HomeMy WebLinkAboutResolution 2017-72 Approving Preliminary PUD for Bass Lake EstatesCity of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2017 -72 Motion By: Keefe Seconded By: Bottema October 26, 2017 APPROVING PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD) PLAN FOR "BASS LAKE ESTATES" FOR E & R INVESTMENTS, LLC ON THE 39.98 -ACRE SITE AT 19219 AND 19235 COUNTY ROAD 10 (PID 25- 119 -23 -44 -0002 AND 25- 119 -23 -44 -0003) (CITY FILE 17 -026) WHEREAS, E & R Investments, LLC ( "the applicant ") has requested approval of a preliminary PUD development plan for 56 single family homes and 52,360 square feet of self- storage in 7 buildings on 39.98 -acres legally described as: Parcel 1: That part of the West Half of the East Half of the Southeast Quarter of Section 25, Township 119, Range 23, lying South of the centerline of County Road 10, except the West 300 feet thereof. Parcel 2: The West 300 feet of the West Half of the East Half of the Southeast Quarter of Section 25, Township 119 North, Range 23 West, lying South of the centerline of County Road 10. WHEREAS, the Planning Commission has reviewed the plan at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for a preliminary PUD development plan, subject to the following conditions: 1. A preliminary PUD development plan is approved to allow the creation of 56 lots for single family homes, one industrial lot and three outlots, in accordance with the application materials and plans received by the City on August 15, 2017 and revisions received September 20, 2017, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested Comprehensive Plan Amendment, rezoning and preliminary plat. 3. The applicant shall comply with all conditions in the City Engineer's memo dated September 25, 2017. 4. The approval is subject to the review of the City Public Safety Committee. The applicant shall work with the City to address any comments from the committee including the June 12, 2017 memo. 5. The approval is subject to the review and approval by the Elm Creek Watershed Management Commission. The applicant shall comply with any conditions of approval from the watershed. The applicant shall comply with any conditions of approval from the County and the October 5, 2017 memo. 7. The extension of sanitary sewer and municipal water is required to serve this site. Approval of this PUD is contingent upon extension of these services to the site. 8. The preliminary PUD development plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 9. The plans must be revised to show house pads and driveway locations as part of the final PUD development application. 10. The plans must be revised to dimension the proposed building and parking setbacks on the industrial property to ensure compliance with the required 60-foot building setback and 50- foot parking and drive aisle setback for the industrial lot. 11. All platted residential lots shall comply with the following: 12. Mechanical equipment (including air conditioning units) must be located in the side or rear yard. 13. All garages must have a minimum 22-foot parking area in front of the garage that does not overlap into sidewalks, drives or streets. Architectural and Design standards 14. All Design Requirements for the RSF-3 district described in Section 1040.050 shall be met for the residential homes. 15. PUD flexibility is granted to allow certain industrial building elevations to exceed the 20% metal siding requirements for internal elevations. 16. Prior to the final PUD plan submittal, the applicant shall provide fully dimensioned building elevations for all four sides of the building. The applicant shall provide copies of the final HOA documents/covenants for City review as part of the final plat application. a. The HOA documents shall note that the HOA is responsible for maintenance of all common areas. b. The HOA documents shall note that Shamrock Golf Course is currently a golf course, but that it may develop in the future consistent with the adopted Corcoran Comprehensive Plan. c. The HOA documents shall note golf balls may enter onto the residential properties and that neither Shamrock Golf Operations, LLC nor its golfers are responsible for any damage that may come from golf balls. d. The HOA documents shall note that Shamrock Golf Course is private property and trespassing is not permitted. e. The HOA documents shall provide notice to homeowners about the activities permitted at Lions Park and associated impacts. 18. The developer shall provide centralized mailbox locations. A mailbox plan shall be provided for City review and approval. Parking 19. Parking shall be permitted on one side of the local streets and shall be signed in accordance with city standards. 20. The 12 parking stalls shall be constructed with phase I of the self-storage buildings. Landscaping and Lighting 21. A revised landscape plan shall be provided for City Council review prior to approval of the final plat and PUD final plan. The revised plan shall incorporate additional landscaping (6 trees and 5 shrubs) along County Road 10 as required for the requested setback flexibility and one tree shall be provided on each of the residential lots. 22. Lawn sprinklers/irrigation systems (if provided) shall all have rain sensors to limit unnecessary watering. 23. The HOA shall be responsible for maintenance of all common lots. 24. The developer must prepare a stormwater maintenance easement for review and approval by the City and the easement will be recorded with the final plat. 25. A final tree preservation plan incompliance with Section 930.010, Subd. 6 D of the Subdivision Ordinance. 26. Plans shall be revised to show proposed street lighting. 27. The applicant shall finalize the fixtures proposed in the submittal and provide detailed specifications that demonstrate compliance with 1060.040 (Lighting) of the Zoning Ordinance. The applicant shall work with the City to finalize the design of the Historia decorative lighting that will be installed. The applicant shall provide street lights in compliance with City Policy. 29. Fence details shall be provided for City review and approval. 30. The location of existing and proposed fencing shall clearly be shown on the plans. 31. The applicant shall work with City staff and revise the plans to provide additional landscaping next to Lots 13 and 27 if possible to provide a buffer from Lions Park. Streets, Parking and Utilities 32. All streets within the development shall be public streets. 33. Utilities shall be stubbed to the property lines for future extension to adjacent properties. The stubs shall be at the developer's expense. 34. All utility facilities shall be located underground. 35. A temporary cul de sac easement shall be submitted with final PUD development plan for review and approval by the City. 36. The applicant must submit an exhibit showing fire vehicle turning radius requirements can be met within the industrial lot. 37. The plans must show barricades and signage indicating future connections to be installed at the end of the stub street (Road B) Wetlands 38. The plans shall be revised to identify wetland buffer monuments and wetland buffer setbacks as required by Section 1050.010 of the Zoning Ordinance. 39. Wetland buffer monuments shall be installed prior to issuance of building permit. 40. Landscape plans shall be revised to incorporate wetland buffer vegetation strips in compliance with Section 1050.10, Subd.8 of the Zoning Ordinance. 41. The developer must install wetland buffer monuments prior to issuance of building permits for adjacent buildings. Drainage/Stormwater Management 42. Drainage and utility easements must be provided over all wetlands, wetland buffers and ponds. 43. The floodplain fill and mitigation must be reviewed and approved by the City Engineer. The final dedication requirements shall be determined with the final plat shall generally be as follows: a. Dedication of a 10 -foot wide trail easement on the west side of the site. b. Construction of the trail as shown on the plans. a. The trail shall be 8 -feet wide. b. The trail shall either be in the right -of -way or within a 20 -foot wide easement. C. In exchange for PUD flexibility, the developer is required to provide finished grading, paving and ground cover for all trails within their developments. No credit toward the required dedication shall be given for this work. d. Park dedication shall be cash in lieu of land in accordance with the park dedication policy in place when the plat is released for recording. Miscellaneous 45. A final PUD development plan must be submitted with the final plat for review and approval. 46. No signage is proposed or approved at this time. Any signage will require a sign permit and compliance with Chapter 84 of the City Code.
