HomeMy WebLinkAbout2015-09-03 - Planning Commission MinutesCITY OF CORCORAN PLANNING COMMISSION MEETING MINUTES 7:00 PM - THURSDAY, SEPTEMBER 3, 2015 The Corcoran Planning Commission met on September 3, 2015, at City Hall in Corcoran, Minnesota. Present were: Chair Jacobs, Vice -chair Ravnholdt, and Commissioner Schultz. Commissioner Theis arrived at 7:03pm. Absent: Commissioner Wu Also present were: Administrator Martens, City Planner Lindahl, and Code Compliance Official Pritchard. 1. Call to Order Chair Jacobs called the meeting to order at 7:00pm 2. Pledge of Allegiance 3. Open Forum — None 4. Approval of: a. Agenda Motion made by Schultz seconded by Ravnholdt to approve the agenda as presented. Voting Aye: Jacobs, Ravnholdt, and Schultz. (Motion carried 3:0) b. July 7, 2015 Planning Commission Minutes Motion made by Ravnholdt seconded by Theis to approve the minutes as presented. Voting Aye: Jacobs, Ravnholdt, Theis, and Schultz. (Motion carried 4:0) 5. New Business a. PUBLIC HEARING. Preliminary Plat and Ordinance Amendment for " Strehler Estates" for property at 22900 Strehler Road (PID 17- 119- 23 -32- 0004) (city file no. 15 -017) b. Staff Report — City Planner Lindahl presented her staff report. ii. Open Public Hearing — Chair Jacobs opened the public hearing. (7 :16pm) iii. Public Comment — Scott Dahlke, Applicant Representative, stated that the odd shape of the lot is what drove this division's lot sizes and shapes and that lot 3 lot lines could be adjusted to meet the minimum lot width requirements as was pointed out in the staff report. Mr. Dahlke stated a shared private drive is necessary in this division. He also stated that a Home Owners Association (HOA) would cover future maintenance and funding for the driveway. Mr. Dahlke clarified that the shared driveway would be approximately 1,250' long and 22' wide with ditches on either side and located within a 60' easement. Lot 4 would then have a private driveway up to 1,000' long depending on the location of the home. Mr. Dahlke clarified that the HOA would contract services for plowing, maintenance, and repair of the shared driveway and that the HOA is collectively responsible for the driveway. He shared that the neighboring property owner to the East of the proposed subdivision was not interested in joining in the shared driveway. Ray Ehrlich, 23105 Larsen Rd, asked if other locations were reviewed for the shared driveway. Mr. Dahlke stated that the location was chosen due to soils, topography, and lot configuration, as well as drainage. Drainage for the driveway would follow the ditches both to the south to Strehler Rd and to the north and then west to a stormwater pond. Greg Franzen, 23020 Strehler Rd, shared concerns that the proposed pond may have a negative impact on his property. He also shared concerns that allowing private shared driveways would create a lack of interconnectivity in the future. iv. Close Hearing Motion made by Ravnholdt seconded by Theis to close the public hearing. Voting Aye: Jacobs, Ravnholdt, Theis, and Schultz. (Motion carried 4:0) (7:37pm) V. Commission Discussion & Recommendation — The Commission asked if the ordinance amendment were approved, if there would be basis for denial of a private drive for future proposals. Staff stated that there are many requirements and that a private shared driveway would still require Council approval. Staff stated that if the City required dedicated right of way (ROW) that it would be making assumptions for future expansion and connections that may never happen and that whether there was a private drive or a City street, it would not likely affect future development of the immediate area. Commission shared concerns with future maintenance of the private drive. Staff stated that the City would review the Development Contract for HOA documents and ensure that the necessary tools were in place to fund driveway maintenance. The City would require all properties to be part of the HOA and that the HOA would have lien rights for non - payment. The Commission inquired if the property owners could petition for the City to take the driveway as a public street. Staff stated that the driveway as it is proposed would not meet City standards. The Commission discussed requiring cul de sacs for all private drives, but determined that it would not make sense for short drives. Staff stated that a maximum '/4 mile private drive was typical but that Council was open to up to a '/2 mile. The Commission discussed the park dedication policy. They asked why the City chose money over land. Staff stated that this was previous Council policy, but they could recommend different. The Commission concluded that they would recommend taking land and cash for park dedication. Motion made by Ravnholdt seconded by Schultz to recommend approval of the ordinance amendment as presented Voting Aye: Jacobs, Ravnholdt, Theis, and Schultz. (Motion carried 4 :0) Motion made by Schultz seconded by Ravnholdt to recommend approval of the findings of fact. Voting Aye: Jacobs, Ravnholdt, Theis, and Schultz. (Motion carried 4 :0) Motion made by Ravnholdt seconded by Schultz to recommend approval of the preliminary plat resolution with an amendment to item 7i. to take land and cash from park dedication. Voting Aye: Jacobs, Ravnholdt, Theis, and Schultz. (Motion carried 4:0) b. PUBLIC HEARING. Preliminary Plat for "Fehn Meadows" at 20909 County Road Number 117 (PID # 03- 119 -23 -12 -0002 and PID 03- 119 -23 -13 -0001) (city file no. 15-018) Staff Report — City Planner Lindahl presented her staff report. ii. Open Public Hearing — Chair Jacobs opened the public hearing. (8:35pm) iii. Public Comment — None iv. Close Hearing Motion made by Theis seconded by Ravnholdt to close the public hearing. Voting Aye: Jacobs, Ravnholdt, Theis, and Schultz. (Motion carried 4:0) (8:35pm) V. Commission Discussion & Recommendation — The commission asked why the City was not requiring more county ROW dedication. Staff stated that past practice was to not require dedication if no new construction was proposed. Staff clarified the requirement that the applicant show an access agreement or move the driveway for the accessory structure. Motion made by Theist seconded by Schultz to recommend approval of the preliminary plat resolution as presented Voting Aye: Jacobs, Ravnholdt, Theis, and Schultz. (Motion carried 4:0) 6. Reports: a.
