APPROVING FINDINGS OF FACT FOR REZONING FOR PROPERTY LOCATED AT 19219
AND 19235 COUNTY ROAD 10 (PID 25-119-23-44-0002 AND 25-119-23-44-0003) (CITY FILE
17-026)
WHEREAS, E & R Investments, LLC ("the applicant") has requested approval of a rezoning
from Urban Reserve (UR) to Planned Unit Development (PUD) for two parcels totaling 39.98-
acres legally described as follows:
Parcel 1:
That part of the West Half of the East Half of the Southeast Quarter of Section 25,
Township 119, Range 23, lying South of the centerline of County Road 10, except the
West 300 feet thereof.
Parcel 2:
The West 300 feet of the West Half of the East Half of the Southeast Quarter of Section
25, Township 119 North, Range 23 West, lying South of the centerline of County Road
10.
WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing
and recommends approval, and;
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from Urban
Reserve (UR) to Planned Unit Development (PUD);
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that it should and hereby does support the request E & R
Investments, LLC for the reclassification of the zoning from UR to PUD for the properties, based
on the following findings:
1 The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the City Comprehensive Plan,
including public facilities and capital improvement plans. Rezoning to a PUD will allow
the property to be developed while maintaining the natural features on the south portion
of the site.
2. The proposed action meets the purpose and intent of this Ordinance or, in the case of a
map amendment, it meets the purpose and intent of the individual district and of the
PUD District, which allows the City to grant flexibility for setbacks, lot size and other
elements of the Zoning Ordinance in exchange for a higher quality development.
3. There is adequate infrastructure available to serve the proposed action. Future public
improvements are planned and the developer will be responsible for paying for
improvements in accordance with the city assessment policy in place at the time of the
improvements.

4. There is an adequate buffer or transition provided between potentially incompatible
districts. The surrounding districts are compatible with the single - family development.
Furthermore, industrial portion of the site will provide a buffer between Lions Park and
the planned residential and the landscaping planned around the perimeter of the site will
provide additional buffering for the planned residential.
5. The zoning is consistent with the Comprehensive Plan land use classification.
6. The planned development will not create an excessive burden on parks, schools, streets
and other public facilities and utilities which serve or are proposed to serve the planned
development.
