Adjournment City of Corcoran September 27, 2018 County of Hennepin State of Minnesota RESOLUTION NO. 2018-73 Page 1 of 1 Motion By: Seconded By: A RESOLUTION HONORING OUTGOING COUNCILMEMBER TONYA LAFAVE WHEREAS, Tony LaFave was elected to the City Council for a term beginning January 1, 2015; and WHEREAS, Councilmember LaFave has placed considerable time, effort, and thought into her role of City Councilmember; and WHEREAS, Councilmember LaFave has resigned from the Council effective August 30, 2018 as she has moved out of the City of Corcoran; and WHEREAS, during her tenure as Councilmember, Corcoran improved its staffing structure, completed the downtown utility and street improvement project, reviewed and approved several development proposals, updated the comprehensive plan, upgraded its bond rating, increased communication, purchased park land, received recognition as a safe city, updated its mission, vision, values and established action steps to achieve the goals of the city; and WHEREAS, Councilmember LaFave has also dedicated significant time and energy to the City of Corcoran as a member of the Northwest Area Jaycees; and WHEREAS, the City of Corcoran wishes to recognize the time, energy, dedication, and leadership provided by Tonya LaFave to the City of Corcoran. NOW, THEREFORE, BE IT RESOLVED, that the City of Corcoran hereby honors Tonya LaFave for her distinguished service to the City of Corcoran. CITY OF CORCORAN City Council Meeting Minutes September 13, 2018 - 7:00 pm The Corcoran City Council met on September 13, 2018 at City Hall in Corcoran, Minnesota. Present were Mayor Thomas, Councilor Bottema, Councilor Dejewski, and Councilor Keefe. Also present were City Administrator Martens, City Clerk/Administrative Services Coordinator Beise, Public Works Director Mattson, and Director of Public Safety Gottschalk. 1.Call to Order / Roll Call Mayor Thomas called the meeting to order at 7:00 pm. 2.Pledge of Allegiance Mayor Thomas invited all in attendance to rise and join in the Pledge of Allegiance. 3.Agenda Approval City Administrator Martens noted the addition of Items 5a. Resolution Recognizing the Efforts of the Northwest Area Jaycees for the Dynamic Sign and 12d. Waiving of Fees. Councilor Dejewski noted the addition of 12e. City Hall Remodel, a continuation of discussion from the work session. MOTION: made by Bottema, seconded by Keefe to approve the agenda as amended. Voting Aye: Thomas, Bottema, Dejewski, and Keefe (Motion carried 4:0) 4.Open Forum No persons were present to speak at Open Forum. 5.Presentations a.Resolution 2018-70 – Recognizing the Efforts of the Northwest Area Jaycees on the Dynamic Sign Mayor Thomas read aloud Resolution 2018-70. MOTION: made by Keefe, seconded by Bottema to adopt Resolution 2018-70 Recognizing the Efforts of the Northwest Area Jaycees on the Dynamic Sign. Voting Aye: Thomas, Bottema, Dejewski, and Keefe (Motion carried 4:0) Council thanked the Jaycees. 6.City Council Resignation and Delectation of a Vacancy City Administrator Martens presented the report noting that no specific process must be conducted to fill the vacancy and Council has discretion. MOTION: made by Keefe, seconded by Dejewski to accept the resignation of Councilmember Tonya LaFave effective August 30, 2018 and to declare a vacancy. Voting Aye: Thomas, Bottema, Dejewski, and Keefe (Motion carried 4:0) Council discussed the preferred process, possible appointment of a Planning Commissioner, and the perception of the appointment of an individual who is on the ballot. Council asked Mr. Schultz his opinion as a possible appointee. Council discussed appointment. MOTION: made by Keefe, to appoint Alan Schultz to the City Council effective immediately. City Administrator Martens noted that the Mayor in the case of vacancy has the ability to break a tie and that staff would recommend a recess to allow staff to create the oath of office for the appointee. Mr. Schultz noted if appointed he would not be able to serve on the Planning Commission. Council 6a. discussed concerns on the timing of the appointment during the election. Council discussed recession of the meeting. MOTION: seconded by Bottema. Council discussed timing of the appointment. Voting Aye: Thomas, Bottema, and Keefe Nay: Dejewski (Motion carried 3:1) City Administrator Martens asked that Item 12d. be considered prior to the consent agenda to allow staff time to create the oath of office. 12. New Business d. Waiving of Fees City Administrator Martens presented the report noting that the property at 22901 Oakdale Drive was in agricultural preserve status when the building rights program was implemented and there is no evidence that any building rights from this property were used in the adjacent developments. City Administrator Martens noted the property owners are requesting the City waive the fees to appeal the number of building rights. City Administrator Martens noted that the appeal would require consultant time and staff notes the waiving of fees could create a precedent. Council discussed a cap on the amount of fees waived, waiving all fees, and the responsibility of individuals to ensure the building permits where provided. MOTION: made by Bottema, seconded by Keefe to waive the $1,000.00 escrow requirement for appealing a building rights determination and only require a $100.00 application fee. Voting Aye: Thomas, Bottema, and Keefe Nay: Dejewski (Motion carried 3:1) Mayor Thomas recessed the meeting at 7:31pm Mayor Thomas reconvened the meeting at 7:39pm 6. City Council Resignation and Delectation of a Vacancy City Clerk/Administrative Services Coordinator Beise administered the oath of office to Councilmember to Alan Schultz. 7. Consent Agenda a. Summary Ordinance 2018-377 Councilor Dejewski asked that Items 6b. and 6c. be considered separately. Council discussed summary ordinances. City Administrator Martens noted the ordinances had been voted on and the summary ordinance allow for reduced publication costs. MOTION: made by Bottema, seconded by Dejewski to approve the consent agenda consisting of Items 7a., 7d., 7e., 7f., and 7g. Voting Aye: Thomas, Bottema, Dejewski, Keefe, and Schultz (Motion carried 5:0) Councilor Dejewski asked that the items be pulled so staff could review with Council certain areas highlighted in the City’s response. City Administrator Martens showed a map of the proposed location of the bicycle facilities discussed in comment a. (4). City Administrator Martens noted that in comment a. (5) additional roadways are shown as being needed however no funds are allocated to these projects. Council discussed the draft plan and City’s response. Council discussed transferring of County Roads to the City. City Administrator Martens noted that the City would have to consent to any transfer of a road. MOTION: made by Dejewski, seconded by Bottema to authorize the Mayor and City Administrator to sign and send the attached letter to Hennepin County. Voting Aye: Thomas, Bottema, Dejewski, Keefe, and Schultz (Motion carried 5:0) Councilor Dejewski asked that the items be pulled so staff could review with Council certain areas highlighted in the City’s response. City Administrator Martens showed a map of the proposed 610 extension, noting coordination among City staff would be required. Public Works Director Mattson noted that additional storm water coordination would be required. Council discussed the budgetary impacts of the projects. Public Works Director noted staff will be planning through development for long-term wetland projects. MOTION: made by Dejewski, seconded by Keefe to authorize the Mayor and City Administrator to sign and send the attached letter to the City of Maple Grove. Voting Aye: Thomas, Bottema, Dejewski, Keefe, and Schultz (Motion carried 5:0) 8. Claims as Presented a. Escrow Claims (Fund #500) Council inquired about being charged for Hennepin County Jail services. Public Safety Director Gottschalk noted that the City receives a bill for each time an individual is booked and for their daily housing if arrested on a local charge. MOTION: made by Bottema, seconded by Keefe to approve escrow claims as revised. Voting Aye: Thomas, Bottema, Dejewski, Keefe and Schultz (Motion carried 5:0) b. Staff Reports / Memos/Commissions a. Commissioner Representatives Mayor Thomas noted Parks and Trails Commissioner Val Robran was in attendance and invited her to speak on items related to their Commission. b. Night to Unite Recap Police Officer Ekenberg presented the report noting the increase in neighborhood parties and attendance at the City Party. Council thanked staff. Council discussed the prizes and ensuring that prizes are distributed at the City Party and the neighborhood parties equally. Council inquired about the locations of the seven neighborhood parties. Staff provided general locations of the parties and noted the feedback received by those who didn’t participate this year. 10. Planning Business No planning business was presented. 11. Unfinished Business No unfinished business was presented. 12. New Business a. 2019 Preliminary Levy City Administrator Martens presented the report outlining that the percentages of expenditures by category has not changed significantly from 2018. Council discussed sewer and water rates and connections. City Administrator Martens noted the water and sewer rates for trunk sewer and water are being reviewed. Council discussed including monies for the Local Government Unit. Council inquired about the detective position. Director of Public Safety Gottschalk noted that position had been posted and applications are being accepted. Council discussed staffing and maintaining the tax rate. Council inquired about the recreation programing revenue. City Administrator Martens noted that an analysis showed the revenue from recreation programing brought the recreation coordinator position to near budget neutral. Council inquired about snow removal costs. Public Works Director Mattson noted materials costs are increasing. Council inquired about methods for reducing salt usage. City Administrator Martens noted that staff are looking at ways to reduce salt and maintain safety. Council inquired about seal coating. Public Works Director Mattson noted the City has begun utilizing a fog sealing technique. MOTION: made by Keefe, seconded by Dejewski to approve Resolution 2018-69 Adopting Preliminary Proposed Tax Levy Collectable in 2019. Voting Aye: Thomas, Bottema, Dejewski, Keefe, and Schultz (Motion carried 5:0) b. 2019 Proposed Levies and Tax Insert City Administrator Martens presented the report noting that the City has been providing the tax inserts for the last three years. Council discussed the building inspections costs and noting it’s paid by a user fee. Council discussed adding tax capacity to the tax insert. MOTION: made by Bottema, seconded by Dejewski to authorize staff to submit the insert to Hennepin County and incur the costs associated with the project with the modifications as discussed. Council discussed how to convey the tax rate has been decreased. Voting Aye: Thomas, Bottema, Dejewski, Keefe, and Schultz (Motion carried 5:0) c. Planning Commission Appointment City Administrator Martens presented the report noting the Mayor and himself met with the applicant this week and seemed like a good fit. Mayor Thomas noted that the applicant wanted to be involved for the betterment of the community. Council discussed the process of appointment including interviews and recruitment. MOTION: made by Keefe, seconded by Bottema to appoint Jeff Dickman to the Planning Commission to fulfill a term ending on February 28, 2021. Voting Aye: Thomas, Bottema, Dejewski, Keefe, and Schultz (Motion carried 5:0) Mayor Thomas Recessed the meeting at 8:41pm Mayor Thomas Reconvened the meeting at 8:43pm e. City Hall Remodel City Administrator Martens presented the report noting the discussion was a continuation of the work session. Council inquired about the proposed financing through park dedication. City Administrator Martens noted that an inter-fund loan could be set up and interest to the fund would be paid. City Administrator Martens detailed that staff may consider the sewer fund rather than park dedication noting that the specifics would be fleshed out in a finance plan. City Administrator Martens noted currently the draft finance plan does not include bonding. Council discussed borrowing from an internal source rather than bonding. Council discussed the use of the long-term planning. Council inquired about sprinkling the building. Director of Public Safety Gottschalk noted sprinkling is a cost consideration especially with a building that is not connected to City water and sewer. Director of Public Safety Gottschalk noted through the remodel less gathering space would limit the need for a sprinkling, however if the building was added onto there could be requirements for sprinkling. Council inquired about limiting storage space and moving to electronic records. City Clerk/Administrative Services Coordinator Beise noted that the City is working on scanning documents for electronic storage however with elections and other records are required to be maintained in physical copies. Per consensus, authorize staff to formalize and refine the finance plan, obtain a quote to proceed with plans and specifications, and refine plans. 13. 2017 Council Schedule City Administrator Martens reviewed the Council schedule. Councilor Schultz noted he could attend the September 18th Parks and Trails Commission meeting. 14. Council Meeting: September 27, 2018 Prepared By: Director Matt Gottschalk Topic: Hennepin County Hazard Mitigation Plan Adoption Action Required: Resolution Adoption Summary: Corcoran City staff assisted Hennepin County Emergency Management in drafting their hazard mitigation plan. The City’s input was specifically related to the hazard mitigation strategies in the City of Corcoran. The hazard mitigation strategies are high level goals and recommendations that are categorized and prioritized in order to mitigate future emergencies and/or disasters. There are certain portions of the plan that contain sensitive infrastructure vulnerability data that should not be shared publicly. The document is too large to put in all of the packets (over 750 pages). With the adoption of this plan the City becomes eligible for hazard mitigation funding as it becomes available. There is a timely nature to this approval as there has been a recent disaster declaration that may provide access for our area to the Hazard Mitigation Program funding. Financial/Budget: There is no financial obligation associated with this adoption; however, adoption will make the City eligible for grant funding to work towards hazard mitigation in our community. Attachments: Resolution 2018-74 City of Corcoran September 27, 2018 County of Hennepin State of Minnesota RESOLUTION NO. 2018-74 Page 1 of 2 Motion By: Seconded By: A RESOLUTION ADOPTING THE HENNEPIN COUNTY ALL-HAZARD MITIGATION PLAN WHEREAS, the City of Corcoran has participated in the hazard mitigation planning process as established under the Disaster Mitigation Act of 2000, and WHEREAS, the Act establishes a framework for the development of a multi-jurisdictional County Hazard Mitigation Plan; and WHEREAS, the Act as part of the planning process requires public involvement and local coordination among neighboring local units of government and businesses; and WHEREAS, the Hennepin County Plan includes a risk assessment including past hazards, hazards that threaten the County, an estimate of structures at risk, a general description of land uses and development trends; and WHEREAS, the Hennepin County Plan includes a mitigation strategy including goals and objectives and an action plan identifying specific mitigation projects and costs; and WHEREAS, the Hennepin County Plan includes a maintenance or implementation process including plan updates, integration of the plan into other planning documents and how Hennepin County will maintain public participation and coordination; and WHEREAS, the Plan has been shared with the Minnesota Division of Homeland Security and Emergency Management and the Federal Emergency Management Agency for review and comment; and WHEREAS, the Hennepin County All-Hazard Mitigation Plan will make the county and participating jurisdictions eligible to receive FEMA hazard mitigation assistance grants; and WHEREAS, this is a multi-jurisdictional Plan and cities that participated in the planning process may choose to also adopt the County Plan. NOW THEREFORE BE IT RESOLVED, that the City of Corcoran supports the hazard mitigation planning effort and wishes to adopt the Hennepin County All-Hazard Mitigation Plan. This year-long process was kicked off with a joint City Council/Commission work session on March 16th followed by three community open houses/events and several commission meetings and Council work sessions. The Parks and Trails Commission reviewed at their March 20th meeting, the Planning Commission held a public hearing on April 5th and on April 26th the City Council approved the 2040 Comprehensive Plan for distribution to adjacent jurisdictions for comment. The adjacent jurisdictions have six months to review and comment and then Corcoran will send to the Metropolitan Council to review for compliance with regional systems. 2.Animal Ordinance (city file 17-038). The City has received questions about allowing animals in commercial areas, specifically bees and chickens. The Council considered this item at their January 25th meeting and established a subcommittee to review the issues and bring back a recommendation to the City Council. Staff has the subcommittee recommendation on bees and is awaiting feedback on chickens. Upon receipt, we will present the subcommittee recommendation to the City Council for direction. 3.Right-of-Way, Small Cell and DAS Ordinance Amendment (City file 17-039). Minnesota’s telecommunications right-of-way user state law (SF1456), regarding small wireless facilities, was signed into law on May 30, 2017. It grants wireless service providers access to the public right-of-wa y to construct, maintain and operate small wireless facilities and wireless support structures. Various sections of the city and zoning code need to be amended to be consistent with state law. At their January 25th meeting, Council directed staff to prepare a draft ordinance and schedule for a Public Hearing at the Planning Commission and Council action. Staff presented a draft at the June 28th Council meeting. A public hearing was held at the August 2nd Planning Commission and the Council approved at the August 23rd City Council meeting. The summary ordinance is expected to be approved at the September 13th Council meeting. 4.Southeast District Master Plan and Design Guidelines update (city file 18-012). The draft 2040 Comprehensive Plan anticipates significant changes to the transportation network that make it necessary to update this plan, which is adopted as Appendix B of the Zoning Ordinance. At the April 26th meeting, the Council authorized staff to begin this work . Staff met with Hennepin County and is now drafting road alignments for incorporation into updated plan options. This item is scheduled for review at the November 8th Council Work Session. 5.Nuisance Ordinance ordinance/process update (city file 18-013). The Council has directed staff to be more proactive in the Code Enforcement efforts. Review of the ordinance and policies suggests Agenda Item 8b. MEMORANDUM 2 that updates are needed in several areas. Staff presented the City Council with a work plan and schedule at the May 24th meeting. Staff and the City attorney brought questions to the July 26th Council meeting for direction. A public hearing will be scheduled for October 4th and City Council action is expected on October 25th. 6. Development Rights and OS&P ordinance updates (city file 18-014). One of the implementation strategies from the Draft 2040 Comprehensive Plan was to consider amendments to the OS&P ordinance to better reflect City goals. The Council is also considering changes to the development rights program. Staff presented the City Council with a work plan and schedule at the May 24th meeting. The Council will discuss further at the October 11th Work Session. 7. Shoulak Ordinance Amendment (city file 18-020)/Lindblad Ordinance Amendment (city file 18- 024). James Shoulak and Marie Lindblad applied separately for ordinance amendments to allow a type of event center in residential areas. While the individual requests are slightly different, the concept of event centers is similar and staff has notified both applicants that we will process the requests concurrently. A public hearing was held at the August 2nd Planning Commission and the Council approved at the August 23rd City Council meeting. The summary ordinance is expected to be approved at the September 13th Council meeting. 8. Ordinance Amendment for Financial Guarantees (city file 18-025). At the May 24th meeting, the City Council directed staff to revert to the previous policy regarding financial guarantees and to amend the ordinance to reduce the required amount from 125% to 100% of the cost of improvements. A public hearing was held at the August 2nd Planning Commission. The Council reviewed this at the August 23rd City Council meeting requested additional revisions to clarify our policy and it is expected to be adopted on September 13th. 9. Final Plat for “Rush Creek Run” at 7320 Rolling Hills Road (PID 28-119-23-22-0003) (city file 18- 026). A request for final plat approval has been submitted but is currently incomplete. The preliminary plat for this project was approved on April 26th. Upon receipt of the missing items, staff will schedule this request for Council action. 10. Final Plat and Final PUD Development Plan for “Encore” at 9975 County Road 101 (PID 1211923120001) (city file 18-027). The preliminary plans were approved by the City Council in June. A request for final plat approval has been submitted and staff is reviewing for completeness. This application is for Phase 1, which will plat the Newman property and create 79 lots (78 home lots plus the activity center). This item is scheduled for Planning Commission review on October 4th and City Council action on October 24th. 11. Final Plat and Final PUD Development Plan for “Final Plat and Final PUD for the Refuge at Rush Creek (PID 03-119-23-13-0002) (City File 18-028). This project was formerly known as “Fehn Meadows 2nd Addition” and was approved by the City Council in June. The item has been scheduled for Planning Commission review on September 6th and City Council action on September 27th. 12. Preliminary Plat, Preliminary PUD and Rezoning for “Pheasant Ridge Second Addition”. (PID 0311923310003, 0311923430005, 0311923410002) (City File 18-029). The Council has reviewed and provided feedback to the applicant on a PUD sketch plan. This formal application for an OS&P subdivision is currently incomplete. Upon receipt of the missing items, staff will schedule this request for Council action. 13. Lot Line Adjustment and Variance for Allen James Pouliot located at 6626 Pioneer Trail (PID 31- 119-23-11-0004) (city file no. 18-030). The applicant is proposing to adjust a lot line between two properties and a variance is required to accommodate the request. The application is currently incomplete. Upon receipt of the missing items, staff will schedule this request for Council action. 14. Lot Combination and Easement Vacation for Tony Maghrak located at 21580 Sicora Lane (PID 09-119-23-11-0003) (city file no. 18-031). The applicant is proposing consolidate two properties and an easement vacation is required along the eliminated lot line. The application is currently incomplete. Upon receipt of the missing items, staff will schedule this request for Council action. MEMORANDUM 3 Also, there are several projects that have been approved, but are still not filed and closed out: 1. Corcoran Business Park (City file 06-005). The City Council granted a one-year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. Staff has spoken to the applicant and will schedule a meeting when more information is available on the Loretto sewer project. 2. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (City file 12-002). Hope Ministries submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. The letter of credit for site improvements has been released, but we are holding the escrow pending completion of the approved landscaping. The applicant has indicated that they are considering a site plan amendment application to modify the approved plans. Staff met again with Pastor Brian Lother in July 2017 to discuss the outstanding issues and future expansion plans on the property. 3. Sawgrass Preliminary Plat, Preliminary PUD Development Plan and Rezoning for Schendel property at 20400 County Road 10 (City file 14-027). The City Council approved the request on December 11, 2014 and granted the applicant 2 years to apply for the final plat and final PUD development plan. Peachtree Partners did not buy the property, but a different developer could still proceed with the approved plan. On December 9, 2016, the applicant submitted a written request to extend the approvals for an additional year. Staff recommended that this request be reviewed by the City Council, but adequate time was not provided to place this on a Council agenda prior to expiration. Staff administratively approved an extension until February 28, 2017 so that this request for extension could be considered at the February 23, 2017 Council meeting. At that meeting, the City Council approved a one year extension. The City Council approved another one year extension at the January 25, 2018 meeting. 4. Commercial Door Addition at 7670 Commerce Street (City file 15-010) The City received an application for approval of a building addition, which required a conditional use permit, interim use permit, variance and site plan approval. The project was reviewed at a public hearing at the June 4th Planning Commission meeting and was approved by the City Council on June 25th. The required landscaping will be finalized and constructed after the downtown infrastructure project is completed. The City will release the remaining escrow when the planting is completed. 5. Private Drive Ordinance Amendment (City file 16-003). The City Council approved an ordinance amendment allowing private drives in the Rural Residential district, subject to certain conditions. However, after adoption the City Council directed staff to revisit this issue and consider an ordinance amendment to eliminate the requirement that private drives off paved roads must be paved. The City Council approved the amendment on May 26th. The Council also identified additional issues that should be reviewed and discussed at a future date. 6. Natural Resource Protection Ordinance (city file 18-010). The Council directed staff to look at options to preserve trees and natural resources to maintain the rural character of the community in both rural and urban areas. Staff presented for Council review at the May 24th meeting and the Council tabled this item. 7. Sketch Plan for “Edgewater of Corcoran” at 19220 County Road 10 (PID 25-119-23-14-0003 and 25-119-23-14-0002) (City file 18-018). Trek Development, Inc. has submitted a sketch plan for a residential development with a senior living continuum of care complex, apartment and single family homes. The Council reviewed the sketch plan at the May 24th meeting and indicated support. 8. *Willow LLC Minor Subdivision at 20801 Larkin Road (city file 18-021) (Incomplete). The applicant is requesting approval of a minor subdivision to split the parcel into two lots. (PID 03-119-23-13-0002) (City File 18-028) 60-Day Review Ends:October 7, 2018 1.Application Request Chris Rains has submitted a request for approval of Final PUD Development Plan and Final Plat for “Refuge at Rush Creek” to allow 14 homes in a new residential development. 2.Planning Commission Review Planning Commission reviewed this item at their regularly scheduled September 6, 2018 meeting. Commissioners voted 3-0, 2 absent, to recommend approval with no changes. 3.Context Level of City Discretion in Decision-Making The City’s discretion in approving a final PUD development plan is limited to whether or not the proposed plan is in substantial conformance with the approved preliminary PUD development plan. If it meets these standards, the City must approve the final PUD development plan. The City’s discretion in approving a final plat is limited to whether or not the proposed plat meets the standards outlined in the City’s subdivision and zoning ordinance and the conditions of preliminary plat approval. If it meets these standards, the City must approve the final plat. Background The City Council approved a Rezoning to PUD (Planned Unit Development), Preliminary PUD Development Plan and Preliminary Plat on June 28, 2018. The approvals were subject to a number of conditions. The developer has been working to address those conditions. Agenda Item: 9a. Refuge at Rush Creek Final PUD Plan and Final Plat (18-028) 2 September 27, 2018 4. Analysis of Request Staff has reviewed the application for consistency with the approved preliminary plans, as well as City policies. The City Engineer’s comments are incorporated into this staff report and the detailed comments are included in the attached engineering memo. Final PUD Development Plan The PUD offers enhanced flexibility to develop the site through the relaxation of most typical zoning district standards. In exchange for this flexibility, the City expects a higher level of design and a more sensitive development than might normally be the case. The final PUD development plan must be reviewed for compliance with the preliminary PUD approvals. Staff finds that the final PUD development plan is generally consistent with the approved preliminary plans. Architecture The preliminary PUD approvals required the applicant to prepare HOA documents for review and approval by the City Attorney. The applicant has submitted these materials, which are currently being reviewed by the City Attorney. The final documents will be filed at Hennepin County with the plat. As part of a final PUD the applicant is required to address architectural standards. The applicant has provided building standards within the HOA document specifying that the front facades shall not include vinyl but instead use stone, LP, Hardie or an equivalent material. There are also limitations on garages, storage structures and roof pitch. Streets The plans show the development is served by a single street. A temporary cul-de-sac easement has been provided for the cul-de-sac at the end of the public street. This cul-de-sac will be removed when the lot to the east develops. Off-Site Public Improvements Hennepin County is requiring off-site improvements in the form of a dedicated right and left turn lane to County Road 117 that will be funded by the developer and constructed by the City. The developer is meeting with the County to finalize the design of these improvements. Lighting The applicant has not submitted a lighting plan that shows light poles for installation on the public streets. A proposal for light fixtures shall be submitted for review by staff. Parks, Trails and Open Space The developer is required to provide mowed trails within the open space and preservation areas. The plans show a mowed grass trail being provided in the open space area. The HOA will be Refuge at Rush Creek Final PUD Plan and Final Plat (18-028) 3 September 27, 2018 responsible for maintenance of the open space and preservation areas (outlots) as well as landscaping, wetland buffers, etc. The HOA will also plow the public sidewalks. The applicant is providing sidewalks along one side of the internal roadways, which is consistent with City policy and Council approval. Under the current ordinance, park dedication of land is required at 4% of the net pre-development area. If the City determines that land is not needed in the area of a proposed subdivision, a cash fee in lieu of land dedication may be required. For residential developments, the cash in lieu of land fee has been calculated based on the per capita share of park system costs at $3,970 per single family unit. The park dedication fee is subject to the fee schedule in place at the time the final plat is released for filing. The current fee schedule would require $55,580.00 (14 lots x $3,970). Final Plat The applicant is requesting approval of a final plat to create 14 lots and 2 Outlots. The final plat is consistent with the approved preliminary plat. Conclusion Staff has reviewed the plan for consistency with the applicable standards outlined in the preliminary approvals, Zoning Ordinance and Subdivision Ordinance. The staff report noted the outstanding issues that must be addressed and we have included conditions in the attached resolutions to address these issues. 5. WHEREAS, the Planning Commission has reviewed the plan at a public meeting and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for a final PUD development plan, subject to the following findings and conditions: 1. A final PUD development plan is approved to allow the creation of 14 lots for single family homes, in accordance with the application materials and plans received by the City on July 17, 2018 and revisions received August 3, 2018 and August 22, 2018, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the final plat. 3. The rezoning approved by Ordinance No. 2018-368 on June 28, 2018 shall take effect upon adoption of this resolution adopting the final PUD development plan. FURTHER, that the following conditions be met prior to release of the final plat for recording with the County: 1. The development contract must be executed by the developer and the City and must be filed with the final plat. 2. The developer shall comply with all conditions of final plat approval (Resolution 2018-72). 3. The applicant shall comply with all conditions in the City Engineer’s memo dated August 28, 2018. 4. REQUEST FOR PLAT APPROVAL. The Developer has asked the City to approve a plat for Refuge at Rush Creek (referred to in this Contract as the "plat"). The land is situated in the County of Hennepin, State of Minnesota, and is legally described in Exhibit A. 2. CONDITIONS OF PLAT APPROVAL. The Developer shall enter into this Contract, furnish the security required by it, and record the plat upon City approval with the County Recorder or Registrar of Titles. 3. RIGHT TO PROCEED. Unless separate written approval has been given by the City, within the plat or land to be platted, the Developer may not grade or otherwise disturb the earth, remove trees, construct sewer lines, water lines, streets, utilities, public or private improvements, or any buildings until all the following conditions have been satisfied: 1) this agreement has been fully executed by both parties and filed with the City Clerk, 2) the necessary security has been received by the City, 3) the plat, development contract and other associated documents have been recorded with the Hennepin County Recorder's Office and proof of recording has been provided to the City, and 4) the City has issued written notice that all conditions have been satisfied and that the Developer may proceed. However, the Developer may be allowed to begin grading the site when items 1, 2 and 4 of the previous sentence have been satisfied. 4. PHASED DEVELOPMENT. If the plat is a phase of a multi-phased preliminary plat, the City may refuse to approve final plats of subsequent phases if the Developer has failed to fulfill all obligations in this Contract and the failure has not been remedied. Development of subsequent phases may not proceed until Development Contracts for such phases are approved by the City. Park charges and area charges for sewer and water referred to in this Contract are not being imposed on outlots, if any, in the plat that are designated in an approved preliminary plat for future subdivision into lots and blocks. Such charges will be calculated and imposed when the outlots are final platted into lots and blocks. 5. PRELIMINARY PLAT STATUS. If the plat is a phase of a multi-phased preliminary plat, the preliminary plat approval for all phases not final platted shall lapse and be void unless final platted into lots and blocks, not outlots, within two (2) years after preliminary plat approval. 6. CHANGES IN OFFICIAL CONTROLS. For two (2) years from the date of this Contract, no amendments to the City's Comprehensive Plan or official controls shall apply to or affect the use, - 2 – development density, lot size, lot layout or dedications of the approved final plat unless required by state or federal law or agreed to in writing by the City and the Developer. Thereafter, notwithstanding anything in this Contract to the contrary, to the full extent permitted by state law, the City may require compliance with any amendments to the City's Comprehensive Plan, official controls, platting or dedication requirements enacted after the date of this Contract. 7. DEVELOPMENT PLANS. The plat shall be developed in accordance with the following plans. The plans shall not be attached to this Contract. If the plans vary from the written terms of this Contract, the written terms shall control. The plans are: Exhibit A – Legal Description Plan A – Final Plat, dated 07/17/18_____ Plan B – Final Grading, Drainage, and Erosion Control Plan, dated 07/17/18 Plan C – Plans and Specifications for Public Improvements, dated 07/17/18 Plan F – Final Landscape Plan, dated 07/17/18 Plan G – Revised Preliminary Plat, dated 07/13/18 8. IMPROVEMENTS. The Developer shall install and pay for all of the following improvements: • Streets • Surface Water Facilities (pipe, ponds, rain gardens, etc.) • Grading and Erosion Control • Sidewalks/Trails • Street Lighting • Underground Utilities • Street Signs and Traffic Control Signs • Landscaping Required by Section 1060 of the Zoning Ordinance • Tree Preservation • Wetland Mitigation and Buffers • Monuments Required by Minnesota Statutes • Miscellaneous Facilities The Developer shall submit plans and specifications which have been prepared by a competent registered professional engineer to the City for approval by the city engineer or designee. The Developer shall instruct its engineer to provide full-time field inspection personnel in order for the Developer's engineer to be able to certify that the construction work meets the approved City standards as a condition of City acceptance. In addition, the City may, at the City's discretion and at the Developer's expense, have one or more City inspectors and a soil engineer inspect the work on a full or part-time basis. The Developer, its contractors and subcontractors, shall follow all instructions received from the City's inspectors. The Developer and/or the Developer’s engineer shall provide for on-site project management. The Developer's engineer is responsible for design changes and contract administration between the Developer and the Developer's contractor. The Developer or his or her engineer shall schedule a pre-construction meeting at a mutually agreeable time at City Hall with all parties concerned, including the City staff, to review the program for the construction work. All labor and work shall be done and performed in the best and most workmanlike manner and in strict conformance with the approved plans and specifications. No deviations from the approved plans and specifications will be permitted unless approved in writing by the city engineer or designee. - 3 – The Developer agrees to furnish to the City a list of contractors being considered for retention by the Developer for the performance of the work required by the contract. The Developer shall not do any work or furnish any materials not covered by the plans and specifications and special conditions of this contract, for which reimbursement is expected from the City, unless such work is first approved in writing by the city engineer or designee. The Developer shall be responsible for construction of all improvements in conformance with the approved plans and specs. 9. OFF-SITE PUBLIC IMPROVMENTS. The City intends to make improvements to County Road 117 at the intersection of the new Old Mill Lane. The public improvements will be designed in partnership with the City and Hennepin County. The developer also agrees to fund off-site improvements as noted in this agreement. The City shall design, bid and manage the project and the developer shall pay for the following improvement, which shall be paid at the time the final plat is released for recording unless otherwise noted: A. The developer shall provide a financial guarantee to the City for the cost of the County Road 117 intersection improvements (estimated at $300,000). The development contract will include $250,000 in the letter of credit and a cash escrow of $50,000. B. When the City bids the project, the City will reduce the letter of credit by $250,000 and require the developer to provide cash escrow for their share of the intersection based on the final bid amount. The developer agrees to pay the City the cost of these improvements as outlined above. The City will notify the developer of required reimbursement under this paragraph for design and construction of such improvements. The costs to be reimbursed include the actual cost to the City for construction of the improvements plus the allocation of the engineering, legal, administrative and other similar costs of the project based on the relative construction costs of the improvements. The developer reserves the right to be refunded for any unused portion of the estimated cost vs the actual cost of each improvement. 10. CONTRACTORS/SUBCONTRACTORS. City Council members, City employees, and City Planning Commission members, and corporations, partnerships, and other entities in which such individuals have greater than a 25% ownership interest or in which they are an officer or director may not act as contractors or subcontractors for the public improvements identified in Paragraph 8 above. 11. PERMITS. The Developer shall obtain or require its contractors and subcontractors to obtain all necessary permits, including but not limited to: • Hennepin County for County Road Access and Work in County Rights-of-Way • Minnesota Department of Health for Wells • NPDES Permits • Hennepin County for Septic System Permits and/or Abandonment • DNR for Dewatering and Work in Protected Waters • City of Corcoran for Building Permits and Building Demolition • Watershed Permits - 4 – 12. TIME OF PERFORMANCE. The Developer shall install all required public improvements by October 31, 2019, unless otherwise approved by the City, with the exception of the final wear course of asphalt on streets. The City will not accept new public streets until 80% of the homes have received a certificate of occupancy and the streets have weathered a full winter season. Final wear course placement outside of this time frame must have the written approval of the City Engineer. The Developer may, however, request an extension of time from the City. If an extension is granted, it shall be conditioned upon updating the security posted by the Developer to reflect cost increases and the extended completion date. 13. LICENSE. The Developer hereby grants the City, its agents, employees, officers and contractors a license to enter the plat to perform all work and inspections deemed appropriate by the City in conjunction with plat development. 14. CONSTRUCTION ACCESS. Construction traffic access and egress for grading, public utility construction, and street construction is restricted to access the subdivision via Old Mill Lane. No construction traffic is permitted on other adjacent local streets. 15. GRADING PLAN. The plat shall be graded in accordance with the approved grading drainage and erosion control plan, Plan "B". The plan shall conform to City of Corcoran Engineering Design Standards. 16. EROSION CONTROL. Prior to initiating site grading, the erosion control plan, Plan B, shall be implemented b y the Developer and inspected and approved by the City. Erosion control practices must comply with the Minnesota Pollution Control Agency’s Best Management Practices. The City may impose additional erosion control requirements if they would be beneficial. All erosion control shall comply with Section 950 (Erosion Control) of the Corcoran City Code and the Corcoran Engineering Design Standards. No development, utility or street construction will be allowed and no building permits will be issued unless the plat is in full compliance with the approved erosion control plan. 17. STREET MAINTENANCE DURING CONSTRUCTION. The Developer shall be responsible for all street maintenance until the streets are accepted by the City. Warning signs shall be placed when hazards develop in streets to prevent the public from traveling on the same and to direct attention to detours. If and when streets become impassable, such streets shall be barricaded and closed. In the event residences are occupied prior to completing streets, the Developer shall maintain a smooth surface and provide proper surface drainage to ensure that the streets are passable to traffic and emergency vehicles. The Developer shall be responsible for keeping streets within and without the subdivision swept clean of dirt and debris that may spill, track, or wash onto the street from Developer’s operation. 18. OWNERSHIP OF IMPROVEMENTS. Upon completion of the work and construction required by this Contract and acceptance of the work by the City, the improvements lying within public easements or right-of-way shall become City property. Prior to acceptance of the improvements by the City, the Developer must furnish the following affidavits: • Contractor’s Certificate • Engineer’s Certificate • Land Surveyor’s Certificate - 5 – 19. PARK DEDICATION. Prior to release of the final plat, the Developer shall satisfy the amount of the park dedication requirements by a cash contribution of $55,580 (14 lots x $3,970). The charge was calculated in accordance with Section 955 of the City’s Subdivision Ordinance. 20. BUILDING PERMITS/CERTIFICATES OF OCCUPANCY. A. Curbing, and one lift of asphalt shall be installed on all public and private streets prior to issuance of any certificate of occupancy, except one model home on a lot acceptable to the City Planner may be issued a certificate of occupancy if needed for the Parade of Homes. B. The Developer shall comply with the City of Corcoran Engineering Design Standards. C. Prior to issuance of building permits, wetland buffer monuments shall be placed in accordance with the City’s zoning ordinance. Specifications for the monuments are available from the City Planner. D. Failure to fulfill any of the terms of this Contract by the Developer, including nonpayment of billings from the City, shall be grounds for denial of building permits, including lots sold to third parties, and the halting of all work in the plat. E. If building permits are issued prior to the acceptance of public improvements, the Developer assumes all liability and costs resulting in delays in completion of public improvements and damage to public improvements caused by the City, Developer, their contractors, subcontractors, materialmen, employees, agents, or third parties. 21. STREET REGULATORY SIGNS/TRAFFIC CONTROL SIGNS. Street name signs shall be installed by the Developer in accordance with the City of Corcoran Engineering Design Standards. The Developer shall install traffic control signs in accordance with the plan approved by the City Engineer and Minnesota Manual on Uniform Traffic Control Devices. All signs must be installed prior to final building inspection approval or earlier if necessary as determined by the City Engineer. 22. STREET LIGHT INSTALLATION AND OPERATION COSTS. The developer shall pay for and install all street lights. The street light shall be of a design approved by the City. The developer shall be responsible for street light operation and maintenance costs until such time as the City accepts the public street where the streetlights are located. After the acceptance the City shall be responsible for all costs, subject to the street lighting policy. The costs of operation are dependent upon the operation costs for Wright Hennepin Electric under contract franchise with the City of Corcoran. 23. RESPONSIBILITY FOR COSTS. C. Except as otherwise specified herein, the Developer shall pay all costs incurred by it or the City in conjunction with the development of the plat, including but not limited to legal, planning, engineering and inspection expenses incurred in connection with approval and acceptance of the plat, the preparation of this Contract, review of construction plans and documents, and all costs and expenses incurred by the City in monitoring and inspecting - 6 – development of the plat. The City may require Developer to post funds in an escrow account, at its discretion. In the event the cash escrow amount is insufficient, Developer shall post additional escrow funds as determined by the City Planner within ten (10) days of written demand. Failure to make payment of the additional escrow amount shall permit the City to supplement those amounts from any other sureties posted by Developer. D. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. E. The Developer shall reimburse the City for costs incurred in the enforcement of this Contract, including engineering and attorneys' fees. F. The Developer shall pay, or cause to be paid when due, and in any event before any penalty is attached, all special assessments referred to in this contract. This is a personal obligation of the Developer and shall continue in full force and effect even if the Developer sells one or more lots, the entire plat, or any part of it. G. The Developer shall pay in full all bills submitted to it by the City for obligations incurred under this Contract within thirty (30) days after receipt. Bills not paid within thirty (30) days shall accrue interest at the rate of eight percent (8%) per year. H. In addition to the charges and special assessments referred to herein, other charges and special assessments may be imposed such as but not limited to sewer availability charges ("SAC"), City water connection charges, City sewer connection charges, and building permit fees. 24. SPECIAL PROVISIONS. The following special provisions shall apply to plat development: A. Compliance with the conditions of Preliminary Plat approval (Resolution 2018-51), Preliminary PUD approval (Resolution 2018-52), Final Plat approval (Resolution 2018-__) and Final PUD approval (2018- ). B. The Developer shall install a temporary turnaround on the east end of 106th Avenue until it is extended to the east when the property to the east develops. Before the City signs the final plat, the Developer shall furnish the City an appropriately executed temporary turnaround easement, in recordable form. C. The Developer shall post a $1,400.00 security for the final placement of interior subdivision iron monuments at property corners. The security was calculated as follows: 14 lots at $100.00 per lot. The security will be held by the City until the Developer's land surveyor certifies that all irons have been set following site grading and utility and street construction. In addition, the certificate of survey must also include a certification that all irons for a specific lot have either been found or set prior to the issuance of a building permit for that lot. D. The Developer must obtain a sign permit from the City Building Official prior to installation of any subdivision identification signs. - 7 – E. The Developer shall supply a complete set of the approved construction plans in an AutoCAD.DWG electronic file format before the preconstruction conference. F. The Developer shall include the “City of Corcoran’s Standard Detail Specifications” (all applicable sections) in the contract documents of their improvement project. G. Other requirements: 1. The Developer may not assign this Contract without the written permission of the City Council. The Developer's obligation hereunder shall continue in full force and effect even if the Developer sells one or more lots, the entire plat, or any part of it. Notwithstanding anything herein to the contrary, in conjunction with a sale of the entire land, the Developer may, without the consent of the City, assign this Contract to a limited liability company or other entity in which the Developer or an affiliate thereof has a controlling membership or other controlling ownership interest, provided that such assignee assumes in writing the obligations of Developer under this Contract. B. Appropriate legal documents including, but not limited to, those regarding Homeowner Association documents, conservation easements, covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. C. Developer shall take out and maintain or cause to be taken out and maintained until six (6) months after the City has accepted the public improvements, public liability and property damage insurance covering personal injury, including death, and claims for property damage which may arise out of Developer's work or the work of its subcontractors or by one directly or indirectly employed by any of them. Limits for bodily injury and death shall be not less than $500,000 for one person and $1,000,000 for each occurrence; limits for property damage shall be not less than $200,000 for each occurrence; or a combination single limit policy of $1,000,000 or more. The City shall be named as an additional insured on the policy, and the Developer shall file with the City a certificate evidencing coverage prior to the City signing the plat. The certificate shall provide that the City must be given thirty (30) days advance written notice of the cancellation of the insurance. The insurance shall be primary and non- contributory as to any policy maintained by the City. D. Third parties shall have no recourse against the City under this Contract. E. If any portion, section, subsection, sentence, clause, paragraph, or phrase of this Contract is for any reason held invalid, such decision shall not affect the validity of the remaining portion of this Contract. - 9 – F. The action or inaction of the City shall not constitute a waiver or amendment to the provisions of this Contract. To be binding, amendments or waivers shall be in writing, signed by the parties and approved by written resolution of the City Council. The City's failure to promptly take legal action to enforce this Contract shall not be a waiver or release. G. This Contract shall run with the land and may be recorded against the title to the property. The Developer covenants with the City, its successors and assigns, that the Developer has fee title to the property being final platted and/or has obtained consents to this Contract, in the form attached hereto, from all parties who have an interest in the property; that there are no unrecorded interests in the property being final platted; and that the Developer will indemnify and hold the City harmless for failure to fulfill any of the foregoing covenants. H. Each right, power or remedy herein conferred upon the City is cumulative and in addition to every other right, power or remedy, express or implied, now or hereafter arising, available to City, at law or in equity, or under any other agreement, and each and every right, power and remedy herein set forth or otherwise so existing may be exercised from time to time as often and in such order as may be deemed expedient by the City and shall not be a waiver of the right to exercise at any time thereafter any other right, power or remedy. I. The Developer represents to the City that the plat complies with all city, county, metropolitan, state, and federal laws and regulations, including but not limited to: subdivision ordinances, zoning ordinances, and environmental regulations. If the City determines that the plat does not comply, the City may, at its option, refuse to allow construction or development work in the plat until the Developer does comply. Upon the City’s demand, the Developer shall cease work until there is compliance. 26. DEVELOPER’S DEFAULT. In the event of default by the Developer as to any of the work to be performed by it hereunder, the City may, at its option, perform the work and the Developer shall promptly reimburse the City for any expense incurred by the City, provided the Developer, except in an emergency as determined by the City, is first given notice of the work in default, not less than 48 hours in advance. This contract is a license for the City to act, and it shall not be necessary for the City to seek a court order for permission to enter the land. When the City does any such work, the City may, in addition to its other remedies, assess the cost in whole or in part. 27. WARRANTY/PERFORMANCE GUARANTEE. The Developer warrants all improvements required to be constructed by it pursuant to this Contract against poor material and faulty workmanship. The Developer shall submit either 1) a warranty/maintenance bond for 100% of the cost of the improvement, or 2) a letter of credit or performance bond for twenty-five percent (25%) of the amount of the original cost of the improvements. A. The required warranty period for materials and workmanship for the utility contractor installing public sewer and water mains shall be two (2) years from the date of final written City acceptance of the work. B. The required warranty period for all work relating to street construction, including concrete curb and gutter, sidewalks and trails, materials and equipment shall be subject to one (1) year from the date of final written acceptance, unless the wearing course is placed during the same construction season as the bituminous base course. In those instances, the subdivider shall - 10 – guarantee all work, including street construction, concrete curb and gutter, sidewalks and trails, material and equipment for a period of two (2) years from the date of final written City acceptance of the work. C. The required warranty period for sod, trees, and landscaping is one full growing season following installation. Following construction, a certification signed by the design landscape architect shall be filed with the City evidencing that the was installed in accordance with the approved plans and specifications. 28. SUMMARY OF SECURITY REQUIREMENTS. To guarantee compliance with the terms of this contract, payment of special assessments, payment of the costs of all public improvements, and construction of all public improvements, the Developer shall furnish the City with a letter of credit, in a form acceptable to the City, from a bank, cash escrow or a combination cash escrow and Letter of Credit ("security") for $1,268,373, which represents 100 percent of the estimated cost of the Improvements. The letter of credit shall include an automatic renewal clause. The letter of credit shall guarantee to the City the construction and satisfactory completion of all items to be completed by the developer; that the letter of credit shall be reduced from time to time as work is performed and accepted in a satisfactory manner; that the city engineer may reduce the letter of credit to the amount reasonably estimated by the City engineer to be necessary to cover the remaining construction obligations; however, the letter of credit shall not be reduced below the amount estimated by the City to cover all obligations of development including payment of costs and expenses incurred by the City for legal, engineering, planning and any other costs until a maintenance bond for period of one year, satisfactory to the city attorney and the city engineer has been provided by the developer or its subcontractor. TO: Corcoran City Council FROM: Mary Matze through Kendra Lindahl, Landform DATE: September 19, 2018 for the September 27, 2018 City Council Work Session RE: Work Plan for Amendments to Development Rights and Open Space & Preservation Plats (City File 18-014) 60-DAY REVIEW DEADLINE:N/A 1.Background Corcoran uses a development rights program as a method of managing development density in rural areas and Metropolitan Urban Service Areas (MUSA) where municipal services are planned but have not yet been provided. Council asked staff to review the development rights policy and the Open Space & Preservation Plat ordinance to understand opportunities for making it easier for property owners to develop their land. This item was scheduled for the August 9, 2018 work session, but was tabled after the session was cancelled. 2.Analysis Development Rights Program Corcoran’s development rights program was developed with the intention of managing development rural areas and areas where municipal services are planned but have not yet been provided. Within the MUSA, developments that are planned for City services are restricted according to minimum lot sizes provisioned by the Zoning Ordinance and density standards identified in the Comprehensive Plan. The number of lots created outside the MUSA that are not planned for City services are restricted by the number of development rights. However, because the sanitary sewer phasing plan is a 20+ year extension to serve the MUSA area, the Code does allow an interim solution for landowners in the Urban Reserve (UR) zoning district with development rights to cluster development in advance of sewer extension. Historically, the development rights program has been more difficult to administer than a minimum lot size and tracking has been a challenge over the years due to inconsistent record-keeping at City Hall. Over the years numerous property owners have disputed development rights assignments because the number is incorrect on the map, or development rights were transferred between property owners without being tracked at City Hall. However, we believe that current development map is as accurate as possible and the City Code provides an appeal process if a landowner can show that the map is in error. Agenda Item: 9b. Development Rights and OS&P Memo 2 September 27, 2018 Streets The development rights program was seen in part as a tool to incentivize property owners to construct and pave streets. While installation of a gravel road makes it easier for the property owner to develop their land, it comes at a significant annual cost to the City. Annual costs of maintaining gravel roads is higher than annual maintenance of paved roads. • Is it the Council’s goal to pave roads in Rural Residential areas? Does the current policy of incentivizing higher density (more lots) for subdivisions that provide paved roads still make sense? Density and Lot sizes The Rural Residential areas are designated by Metropolitan Council as Diversified Rural, which allows development at 1 unit per 10 acres. This density minimum is consistent with the current policy for Rural Residential subdivisions with paved streets. The Zoning Ordinance allows property owners served by unpaved streets to develop their property at a rate of 1 unit per 30 acres and those properties served by paved streets to develop at 1 unit per 10 acres. If a property owner with an unpaved street wishes to pave a street, they may do so to increase the number of development rights. If Council wishes to update the policy to allow all land owners to develop at 1 unit per 10 regardless of whether or not roads are paved, consistent with Metropolitan Council policy, they would have two options to achieve this strategy: a. All land owners to develop at 1 unit per 10 regardless of whether or not roads are paved. b. Create a minimum lot size for the Rural Residential and Urban Reserve District. Lot sizes clearly defines for staff, landowners and developers the minimum standards for development. A 10-acre minimum lot size clearly identifies how much land is needed for subdivision. This program is much easier to administer and understand. However, there are a number of challenges to updating the current policy: a. Updating the density standard in the development rights map would significantly change the policy that has been in place for the last 30 years. The program has some challenges, but landowners in rural Corcoran have made decisions based on this program. Changing it to a minimum lot size or minimum program would create winners and losers by allow large lot property owners that have not previously developed land to develop land at a greater density than their neighbors that subdivided property under the old policy (which allowed only one lot per 30 acres). b. Changing to a minimum lot size standard may allow landowners to further develop land that was planned as open space. The City allows developers to cluster homes on smaller lots without a conservation or deed restriction on the large lot intended as permanent open space. Allowing a minimum 10-acre lot size (consistent with Met Council density Development Rights and OS&P Memo 3 September 27, 2018 requirements) may result in increased density in the rural area and inefficient development that disrupts natural resource communities and prevents the city from providing sewered services in the future. Clustered development Council could revisit incentives for clustered development in exchange for development rights. The City currently incentivizes clustered development through the Open Space & Preservation Ordinance. However, there are a number of considerations that Council should discuss related to the standards in that Ordinance. Open Space & Preservation Ordinance In 2004, the City adopted an Open Space & Preservation (OS&P) Ordinance that increased development rights in exchange for the preservation of Open Space. The original OS&P Ordinance was seen as a way to preserve natural resources and farmland. This ordinance was updated in 2011 by a subcommittee to make it easier for property owners to develop their land, and removed many requirements for preservation of natural resources. Current staff was not a part of these discussions. The current Ordinance allows property owners to increase their development rights if they develop under the City’s Open Space & Preservation (OS&P) Ordinance. Under this Ordinance the developer may double or triple the number of units allowed on a site. The current ordinance (approved in 2011) requires that only 25% of the land on the property be preserved (permanently or temporarily) as open space, with 50% of dedicated open space preserved as upland. The definition of upland found in Section 915 of the City Code is “land not classified as a wetland or water body and is generally dry.” Section 940.050, Subd. 1(A) 3 of the City Code allows wetland restoration to be credited towards the required upland. “Wetland restoration (including abandonment of legally tiled areas) will be credited towards the 12.5% upland. One acre of restored wetland shall equal one acre of upland.” This language confusing and has been difficult to interpret on recent OSP applications and should be addressed as part of an ordinance update. It is not clear why the City would allow wetland restoration to count as upland. The 2011 Ordinance allows OS&P plats for land in greenway corridors, land with natural resources, or areas that are identified as “target areas” by the City. The ordinance also allows Council to approve OS&P plats if permanent preservation or restoration is proposed. The ordinance states that preservation and restoration areas shall follow the City’s adopted Design Standards for Preservation and Restoration lands. However, staff notes that while these items have been on the City’s work plan, the City has not: • Developed Design Standards for Preservation and Restoration; • Identified target areas for OS&P Plats. Updates to the OS&P Ordinance in 2011 eliminated standards that encouraged / required: • Permanent open space preservation Development Rights and OS&P Memo 4 September 27, 2018 • Preservation of natural resources • Smaller lot sizes (which allows more land to be preserved) • Higher levels of architectural design • Higher landscaping standards The 2011 OS&P updates focused instead on incentivizing construction of common well and septic. Essentially, without strong preservation and restoration standards, the OS&P standards allow an increased number of development rights without the benefits of meaningful natural resource protection. While the City wants to make land development easier, natural resource protection seems to be very important as well. Because Design Standards and Target Areas have not been developed, the City has accepted OS&P plats whenever requested by a subdivider. No management standards for natural resources, no buffer requirements (except for Shoreland and Wetland), no architectural standards, and no HOA standards have been enforced by the City. • Council should discuss whether or not the OS&P standards are achieving desired natural resource protection or if the OS&P plat is simply giving land owners more opportunities to develop their land. • Council should also discuss whether identifying OS&P target areas is still relevant and if Design Standards for Preservation and Restoration should be prioritized on the 2018 or 2019 Work Plan. Flexible Design Guidelines The current OS&P Ordinance does not comply with the Metropolitan Council policies for the Diversified Rural Areas, which does not allow for permanent preservation of land. The OS&P ordinance allows land to be temporarily or permanently preserved, and the developer is essentially allowed to develop at a greater density than 1 unit per 10 acres. While the Metropolitan Council’s policies support increased clustered density, they do not support permanent preservation of land. Metropolitan Council allows increased density via a “Flexible Development” policy. The reasoning behind this is that if the property owner chooses to subdivide the property with temporary preservation, further development of land is possible on the land in the future. This strategy gives the community and land owners the option to allow land to be preserved for future development and immediate preservation of natural resources. To mitigate the potential for increased density in the rural area, the City could consider adopting Metropolitan Council’s “Flexible Residential” design standards that allow for rural and large lot properties to develop at greater densities than 4 units per 40 acres (or 1 unit per 10 acres) by requiring subdivision designs that preserve land for future development. This strategy gives the community flexibility in that it: a. protects natural resources in the immediate future (until services can be provided); b. preserves land for more urban development in the future, if needed; c. gives the property owner an opportunity to develop the land at a higher density Development Rights and OS&P Memo 5 September 27, 2018 However, if this strategy is used the Metropolitan Council requires that communities develop ordinances that limit development to 25% of the developable land, reserving the other 75% of that land as open space that could be developed in the future. This is significantly more land that is preserved than under the 2004 and 2011 OS&P Ordinances. Additionally, changing the program will require that the City comply with the density standards (4 lots per 40 acres) for the Diversified Rural areas. Density bonuses would be required to comply with Met Council’s Flexible Design policies. If Council desires to improve the OS&P Ordinance to allow for increased development and preservation of natural resources, staff recommends updating the ordinance so that it achieves increased temporary preservation of land, strengthens design standards, and increases density bonuses for higher levels of design and natural resource management. This could be a modified form of the flexible design guidelines that requires less preservation of buildable land than the current Met Council policy, but more buildable land than currently preserved under the OS&P ordinance. Staff recommends that the City Council discuss the following items: a. Are paved streets still a priority for the Council? Development Rights and OS&P Memo 6 September 27, 2018 • Both the development rights program and the OS&P program require paved streets to maximize the development potential of a site. A landowner gets 1 per 10 acres if they are on a paved road and 1 per 30 acres if they are on a gravel road. The Council could simply shift to 1 per 10 acres regardless of whether or not a street is paved. • An OS&P development requires paved streets in the development and the Council policy is to require paved access to the site as well. Is this still a priority? The Council could eliminate the requirement for paved streets or clarify that they will only require pavement within the OS&P development not leading up to it. b. What are the concerns about the current OS&P ordinance? • The ordinance was drafted in 2004 and we had two OSP developments (Summerhill and Meadow Creek Estates). The recession happened, the ordinance was revised and now we have our first OSP proposal since 2005. We should be careful to separate the impacts of the recession from the ordinance standards. • Should roads be paved? • Are we giving density bonuses for the right things? • Should we give more density bonuses? • Are the design standards sufficient? • The design standards have a build-to line of 75 feet to keep structures closer to the street which would make it more cost effective for residents to connect to sewer and water in the future. Does that make sense given the timeline for possible future sewer service? (the original OS&P ordinance had standard setback requirements) • A PUD is required if a developer strays from the standards. c. What are the Council’s goals for the OS&P ordinance? • Originally, it was created to preserve natural resources and rural character. Is that still the goal? If not, what is the goal of the Ordinance? Summary Recommendations There are several issues with the Open Space and Preservation guidelines that the Council should consider. Staff feels that the primary issues that need to be address with the update are as follows: 1. Staff feels that maintaining the current policy of allowing 1 unit per 10 acres for paved roads and 1 unit per 30 acres for gravel road development is fair and reasonable given cost of providing services. Furthermore, changing this long-standing policy would create winners and losers for those property owners that have developed their land under the current ordinance. Development Rights and OS&P Memo 7 September 27, 2018 2. The standards for OS & P plats should incorporate stronger natural resource protection and preservation and design requirements. 3. The ordinance should require preservation of more open space than is currently preserved in the ordinance (The 2004 ordinance required 50% preservation, the Metropolitan Council requires 75% preservation and the current ordinance only requires 25% preservation). 4. Definitions related to the upland calculation should be clarified and wetland restoration should not be counted toward an upland calculation. The Council could provide direction to staff regarding specific ordinance amendments or ask for additional information to be brought back to a future work session. 3. Action Provide feedback to staff about the issues related to development rights and cluster developments. The Council should direct staff on how to proceed. Attachments 1. Some Diversified Rural communities are also located in the Long-term Wastewater Service Area (LTSA). These areas are designated to ensure land availability to accommodate growth post-2040 at the edge of the urbanizing area. Purpose The purpose of flexible residential development ordinances and tools in these areas should be to preserve land for post-2040 growth and to accommodate the future extension of regional urban services. In August 2008, the Council adopted Flexible Residential Development Ordinance Guidelines for the Diversified Rural Area that describes the factors communities should take into account if they are considering allowing residential development at densities greater than 4 units per 40 acres in their communities. The Council has since incorporated these guidelines into Thrive MSP 2040. Function For those communities on the edge of the urbanizing area, designated as part of the LTSA, residential development ordinances should provide for interim land uses without precluding the opportunity for future development at densities of at least 3 units per net developable acre to ensure future, cost-effective and efficient regional wastewater treatment services. For areas outside of the LTSA, the Council also encourages the clustering of homes, particularly when communities are considering densities greater than 4 units per 40 acres. Communities should study and assess their landscapes to refine their development priorities. There may be areas within the community that contain an abundance of sensitive natural resources or that the community has identified as a greenway or conservation corridor. These areas may not be most suitable for future urbanization as the capability of the land to support development is low and constrained. In these cases, open space development or cluster development may be adapted to protect those resources to meet the community’s goals. Flexible Residential Development Guidelines In considering ordinances and development that exceeds the 4 units per 40 acres density, communities should apply the following guidelines: 1. Include the need to reserve land resources for efficient future urban development as part of the ordinance purpose. 2. Identify the land characteristics required to support future urbanization. 3. Allow no more than 25% of the developable land in a project to be developed, reserving larger future urbanization parcels. 4. Protect future urbanization parcels with temporary development agreements, easements, or deed restrictions. 5. Provide for the rezoning of the future urbanization parcels to a residential zoning classification at densities consistent with Council policy at such time that urban services are available. 6. Encourage the use of community wastewater treatment systems to serve the temporary cluster. There are a number of tools that communities have utilized to meet these goals, including but not limited to the following: 1. Adopt Cluster Ordinances to preserve open space and allow future urbanization. 2. Permit density bonuses for meeting certain specified ordinance requirements. 3. Use of Planned Unit Development (PUD) regulations to manage development and preserve open space. 4. Require Build-Out Plans (Ghost Platting) to demonstrate future subdivision for the delivery of urban services. 5. Employ platting techniques along with deed restrictions, easements, and covenants to protect open space for future development. 6. Use of overlay districts in specified areas to ensure mandatory clustering; for example, on land adjacent to urban service areas. If a community adopts regulations to allow densities in the Diversified Rural area which exceed 4 units per 40 acres, the Metropolitan Council will need to review any revised ordinance details to ensure compliance with the community’s Comprehensive Plan and future expansion of urban services. FLEXIBLE RESIDENTIAL DEVELOPMENT EXAMPLES There are many different development styles a community might use to alow for current development while reserving land for future urban development. This section describes some of the development patterns available to communities. Traditional Rural Cluster The traditional rural cluster above shows that a mandatory cluster district may allow for a defined, limited number of lot splits within a contiguous rural acreage if certain parameters are met, such as specified lot sizes and frontage on a local street. The above example allows for future subdivision of the residual parcel to allow for urban services. This method of subdivision would need to be tracked by the municipality over time to ensure that sufficient land is preserved to allow for a subdivision layout at acceptable densities and access to allow for future urban services. The first image shows a conventional large-lot rural development which precludes the provision of urban services due to the ineffective lot layout and inefficiency of multiple or long-distance connection points to urban services. The Council has found that this style of large-lot rural development does not advance the mission of ensuring orderly and economical development in the region. Additional urbanized development may be accommodated in the eastern portion of that site as well. The Rural Cluster Development may utilize a communal septic system until such time that urban services become available. Build-Out Plan (Ghost Platting) The Build-Out Plan, or ghost platting, is a method of master planning for future urban densities in rural large-lot subdivisions. The subdivision is organized in a way that will facilitate a transition to higher density at some future date, perhaps through the use of development or service infrastructure triggers. This is often achieved by restricting the location of buildings to avoid obstructions to future utility and roadway easements. Platting for future urban densities is achieved by establishing lines for future splits of large lots into smaller lots and dedication of rights-of-way and easements for future streets, utilities, storm water facilities, etc. This method of subdivision is another front-loading process which preserves land for future urbanization. Oftentimes, the Build-Out Plan may limit the location and size of the residential footprint to more effectively allow for future subdivision of lots. Build Through Acreages Build Through Acreages can allow for development at lower densities while preserving open space for future development through the platting process. A large outlot can be established to allow for future development at densities that can allow for urban service expansion. The outlot may also be encumbered with deed restrictions, covenants, or easements to provide the interim protection of open space and maintain subsequent triggers for development and service delivery. This method can also be useful in areas in a Rural Residential community designation that may benefit from clustering, but are still undeveloped in the conventional large-lot pattern. In these cases, it may be advisable to preserve land for future residential development if the outlot abuts land within the Council’s Long Term Service Area. Applications were due on August 27th and 19 were received (completed applications). The City held first round interviews on September 6th and second round interviews on September 13th which included an equipment operation test. A preferred candidate has been selected and is in the background review process which is anticipated to be completed on Tuesday, September 25th. Once completed, staff will send information on the offer and candidate to the City Council in advance of the meeting. Financial/Budget: The details of the offer will include items related to salary and benefits. The budget will see a savings as the position will have been vacant for approximately three and a half months. This project is required to provide a looped water system for the development in case of a water pipe break and to provide for increased fire flows. A rough financial estimate of the project is $1,400,000 and is to be paid for out of the water fund. This has been planned for several years and is included in the City’s financial management plan. Gleason Parkway Extension project The scope of this project is to extend Gleason Parkway in the Ravinia development westward in order to connect to County Road 116 (see attached exhibit). The project would also include turn lanes on County Road 116. A financial estimate is around $1,500,000 and is to be paid by Lennar as outlined in the development agreement. The first phase of both projects includes completing the required wetland delineation, identifying the need to purchase additional right-of-way or project related property, completing soil borings, and obtaining appraisals to begin the purchase discussion. This is the action staff is requesting approval to proceed with. Financial/Budget: Estimates of total project cost is outlined above and further outlined in the financial management plan. The projects are funded out of non-general fund accounts (water fund and developer).
