Open Public Hearing — • Ray Lunde - 6735 Horseshoe Bend Drive — supports the business. • Rick Nyquist - 21901 Homestead Trail is a general contractor and stated to put in a bathroom would put Schmid out of business because of the unnecessary expense • Jim Tilbury - 22201 Horseshoe Trail expressed there was no need for a bathroom it would be overkill. It was a convenience to residents to have this shop where it is located. • Steve Schmid spoke and requested approval of the IUP. iii. Public Comment iv. Commission Discussion & Recommendation Krueger asked for explanation of the minimum required stalls for parking, Schmid stated 2 cars could be parked inside. Kadlec express concerns about floor drain and it was stated there would not be one. Wu and Ravnholdt - stated in the past previous Home Occupations did not have to have restrooms. Discussion was the building was not retail and the amount of time spent was minimal dropping off and picking up vehicles. Wu expressed concerns if it would be a liability issue to not follow building code. Ravnholdt asked if restroom could be waived. Krueger asked to modify # 8 of resolution with the building inspector to remove installation of a restroom for compliance. Hank asked for a show of hands in favor of waiving the restroom requirements. , vote was unanimous. Discussion of condition #3a which should be modified to change "building will be constructed" to "business will be operated ".. Application Request The City of Corcoran reached agreement with the Wesley W. Roehlke and Eileen G. Roehlke Trust to purchase property for a new public works facility. The current application is to create a new 11.84 -acre site for a public works facility and rezone that portion of the property to P -1 (Public Institutional). The remaining parcel would be platted as an outlot and retained by the Roehlke's; however, the purchase agreement would allow the City to purchase additional land in the future. 2. Context Zoning and Land Use The subject property is guided Rural /Ag Residential on the 2030 Future Land Use Plan and zoned Rural Residential. The properties to the south, east and west are guided Rural /Ag and zoned Rural Residential. The property to the north is guided Rural Service /Commercial and is zoned Transitional Rural Commission. Natural Characteristics of the Site The 2030 Comprehensive Plan shows wetland areas scattered throughout the property and Rush Creek runs through the property and portions of the property are located in the Shoreland Overlay District. No impact to those areas is proposed. 3. ANALYSIS: Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and City Code requirements, as well as City policies. Level of City Discretion in Decision - Making The City's discretion in approving or denying a preliminary plat is limited to whether or not the proposed plat meets the standards outlined in the City Code. If it meets these standards, the City must approve the preliminary plat. The City has a relatively high level of discretion in approving or denying a rezoning application. The proposed zoning for a property must be consistent with the City's Comprehensive Plan. If the proposed zoning is not consistent with the Comprehensive Plan, the City must deny the rezoning application. The Zoning Ordinance and Map are the enforcement tools used to implement the goals and standards set in the Comprehensive Plan. B. Consistency with Ordinance Standards Rezoning The proposed project is located outside of the Metropolitan Urban Service Area (MUSA) of the City. This is the area not planned to be serviced by sanitary sewer and municipal water. The subject property is currently zoned RR (Rural Residential), which does not allow civic uses; therefore, the new lot would be rezoned to P -1 (Public /Institutional). As noted in the ordinance, "The purpose of the PI district is to provide a zoning district specifically for uses oriented to the general public and semi - public uses. This district is unique in that it generally provides services to the public rather than a sale of goods." The City must review this request for compliance with the rezoning standards outlined in Section 1070 of the Zoning Ordinance as follows: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the City Comprehensive Plan, including public facilities and capital improvement plans. The rezoning will allow development of a new public works facility on the new lot. A new public facility has been included in capital improvement discussions for many years and will provided needed public works space. 2. The proposed action meets the purpose and intent of this Ordinance or, in the case of a map amendment, it meets the purpose and intent of the individual district. The rezoning meets the purpose and intent of the Zoning Ordinance and, specifically, the P -1 zoning district. The existing uses are not in conflict with applicable provisions of the zoning ordinance. 3. There is adequate infrastructure available to serve the proposed action. There is adequate infrastructure available to serve the existing properties. The new lot will have access off County Road 19 and will be served by private well and septic. Lot Size The plat would create one 11.84 -acre lot for the new public works facility and one outlot for the existing farmstead. Both lots would exceed the minimum lot size requirements in their respective districts. Streets No new streets are proposed. The preliminary plat shows a 50-foot 1/2 right -of -way for County Road 19. This is consistent with the easement that was provided to the County when County Road 19 was upgraded recently. As required by state law, the City submitted the proposed plat to Hennepin County for review. Hennepin County Transportation Department has reviewed the proposed plat. Hennepin County notes that permits will be required for any work in the County right -of -way. Wetlands A wetland delineation was completed for Lot 1, Block 1. The wetland delineation must be submitted to Elm Creek Watershed Management Commission (ECWMC) for review and approval. The Corcoran Natural Resources Communities Quality Ranking Map does not show the wetlands that are located in Lot 1, Block 1. Staff has determined that these are medium quality wetlands for the purpose of buffer requirements. Detail A on the preliminary plat shows these required buffers. Section 1050.010 of the zoning ordinance requires an average wetland buffer of 25 feet (10 -foot min /20 -foot max.) and a structure setback of 15 feet from the buffer or a parking setback of 5 feet from the buffer. These buffers are required to be installed when the property is platted. Wetland buffer monuments must be installed prior to issuance of building permit. Shoreland Overlay District Section 1050.020 of the zoning ordinance notes that the property within 300 feet of the creek is located in the Shoreland Overlay District as required by State Law. The ordinance requires a 25- foot shoreland buffer and monument signs. The city allows the wetland buffer monument signs to be used to delineate this buffer. The shoreland buffer and signs are shown on the plans. The buffer monuments must be installed prior to issuance of building permit. The Shoreland Overlay District also limits land within this overlay district to a maximum impervious surface coverage of 25 %. It appears that the general concept plan for the public works facility would concentrate the impervious areas on the north end of the site. Staff has included a condition that the site plan comply with the Shoreland Overlay District standards. Roehlke Addition (city file 12 -010) September 6, 2012 J 0 Drainage and Utility Easements Section 945.060, Subd. 2 of the Subdivision Ordinance requires 10 -foot drainage and utility easements around the perimeter of the lot (10 -foot adjacent to right -of -way and 5 -foot adjacent to shared lot lines). The plans comply with these requirements. All wetlands must be blanketed by a drainage and utility easement. The plans comply. Parks and Trails Park dedication is not required for public land. The Parks & Trails Plan in the adopted 2030 Comprehensive Plan does show a "trailhead search area" and an "athletic search area" in the vicinity of this parcel. The City is continuing to discuss the possibility of a trailhead in conjunction with the public works facility with Three Rivers Park District. Additionally, the purchase agreement with the Roehlke's allows the City to purchase additional land for a park. The City Council has expressed interest in the park land acquisition as possibility in the future. When Outlot A is developed, the City would work with the applicant to provide an on -road trail on County Road 10 and a trail through the site, as shown in the Comprehensive Plan. Final Plat The final plat requires action by the City Council only and will be reviewed at the September 27th Council meeting. Site Plan There is no site plan review at this time. The City Council is working through the design process and site plan review and approval will occur at a later date. The well and septic locations were reviewed and permitted by Hennepin County with the future site plan application. C. Conclusions Staff has reviewed the preliminary plat and rezoning for consistency with the applicable standards outlined in the Comprehensive Plan, Zoning Ordinance and Subdivision Ordinance. Staff noted in the staff report the outstanding items that must be addressed and we have included conditions in the attached draft resolutions to address these issues. 4. Action Recommend approval of the following, subject to the findings and conditions in the attached resolution: a. Ordinance approving the rezoning from RR to P -1 b. No grading or site plan for the PW facility proposed on Lot 1, Block 1 was included with the submittal. Based on this information, I have the following comments; 1) The ECWMC is the LGU in charge of administering the MN WCA. The wetlands on site must be delineated, then reviewed and approved by the Commission. A complete ECWMC application must be provided to the Commission for this purpose. 2) Prior to site work, a complete application must be submitted to the Commission for review and approval when the public works facility moves forward. 3) From my review, the proposed drainage and utility easement encompasses the 100 year elevations on this lot. The 100 year floodplain elevation on lot 1, block 1 is 994.6. 4) No easements are proposed for the outlot A parcel. When that area is subdivided further, the wetlands and 100 year flood elevations will need to be covered by D & U Easements. Please contact me if you have any questions on this information. ( Wenck) staff conducted a wetland determination on the subject property in the City of Corcoran, in Hennepin County, Minnesota. This report documents findings from an off -site review of aerial photographs for the purpose of identifying areas of wetland on the subject property. Wetlands are defined in the Federal Register (1982) as "areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs, and similar areas." An area must have 3 elements present in order to be delineated as a wetland: 1) Greater than 50% dominance of hydrophytic plant species. 2) A hydric soil substrate. 3) Wetland hydrology during the growing season. The subject property is currently an agricultural field. In agricultural lands -where soils are annually disturbed and natural vegetation cover is absent - wetland boundaries are determined by reviewing precipitation records to classify climatic conditions and analyzing historic aerial photographs for signatures of wetland hydrology. \\ Francis \Voll\2294 - Corcoran\13 - Public Works Building \Wetland Determination \Wetland Report Final Pd&\Determination Report.Docx 1 -1 2.0 Site Description The subject property is located in the NE 1/4 of Section 18, Township 119, Range 23, in the City of Corcoran in Hennepin County, Minnesota (Figure 1). The subject of this wetland determination is an approximately 50 acre parcel comprised entirely of cultivated agricultural land. \\Francis \Voll\2294 - Corcoran \13 - Public Works Building \Wetland Determination \Wetland Report Final Pdfs\Determination Report.Docx 2 -1 3.0 Methods Wetland determinations, defined in CFR 7 Sec 12.2 as "a decision regarding whether or not an area is a wetland, including identification of wetland type and size ", are conducted on agricultural land using on -site and off -site methods described in several guidance documents. The wetland investigation was conducted by Wenck staff using off -site methodology set forth in Atypical Procedure: Offsite Hydrology Determination by Using Rainfall Data with Farm Service Agency Imagery (BWSR 2006) and State of Minnesota Interagency Cooperative Agreement for Implementation of the Federal Wetland Delineation Memorandum of Agreement (BWSR 1994). This methodology was developed to aid in the determination of wetland hydrology in cropped areas. The protocols described in this document were the result of federal and state agency's efforts to promote consistency between wetland determinations made under the National Food Security Act (NFSA) Manual, the ACOE 1987 Manual, and the Wetland Conservation Act (WCA). Available Farm Service Agency (FSA) aerial imagery was obtained from Hennepin County for the years 1981 -2000. National Oceanic and Atmospheric Administration (NOAA) precipitation data for each of these years was collected and analyzed through the University of Minnesota's "Minnesota Climatology Working Group" website. Precipitation data from three months prior to the assumed date of the aerial photograph from a location near the property was compiled and analyzed. The precipitation conditions during this period of each year were assessed as "Normal ", "Wet ", or "Dry" according to the methodology. FSA imagery from "Normal" precipitation years was reviewed for signatures of wetland hydrology. According to the methodology guidelines, the FSA imagery was assumed to be taken July 1 of each year. Wetland hydrology signatures include primary indicators such as surface water (WSW), drowned out crops (WDO), areas that do not appear to be cropped (WNC), or areas with visual wetland \\Francis \Voll\2294 - Corcoran \13 - Public Works Building \Wetland Determination \Wetland Report Final Pdfs\Detenminatlon Report.Docx 3 -1 vegetation signatures (WWS). Secondary indicators of wetland hydrology include crop stress (WCS). The presence of mapping conventions that are primary indicators of wetland hydrology is strong evidence that wetland hydrology (inundation for at least 15 days) is present during those years. Crop stress is a weaker indicator of wetland hydrology. Crop stress may occur under conditions that do not constitute wetland hydrology, including: significant precipitation recently before the aerial photograph was taken; high alkalinity in the soils; or delayed planting. The National Wetland Inventory (Figure 2) and County Soil Survey (Figure 3) were reviewed to aid in the investigation. In order to increase the accuracy of the wetland determination, a decision matrix that incorporates additional factors for determining if an area is wetland was used. The matrix considers if an area is mapped as a wetland basin by the National Wetland Inventory (NWI) or hydric soil by the NRCS soil survey (BWSR 2006). For areas that are mapped by the NWI as a wetland basin: • If wetland hydrology indicators are observed in at least 30% of years with normal precipitation, the area is considered a wetland; • If wetland hydrology indicators are observed in less than 30% of aerial photographs, field verification is recommended. For areas that are not mapped as an NWI wetland basin: • If wetland hydrology indicators are visible on at least 50% of years with nonnal precipitation, the area is considered a wetland • If wetland hydrology indicators are observed on 30% to 50% of aerial photographs, field verification is recommended; or • If wetland hydrology indicators are observed in less than 30% of aerial photographs, the area is considered to be non - wetland or effectively drained. \\Francis \Voll\2294 - Corcoran \13 - Public Works Building \Wetland Determination \Wetland Report Final Pdfs\Determination Report.Doex 3 -2 4.0 Results Initial review of all available aerial imagery identified seven potential areas of wetland on the subject property. These seven areas were the focus of this wetland determination (Figure 4). The final wetland boundaries shown in Figure 5 were based on analysis of the estimated wetland boundary during normal years of precipitation conditions. The final boundary was drawn to include that percentage of the given wetland investigation area that exhibited wet signatures in most or every observed year of normal precipitation aerial imagery. Precipitation data analysis determined that eleven years experienced normal precipitation during the three months prior to the date the aerial photographs were taken from 1981 to 2000. One normal year lacked imagery (1982) and was not included in the analysis. Imagery from normal years and approximate wetland boundaries for each year are included as Appendix C. The analysis of wetland hydrology indicators paired with precipitation data are summarized for each potential wetland investigation area in Appendix B. Precipitation data and analysis is presented in Appendix A. Investigation Areas la, 2a, and 3 Investigation Areas 1 a, 2a, and 3 are all listed in the NWI, are mapped for hydric soils (Glencoe or Cordova series), and exhibited visual indicators of wetland hydrology in at least 90% of years of aerial photographs with normal precipitation that were reviewed. According to the off -site wetland determination methodology, these areas qualify as wetland. Investigation Areas lb, 2b, and 4 Investigation Areas lb, 2b, and 4 are not listed in the NWI as wetland basins. Each of these areas are mapped as containing hydric soils (Hamel or Cordova series), and exhibited visual indicators of wetland hydrology in at least 50% of years of aerial photographs with normal \\Francis \Voll\2294 - Corcoran \13 - Public Works Building \Wetland Determination \Wetland Report Final Pdfs\Determination Report.Doex 4 -1 precipitation that were reviewed. According to the off -site wetland determination methodology, these areas also qualify as wetland. Investigation Area 2c Investigation Area 2c is not listed in the NWI, and is on the edge of a mapped hydric soil series, Cordova. The area exhibited visual indicators of wetland hydrology in 30% of years of aerial photographs with normal precipitation that were reviewed, and no primary indicators were observed in any normal precipitation year. These wetlands are regulated by local, state, and federal agencies. No grading or filling in these wetlands should commence until all necessary permits have been obtained. This wetland determination meets the standards and criteria described in Atypical Procedure: Offsite Hydrology Determination by Using Rainfall Data with Farm Service Agency Imagery (BWSR 2006) and State of Minnesota Interagency Cooperative Agreement for Implementation of the Federal Wetland Delineation Memorandum of Agreement (BWSR 1994). Armbruster Topography and Wetland Waiver (city file no. 09 -011). An application has been received for a waiver from the topography and wetland requirements and was reviewed by the City Council on November 23, 2009. The City Council expressed concerns about the concept and directed the applicant to revise the concept plan. The applicant submitted a letter extending the review period until January 2013. This will allow the city time to complete the ordinance updates and allow the applicant additional time to explore their options for development /subdivision. 2. Corcoran Public Works Building Preliminary and Final Plat and Ordinance Amendment (City File 12 -010). The City is in the process of acquiring land from the Roehlke's for a new public works building on County Road 19. The application would be for a preliminary and final plat to create a new lot for the public works facility and an outlot for the remaining land that will be retained by the Roehlke's. The new public works site will be rezoned to Public /Institutional (P -1) to accommodate this use. This item has been scheduled for a public hearing at the Planning Commission on September 6th and City Council review on September 27th. 3. Daryl & Louredette Patnode Request for Agricultural Preserve Designation and Expiration for 23301 County Road 50 (PID 30- 119 -23 -11 -0001) (city file no. 12 -012). An application for Agricultural Preserve was submitted. The item has been scheduled for Council review on September 27tH Also, there are a number of projects that have been approved, but are still not filed and closed out: 1. Corcoran Business Park (city file 06 -005). The City Council granted a one year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and will be working to close out this project. 2. Northern Natural Gas Administrative Permit (city file 09 -009). An administrative permit for a meter station was approved and is under construction. The city will retain the escrow account until the project is completed to ensure that the project is completed according to the plans. The majority of the improvements and conditions of approval have been met. However, the landscaping has not yet been installed. Northern Natural Gas indicates that there are still connections that need to be made on site and landscaping cannot be installed until completed. City staff was notified that the landscaping was installed on site and conducted an inspection June 3, 2011. The landscaping and all other improvements were installed per City requirements. Staff will begin the project closeout process after the landscape guarantee period expires in 2013. 3. Satellite Industries Site Plan Amendment, Conditional Use Permit Amendment, Lot Consolidation and Easement Vacation (city file 10 -007). On September 23rd the City Council approved Resolutions 2010 -37, 2010 -38 and 2010 -39 approving the request with a number of Landform", SensiblyGr een " and Site to Finish=" are service marks of Landform Professional Services, LLC. 1 conditions. The applicant has addressed those conditions and has submitted a building permit application and has begun site work. Staff inspected the site on October 12th and found that the major site improvements had been made, but there are several items that still have to be addressed. We have discussed these items with the landowner. The city has a financial guarantee in place to ensure completion. 4. Park Place Storage After- the -Fact Extension of Approvals (city file no. 10 -008). On September 23, 2010, the City Council approved a site plan and conditional use permit amendment for Park Place Storage to construct the 18th and final mini - storage building on that site. The approvals expired on September 23, 2011. The applicant contacted the City and requested a one year extension until September 23, 2012. The request was approved by the City Council on January 26, 2012. 5. Corcoran Wildlife Preserve (city file 10 -009). Preliminary plat (city file 06 -004) was approved on September 27, 2007 (Res. 2007 -72) with 8 findings and conditions. On September 23, 2010, the city council approved Resolution 2010 -40 approving the final plat. The applicant has 2 years to address all conditions of approval and record the final plat. The final plat approvals will expire on September 23, 2012 unless the applicant requests and is granted an extension. 6. Rocks N Blocks Site Plan Amendment and Conditional Use Permit (city file no. 10 -012). An application was received for a Conditional Use Permit and Site Plan Amendment to continue operation of a business with outside storage at 20010 75th Avenue North. The application was approved by the City Council on June 23rd. This was approved as a way to correct a code enforcement issue. No work has been done on site to correct the code violations. The applicant has not yet complied with the conditions of approval and has asked for a 3 month extension. The approvals will expire on September 23, 2012. 7. Custom Filtration Inc. Preliminary and Final Plat (city file no. 11 -008). The city received an application to combine the existing Custom Filtration lot with the outlot to the west. The request was approved by the City Council on December 19th. The applicant is working through finance and other issues and intends to file the plat later this year. 8. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (city file 12 -002). Hope Ministries has submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. 9. Schmid IUP for Auto Repair Home Occupation at 6334 Rolling Hills Road (PID 33- 119 -23 -33 -001) (city file no. 12 -009). As a result of a code enforcement action, Steven Schmid has requested an interim use permit to allow auto repair as a home occupation. The item was approved by the City Council on June 28, 2012. 10. Sprint Tower Administrative Permit and Site Plan Modification (PID 25- 119 -23 -41 -0001) (city file no. 12 -013). Administrative approval to allow replacement of existing antennas and ground equipment on the tower at 7205 CR 101 was granted on 07/16/12. 11. David and Betty Heinz Certificate of Compliance (PID 03- 119 -23 -14 -0002) (City File 12 -014). An after - the -fact Certificate of Compliance for construction of an Agricultural Building that exceeds size limits with metal roof and siding at 20801 County Road 117 was approved on 07/09/12.
