A RESOLUTION APPROVING FINDINGS OF FACT FOR AN ORDINANCE AMENDMENT TO
THE TEXT OF CHAPTER 52, CHAPTER 10 SECTION 1020 AND SECTION 1060 OF THE
CORCORAN CITY CODE RELATED TO RIGHT OF WAY MANAGEMENT (CITY FILE 17-
039)
WHEREAS, the City Council directed staff to prepare an ordinance amendment to amend the
City Code to establish a right of way ordinance and telecommunication standards; and
WHEREAS, the amendment allows the City to manage its public streets, sidewalks, ditches and
utilities; and
WHEREAS, the amendment will allow the City to permit and charge fees for work within the
right of way; and
WHEREAS, the amendment will bring City code into conformance with State Statute regarding
small wireless facilities; and
WHEREAS, the amendment would be consistent with the 2030 Comprehensive Plan; and
WHEREAS, the amendment would be consistent with other City Code standards and City
policies; and
WHEREAS, the Planning Commission has reviewed the proposed text amendments at a duly
called Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that it should and hereby does approve the Right of Way
Management Ordinance amendment based upon the following findings:
1. The proposed adoption would be consistent with State law and the City's
Comprehensive Plan, and compatible with other provisions of the City Code.
2. The amendment would amend the ordinance to allow the City of Corcoran to manage
the right of way and telecommunication facilities within the right of way.
