City Planner Lindahl reviewed the preliminary plat process for this property with the commissioners and recommends approval. no 2. Applicant had questions about the 100 year floodplain and drainage easement issues. Planner Lindahl indicated all the floodplain appears to be in the wetland. 3. Chair Hank inquired about the driveway and possible need for an easement. City Planner Lindahl suggested staff seek an opinion from the city attorney. Mayor Guenthner suggested recording on the deed reservation of the easement. 4. 7:20 Open Public Hearing — No public comment Motion by Jacobs second by Krueger to close the public hearing. Planner Lindahl suggest moving the regularly scheduled Thursday July 5, 2012 meeting to Tuesday July 10, 2012. By consensus the commissioners agreed to move the July 5, 2012 meeting to July 10, 2012. 9. Reports • Liaison Report (Guenther) • The plans and specs for the base sewer and water project have been approved. Easement negotiations continue along with conversation with Met Council regarding the lift station. A meeting will be held May 4, 2012 with Downtown business owners to discuss a potential sewer and water project downtown. • City has signed a purchase agreement for Roehlke property at Co Rd 19 and Co Rd 10. The agreement allows for a purchase of 10 acres now and options for additional acres at 5 year and 7 year marks. • City engineer is analyzing paving projects for Trail Haven Rd., Foxline Dr. and Treeline Dr. • The Hwy 55 overlay project has begun in Rockford and will continue West to East. Application Request The applicant has requested approval of a conditional home occupation license (CHOL) to allow operation of his auto repair business in a detached accessory building at 6334 Rolling Hills Road. This request is the result of a Code Enforcement action where the City was notified that the owner was operating the business without the required City permits. CHOLs are processed as an interim use permit (IUP) according to Section 1030.100 of the Zoning Ordinance. 2. Context Zoning and Land Use The subject property is guided Existing Residential on the 2030 Future Land Use Plan and is zoned Urban Reserve. The surrounding properties are guided Existing Residential on the 2030 Future Land Use Plan and zoned Urban Reserve. Natural Characteristics of the Site There are no trees or significant natural resources that would be impacted by this request. 3. Analysis of Request Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and City Code requirements, as well as City policies. A. Level of City Discretion in Decision - Making The City's discretion in approving or denying a CHOL is limited to whether or not the proposed request meets the standards outlined in the City Code. Consistency with Ordinance Standards Conditional Home Occupation License Section 1030.100 of the Zoning Ordinance establishes the standards for home occupations. There are three classifications of home occupation under the ordinance: allowed, special and conditional. Allowed Home Occupations must comply with general standards in Subd. 4 of this Section and the following standards in Subd. 5: 1. The Allowed Home Occupation shall be located within the principal dwelling on the property, except that a business office or computer workstation may be maintained in any permitted structure. 2. No customer visits to the premises shall be permitted. 3. No deliveries other than those routinely made in a residential district (U.S. Mail, United Parcel Service, etc.) shall be permitted. A Special Home Occupation must comply with all conditions for an Allowed Home Occupation, but may be administratively approved to allow the following: 1. Services may be provided to customers on site provided no more than 2 additional parking stalls are necessary for customer parking and the spaces shall be provided on the lot. The Home Occupation shall not add more than 10 daily, non - residential vehicle trips to or from the property. 2. A single vehicle up to 26,000 lb. GVW may be allowed by Administrative Permit. The City Administrator shall consider the vehicle size in relation to the intended use, the road surface, the character of the neighborhood, number of vehicle trips and any other relevant matters in deciding whether to issue an Administrative Permit. Any proposed home occupation that does not meet the standards of the Allowed or Special Home Occupation requires a Conditional Home Occupation License. In this case, the Conditional Home Occupation is required because the home occupation will take place in a detached accessory building. A CHOL is processed as an interim use permit because it is a license personal to the individual applicant and the particular business for which the application is made. If the business ceases, if ownership of the business changes, or if the individual to whom a license has been issued ceases to own the subject premises, the CHOL is automatically revoked. The city must review the CHOL request for compliance with the conditions in Section 1030.100, Subd. 7 of the ordinance. Specifically: 1. The nature and general character of the geographic area in which the CHOL property is located. The City may consider, in addition to other factors and not by way of limitation, the Schmid CHOL (12 -009) June 7, 2012 • 9 0 EP • i existence and condition of gravel and paved roads in the area, existence and proximity of collector, County and State roadways in the area, CHOL lot area, the proximity of CHOL operations to neighboring residences, size of neighboring lots, and use of neighboring properties. The business currently operates in a detached accessory building in the north central portion of the 4.47 -acre lot. The accessory building is not visible from the public street. This accessory building appears to be a legal non - conforming structure as it currently extends over the north property line. The accessory building is located behind the home and is accessed via a gravel driveway off Rolling Hills Road. When staff visited the site, there was no outside storage related to auto repair and the area was neat and orderly. Staff also reviewed city files for other home occupations in the vicinity and found two nearby home occupations: • In 2002, the City approved a special home occupation for James Wiley for a construction business at 6805 Rolling Hills Road. • In 2004, the City approved a CHOL for Greg Gunderson for Auto Repair at 6300 Horseshoe Bend. 2. Consideration shall be made for potential property devaluation of adjacent and surrounding properties. Provided that the business operates inside the accessory building and there is no outside storage of vehicles or materials, staff finds that there is limited potential for property devaluation. 3. Nuisance factors shall be considered, including but not limited to sight, odor, light, glare and noise, and any other nuisance factors that may result from issuance of the CHOL. This type of business can have noise impacts, but the applicant has indicated that the accessory building doors remain closed during repairs. If the doors on this insulated accessory building remain closed during repairs, there should be little impact to surround properties. 4. Environmental concerns, including but not limited to drainage, wastewater, wells and wetland issues. The Building Official has raised several concerns that must be addressed by the applicant. Staff has included these as conditions of approval in the draft resolution, specifically: • The commercial operation should have a restroom for customers • The commercial building must be handicapped accessible • Floor drains are not permitted unless a flammable waste trap and an approved storage tank are provided • Fire extinguishers are required and yearly maintenance is required • The building floor plans must be provided to verify exit doors with a minimum with of 36" Schmid CHOL (12 -009) June 7, 2012 • a • • • Given the limited number of customers who would visit this site, staff questions whether or not a customer restroom should be required as a condition of approval. The Planning Commission may wish to discuss this item and make a recommendation. 5. Compliance with Section 1030.020 (Accessory Buildings, Structures, Uses and Equipment) of the Zoning Ordinance and with other relevant Code sections. The existing accessory building appears to be a non - conforming structure due to setbacks. The building extends over the north property line. Staff reviewed this issue with the city attorney and he opines that the location of the non - conforming structure should have no impact on the CHOL review. 6. Impact on the neighboring properties shall be considered before issuing a CHOL. This business has been operating on this site without the required permit for 2 -3 years. The City has not received any complaints about this property regarding the operation of the business. Staff has not received any complaints about the similar auto repair businesses in the area either. We speculate that the parcels in this area are large enough to provide some transition between the adjacent homes and the home occupation and that the business owner has a limited amount of business that is conducted in the accessory building. 4. Conclusions Staff finds that the standards for a Conditional Home Occupation License have been met. The proposed auto repair business has a limited impact on the neighborhood provided it continues to operate in the detached accessory building without outside storage. The ordinance requires that all licenses issued under this Ordinance shall be reviewed by the City every 3 years from the date of issuance for a determination that the existing Home Occupation, considered in light of the existing standards and criteria, still warrants the issuance of a license. The City may revoke or modify a CHOL upon a finding that conditions have changed to warrant revocation or modification of the license. 5. Recommendation Staff recommends that the Planning Commission recommend approval of the draft resolution approving the Interim Use Permit for the Conditional Home Occupation License. Attachments 1. The proposed use will be screened from the public street and the auto repair will be conducted inside the building. There will be minimal impact on neighboring property owners because the building will be constructed in compliance with the ordinance requirements, there will be no outside storage of materials. b. The detached accessory building is a non - conforming building. Approval of the CHOL would have no impact on the non - conforming building status related to setbacks. There is nothing to indicate that the proposed use would devalue adjacent and surrounding properties. c. The auto repair equipment would be located inside the building and would not generate noise beyond state standards. A building inspection must be completed by the City prior to beginning operation of the Home Occupation in the detached accessory building to ensure compliance with all City building code requirements. 9. The Conditional Home Occupation License shall be issued for 3 years in accordance with the procedures outlined in Section 1030.100 of the Zoning Ordinance. The permit shall be administratively reviewed every 3 years to ensure compliance with conditions of approval and ordinance requirements. 10. The City may revoke or modify the CHOL upon a finding that conditions have changed to warrant revocation or modifications of the license. Automobile repair services are not an allowed home occupation business except with a Conditional Use Permit. This is considered a Home Occupation and covered by Section 1030.100 of the City Code. I have included information on Home Occupations in the City of Corcoran. I have also verified that your property on Rolling Hills Road appears to have no visible signs from the public right of way of an automotive service business. However, I did view a Web Page (schmidysmotorcity.com) that indicated that an automotive repair service was operating at 6334 Rolling Hills Road. I have attached to this letter information about the city's Home Occupation Permit Process. There are three levels of home occupations. An automobile repair business is considered a Conditional Home Occupation. The fee to procure a Conditional Home Occupation is a filing fee of $550 and an Escrow of $2,000 (refundable if not used). I am an ASE certified Master Technician and have been working as a full time auto mechanic at various auto shops for the past 30 years. I have lived at the above address in Corcoran since 2001. i) I have helped friends and family with their automobiles over the years. Since losing my full time job due to the economy in 2009 I have not been able to find a satisfactory full time opportunity. I have found work as a tech on a part time subcontractor basis at a couple of shops but have been supplementing my income by doing more work at home, To comply with current regulations I have available for your inspection all the required paperwork and insurance information. I have made no effort to advertise this business except that a friend set up a website for me at schmidysmotorcity.com. and printed a number of business cards. The scope of work I do includes general automotive repair, and diagnostics, especially electrical issues ii) The only noise that is generated is from the Impact wrench and the noise is contained inside the insulated pole building. With the doors shut. No one has ever complained about noise to me nor the city. There are no issues with odor or light emanating from the barn. iii) To the best of my knowledge this business generates no environmental concerns. I am proud to run the cleanest shop you will find and invite anyone to inspect the operation at any time. I have been told that I am a compulsive organization freak. I think I just like things in order. Who would want to work in a mess? iv) The work is all done inside the 900 square foot pole barn located northeast of the house behind the hill. The barn cannot be seen from the front of the property. Occasionally a car will sit outside the barn waiting to be worked on or picked up. These cars are not visible from the road. v) This business does not require any special equipment other than the standard auto repair tools, etc. vi) There is no outside storage of anything business related. vii) The business does use motor oil and the MSDS is required. A copy has been included for you. Used oil is delivered to a recycler. Oil changes are a very minor part, usaly performed with other duties. viii) An occasional delivery of parts does occur, normally from NAPA in Corcoran. If construction is not commenced within these time periods, any building permits issued for the PUD shall be void and the Planning Commission may initiate proceeding to rezone the subject property. The one year period ended on August 27, 2010. Staff visited the site on November 1s' and noted that while some improvements have taken place, including permits along CR 101, the outside storage of vehicles was not initiated within the one year period and the approvals have expired for that portion of the project. Administrative approval was sent out on April 26, 2012 and staff will begin closing out the file. An administrative permit for a meter station was approved and is under construction. The city will retain the escrow account until the project is completed to ensure that the project is completed according to the plans. The majority of the improvements and conditions of approval have been met. However, the landscaping has not yet been installed. Northern Natural Gas indicates that there are still connections that need to be made on site and landscaping cannot be installed until completed. City staff was notified that the landscaping was installed on site and conducted an inspection June 3, 2011. The landscaping and all other improvements were installed per City requirements. Staff will begin the project closeout process. 5. Satellite Industries Site Plan Amendment, Conditional Use Permit Amendment, Lot Consolidation and Easement Vacation (city file 10 -007). On September 23rd the City Council approved Resolutions 2010 -37, 2010 -38 and 2010 -39 approving the request with a number of conditions. The applicant has addressed those conditions and has submitted a building permit application and has begun site work. Staff inspected the site on October 12th and found that the major site improvements had been made, but there are several items that still have to be addressed. We have discussed these items with the landowner. The city has a financial guarantee in place to ensure completion. 6. Park Place Storage After - the -Fact Extension of Approvals (city file no. 10 -008). On September 23, 2010, the City Council approved a site plan and conditional use permit amendment for Park Place Storage to construct the 18th and final mini - storage building on that site. The approvals expired on September 23, 2011. The applicant contacted the City and requested a one year extension until September 23, 2012. The request was approved by the City Council on January 26, 2012. 7. Corcoran Wildlife Preserve (city file 10 -009). Preliminary plat (city file 06 -004) was approved on September 27, 2007 (Res. 2007 -72) with 8 findings and conditions. On September 23, 2010, the city council approved Resolution 2010 -40 approving the final plat. The applicant has 2 years to address all conditions of approval and record the final plat. The final plat approvals will expire on September 23, 2012 unless the applicant requests and is granted an extension. 8. Rocks N Blocks Site Plan Amendment and Conditional Use Permit (city file no. 10 -012). An application was received for a Conditional Use Permit and Site Plan Amendment to continue operation of a business with outside storage at 20010 75th Avenue North. The application was approved by the City Council on June 23rd. This was approved as a way to correct a code enforcement issue. No work has been done on site to correct the code violations. The City Administrator sent a letter to the applicant on October 14th regarding the required code violation corrections. 3. Shamrock Golf Course Site Plan Amendment at 19625 Larkin Road (city file no. 11 -014). Mark Deziel has submitted an application for a site plan amendment for Shamrock Golf Course for a small storage building in the southern portion of the site. The application has been approved. 4. Patnode Agricultural Preserve Designation and Initiation of Expiration (PID 20- 119 -23 -31 -0003) (city file 12 -004). Daniel and Cynthia Patnode have submitted a request to renew the agricultural preserve designation on this 79 -acre parcel, which expired on March 12, 2012. They are requesting approval of the designation and the notice initiating expiration which would result in removal of the land from Agricultural Preserve 8 years after initiation (in 2020). This application was approved at the April 26, 2012 Council meeting. 5. Patnode Agricultural Preserve Designation and Initiation of Expiration (PID 29- 119 -23 -12 -0006) (city file 12 -005). James and Beverly Patnode have submitted a request to renew the agricultural preserve designation on this 55.65 -acre parcel, which expired on March 12, 2012. They are requesting approval of the designation and the notice initiating expiration which would result in removal of the land from Agricultural Preserve 8 years after initiation (in 2020). This application was approved at the April 26, 2012 Council meeting. 9. Daryl and Lori Patnode Accessory Building Contract /Certificate of Compliance (city file no. 11- 006). The Patnodes requested that the City allow them to construct an addition onto an existing barn without approval of a CUP or Certificate of Compliance due the close of the construction season and need for the barn addition. The City agreed to allow the Patnodes to begin construction on the barn with the condition that they submit a Certificate of Compliance for City approval upon adoption of the MEMORANDUM 2 new Zoning Ordinance that will create the new process. This has been completed and staff will close out the file. 10. Custom Filtration Inc. Preliminary and Final Plat (city file no. 11 -008). The city received an application to combine the existing Custom Filtration lot with the outlot to the west. The request was approved by the City Council on December 19th. The applicant is working through finance and other issues and intends to file the plat later this year. 11. Highland Bank Preliminary and Final Plat approval for "Highland Subdivision" at 10435 CR 19 (city file no. 11 -010). On November 21St Highland Bank received City Council approval of a preliminary and final plat to subdivide the existing 60.56 -acre parcel into one 5 -acre lot with the existing home and one 54.19 -acre outlot. The mylar has been released to the applicant for filing. 12. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (city file 12 -002). Hope Ministries has submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. 6. Richard Dempsey Agricultural Preserve Designation and Initiation of Expiration (city file 12- 003). Richard Dempsey has submitted a request to renew his agricultural preserve designation that expired on February 12, 2012. He is requesting approval of the designation and the notice initiating expiration which would result in removal of the land from Agricultural Preserve 8 years after initiation (in 2020). This was approved by the City Council on March 22nd and was sent to the applicant for recording. 7. Duane Patnode Certificate of Compliance (City file 12 -007). The certificate of compliance for an agricultural building in excess of the standard size limitations and with metal roof and siding was administratively approved on April 4, 2012. 8. Ben Heitke Certificate of Compliance at 22201 Homestead Trail (PID 28- 119 -23 -33 -002) (City file 12 -008). The certificate of compliance for an accessory building with metal roof and siding was administratively approved on April 11, 2012. MEMORANDUM
