Adjournment CITY OF CORCORAN Council Work Session Minutes July 20, 2017 - 7:00pm The Corcoran City Council met on July 20, 2017 in work session, at City Hall in Corcoran, Minnesota. Present were: Mayor Thomas, Councilor Dejewski, and Councilor Keefe. Councilor LaFave and Councilor Bottema arrived at 7:03pm. Also present were City Administrator Martens, City Clerk/Administrative Services Coordinator Beise, City Planner Lindahl, City Engineer Torve, Public Works Superintendent Meister, and Code Compliance Official Pritchard. Mayor Thomas called the work session to order at 7:00pm on Thursday, July 20, 2017. Agenda Items 1 and 2 were rearranged. 1.Transportation Plan City Planner Lindahl and City Administrator Martens made a brief presentation and shared new information regarding County Road realignment. Administrator Martens shared that the County Road 50/10 realignment project would cost between $12-16 million and that the County would not fund the project. Staff stated that without the realignment, the Downtown Mixed Use and Southeast district plans would have to be amended/revised. The Council discussed options for funding, intersection safety, and the County’s stance as well as options moving forward. The Council discussed other intersections in the City, including Co Rd 10 and Co Rd 116, Co Rd 19 and Co Rd 30, and Co Rd 10 and Larkin Rd, as well as options for changes. The Council directed staff to research and provide options and add another work session. The Council discussed regional traffic changes as well as traffic counts and change in growth projections. The Council took comments regarding the Transportation plan: John Dahl, 6330 Willow Drive, addressed the Council regarding the Willow/Larkin paving project and referencing a previous petition against the paving project, stated that he and others do not want the project to move forward. Mayor Thomas stated that there would be future meetings on this project, but that the work session was not addressing specific local street projects. Dorothy Theis, 9530 Cain Rd, shared that the City already has a policy in place to provide ROW for future road extensions. Mrs. Theis also referenced an article regarding asphalt and gravel roads. Peter Waldorf, 20117 Larkin Rd, commented on the Willow/Larkin paving and shared his opposition for the project. Jim Wawra, 21301 Larkin Rd, requested information about the City/County meeting and asked questions related to County ROW as well as a Co Rd 50 connection to Co Rd 10. Jeff Dickman, 7203 Olde Settlers Rd, asked questions and made statements regarding traffic assumptions, population triggers, multiple school districts, and walkable community. Phil Bongaarts, 19949 Larkin Rd, inquired as to whom the contacts would be at the County and Met Council and if this information could be shared. The Commission briefly discussed other realignment options, such as terminating Larkin Rd between Co Rd 10 and Co Rd 116 and creating a parkway. 2.Discussion of Proposed Amendments to Park and Trail Plan City Planner Lindahl made her presentation. The Council discussed cost of trails, design in the rural area vs. other areas, equestrian trails and multi-use trails as well as the regional trails system. Also discussed was utilizing looped trails for 6a. equestrian use and horse trail design. The Commission discussed an athletic complex and a community park with multiple uses, such as play fields and open space, splash pads, etc. The Council discussed expanding search areas for parks/athletic complex as to not limit the location. The Council discussed a trail/bicycling network and on road vs. off road as well as a need to add trails to all collector roads and create interconnectivity. The Council discussed snowmobile trails. The Council added that safety is the number one priority for trails. The Council took comments regarding the Parks and Trails plan: Jeff Dickman, 7203 Old Settlers Rd, made comments regarding the athletic search area and stated that a lot of options exist, including negotiating use rates with surrounding areas and existing facilities. He also commented on the possibility of Shamrock Golf Course becoming a public park. He questions whether or not horse trails were needed and stated that bikes and horses could co-exist. Dorothy Theis, 9530 Cain Rd, stated that horses just needed a clear path, not a trail and that nature parks could be utilized. She also stated that development would drive horses and snowmobiles out. Mrs. Theis stated that trails are hard to get without a development and that the trails should connect to Three Rivers system. Lilian Wawra, 21301 Larkin Rd, stated that the Crow Hassan horse trail serves north Corcoran and that just trails in the south are needed. Jim Wawra, 21301 Larkin Rd, stated that people do use bikes for commuting, but that policies for “Downtown” do not apply here. 3. Next Steps City Planner Lindahl reviewed the schedule and next steps. The Council directed Staff to schedule a work session to further discuss transportation and related items on August 10, 2017. 4. Adjourn MOTION: made by Dejewski, seconded by Keefe to adjourn. Present were Mayor Thomas, Councilor Bottema, Councilor Dejewski, and Councilor LaFave. Councilor Keefe was excused. Also present were City Administrator Martens, City Engineer Torve, Public Works Director Mattson, Code Compliance Official Pritchard, Director of Public Safety Gottschalk, and City Clerk/Administrative Services Coordinator Beise. 1.Call to Order / Roll Call Mayor Thomas called the meeting to order at 7:00 pm. 2.Pledge of Allegiance Mayor Thomas invited all in attendance to rise and join in the Pledge of Allegiance. 3.Agenda Approval City Administrator Martens noted the addition of Item 5b. Country Daze Update and additional claims. MOTION: made by Dejewski, seconded by LaFave to approve the agenda as amended. Voting Aye: Thomas, Bottema, Dejewski, and LaFave (Motion carried 4:0) 4.Open Forum No persons were present for open forum. 5.Presentations a. Introduction of Public Works Director – Kevin Mattson City Administrator Martens introduced Mr. Mattson. Mr. Mattson provided a brief professional and personal history and thanked Council for the opportunity. Council welcomed Kevin to the team. b. Country Daze Update – Chad Robran Mr. Robran updated the Council on the progress of Corcoran Country Daze including the new location at Lions Park and the new activities for 2017. 6.Consent Agenda a. Draft Minutes of the July 27, 2017 Council Meeting MOTION: made by LaFave, seconded by Bottema to approve the consent agenda. Voting Aye: Thomas, Bottema, Dejewski, and LaFave (Motion carried 4:0) 7.Claims as Presented a. Escrow Claims (Fund #500) MOTION: made by Bottema, seconded by LaFave to approve escrow claims as presented. Voting Aye: Thomas, Bottema, Dejewski, and LaFave (Motion carried 4:0) b. All Other Financial Claims Mayor Thomas noted the additional claims. Councilor Dejewski inquired about the Mimbach Fleet Supply claim and the Rolf Erickson Enterprises claim. City Administrator Martens noted staff would follow up on the Mimbach purchase and the expenses for Rolf Erickson Enterprises are per the assessment contract. Staff Reports / Memos/Commissions a. Commissioner Representatives Mayor Thomas noted Parks and Trails Commissioner Krueger and Planning Commissioner Russell were in attendance and invited them to speak during items related to their commissions. b. Code Enforcement Update Code Compliance Official Pritchard presented the report noting the current ordinance standards are confusing and cumbersome and which could be improved with an ordinance review and update. Council discussed cost, complaint process, the current approach, and the timelines for each type of nuisance. Council requested a timeline of current processes. Council discussed looking at future compliance items as the City begins to grow with denser housing areas. City Administrator Martens noted that staffing may be impacted with a more progressive approach to code enf orcement. Per consensus, Council directed staff to complete a comprehensive review and draft amendments to update the nuisance ordinance and other related ordinances. c. 4M Fund – Minnesota Municipal Money Market Fund City Clerk/Administrative Services Coordinator Beise presented the report noting no action with the 4M Fund. Council discussed the current location of the fund, the costs associated with the City’s current brokerage, and the timeline for holding the escrow. City Clerk/Administrative Services Coordinator Beise noted that staff would be moving the monies into FDIC insured certificates of deposits and no fees are charged for the creation of the certificates of deposit. City Clerk/Administrative Services Coordinator Beise noted she will be working with City Planner Lindahl and the applicant on the timeline of holding the escrow. 9. Planning Business No planning business was presented. 10. Unfinished Business No unfinished business was presented. 11. New Business a. Willow Drive/Larkin Road Feasibility John Dahl, 6330 Willow Drive, addressed the Council on the Willow Drive/Larkin Road project. Mr. Dahl addressed concerns with traffic counts and the project. Mike Kariniemi, 6855 Willow Drive, addressed the Council on the Willow Drive/Larkin Road project. Mr. Karinemi addressed the Council in support of paving projects. City Administrator Martens presented the report outlining the current process, the proposed costs and possible funding mechanisms. Council inquired about obtaining grants and the number of businesses on Larkin. City Administrator Martens noted there are some smaller grants available and there are five businesses located on this road in Corcoran. Council discussed trail assessments, trail types, and bonding. Council inquired about the culvert included in the project and the cost of paving Trail Haven. City Engineer Torve noted the costs were included and additional costs would be required with an off road trail. City Administrator Martens noted the estimated cost of Trail Haven was $2.6 million without a trail. Council discussed Trail Haven Road, gravel off road trails, a feasibility study for Trail Haven, debt service and preferences on bonding. MOTION: made by Dejewski, seconded by Bottema to complete a feasibility study to pave Trail Haven Road. Council discussed obtaining traffic counts for Trail Haven Road and Willow Drive/Larkin Road. Truck Project – Public Works City Administrator Martens presented the report noting that Public Works Superintendent Meister worked hard with the insurance company for several months to get the insurance payment. Council inquired about the model year of the truck. City Administrator Martens noted buying the newest model capitalizes on future resale and these trucks are replaced every ten years on current schedule. Resolution of Support of Brockton Interchange City Administrator Martens presented the report noting the City received a request of support from the City of Dayton for their funding efforts for the Brockton Interchange project. MOTION: made by Dejewski, seconded by Bottema to adopt Resolution 2017-43 Supporting the City of Dayton’s Application to the 2017 Minnesota Transportation Economic Development (TED) Program and Minnesota Highway Freight Program (MHFP). Voting Aye: Thomas, Bottema, Dejewski, and LaFave (Motion carried 4:0) d. 2017 Night to Unite Director of Public Safety Gottschalk presented the report noting an increased number of attendees as well as recognizing the efforts of City staff, volunteers, and sponsors. Council thanked staff for their efforts and recognized the efforts of community organizations. Council discussed the goal of the event and whether the event at Public Works should be on a separate night. Council discussed the feedback they received from community members. City Administrator Martens noted all but, two full-time staff members who had previous commitments, participated in the festivities. Mayor Thomas read aloud Resolution 2017-44 Recognizing the 2017 Night to Unite Events and Donations. MOTION: made by Dejewski, seconded by Bottema to adopt Resolution 2017-44 Recognizing the 2017 Night to Unite Events and Donations. Council Liaison Calendar The Council liaison calendar was not reviewed, but was available in the Council Packet. City Administrator Martens noted that the Parks and Trails Commission Liaison position for the August 15th meeting was available and would be a park tour. 14. Council Meeting: August 10, 2017 Prepared By: Brad Martens Topic: Resolution 2017-48 Cancelling Remaining Post 2017 Sewer and Water Related Special Assessments on Certain Parcels Action Required: Approval Summary: Over the past year staff has worked to obtain necessary parcels and easements for the downtown utility and street improvement project. On June 8, 2017 the City Council approved a purchase agreement and an agreement to cancel special assessments in order to purchase the following properties located generally behind the Stanchion: • PID 26-119-23-11-0005 • PID 26-119-23-11-0006 On August 15, 2017 the City closed on the properties which are now in possession of the City. The final remaining step is to cancel the special assessments per the agreement approved on June 8, 2017. A resolution taking that action is attached to this report. Financial/Budget: Costs associated with cancelling the special assessments are incorporated into the downtown utility and street improvement project. A final overview of the project will be presented following completion this fall. Attachments: Resolution 2017-48 Cancelling Remaining Post 2017 Sewer and Water Related Special Assessments on Certain Parcels City of Corcoran August 24, 2017 County of Hennepin State of Minnesota RESOLUTION NO. 2017-48 Page 1 of 2 Motion By: Seconded By: A RESOLUTION CANCELLING REMAINING POST 2017 SEWER AND WATER RELATED SPECIAL ASSESSMENTS ON CERTAIN PARCELS WHEREAS, the City Council of the City of Corcoran has imposed special assessments on several parcels within the City related to the Downtown Utility and Street Improvement Project (the “Project”); and WHEREAS, Scott and Marie Treptau (the “Owners”) are the owners of three such parcels as described below: 20113 County Road 50 (PID 26-119-23-12-0001) 20101 County Road 50 (PID 26-119-23-11-0009) 20045 County Road 10 (PID: 26-119-23-11-0008); and WHEREAS, pursuant to the terms of a Purchase Agreement with the Owners for the purchase of other property, the City has agreed to cancel the remaining post 2017 Downtown Utility and Street Improvement Project related special assessments on the above listed properties, in the amounts noted below, which belong to Owners; 20113 County Road 50 (PID 26-119-23-12-0001) - $26,055 20101 County Road 50 (PID 26-119-23-11-0009) - $26,055 20045 County Road 10 (PID: 26-119-23-11-0008)- $28,485; and WHEREAS, Owners shall be responsible for payment of all 2017 assessment payments on the above listed properties (including any applicable interest and fees). This year-long process was kicked off with a joint City Council/Commission work session on March 16th followed by a community open house on April 17th and several commission meetings and Council work sessions. The next public event is Corcoran Country Daze on August 19th. 2.Motley Lot Line Adjustment and Variance for Existing Oversized Accessory Building at 6620 Pioneer Trail (PID 31-119-23-14-0010 and 31-119-23-11-0003) (city file 17-014). Steve and Stephanie Motley have request approval of a lot line adjustment and variance. The item was reviewed by the Planning Commission on August 3rd and City Council is expected to take action on August 24th. 3.Gmach Farms Subdivision 1 Preliminary Plat, Final Plat and Variance (city file 17-017). George Gmach has submitted an application for approval of a subdivision with three lots and one outlot. The Preliminary Plat was scheduled for a public hearing at the August 3rd Planning Commission meeting and City Council action on August 24th. The variance will be reviewed at the September 7th Planning Commission meeting and the Council will consider the variance and final plat at the September 28th meeting. 4.Solar Garden Moratorium (city file 17-018). The City Council adopted a moratorium on community solar gardens at the May 25th City Council meeting and directed staff to proceed with an ordinance amendment. The Public Hearing is scheduled for the September 7th Planning Commission meeting and the City Council is expected to take action on September 28th. 5.Mayers Ag Preserve (city file 17-019). Staff has received an incomplete application from Ernie Mayers for six properties near Larkin Road to be entered into the Agricultural Preserve program. We are reviewing for completeness. The item may be placed on the September 28th City Council meeting. 6.CHOL/IUP for Good Dogs MN at 10220 Trail Haven Road (PID 03-119-23-33-0001) (city file 17- 021). Staff has received an application for a Conditional Home Occupation License (CHOL) for a dog kennel, which is processed as an Interim Use Permit (IUP). The item has been scheduled for a public hearing at the September 7th Planning Commission meeting and Council action on September 28th. 7.Bass Lake Crossing First Addition Final Plat (city file 17-022). MI Homes has submitted a PUD Final Plan and Final Plat for phase 1 of the subdivision. The application has been scheduled for Planning Commission review on September 7th and Council consideration at either the September 14th or September 28th City Council meeting. 8.Bass Lake Crossing Lot Line Adjustment (city file 17-023). MI Homes has submitted lot line adjustment for the common lot line between their property and the property to the east to Agenda Item 8b. MEMORANDUM 2 accommodate the new public street from County Road 10. This may be approved administratively contingent upon approval of the final plat. Also, there are several projects that have been approved, but are still not filed and closed out: 1. Corcoran Business Park (City file 06-005). The City Council granted a one-year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. Staff has spoken to the applicant and will schedule a meeting when more information is available on the Loretto sewer project. 2. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (City file 12-002). Hope Ministries submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. The letter of credit for site improvements has been released, but we are holding the escrow pending completion of the approved landscaping. The applicant has indicated that they are considering a site plan amendment application to modify the approved plans. Staff met again with Pastor Brian Lother in July 2017 to discuss the outstanding issues and future expansion plans on the property. 3. Sawgrass Preliminary Plat, Preliminary PUD Development Plan and Rezoning for on Schendel property at 20400 County Road 10 (City file 14-027). The City Council approved the request on December 11, 2014 and granted the applicant 2 years to apply for the final plat and final PUD development plan. Peachtree Partners did not buy the property, but a different developer could still proceed with the approved plan. On December 9, 2016, the applicant submitted a written request to extend the approvals for an additional year. Staff recommended that this request be reviewed by the City Council, but adequate time was not provided to place this on a Council agenda prior to expiration. Staff administratively approved an extension until February 28, 2017 so that this request for extension could be considered at the February 23, 2017 Council meeting. At that meeting, the City Council approved a one year extension. 4. Commercial Door Addition at 7670 Commerce Street (City file 15-010) The City received an application for approval of a building addition, which required a conditional use permit, interim use permit, variance and site plan approval. The project was reviewed at a public hearing at the June 4th Planning Commission meeting and was approved by the City Council on June 25th. The required landscaping will be finalized and constructed after the downtown infrastructure project is completed. The City will release the remaining escrow when the planting is completed. 5. “Strehler Estates” Final Plat (PID 17-119-23-32-0004) (city file no. 16-001). The applicant submitted a request for approval of a preliminary plat to create 4 lots and an ordinance amendment to allow a private drive for property at 22900 Strehler Road. The City Council approved both items on October 8th. The final plat was approved by the City Council at the January 28th meeting. A stop work order was issued as the developer began construction of the private drive in advance of filing the plat. The applicant is working to address the conditions of approval and then will record the final plat at Hennepin County. 6. Private Drive Ordinance Amendment (City file 16-003). The City Council approved an ordinance amendment allowing private drives in the Rural Residential district, subject to certain conditions. However, after adoption the City Council directed staff to revisit this issue and consider an ordinance amendment to eliminate the requirement that private drives off paved roads must be paved. The City Council approved the amendment on May 26th. The Council also identified additional issues that should be reviewed and discussed at a future date. 7. Interim Use Permit for a solar farm at 23710 State Highway 55. (PID 31-119-23-32-0001) (City File 16-032). The City recently amended the Zoning Ordinance to allow solar farms in certain districts. The landowners have requested approval for this site. The Planning Commission recommended approval after the public hearing on December 1st and City Council approved the request on December 19th. The applicant is currently working to address the conditions of approval. The applicant has submitted a request that the Council consider revising the financial guarantee requirements. On March 9th, the Council reaffirmed the conditions of the original approval. The project is under construction. MEMORANDUM 3 8. Interim Use Permit for Community Solar Garden at 23850 County Road 50 (PID 30-119-23-32- 0003) (City File 17-007). Sunrise Solar dba SEV MN 2, LLC submitted a request for approval of an interim use permit for a community solar garden on approximately 80.02-acres at 23850 County Road 50. The Planning Commission held a public hearing on May 4, 2017 and voted to recommend approval. The City Council tabled this item on May 25th and authorized “staff to obtain an appraisal or similar funded by the project escrow to determine valuation change to homes on Rebecca Park Trail due to development of any allowed use in the RR district.” The item was approved at the June 22nd meeting. 9. Site Plan Modification for Ballistic Products at 20055 and 20015 75th Avenue (PID 26-119-23-11- 0036 and 26-119-23-11-0037) (City file 17-011). Ballistic Products requested a site plan modification for construction of an access lane between the two buildings the own on these separate lots. The administrative permit was granted on April 19, 2017. Staff is working with the landowner to ensure that the appropriate cross access and maintenance agreements are prepared and recorded at Hennepin County. Staff is working to close out the file and refund the remaining escrow. 10. Bass Lake Crossing Comprehensive Plan Amendment, Rezoning to PUD, Preliminary Plat and Preliminary PUD Development Plan for property at 19400 CR 10 (PID 25-119-23-13-0002 & 25- 119-23-13-0003) (City File 17-012). M/I Homes submitted the application on April 19, 2017 and staff is reviewing the application for completeness. The application was reviewed by the Parks Commission on May 16th, a public hearing was held at the June 8th Planning Commission meeting and the Commission voted to recommend approval. The City Council approved the request at their June 22nd meeting and modified the Planning Commission recommendation by requiring sidewalks on both sides of the new public streets. The applicant requested that the Council reconsider the requirement and allow them to construct sidewalks on only one side of the public street and the Council approved the request at the July 27th Council meeting. The Metropolitan Council is completing their review of the Comprehensive Plan Amendment. 11. Ravinia 7th Addition PUD Final Plan and Final Plat (City File 17-013). Lennar has submitted a request for approval. The Planning Commission reviewed the Final PUD Plan at their July 6th Planning Commission meeting and recommended approval. The City Council approved the request for Final Plat, Final PUD Plan and easement vacation at the July 27th City Council meeting. 12. Bass Lake Estates PUD Sketch Plan at 19219 & 19235 County Road 10 (PID 25-119-23-44-0003 and 25-119-23-44-0002) (City File 17-015). An applicant for sketch plan has been submitted by E&R Investments, LLC for a mixed-use project of self-storage and detached villas on the 35-acre site. The sketch plan was reviewed by the Council at their June 22nd meeting. 13. Gmach Lot Consolidation (city file 17-020). Staff received an application for a lot consolidation to consolidate Outlot A that would be created with the “Gmach Farms Subdivision 1” to be combined with the existing home on 22600 Oakdale Drive. Council Meeting: August 24, 2017 Prepared By: Mike Pritchard Topic: CODE COMPLIANCE REPORT – July 2017 Action Required: Information Only Code Enforcement Issues: Complaint 16-015 (4/6/2016): Home Occupation, Exterior Storage at 21XXX County Road 50. The property owner has been operating an outdoor services business and storing business vehicles and materials on the property, which is in violation of City Code. The owner agreed verbally to a date of “Fall 2016” to have the site in compliance. On November 1, 2016, the City requested a written plan of action to bring the site into compliance. A plan was received on November 30, 2016 which had a completion date of February 28, 2017. On March 1, the owner asked for an extension to March 31. The extension was granted and the owner was advised that no more extensions would be approved. Because there was no progress, the complaint was referred to the City Attorney. The City was in court on May 31. The judge allowed an extension and set a new court date for September 27. Complaint 16-010 (4/1/2016): Home Occupation, Junk/Debris at 21XXX County Road 10. The property owner has been conducting a retail sales business from the property which is in violation of the Home Occupation Ordinance as well as an existing Conditional Use Permit on the property. The City has made multiple attempts to gain compliance, but the owner has refused to comply. This matter has been referred to the City Attorney. The matter has been to court and the City attorney is working with the property owner’s attorney to resolve. The matter will be back in court late August. Complaint 16-003 (12/17/2015): Exterior Storage, Junk/Debris at 20XXX Co Rd 10 and on City Property. The property owner(s) signed an agreement on April 23rd to have the City property completely cleaned up no later than September 30, 2016. The deadline was missed. Council passed an Abatement Order via Resolution 2016-84. A final deadline for compliance was set for March 31. Although the City property has been cleaned and is in compliance, many items remain out of compliance on the private property. This matter has been referred to the City Attorney. The matter was in court on June 6, 2017. A new court date was scheduled for August 16, 2017. The case was continued to September 6 at the owner’s request. No change is proposed to the existing size or location of the barn, but a new door is proposed on the south so that the Motley’s can access the barn from their property rather than the adjacent property. A new driveway is requested from Pioneer Trail to serve the barn. The applicant must apply for a new driveway permit to make this change and the existing drive on the back must be removed. And 4.The applicant must apply for a driveway permit to serve the accessory building. As a condition of approval, the City will require removal of the driveway on the north side of accessory building. Access to the Tract B accessory building shall only be from the Tract B driveway or new driveway on Pioneer Trail. The attached resolution approving the variance, reflects these changes. Agenda Item 9a. Motley Lot Line Adjustment and Variance (city file 17-014) 2 August 24, 2017 3. Context Background The applicant is requesting approval of a lot line adjustment that would increase the Motley lot (Tract B) from 1.09 to 1.67 acres in size. The lot line adjustment would make the existing barn part of Tract B rather than the 47.68-acre Tract A. As part of the 1996 subdivision that created the Motley parcel, it was anticipated that they would eventually acquire the barn and land as currently proposed. Zoning and Land Use The property is guided Rural/Ag Residential and zoned Rural Residential. The property to the west and north is guided Rural/Ag Residential and zoned Rural Residential. The property to the south and east is in the Metropolitan Urban Service Area (MUSA) and is guided Low Density Residential and Existing Residential and zoned Urban Reserve. 4. Analysis Staff has reviewed the application for consistency with the Comprehensive Plan, Zoning Ordinance and City policies. The City Engineer’s comments are incorporated into this staff report. A. Level of City Discretion in Decision-Making The City’s discretion in approving or denying a lot line adjustment is limited to whether or not the lot consolidation meets the standards outlined in the Subdivision Ordinance. If it meets these standards, the City must approve the lot consolidation. The City has a relatively high level of discretion in approving or denying a variance application. The City has a higher level of discretion with a variance because the burden of proof is on the applicant to show that the variance standards have been met. B. Consistency with Ordinance Standards Lot Line Adjustment Section 926 of the Subdivision Ordinance allows lot line adjustments subject to the 10 conditions. The ordinance allows the lot line adjustment to be administratively approved if all of the following conditions are met: 1. The lot line adjustment shall be in compliance with the Comprehensive Plan and the purpose and intent of this Chapter. The lot line adjustment shall not cause any structure on the property to be made non- conforming or to be in violation of the Zoning Chapter or any other provisions of the City Code. The lot division shall be part of a previously recorded plat or Registered Land Survey. The lot line adjustment will result in the existing barn being on the smaller Tract B not the 47-acre Tract A. This will result in a larger accessory building on the lot than allowed by ordinance. This will require approval of a variance, which is discussed later in the staff report. The need for the variance means the lot line adjustment must be approved by the City Council rather than administratively. 4. The lot line adjustment shall result in lots that meet the minimum dimensional requirements for the zoning district in which the property is located, or shall not further increase the non-conformity of any lot dimension. The lot line adjustment will decrease the non-conformity of the Motley lot. The lot is currently non-conforming due to lot size. The Rural Residential zoning district has a 2- acre minimum lot size, but the existing Motley lot is only 1.09 acres and will increase to 1.67 acres. 5. All parcels resulting from the lot line adjustment shall have frontage and access on an existing improved street. Complies 6. The resulting parcels shall generally conform with the shape, character, and area of existing or anticipated land subdivisions in the surrounding areas. Complies 7. Complies Motley Lot Line Adjustment and Variance (city file 17-014) 4 August 24, 2017 Variance A variance is requested to allow an approximately 3,600 sq. ft. existing accessory structure to be located on a 1.67-acre lot, where the City Code would typically allow 1,400 square feet. The burden of proof is on the applicant to show that all of the following criteria have been met: 1. That there are practical difficulties in complying with the Zoning Ordinance. The applicant indicates that there are practical difficulties in complying with the Zoning Ordinance, because the original purchase agreement only allowed them to extend the north property line to the east and include the property and barn with their lot. In order to comply with the ordinance standards, the Motley’s would need to purchase an additional 8.5 +/- acres from the adjacent property. No change is proposed to the size or location of the existing building. 2. That the conditions upon which a petition for a variation is based are unique to the parcel of land for which the variance is sought and were not created by the landowner. This is a unique situation as the two property owners have anticipated this scenario since the Motley’s purchased their existing lot in 1996 and the appearance of the existing barn from adjacent properties and public street will not change. 3. That the granting of the variation will not alter the essential character of the locality. The granting of the variance will not alter the essential character of the locality. No change is proposed to the existing size or location of the barn, but a new door is proposed on the south so that the Motley’s can access the barn from their property rather than the adjacent property. The proposed variance would be in harmony with the general purposes and intent of the Ordinance. No change is proposed to the size or location of the barn. The variance results from the lot line adjustment that will reduce the non-conformity of the Motley lot, which is consistent with City policy to reduce or eliminate non-conformities. No commercial operation is permitted in the accessory building. 5. The variance is consistent with the Comprehensive Plan. The variance to allow the existing barn to remain is consistent with the Comprehensive Plan vision for the Rural Residential district. That the conditions upon which a petition for a variation is based are unique to the parcel of land for which the variance is sought and were not created by the landowner. This is a unique situation as the two property owners have anticipated this scenario since the Motley’s purchased their existing lot in 1996 and the appearance of the existing barn from adjacent properties and public street will not change. c. The granting of the variance will not alter the essential character of the locality. No change is proposed to the existing size or location of the barn, but a new door is proposed on the south so that the Motley’s can access the barn from their property rather than the adjacent property. Gmach is requesting approval of a preliminary to create three lots and one outlot. The existing farmstead is located on Lot 1 and new homes would be built on Lots 2 and 3. 2.Planning Commission Public Hearing The Planning Commission reviewed this items at a public hearing on August 3rd. Other than the applicant, there was no one present to speak on the item, but a letter in opposition was received and entered into the record. The Planning Commission voted unanimously to recommend approval of the request. 3.Context Background On March 23, 2014, the City reviewed a sketch plan for the subdivision and agreed to waive the wetland delineation on the farmstead if the Elm Creek Watershed Management Commission (ECWMC) agreed. The ECWMC agreed to waive the requirements for the existing parcel and provided a notice of decision stating that there are no wetlands on the two lots where development is proposed. Zoning and Land Use The property is guided Rural/Ag Residential and zoned Rural Residential. The surrounding properties to the east, south and west are guided and zoned the same, but the property to north across County Road 117 is located in the City of Rogers. Natural Resources There are several wetlands on site, but some of the wetlands on the farm have been impacted. Agenda Item 9b. Gmach Farm Subdivision (city file 17-017) 2 August 24, 2017 Parks and Trails The Parks and Trails Map from 2030 Comprehensive Plan shows a proposed County Bike Trail on Oakdale Drive. 4. Analysis Staff has reviewed the application for consistency with the Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance, and City Code requirements, as well as City policies. A. Level of City Discretion in Decision-Making The City’s discretion in approving a preliminary and final plat is limited to whether or not the proposed plat meets the standards outlined in the City’s subdivision ordinance and zoning ordinance. If it meets these standards, the City must approve the final plat. B. Consistency with Ordinance Standards Development Rights There 3 remaining development rights on this property. Two would be used to create Lots 2 and 3. One development right would remain with the farmstead. This was a problem with the recently approved Bass Lake Crossing and staff recommends that we revisit this issue as part of the next ordinance update. While the variance is not part of this application tonight, this property is unique and does create some practical difficulties for the landowner: • Lot 2. It is clear that Rush Creek Drive was intended to provide access to this property because the 60-foot wide right-of-way is stubbed to the property line and the road ends in a Gmach Farm Subdivision (city file 17-017) 3 August 24, 2017 “temporary cul de sac”. Howe ver, the nature of this type of street stub means that the lot cannot meet the minimum frontage requirements and a variance is required. • Lot 3. The curvature of the road (Oakdale Drive) creates a unique condition where the lot is 200 feet wide, but does not have 200 feet of frontage on Oakdale; therefore, a variance is required. • Outlot A. This parcel should be combined with the adjacent parcel to create a single conforming lot. The applicant indicates that the plat will be revised to include the property to the west with Outlot A. The Public Hearing notice for the Planning Commission meeting was for the Preliminary Plat only and did not include a variance. The variance will be considered at the September 7th Planning Commission meeting. he Council indicated support for the two variances as part of the sketch plan review and staff recommends approval of the preliminary plat with the condition that the applicant apply for and receive a variance for the lot width requirements for Lot 2 and 3 prior to release of the final plat for recording. We have also included a condition that that applicant revise the plat to include the property at 22600 Oakdale Drive in the plat. This property and the property shown as Outlot A will become a new Lot 4. The new lot 4 would conform with ordinance requirements. Staff spoke to the applicant and he will be applying for a variance and amending the final plat, both of which will be reviewed at the September meetings. Well and Septic The existing farmstead’s well and septic on proposed Lot 1, Block 1 will remain. New well and septic will be provided for Lot 2 and Lot 3 when the new homes are built. Streets No new streets are proposed. Lot 1 will continue to have driveway access onto County Road 117. Lot 2 will access off Rush Creek Drive. Lot 3 will have a new access onto Oakdale Drive. The city engineer has reviewed the sight lines and has identified an appropriate location for the new driveway in accordance with transportation standards. A driveway permit is required from the City prior to installation of the new driveways. Natural Characteristics of the Site There are trees on the farmstead and Outlot A. No tree removal is proposed. Wetlands A wetland delineation was approved by ECWMC. There are no wetlands on Lots 2 and 3. Drainage and Utility Easements Gmach Farm Subdivision (city file 17-017) 4 August 24, 2017 Section 945.060, Subd. 2 of the Subdivision Ordinance requires 10-foot drainage and utility easements around the perimeter of the lot. The plans comply with these requirements. Parks and Trails Staff notes that Section 955.020 of the Subdivision Ordinance requires park dedication for newly created lots. The subdivision will create two new buildable lots (Lots 2 and 3) that will have to pay park dedication fees. If Lot 1 is subdivided in the future, it would be responsible for park dedication fees for the new lot at that time. The Parks & Trails Plan in the 2030 Comprehensive Plan shows a future County Bike trail in the Oakdale right-of-way. The trail will be constructed in the right-of-way. No land beyond the required 50 foot ½ right-of-way is required for this future trail. Final Plat The applicant has also requested approval of a final plat. The final plat requires action by the City Council only. Variance As noted earlier in the staff report, the plat requires a variance from the lot width requirements, but the application and public notice did not include a variance. We have included conditions of approval making the preliminary plat approval contingent upon approval of the variances. Staff will work with the applicant to bring that back to the September 7th meeting for review. It could then be reviewed at the September 28th City Council meeting with the updated final plat. C. Conclusions Staff has reviewed the preliminary plat for consistency with the applicable standards outlined in the Comprehensive Plan, Zoning Ordinance and Subdivision Ordinance. Staff noted in the staff report the outstanding issues that must be addressed and have included conditions in the attached draft resolutions to address these issues. 5. We have reviewed the intersection sight distance on Oakdale Drive to determine if distance requirements are met. Oakdale Drive is a two-lane local roadway with a speed limit of 50 miles per hour. At the property location, the road curves and is signed with an advisory speed of 40 miles per hour. Information published by the American Association of State Highway and Transportation Officials (AASHTO) was used to determine the sight distance requirement. For vehicles entering onto Oakdale Drive from the north, the sight distance requirement is 480 feet to the east and 555 feet to the west. At the western edge of lot 3, the sight distance to the east is 600 feet and the sight distance to the west is 1,050 feet. Therefore, the sight distance in both directions meets the requirements at the western edge of lot 3. At the western edge of lot 2, the sight distance to the east is 400 feet and the sight distance to the west is 1,250 feet. Therefore, the sight distance to the east does not meet the requirement while the sight distance to the west does meet the requirement. Based on this analysis, access onto Oakdale Drive could be located at the western edge of lot 3. Access for lot 2 should be provided to Rush Creek Drive on the east side of the property. I write in opposition to the plan as submitted on a number of grounds. I obviously cannot fully speak to the variance review criteria at this time as the applicant and City Planner, both of whom are well experienced and versed in Corcoran planning requirements, conveniently neglected the variance process up to this point even though a variance had been discussed in March, 2017. However, based upon the current application, it is doubtful the applicant can satisfy the substantial burden of proof of the variance review criteria. I reserve further public comment on a variance for this preliminary and final plat, provided that this application is not ushered through as one might expect considering the applicant’s longstanding and current ties with the government of this city. The City Planner notes that Rush Creek Drive is to serve Lot 2, that the road “ends in a ‘temporary cul-de-sac,’” and “[i]t is clear that Rush Creek Drive was intended to provide access to this property.” I would be interested to learn what materials or information the City Planner relies upon to conclude that Rush Creek Drive was built with the intention of serving the property in this application, and not built simply as a road to serve a subdivision created in the mid 1970’s. The questionable foundation of this assumption notwithstanding, the addition of a parcel accessing Rush Creek Drive ultimately results in an additional parcel accessing Bechtold Road, a minor collector roadway. It could be argued that one additional parcel connecting to Bechtold Road is not likely to cause enough excess wear for concern. However, the fact remains that the proposed parcel access ultimately will create an increase of road traffic on a gravel road that has already seen a steady, significant increase in traffic over recent years resulting in the increased frequency of maintenance. Moreover, the subject of increased development traffic on gravel roads has been a valid concern addressed in other land use applications. The Preliminary and Final Plat are inconsistent with the character and nature of the surrounding area, and therefore, are inconsistent with the Comprehensive Plan. The current plan would put three houses (1 existing and 2 proposed) in close proximity to, and along, a span of less than 700 feet. The entirety of open space will be behind these residences and lots. The first Residential Land Use goal of the 2030 Comprehensive Plan is to “[e]nsure housing development is compatible with existing and adjacent land uses.” The first policy in accomplishing this goal is to, among other things, “[e]stablish development guidelines for appropriate amount of green spaces [and] viewshed analysis . . . throughout the community.” Further, “[t]he Rural/Ag Residential areas will continue to be defined by natural areas, such as wetlands and floodplains, and areas that are utilized for planted fields, pasture land, hobby farms, and large residential lots.” Lastly, the draft language to the 2030 Comprehensive Plan states: For residents of Corcoran, rural character is . . . seen as they drive through the area . . . [n]ew development must be respectful of this objective, and will be reviewed by the City with an expectation that developers will show how the objective is being met by their projects. In this regard, it is expected that development proposals will include ‘viewshed’ analysis that provides information on the views residents of the project will see, and how the project will affect the views of others. Where development is to be located in the rural/agricultural residential areas, the objective will concentrate on views of natural resource areas, existing woodlands, and vistas. Thus, the Preliminary and Final Plat as submitted are incompatible with the ratified and draft language, as well as the scope and intent of the Comprehensive Plan. Moreover, the proposed development is wholly and fundamentally inconsistent with “existing and adjacent land uses.” It can be argued that there are numerous lots of equal and smaller size of similar composition within the surrounding area and that this proposal is no different than what has already been accomplished. However, these areas of development are substantially buffered and are set back differently than the proposed plan. The proposed development will cause a significant negative impact to the characteristics of the surrounding area that will be far more conspicuous and detracting than the preexisting developments. The Planning Commission should not consider this application at this time without an approved variance and with amendments to the plats outstanding. Council Meeting: August 24, 2017 Prepared By: Brad Martens Topic: TIF Update Action Required: Direction Summary: On July 27th the City heard a presentation on tax increment financing (TIF) from Mike Fischer of LBH, Inc. Since that time, staff has followed up with Mr. Fischer as well as Tammy Omdal of Northland Securities who is our financial advisor. If the City would like to proceed towards creating a new TIF district the first step would be to hire a consultant to review the existing conditions of properties in the area of the proposed district for blight and sub-standard structures. If after the review it is found that sufficient conditions exist for a TIF district, the Council could pass a resolution with findings of facts which would preserve the authority of the City Council to create a district. While a TIF district could potentially help to spur development that may not otherwise happen, some negatives exist with moving forward with an assessment of existing properties and the creation of a district. Potential negative impacts include the following: • Existing property owners may not appreciate their property being labeled as blighted or sub-standard • There is likely very little benefit to existing property owners • Land costs could potentially increase if property owners now think their land is worth more with access to TIF; this potentially makes improvements more difficult financially • There is currently no existing project in mind to work towards The City Council should consider whether it wants to move forward with hiring a consultant to take the first step towards establishing a TIF district. It should be noted that TIF funds cannot be used for parks. Financial/Budget: In speaking with experts in the field of TIF it is believed that hiring a consultant to review existing conditions in advance of a possible TIF district will cost $20,000 - $25,000.
