HomeMy WebLinkAboutResolution 2017-67 Approving Preliminary Plat and Variances on Pioneer TrailCity of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2017-67 Motion By: Bottema Seconded By: LaFave October 26, 2017 A RESOLUTION TO APPROVE A PRELIMINARY PLAT AND VARIANCE FOR PROPERTIES LOCATED AT 6450 & 6470 PIONEER TRAIL (PID 32-119-23-32-0013 & 32-119-23-32-0012) (CITY FILE NO. 17-025) WHEREAS, Kenny Doboszenski has requested approval of a preliminary plat and variance to allow for the replatting of two properties totaling 7.80 acres. The properties are legally described as: Lots 1 and 2, Block 1, Hales Corner, according to the recorded plat thereof, Hennepin County, Minnesota WHEREAS, the Planning Commission reviewed the submitted preliminary plat at a duly called Public Hearing and recommends approval, and; NOW THEREFORE BE IT RESOLVED that the Corcoran City Council approves the request for a preliminary plat and variance subject to the following findings and conditions: 1. A preliminary plat for two lots is approved, in accordance with the plans received by the City on August 14, 2017, except as amended by this resolution. 2. Variance from Zoning Ordinance Section §1040.020, Subd. 9 to allow the proposed Lot 1 and Lot 2, Block 1 to be platted as shown on the plans, which does not meet the minimum lot size and width based on the following findings: a. The existing Lot 1 and Lot 2 are existing legal non-conforming lots for both lot size and width. The applicant has a practical difficulty in complying with the UR (Urban Reserve) standards for lot size and width. The preliminary plat adjusts the common lot line and both lots would retain their legal non-conforming lot size and width. Furthermore, if the lots were located outside the MUSA (Metropolitan Urban Service Area) like the adjacent properties it would comply with the RR (Rural Residential) standards for lot size and width. b. The subject property is unique because the two lots do not occupy enough land for them to comply with the lot size requirements of the Urban Reserve district. The current lot widths are not being changed from the existing lot widths. c. The granting of this variance will not alter the essential character of the locality. The lot size and width are consistent with the surrounding properties. d. The proposed variance would be in harmony with the general purposes and intent of the ordinance. Proposed Lot 1 and Lot 2, Block 1 will continue to preserve urban service areas. The existing legal non-conforming lot width will be unchanged. e. The variance is consistent with the Comprehensive Plan which calls for rural residential that will provide a transition from a rural environment to a more urbanized land pattern. 3. Prior to release of escrow: October 26, 2017 a. Record the approving resolutions, mylar and all related documents at Hennepin County and provide proof of recording to the City. b. Lot corner monuments shall be installed as required by the Subdivision Ordinance. c. The applicant shall provide the approved preliminary and final plat drawings to the City in an electronic (AutoCAD) format. 5. Approval of the preliminary plat shall expire within one year of the date of approval unless the applicant has filed a complete application for approval of a final plat.
