AMENDING RESOLUTION 2015 -68 APPROVING VACATION OF THE REMAINING
PORTION OF THE UNIMPROVED EAST COMMERCE STREET LYING NORTH OF 75TH
AVENUE AND THE ADJACENT DRAINAGE AND UTILITY EASEMENTS WITHIN THE
"COUTRYSIDE PLAZA 2ND ADDITION" (CITY FILE NO. 12 -022)
WHEREAS, Resolution 2015 -68 was approved at the December 21, 2015 City Council meeting
and requires amendment of the legal description further described below;
WHEREAS, a petition signed by the three property owners abutting the unimproved portion of
East Commerce Street lying north of 751h Avenue was received by the City Clerk on the 711 of
December 2015; and
WHEREAS, the City Clerk review and examined the signatures on said petition and determined
that such signatures constituted all of the landowners abutting upon the (portion of) street to be
vacated; and
WHEREAS, the petition requested that the City Council pursuant to Minnesota Statute §412.851
and §440.13 vacate a portion of East Commerce Street legally described as follows:
That portion of unimproved East Commerce Street lying north of 75'h Avenue as shown
in the plat of Countryside Plaza 2nd Addition, Hennepin County, Minnesota
WHEREAS, the petition also requested vacation of the existing easements legally described as
follows:
The 10 -foot drainage and utility easement on the east side of the unimproved portion of
East Commerce Street lying north of 75th Avenue,
And
The 10 -foot drainage and utility easement on the west side of the unimproved portion of
East Commerce Street lying north of 75th Avenue,
WHEREAS, the Corcoran City Council considered this item at a duly called Public Hearing; and
WHEREAS, the City find that the existing street right -of -way and drainage and utility easements
are no longer required; and
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA:

1. That the portion of unimproved East Commerce Street lying north of 75th Avenue as
shown in the plat of Countryside Plaza 2nd Addition, Hennepin County, Minnesota is hereby
vacated.
2. That the 10 -foot drainage and utility easement on the east side of the unimproved
portion of East Commerce Street lying north of 751 Avenue as shown in the plat of
Countryside Plaza 2 1d Addition, Hennepin County, Minnesota, is hereby vacated.
3. That the 10 -foot drainage and utility easement on the west side of the unimproved
portion of East Commerce Street lying north of 751h Avenue as shown in the plat of
Countryside Plaza 2nd Addition, Hennepin County, Minnesota, is hereby vacated.
4. That applicant must record the resolution approving the before - mentioned vacations at
Hennepin County and provide the City of Corcoran with proof of recording.
