Parks and Trails Commission Meeting Minutes April 18, 2017 - 7:00pm The Corcoran Parks and Trails Commission met on April 18, 2017, at City Hall in Corcoran, MN. Present were, Commissioners - Anderson, Meister, Nybo, Regan, and Student Commissioner Beck. Commissioner Strehler arrived at 7:10 pm. Also present were Seasonal Recreation Coordinator Bauer, and City Administrator Martens. Absent were Commissioners Krueger and Robran. 1. Call to Order / Roll Call Chairperson Anderson called the meeting to order at 7:00 pm. 2. Pledge of Allegiance Chairperson Anderson invited all in attendance to rise and join in the Pledge of Allegiance. 3. Agenda Approval a. Agenda Motion: Made by Meister, seconded by Nybo, to approve the agenda with the addition of 9b. Lease Agreement Update, 9c. Meister Field Project Update, and 9d. Roehlke Purchase Agreement Extension. Voting Aye: Anderson, Meister, Nybo, and Regan (Motion carried 4:0) 4. Minutes a. Minutes – February 21, 2017 Motion: Made by Nybo, seconded by Meister, to approve the minutes as presented. Voting Aye: Anderson, Meister, Nybo, and Regan (Motion carried 4:0) 5. Open Forum - None 6. Presentations - None 7. Unfinished Business a. Ravinia Neighborhood Park Concept Review City Administrator Martens presented the updated park concept based upon feedback of the commission at the February 21st meeting and outlined a schedule for moving forward with the project. Commissioners discussed costs, timing of amenities, concerns about safety with grading and landscaping only in 2017, schedule, and involvement of neighboring community. Motion: Made by Regan, seconded by Meister, to recommend the City Council move forward with the project to begin grading and landscaping work in 2017. Voting Aye: Anderson, Meister, Nybo, Regan, and Strehler (Motion carried 5:0) 8. New Business c. 2030 Comprehensive Plan Review City Administrator Martens updated the commission on the process for the update to the 2040 Comprehensive Plan. The commission was asked to begin considering whether trail gaps existed, if the trails proposed were the correct types of trails, and if parks should be added, removed, or moved. Commissioners discussed the existing plan and the need to be prepared to make recommendations at an upcoming meeting with the City Planner. 9. Reports/Information a. Active Planning Applications – Informational only, no action taken CITY OF CORCORAN Item 4a. b. Lease Agreement Update City Administrator Martens informed the commission that a lease agreement had been approved with the Rockford School District for use of the fields for 2017. The lease requires a $5,000 payment to the school district. Commissioners discussed the terms of the agreement and future plans for athletic space. c. Meister Field Improvement Project City Administrator Martens informed the commission that $40,000 has been secured for the $50,850 project. Staff will be requesting the remaining funds from the Corcoran Lions Club. d. Roehlke Purchase Agreement Extension City Administrator Martens informed the commission that the City Council reviewed a proposal to extend the purchase agreement on what is known as the Roehlke property for one year and that the Council tabled the decision to the April 27th meeting. Commissioners discussed the need for athletic space in the community and their support for the Roehlke property. Motion: Made by Regan, seconded by Nybo, to recommend the City Council extend the purchase agreement and keep the purchase of athletic space a priority for the community. Voting Aye: Anderson, Meister, Nybo, Regan, and Strehler (Motion carried 5:0) 10. Subcommittee and Miscellaneous Reports a. City Council Report Commissioner Regan provided an update from the March 23, 2017 meeting as the Parks and Trails Commission liaison. b. Garden Club Report Chair Anderson and Commissioner Meister provided an update on Garden Club activities including the tree giveaway on Saturday. Also mentioned was that the pollinator plot is in good condition. c. Park Dedication Fund City Administrator Martens informed the commission that the fund is approximately $506,000. 11. Other Business/Announcements Commissioner Meister provided an update on activities of the Elm Creek Watershed Management Commission including an upcoming manure management ordinance requirement. 12. Commissioner Liaison Calendar Commissioners reviewed the calendar. Commissioners Regan and Nybo switched meetings in July. 13. TO: Corcoran Parks and Trails Commission FROM: Mary Matze through Kendra Lindahl, Landform D ATE: May 10, 2017 for the May 16, 2017 Parks and Trails Commission Meeting RE: Comprehensive Plan Amendment, Rezoning, Preliminary Plat, and Preliminary PUD for “Bass Lake Crossing” a residential development at County Road 10 & Larkin Road (PID 25-119-23-13-0003, 25-119-23-13-0002 and 25-119-23-14-0002) (City File 17- 012) 1.Application Request MI Homes of Minneapolis, LLC has submitted a request for a Comprehensive Plan Amendment, Rezoning, Preliminary Plat, and Preliminary PUD for “Bass Lake Crossing” a residential development of 97 homes on a 51.26 acres. A public hearing at Planning Commission has been tentatively scheduled for June 1, 2017 and Council is expected to take action on the request on June 22, 2017. The Parks and Trails Commission should review and make a recommendation on the park dedication requirements. 2.Context Background City Council reviewed a sketch plan of the development on March 23, 2017. Zoning and Land Use The property is guided Mixed Residential and zoned RSF-3 (Single and Two Family Residential 3). The applicant is proposing to re-guide the property to low-density residential, which is consistent with the existing zoning and the Southeast District Plan. Surrounding Properties The surrounding properties are guided Mixed Residential to the east, west and south, and Low Density Residential to the north. The property to the east and west is zoned RSF-3 (Single and Two Family Residential 3); property to the north is zoned RSF-2 (Single Family Residential 2); property to the south is zoned UR (Urban Reserve). Agenda Item: 8a. Bass Lake Crossing CPA, RZ, PP and PUD (city file 17-012) 2 May 16, 2017 Natural Characteristics of the Site The 2030 Natural Resource Inventory identifies a High Quality Natural Maple Basswood Community in the Northeast Corner of the site. The Natural Resource Communities Quality Ranking map shows that there is a medium quality wetland in that same location. Parks and Trails The 2030 Comprehensive Plan shows a proposed on-road trail along County Road 10 and Larkin Road. An off-road trail is shown on the map just outside the eastern boundary of the property. The off-road trail appears to wind slightly into the property on the southeast corner and is shown crossing the third parcel where the development’s proposed access road is located. 3. Analysis of Request Section 955.020 of the Subdivision Ordinance requires park dedication at the time of platting for land that has not previously provided park dedication, pursuant to Minnesota Statutes 462.358, Subd. 2b. Sidewalks The applicant shows five-foot sidewalks on one side of the street in the proposed plans as required by ordinance. Parks and Trails Plan The Comprehensive Plan’s 2030 Parks & Trails Plan shows an on-road trail on County Road 10. Park dedication shall only be granted for trail easement areas as shown on the Comprehensive Plan and will not be given for trails located within public right-of-way. The plans show a 60-foot right-of- way dedication on along County Road 10. We believe this is sufficient right-of-way to include an on- road trail, but are awaiting Hennepin County review comments. The 2030 Parks & Trails Plan shows an off-road trail just outside the eastern boundary of the property. The off-road trail appears to wind slightly into the property on the southeast corner and is shown crossing the third parcel where the development’s proposed access road is located. No trails are shown on the plans; however, a sidewalk is shown on the access drive parcel generally in the location of the planned trail. The applicant should show how the trail could be located on the parcel where the road is proposed and how it could be extended through their property and the neighbor’s property as needed to get around the wetland. Trails shall be a minimum of 8 feet wide, unless located directly behind a curb, in which case they shall be a minimum of 10 feet wide. • Commissioners should discuss whether an easement for off-road trail along the southeastern boundary of the property and the property where road access is located would be appropriate or whether the trail should be located on the property to the east. The developer is required to provide finished grading and ground cover for trails within their developments. No credit toward the required dedication shall be given for this work. Trails shall be paved by the developer as well as part of the PUD. Bass Lake Crossing CPA, RZ, PP and PUD (city file 17-012) 3 May 16, 2017 Park Dedication Requirements Under the current ordinance, park dedication of land is required at 15% of the net pre-development area. If the City determines that land is not needed in the area of a proposed subdivision, a cash fee in lieu of land dedication may be required. For residential developments, the cash in lieu of land fee has been calculated based on the per capita share of park system costs at $3,970 per single family unit. The City should generally accept park dedication in the form of land where shown on the maps; however, the City may choose to accept cash or a combination of cash and land. The following table titled “Park Dedication Analysis” provides the estimated park dedication requirements of land and cash-in-lieu of land. Staff will require the applicant to provide the gross and net developable area to accurately calculate the park dedication. • The Parks and Trails Commission should provide a recommendation on whether the developer should provide a trail, land, cash in-lieu of land or some combination thereof to meet the park dedication requirements. When making this decision, the Parks and Trails Commission should consider the location of the proposed trails, parks, and natural resources identified in the Comprehensive Plan and the technical requirements for sizing when considering land dedication or cash in-lieu of land. 4. Recommendation Move to recommend approval of a combination of land dedication for the net developable area for the trail shown in the southeast corner of the site and a per unit cash-in-lieu of land fee. It is requested that the Commission discuss if they would like to take any action related to the attendance record. Staff has spoken with Commissioner Robran who has attendance difficulties due to coaching. The Planning Commission reviewed this item at a public hearing on April 6th and the City Council is expected to take action on April 27th. 2.2040 Corcoran Comprehensive Plan (City file 17-001). This year-long process was kicked off with a joint City Council/Commission work session on March 16th followed by a community open house on April 17th and a Parks and Trails Commission update on April 18th. The City Council will have a key issues work session on April 20th, followed by a key issues update at the Planning Commission on May 4th. The next public open house is scheduled for Night to Unite on August 1st. 3.City Code Amendments (city file 17-005). The City Council authorized staff to make several small and “clean up” ordinance amendments. A public hearing is scheduled for the May 4th Planning Commission meeting and Council action is expected at the May 25th meeting. 4.Special Home Occupation for Koru Massage and Bodywork at 6701 Pioneer Trail (PID 31-1119- 23-13-006) (City file 17-008). The applicant has applied for a special home occupation license. Staff is reviewing the application, which is expected to be administratively approved. 5.OS&P Sketch Plan review for “Pheasant Ridge” on County Road 117 (PID 03-119-23-13-0002) (City file 17-009). Chris Rains has submitted a request for sketch plan review of a 14-lot OS&P cluster development on Outlot A, Fehn Meadows. The Council is expected to review this item at their April 27th meeting. 6.Administrative Permit for a Press Box at Snyder Field at 202000 CR 50 (PID 23-119-23-43-0007) City File 17-010). An administrative site plan modification application was received for the addition of a press box at Snyder Field. Staff is processing this application for administrative approval. 7.Bass Lake Crossing Comprehensive Plan Amendment, Rezoning to PUD, Preliminary Plat and Preliminary PUD Development Plan for property at 19400 CR 10 (PID 25-119-23-13-0002 & 25- 119-23-13-0003) (City File 17-012). M/I Homes submitted the application on April 19, 2017 and staff is reviewing the application for completeness. If the application is complete, it will be scheduled for Parks Commission review on May 16th, a public hearing at the June 8th Planning Commission meeting and June 29th City Council action. Agenda Item 9a. MEMORANDUM 2 Also, there are several projects that have been approved, but are still not filed and closed out: 1. Corcoran Business Park (City file 06-005). The City Council granted a one-year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. Staff has spoken to the applicant and will schedule a meeting when more information is available on the Loretto sewer project. 2. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (City file 12-002). Hope Ministries submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. The letter of credit for site improvements has been released, but we are holding the escrow pending completion of the approved landscaping. The applicant has indicated that they are considering a site plan amendment application to modify the approved plans. Staff met again with Pastor Brian Lother in December to try to finalize this issue and address some other questions or concerns from him. We hope to be able to wrap this up in the near future. 3. Sawgrass Preliminary Plat, Preliminary PUD Development Plan and Rezoning for on Schendel property at 20400 County Road 10 (City file 14-027). The City Council approved the request on December 11, 2014 and granted the applicant 2 years to apply for the final plat and final PUD development plan. Peachtree Partners did not buy the property, but a different developer could still proceed with the approved plan. On December 9, 2016, the applicant submitted a written request to extend the approvals for an additional year. Staff recommended that this request be reviewed by the City Council, but adequate time was not provided to place this on a Council agenda prior to expiration. Staff administratively approved an extension until February 28, 2017 so that this request for extension could be considered at the February 23, 2017 Council meeting. At that meeting, the City Council approved a one year extension. 4. Commercial Door Addition at 7670 Commerce Street (City file 15-010) The City received an application for approval of a building addition, which required a conditional use permit, interim use permit, variance and site plan approval. The project was reviewed at a public hearing at the June 4th Planning Commission meeting and was approved by the City Council on June 25th. The required landscaping will be finalized and constructed after the downtown infrastructure project is completed. The City will release the remaining escrow when the planting is completed. 5. “Strehler Estates” Final Plat (PID 17-119-23-32-0004) (city file no. 16-001). The applicant submitted a request for approval of a preliminary plat to create 4 lots and an ordinance amendment to allow a private drive for property at 22900 Strehler Road. The City Council approved both items on October 8th. The final plat was approved by the City Council at the January 28th meeting. A stop work order was issued as the developer began construction of the private drive in advance of filing the plat. The applicant is working to address the conditions of approval and then will record the final plat at Hennepin County. 6. Private Drive Ordinance Amendment (City file 16-003). The City Council approved an ordinance amendment allowing private drives in the Rural Residential district, subject to certain conditions. However, after adoption the City Council directed staff to revisit this issue and consider an ordinance amendment to eliminate the requirement that private drives off paved roads must be paved. The City Council approved the amendment on May 26th. The Council also identified additional issues that should be reviewed and discussed at a future date. 7. IUP for Commercial Kennel for Daniel Benjamin at 19520 Stieg Road (City File 16-020). Daniel Benjamin has submitted an application for an IUP for a commercial kennel. The kennel would be located on his property, would be owned and operated by him and would have employees. The Planning Commission recommended approval after the public hearing at the August 4th Planning Commission and the request was approved by the City Council on August 25th. The applicant is working to address the conditions of approval and will then apply for a building permit. 8. Park Place Storage request for Rezoning, Variance, Conditional Use Permit, Site Plan and Preliminary Plat (City file 16-002). The City Council reviewed a sketch plan last year for expansion of the existing mini-storage facility. The applicant has submitted the application, but is working to provide MEMORANDUM 3 additional information for completeness. The Planning Commission reviewed this item at a public hearing on September 1st and voted to recommend approval. The City Council approved the request on September 22nd. The applicant has submitted a building permit, but has not yet begun work. 9. Interim Use Permit for a solar farm at 23710 State Highway 55. (PID 31-119-23-32-0001) (City File 16-032). The City recently amended the Zoning Ordinance to allow solar farms in certain districts. The landowners have requested approval for this site. The Planning Commission recommended approval after the public hearing on December 1st and City Council approved the request on December 19th. The applicant is currently working to address the conditions of approval. The applicant has submitted a request that the Council consider revising the financial guarantee requirements. On March 9th, the Council reaffirmed the conditions of the original approval. 10. Motor Café Conditional Use Permits and Site Plan at 23030 Highway 55 (PID 32-119-23-33-0009) (City File 16-033). The applicant is requesting approval of a Site Plan and Conditional Use Permits for Auto Sales/Repair and to allow more than 20% metal siding. The existing business was a non- conforming use that burned on May 24, 2016. The non-conforming status was lost and the code requires the building to be restored in conformity with the regulations of this Ordinance. The City Council approved the request at their January 26th City Council meeting. 11. Industrial Lot Standards. Staff received a request from the property owner at 19905 75th Avenue to consider changes to the minimum lot size standards in the Industrial zoning districts. Staff prepared a summary of the issues for City Council consideration at the August 25th meeting. The Maxfield Research study was presented to the City Council at their last meeting. 12. Lennar Final Plat, and PUD Final Development Plan for “Ravinia 8th Addition” (the Schwalbe property) (PID 36-119-23-14-0001) (city file 17-002). Lennar has submitted the application for approval. Staff is reviewing the application for completeness. The Planning Commission reviewed this item on March 2nd and the City Council approved the request at their March 23rd City Council meeting. 13. Sunrise Solar IUP and Preliminary Plat for a Community Solar Garden on the Pouliot property on County Road 19 (PID 30-119-23-44-0003 and 29-119-23-33-0001) (city file 17-003). This application has been withdrawn. Staff is working to close out the file. 14. Gmach Sketch Plan at 22525 County Road 117 (PID 05-119-23-13-0002) (city file 17-004). George Gmach has submitted a sketch plan for a small subdivision with variances from the minimum lot width requirements. This item was reviewed at the March 23rd City Council meeting. 15. Bass Lake Crossing Sketch Plan for property at 19400 CR 10 (PID 25-119-23-13-0002 & 25-119- 23-13-0003) (City File 17-006). M/I Homes submitted a sketch plan for consideration at the March 23rd City Council meeting. The Council provided feedback. 16. A full recap can be found by reviewing the approved City Council minutes on the website April 27, 2017 Council Meeting • Katie Rodriguez – Metropolitan Councilmember o Councilmember Rodriguez provided an overview of Metropolitan Council activities and answered questions from the City Council • Open Book Meeting Report o Council reviewed information related to the Open Book meeting that was held on April 13th • Interim Use Permit for a Conditional Home Occupation License for an Upholstery Business (Designers Choice Upholstery) Located at 20125 County Road 117(PID 02-119-23-12-0005) (City File 16-013) o Approved the conditional home occupation license as presented • Pheasant Ridge OSP Sketch Plan Application for the Property Located on County Road 117 (PID 03-119-23-13-0002) (City File 17-005) o Provided feedback on the concept to develop 14 lots on the property; next step would be for the applicant to apply for preliminary plat approval • Extension to Roehlke Purchase Agreement o Directed staff to coordinate an amendment to the purchase agreement to extend the term for when purchase can take place 10a. • Action Steps to Retain and Attract Business o Provided staff direction on items of interest to retain and attract business; staff will develop work plan for future review; approved up to $500 for staff to receive assistance in understanding whether a TIF district could be created in the downtown area • Action Steps to Increase Communication o Provided staff direction on items of interest to retain and attract business; staff will develop work plan for future review • Labor Agreement Negotiation Process o Appointed Councilmembers LaFave and Dejewski to assist in negotiating a new labor agreement between the City of Corcoran and Minnesota Teamsters Public and Law Enforcement Employee’s Union Local NO. 320 • 2017 Road Stabilization Program o Approved the resolution calling for a public hearing at the May 25th meeting • Ravinia Neighborhood Park – Grading and Landscaping o Authorized staff to coordinate grading and landscaping work with Lennar and to obtain quotes for costs under the responsibility of the City • Awarding Gravel Hauling Contract o Approved a quote from Equipment Transport Sand & Gravel Inc. for gravel hauling • Closed Session – Attorney Client Privilege o Held a closed session in regards to the floor settling issue at the Public Works facility; approved a resolution approving the terms of a settlement agreement including a $41,500 payment to the City of Corcoran May 11, 2017 Council Meeting The following is a list of some items on the agenda for the May 11th meeting.
