HomeMy WebLinkAboutResolution 2017-60 Approving Variance for Property-GmachCity of Corcoran County of Hennepin State of Minnesota z Motion By: LaFave Seconded By: Keefe September 28, 2017 A RESOLUTION TO APPROVE A VARIANCE FOR PROPERTY LOCATED AT 22525 COUNTY ROAD 117 (PID 05-119-23-13-0002) (CITY FILE NO. 17-017) WHEREAS, George B. Gmach has requested approval of a preliminary plat to allow for the subdivision of the property legally described as: That part of the East Half of the West Half of the Northeast Quarter of Section 5, in Township 119, of Range 23, Hennepin County, Minnesota, EXCEPT the North 40.00 feet thereof WHEREAS, the submitted preliminary plat does not comply with the minimum lot width standards, and; WHEREAS, the Planning Commission reviewed the submitted variance request at a duly called public meeting and recommends approval, and; NOW THEREFORE BE IT RESOLVED that the Corcoran City Council approves the request for a variance, subject to the following findings and conditions: 1. The variance is approved in accordance with the revised plans received on August 17, 2017. 2. The variance to approve a lot width of less than 200 feet on Lot 2 and Lot 3 is approved based on the following findings: a. There are practical difficulties in complying with the Zoning Ordinance. Specifically, i. It is clear that Rush Creek Drive was intended to provide access to this property because the 60-foot wide right-of-way is stubbed to the property line and the road ends in a "temporary cul de sac". However, the nature of this type of street stub means that Lot 2 cannot meet the minimum frontage requirements without unnecessarily extending the cul de sac into the property at the applicant's cost and increasing the street area to be maintained by the City. The lot itself is 200 feet wide. ii. The curvature of Oakdale Drive creates a unique condition where Lot 3 is 200 feet wide, but does not have 200 feet of frontage on Oakdale. b. That the conditions upon which a petition for a variation is based are unique to the parcel of land for which the variance is sought and were not created by the landowner. The conditions are unique to this property and are due to the curvature of an existing street (Oakdale Drive) and the location of the existing 60- foot wide right-of-way for possible extension of Rush Creek Drive. That the granting of the variation will not alter the essential character of the locality. The variance will not alter the essential character of the locality, but will simply allow development of two new single family homes on lots similar in size to adjacent developments with access onto public streets. d. The proposed variance would be in harmony with the general purposes and intent of the Ordinance. The proposed variance would allow development of two new single family homes on lots that meet the minimum size requirements and do meet the minimum lot width requirement at the setback lines. The variance is to allow a reduced lot width at the lot line. Development of the homes will be consistent with other rural neighborhoods in the area. e. The variance is consistent with the Comprehensive Plan. The variance would allow development of two single family homes as anticipated in the Comprehensive Plan. Both new lot have access onto public streets and are able to provide the well and septic systems to serve the new homes. 3. Approval of the variance shall expire within one year of the date of approval unless the applicant has filed a complete application for approval of a final plat consistent with the preliminary plat and variance approvals.
