lot without frontage on a public street. Additionally, the applicant is requesting approval of a topographic survey and wetland delineation waiver. The Council approved the request at the May 23rd meeting. 15. *Tabor Initiation of Expiration of Agricultural Preserve at 19450 Gleason Road (city file 19-009). The Tabors are initiating expiration of agricultural preserve. The Council approved the request at the June 27th meeting. 16. *Corcoran Self-Storage PUD Amendment (City file 19-010). E & R Investments, LLC submitted a request for approval of a PUD Amendment to the approved Phasing Plan for Corcoran Self Storage. The change to the phasing plan was approved by the City Council at their June 27th meeting. 17. Ravinia 13th Addition Final Plat, Final PUD and PUD Amendment (City file 19-012). Lennar is requesting approval of a PUD amendment to allow twinhomes for a portion of the site where the villa homes were planned and a PUD amendment to allow garage forward design for these twinhomes. The project also includes single family Landmark homes. This item was reviewed at the July 9th Planning Commission and following the Planning Commission meeting, the applicant revised the plans to include villa homes instead of twinhomes and Council approved at the July 25th meeting. 18. Strehler 1st Addition Preliminary Plat, Final Plat and Variance at 22505 Strehler Road (PID 20- 119-23-14-0001) (City File 19-014). The Council approved wetland and topographic survey for this applicant earlier this year. The Planning Commission reviewed the item at a public hearing on August 1st and Council is expected to act at the August 22nd meeting. 19. Kissner Topo/Wetland Waiver at 22105 County Road 50 (city file 19-015). The applicant is requesting approval of the waivers so that he can replat his farm property with the south portion of the St. Jane Chantel cemetery on County Road 50. The cemetery land south County Road 50 has no MEMORANDUM 4 graves and would be added to the Kissner land in a future plat. No development is proposed. The Council approved this item at the July 25th meeting. 20. Residential Development Standards. In 2019, City Council asked staff to update the Guidebook for Self-Tour of Residential Developments. The task was to determine how other communities are dealing with similar concerns of the City of Corcoran, mainly side yard setbacks, lot size and lot widths. The tour was updated to give the Council real world examples of a variety of residential developments with different densities and design constraints. The guidebook was presented for discussion at the May 23rd Council meeting. Council asked for more time for the tour and directed staff to schedule a discussion at the July 25th Work Session. The Council provided direction to staff at the July 25th meeting about where flexibility would not be considered and directed no ordinance changes.
