RESOLUTION NO. 2016 -42

RESOLUTION ORDERING IMPROVEMENT OF DUST CONTROL TREATMENTS TO BE
APPLIED TO CITY STREETS IN 2016
WHEREAS, Resolution 2016 -35 of the City Council adopted the April 28th, 2016, which fixed a
date for a public hearing on the proposed improvement of dust control treatments to be applied
to streets throughout the City as outlined in Exhibit A; and
WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was given,
and the hearing was held thereon on the 26th day of May, 2016, at which all persons desiring to
be heard were given an opportunity to be heard thereon; and
WHEREAS, the City Council received a report from the City Administrator at the hearing
indicating that the project is necessary, cost - effective, and feasible, and will be best
accomplished as proposed, and informing the City Council of the estimated cost of the proposed
treatments; and
WHEREAS, the City Administrator prepared an estimate of the total charges to the affected land
owners, as well as a method for calculating costs to individual land owners, which was available
at the hearing.
NOW, THEREFORE, BE IT RESOLVED by the Corcoran City Council:
1. The Corcoran City Council determined the improvement of the application dust control
treatments necessary, cost - effective, and feasible.
2. The City Council received and accepted a petition from residents on Lily Pond Lane of
more than 50% of the residents requesting removal and has removed the Lily Pond Lane
from the project
3. The Clerk shall remove Fox Valley Drive or any other cul -de -sac from the improvement
project if a petition asking for removal is received by the Clerk no later than June 3, 2016
with more than 50% of the properties requesting removal.
4. Such improvements are hereby ordered as proposed in the council resolution adopted
28th day of April, 2016.
