HomeMy WebLinkAboutResolution 2017-63 Approving Interim Use Permit-Good Dogs KennelCity of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2017-63 Motion By: Keefe Seconded By: Dejewski September 28, 2017 APPROVING AN INTERIM USE PERMIT FOR KELLEE ZENK DBA GOOD DOGS MINNESOTA AT 10220 TRAIL HAVEN ROAD (PI D 03-119-23-33-0001) (CITY FILE 17-021) WHEREAS, the landowner has requested approval of an interim use permit to allow a Conditional Home Occupation License for a Commercial Kennel at property legally described as follows: The South 330 feet of the North 444 feet of the Southwest Quarter of the Southwest Quarter in Section 3, Township 119 North, Range 23 West of the 5th Principal Meridian, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the interim use permit at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for an interim use permit, subject to the following findings and conditions: 1. An interim use permit is approved to allow a commercial kennel for boarding and training dogs as a Conditional Home Occupation License, in accordance with the application received by the City on July 19, 2017 and revisions received on August 4, 2017 and August 14, 2017, except as amended by this resolution. 2. The Zoning Ordinance allows Conditional Home Occupation Licenses and Commercial Kennels as Interim Uses in the RR zoning district. Furthermore: a. The City finds that the intent of this dual listing to allow more flexibility for this type of home occupation than other home occupations. b. The applicant shall comply with all home occupation standards except as specifically modified per this resolution. 3. The Conditional Home Occupation License is issued to Kellee Zenk for the operation of "Good Dogs Minnesota". This permit is non-transferable. If the business ceases, if ownership of the business changes, or if the individual to whom a license has been issued ceases to own the subject premises, the CHOL is automatically revoked 4. The Conditional Home Occupation License is approved based on the finding that the standards in Section 1030.100, Subd. 7 and Section 1070.030 have been met. Specifically: a. The applicant is requesting the conditional home occupation license to operate her commercial kennel business in the existing home and new fenced area. b. The home would be modified and upgraded to accommodate the proposed commercial operations. There is nothing to indicate that the proposed improvements would devalue adjacent and surrounding properties. The nearest homes are 225+ feet away from the proposed fenced area and 350+ feet from the kennel area. d. There are no environmental concerns, including but not limited to drainage, wastewater, wells and wetland issues related to this project. e. No public services are needed to accommodate the proposed use. f. The home occupation appears to have minimal impact on neighboring properties. 5. No business signage is proposed. 6. A maximum of nine dogs shall be allowed on site. The maximum number of pets to be boarded overnight is three. Training of four additional dogs in small classes will be allowed in addition to the owners two dogs. ,n L, 7. Training shall be no more than one 90-minute class per day up to four days per wevr', 8. All training exercise shall occur in the fenced training area. 9. No outside storage of materials related to the home occupation is allowed. 10. Any lighting proposed must comply with Section 1060.040 of the Zoning Ordinance. 11. No employees shall be permitted, except the owner of the home and business. 12. A building permit must be obtained and a final inspection completed by the City prior to beginning operation of the Home Occupation in the existing basement of the home. 13. No approvals are granted for impacts to wetlands. The applicant is responsible for coordinating with Elm Creek Watershed Management Commission for any required wetland of stormwater permits. 14. The applicant must comply with the waste management plan provided with the application and ensure sanitary disposal of all animal waste. 15. Prior to installing the fence and beginning operation, the applicant/landowner must: a. Record the approving resolution at Hennepin County and provide proof of recording to the City. b. Submit fence details for the fence that will enclose the training area for review and approval by the City. c. Submit electronic files of the certificate of survey prepared by Meyer-Rohlin. to the City in AutoCAD format. The Conditional Home Occupation License shall be issued for 3 years in accordance with the procedures outlined in Section 1030.100 of the Zoning Ordinance. The permit shall be administratively reviewed every 3 years to ensure compliance with conditions of approval and ordinance requirements. 17. The City may revoke or modify the CHOL upon a finding that conditions have changed to warrant revocation or modifications of the license. 18. Approval shall expire within one year of the date of approval unless the applicant commences the authorized use and completes the required improvements.
