In addition, the Planning Commission has created the position of Vice - Chairperson to fill the role of Chairperson in his /her absence. Both of these positions are for a term of one year. Although the City Code states that the commission shall "elect" a chairperson, it does not define how that process happens. Staff recommends the Planning Commission use the motion, second, and vote process to select both the Chairperson and Vice - Chairperson. This item was originally discussed at the February 5, 2015 Planning Commission meeting. Due to two members being absent, the commission appointed Chair Jacobs as Acting Chair for the February 5, 2015 meeting. A formal appointment must take place for the remainder of the year. Attachment: N/A CITY OF CORCORAN PLANNING COMMISSION MEETING MINUTES 7:00 PM — THURSDAY, FEBRUARY 5, 2015 The Corcoran Planning Commission met on February 5, 2015, at City Hall in Corcoran, Minnesota. Present were: Chair Jacobs, Commissioner Wu, Commissioner Theis, and Commissioner Schultz. Absent: Vice -Chair Ravnholdt and Commissioner Krueger. Also present were: Council Liaison LaFave, Administrator Martens, City Planner Lindahl, and Code Compliance Official Pritchard. j 1. Call to Order Chair Jacobs called the meeting to order at 7:( 2. Staff Report — City Planner Lindahl presented her staff report. ii. Open Public Hearing — Chair Jacobs opened the public hearing. (7.10pm) iii. Public Comment — None iv. Commission Discussion & Recommendation — The Commission asked for clarification if there were any structures located on the proposed outlot. The owner, Don Tombers stated there were not. Non - conforming status and implications were discussed, including State regulations. Staff stated that if a non - conforming structure were destroyed, it could only be replaced exactly as it exists today, meaning the footprint, size, height, etc. would have to remain the same. It was also noted that an agricultural accessory structure could be allowed by Conditional Use Permit on the proposed outlot. The structures would be allowed to stay indefinitely as the non - conforming status would apply to the land, not the owner. The Commission inquired whether or not there are similar non - conformities in the City. Staff stated that there are a number of non - conformities existing but the total amount is unknown. Motion made by Theis seconded by Wu to recommend approval of the Resolution as presented. Voting Aye: Jacobs, Wu, Theis, and Schultz. (Motion carried 4:0) (7:18pm) 4" b. PUBLIC HEARING. Corcoran Pet Care Center Sign Plan and Variance at 7559 CR 116 (PID 26- 119 -23 -11 -0016) (city file 14 -031) i. Staff Report — City Planner Lindahl presented her staff report. ii. Open Public Hearing — Chair Jacobs opened the public hearing. (7:27pm) iii. Public Comment — Mr. Lyndon Minks, applicant /contractor and owner representative, discussed the resolution condition regarding parapet height and agreed the sign parapet could be lowered and the intermittent parapet could be raised to be more proportionate. He agreed that a 4.5' maximum height would work. He also stated that the exterior materials would be of high quality, utilizing standing seam steel roofing on the mansard and Hardi- plank panel siding on the walls and parapets. Dr. Ian Drummond and Ms. Susan Drummond, owners, stated the lettering on the signs would be similar, but depending on amount of text, the letters may differ in font size. Ms. Drummond also stated that they would like to allow corporate logos and brand symbols. The Commission asked if the sign parapet locations would limit the tenant locations. Ms. Drummond stated that the design is for current tenants, but that tenants could change over time. Mr. Minks stated that the raised parapets could be moved and /or rebuilt to accommodate new tenants. Mr. Shorty Dorweiler, tenant (Farmers State Bank), stated he would like to include a corporate logo in his signage. He also stated that he may want to add a time /temp sign in the future. iv. Commission Discussion & Recommendation — The Commission agreed that the Resolution should be amended to add a condition that requires a revised letter from the applicant that includes corporate logos and brand symbols as part of the signage plan request. The maximum height for the sign parapets was discussed. The Commission concurred that a maximum of 5' parapet would be proportionate to the face height of the building and should be allowed and included in the Resolution. Motion made by Schultz seconded by Theis to recommend approval of the Resolution with amendments to condition #4 to allow a maximum parapet height of 5', as well as renumbering the conditions to add condition #5 requiring a revised letter from the applicant requesting that logos and symbols be allowed as part of the sign plan. Council Correspondence — Annual Report and 2015 Priorities — The Commission reviewed the draft letter and discussed possible priorities for 2015. Many items were discussed, including: a Sign Ordinance update and evaluating Commission process and efficiency. Creating a Tree Preservation Policy or Ordinance was discussed at some length. Also discussed was the possibility of a Subdivision Ordinance update or incentives promoting sustainable development, such as: water and irrigation restrictions, energy conservation, and limiting changes to the site's natural characteristics (topography, trees, wetlands, meadows, etc.). The Commission discussed Subdivision Ordinance changes to restrict cul de sacs, as well as promote larger homes in Wayzata School District and more affordable homes in the other school districts. The Commission also discussed updating the Downtown Design Guidelines and promoting more commercial and industrial development along County Road 10 east of County Road 116. Administrator Martens stated that he would compile a list and send a survey to the Commission to select top priorities for 2015; Chair Jacobs would then present this list to Council on February 26, 2015. 7. Application Request Lennar submitted a request for approval of Final PUD Development Plan for Phase II, "Ravinia 2nd Addition" to allow 36 single family detached home lots on 61.76 acres. This is part of the "Ravinia" subdivision planned for a total of 426 single family detached home lots on 266.57 acres. Only the final PUD development plan is reviewed by the Planning Commission. The Planning Commission recommendation will be forwarded to the City Council. The City Council is expected to take action on the final PUD development plan and final plat for Phase II on April 23, 2015. 2. CONTEXT Level of City Discretion in Decision - Making The City's discretion in approving a final PUD development plan is limited to whether or not the proposed plan is in substantial conformance with the approved preliminary PUD development plan. If it meets these standards, the City must approve the final PUD development plan. The City's discretion in approving a final plat is limited to whether or not the proposed plat meets the standards outlined in the City's subdivision and zoning ordinance and the conditions of preliminary plat approval. If it meets these standards, the City must approve the final plat. Background The City Council approved a Rezoning to PUD (Planned Unit Development), Preliminary PUD Development Plan and Preliminary Plat on December 23, 2013. The Final PUD Development Plan and Final Plat for Phase I was approved by City Council on April 24, 2014. The Final PUD Development Plan was amended by the Council on January 8, 2015 to allow for vinyl siding instead of LP siding on all sides of the homes and to allow 5 -foot setbacks behind garages. The developer has been working with the City to address those conditions. 3. Analysis of Request Staff has reviewed the application for consistency with the approved preliminary plans, as well as City policies. The City Engineer's comments are incorporated into this staff report and resolution and the detailed comments are included in the attached engineering memo. Final PUD Development Plan — "Ravinia 2nd Addition" The PUD offers enhanced flexibility to develop the site through the relaxation of most typical zoning district standards. The PUD allows for a greater variety of land uses, construction phasing and a potential for lower development costs. In exchange for this flexibility, the City expects a higher level of design and a more sensitive development than might normally be the case. The final PUD development plan must be reviewed for compliance with the preliminary PUD approvals. Staff finds that the final PUD development plan is generally consistent with the approved preliminary plans. Architecture The preliminary PUD approvals required the applicant to prepare HOA documents for review and approval by the City Attorney. The final documents (Design Review Guidelines for The Ravinia Neighborhood Association, Ravinia Lifestyle Homes Declaration of Covenants and the overall Neighborhood Declaration of Covenants for Ravinia) were approved and have been filed at Hennepin County. The applicant submitted a series of house plans and color palettes for the project with the preliminary PUD development plan. The current, more detailed plans include 4 different home series (Landmark, American Heartland, Lifestyle and NextGen), with options that allow more than 80 different home elevations with a wide variety of color and material combinations. Each house plan will be reviewed by the City prior to building permit to ensure that the ordinance standards as modified by the PUD are met. However, because this development will be constructed over a period of time, we expect that new or modified house plans will be added to the product line and would be administratively reviewed and approved by the City. The submitted plans comply with the PUD approvals. Parking On street parking is allowed on all public streets except Gleason Parkway. On street parking is allowed on one side of the streets, but is prohibited in cul de sacs. Sidewalks will be installed on one side of every local street. Lennar final PUD Development Plan — Ravinia 2nd Addition (15 -003) April 2, 2015 • • 0 Mail Delivery • Two centralized mailbox locations are shown on the landscape plans. Condition 19 of Resolution 2014 -19 requires that the location of mailboxes be approved by the US Postal Service. The applicant will need to provide proof of the approved location to the City for review and approval. Signage The preliminary PUD approvals allow two development signs at the main County Road 101 entrance, one sign at the Hackamore entrance and 7 smaller sub - neighborhood signs within the project. One sub - neighborhood sign is planned for the 2nd Addition at the southwest corner of Gleason Parkway and Bridle Path. The concept plans for these signs were approved with the preliminary plat, but no details were provided with this application. Detailed sign plans must be submitted for review and approval by the City Planner prior to issuance of a sign permit. The ordinance requires signs to be set back 10 feet from the property line and outside the sight visibility triangle. The applicant must show compliance with these setback requirements when the building permit is requested for the sub - neighborhood signage. Streets A temporary turnaround should be provided at the southerly extent of Larkspur Lane shown in Phase 2 as specified in the Engineer's memo dated March 16, 2015. A temporary turnaround is required on all temporary dead -ends within the project. The preliminary approvals require the developer to maintain the landscaping and irrigation Ravinia Parkway and the cul de sac islands. The maintenance agreement has been filed at Hennepin County. Off -Site Public Improvements There are a number of off -site improvements to streets that have been funded by the developer and constructed by the City, including improvements to County Road 101 and Gleason. The City is also completing extension of sanitary sewer and water to serve this project. These improvements are under construction as part of Phase I. The project is being constructed by the City and paid for by the developer. Financial guarantees for future improvements have been provided by the developer and paid for as outlined in the development contract that was approved by the City Council with the final plat. The master development contract shall be amended with each phase to ensure that the financial commitments of the applicant have been met. Lighting The applicant submitted a lighting plan with the Phase I Final PUD plan that included decorative light poles for installation on the public streets. Fixtures have been installed on site according to the submitted plans, however, the fixture -type is different than the approved fixture -type shown in Phase I plans. Wright- Hennepin Electric does not supply the fixture -type that was proposed, therefore an alternative light fixture was selected by the applicant and approved by the City. While the fixtures Lennar final PUD Development Plan — Ravinia 2 "d Addition (15- 003) April 2, 2015 09 O have already been installed on the entire site as part of Phase I construction, the applicant will need to provide an updated lighting plan that shows details and location of the lights that were installed on site. Parks, Trails and Open Space The preliminary approvals required a number trail easements and dedication of two public parks. Additionally, the developer proposed a private park that is being constructed as part of Phase I. The private park is owned and maintained by the Homeowners Association for their exclusive use. No public parks are proposed for the area to be developed in Phase II, however, future park dedication will include land dedication that exceeds ordinance requirement by approximately 40 %. The ordinance requires dedication of 22.74 net acres of park dedication and the applicant is proposing to provide 32.12 net acres of public park. This additional park land dedication is one of the benefits of the PUD. • Public Park 1 in the northwest portion of the site is 23.06 net acres (42.84 gross acres) • Public Park 2 north of Gleason Road in the central portion of the site is 3.57 net acres (5.12 gross acres). • Public trails. The applicant is showing 4.99 net acres (4.99 gross acres) of public easements for off -road trails. The applicant also provided an off road trail easement along the County Road 101 right -of -way. Wetlands A wetland delineation for the wetlands on site was completed for the preliminary plat submittal. The wetlands in Phase II were ranked as low or medium quality by the National Resource Communities Quality Ranking Map. Therefore, the Council allowed the applicant to provide buffers and buffer setbacks that are consistent with medium quality wetlands for all wetlands in lieu of providing a MNRAM report. Wetland #15 and Wetland #7 are low quality wetlands and require an average buffer width of 15 feet. All other wetlands in Phase II are medium quality wetlands and require a minimum buffer width of 25 feet. Placement of buffer monuments, buffers, and buffer setbacks are in compliance with Section 1050.010, Subdivision 5 of the Zoning Ordinance. Section 1050.010, Subd. 8 provides performance standards for buffer strip vegetation. The applicant shall provide the City with seed mixes and specifications for the wetland buffer strip. Plans show that drainage and utility easements have been provided for outlots A, B, and C, as required by Condition #46 of Resolution #2013 -61. The Final Plat shows easements over the wetlands and the wetland buffer. Development Phasing The developer plans to develop this project in 9 phases. The developer began work on Phase I in May 2014. Phase I included 38 lots and 5 outlots. Phase II includes 36 lots and 2 outlots. The final plat is consistent with the approved preliminary plat. The final plat is reviewed only by the City Council. The development contract will also be reviewed by the City Council. The Planning Commission will not provide a recommendation on the Final Plat. Conclusion Staff has reviewed the plan for consistency with the applicable standards outlined in the preliminary approvals, Zoning Ordinance and Subdivision Ordinance. The staff report noted the outstanding issues that must be addressed and we have included conditions in the attached resolutions to address these issues. The final plat will be presented to the City Council at the April 23, 2015 meeting with the final PUD development plan for "Ravinia 2nd Addition." However, the final plat is not subject to Planning Commission review —the Planning Commission will only make a recommendation on the final PUD development plan. 4. The applicant must record the approving resolutions and associated documents at Hennepin County and provide proof of recording to the City. b. The plans show centralized mailbox locations. These mailbox locations shall be approved by the US Postal Service and proof of the approved locations provided to the city for review and approval. c. The developer shall provide a separate Final Street Lighting Plan. d. The developer must provide sign details for the sub - neighborhood sign for review and approval by the City Planner. PUD flexibility was granted to allow this signage but detailed plans must be provided to ensure compliance. e. The developer shall provide a revised landscape plan that is consistent with the March 4, 2015 plans and plat. f. The applicant shall work with City staff to revise the Landscape Plan to ensure that all boulevard landscaping for Gleason Parkway is located within the boulevard (between the curb and sidewalk) where feasible. g. All permanent wetland buffer monument signs must be erected along the wetland buffer line as required by Section 1050.010, Subd. 7 of the Zoning Ordinance. i. Wetland signs shall be purchased from the City. ii. The final locations must be inspected and approved by City staff. iii. Many of the comments were in response to the pre- revised drawing set and may no longer be pertinent to the final extents of Phase 2. These comments were left in this list, many of which are noted, for reference when the applicable future phase moves forward. General 1. The invert of MH 33 could be lowered to "transfer" grade to the next upstream run. 14. Two butterfly valves should be added on the watermain along Bridle Path, one on either side of the lateral to Larkspur Lane to minimize disruptions in case of a shutdown. All intersection valves should be shown and installed per detail plate WAT -08" 15. Butterfly valves could be added at the northerly and westerly watermain connection points on Bridle Path. These valves are not required, however, the contractor will be required to pass hydrostatic testing for the newly installed main; the absence of valves would require testing against existing watermain. 16. The proposed storm sewer and watermain crossing on Bridle Path at Paddock Lane (W) should be verified for 24" separation between pipes per MDH. 17. The invert elevation of sanitary MH 15 should be verified such it will allow extension to provide service to potential future development to the south (beyond the currently identified future phase(s). 23. Clearly identify all lots where upsized water services are to be installed. Storm Sewer 24. The stormwater model used for determining the proposed wetland and pond water levels shall be verified. (Elevations shown on the plans appear to generally match those expected; however, the model will still need to be reviewed.) 25. Provide storm sewer calculations for storm sewer networks throughout Phase 2 to verify design capacities and local flooding potential. 26. Consider showing sanitary and watermain utility crossings in profile views. 27. It appears the shaded drawdown areas in the stormwater pond are shown incorrectly. It is believed the contours shown around the perimeters of the ponds are to represent the top and bottom of the maintenance benches. The drawdown areas are intended to be within these bench areas. Adjust extents of shaded areas or add notes, etc. to clarify. 28. Shift CB's, up or down stationing, whenever possible to align with property lines (extended) to avoid potential driveway conflicts with grates. 29. Consider revisions to the CB, and impacted pipe, on Bridle Path near Paddock Lane (W). MH 2 could be relocated, as a CB, to the lot line (extended) between lots 2 and 3. Flow direction between CBs 9 and 10 could be reversed and CB 10 connected to relocated MH 2. Consider sliding CBs 18 and 22 north to the next property line (extended) to the north. This would eliminate potential conflict with driveways and grates. This may also require sliding sanitary MH 8 south or north to avoid conflict with structure and storm lateral. 32. The design of Stormwater Treatment Pond 8 results shows the discharge pipe invert into wetland #15 at 986.5, or 0.5' below the NWL for the wetland. It is preferred this discharge pipe would be raised to an elevation 0.5'+ above the wetland NWL. It is noted pipe elevations are tight and pipe grades are already minimal. However, raising the NWL of the pond to 988.0 (raise 1') will be reviewed by Wenck. Consider modifying storm sewer on Larkspur Lane to gain additional grade in effort to raise the NWL. It should be explored if the run between the pond and the street could be shifted to the south line of either Lot 6 or Lot 7. The connection at the street could be connected to CB 32 or MH 31 and flow direction /pipe elevations be altered accordingly. [This may be part of a future phase.] 33. Add /adjust information shown on Typical Filtration Shelf Detail (Sheet 13). The top of the filter trench should be the middle of the maintenance bench. 34. The Pond outlet details show a sump depth of 4 feet from the NWL to the bottom of the sump. The 2 foot sump depth should be from the bottom of the inlet invert to the bottom of the sump. This should be fixed for all pond outlet details. 35. All homes not adjacent to a wetland or storm water pond, will require a storm sewer service be extended to the property line to allow connection of a sump pump discharge. The services can be connected to a (dedicated) 6" rigid, non - perforated, pipe that connects to the storm sewer system. This pipe is to be placed approximately 1 foot behind the curb. The services can be placed at shared locations of common lot lines to serve both adjacent homes if desired. Additionally, if a storm structure is located where a service stub is to be installed, connection can be made directly to the structure. All pipes and services must be installed with grade to drain properly. Service ends are to be approximately 1 foot below the finished grade surface, capped, and marked with a 2 "x2" post. 36. Road Sub -drain shall be install at a minimum of: • 250 If in both directions of a low point catch basin. 150 If upstream of a mid -slope catch basin. The model should be submitted for review of phase 2 in case changes have been made to the model during design of phase 2. 37. Model has a 12" outlet pipe for ponds 6 and 7. The plans show the outlet pipe is 15 ". Adjust model and plans accordingly so they are in agreement. 38. The EOF in the model for ponds 6, 7 and 8 are larger than specified on the plans. The EOF dimensions should be consistent between the model and the plans. It is understood that the EOF is not utilized in the model runs, so HWL results are not impacted. 39. The EOF elevation in the model for pond 7 is not the same as specified on the plans. The elevation should be changed so the model and plans are in agreement. 40. Areas used in modeling the volumes for ponds 6, 7 and 8 do not closely match areas from grading plans. a. Pond 6, notably, area for elevation 988 was larger in model than in plans. All areas used in modeling the volume for pond 6 should be checked and should match the areas proposed on the grading plans. b. Pond 7, the areas in the model seemed to be smaller than proposed on the plans. This results in a conservative model. Pond 7 areas should be checked and should match the proposed grading plans. c. Pond 8, The areas in the model correspond to elevations not easily represented on the grading plans. It is difficult to tell if volume is represented closely to proposed plans. Pond 8 areas and elevations should be checked and should match the proposed grading plans. 41. There is a culvert for outlet of Wetland 6. The model does not include a culvert outlet and instead models a large overland weir outlet. Previous field visits have identified this culvert which flows east under County Road 101. The culvert size was identified as a 24" cmp, the west side invert was at 984.5 feet and the east side invert at 983.7 feet elevation. The size, material and elevations should be verified and surveyed. Survey elevations and outlet description should be submitted for verification of modeled outlet. 42. The model shows a large overland flow outlet to Wetland 15. The outlet should be field verified and surveyed. Site Plan Amendment and Variance for the Public Works facility at 9100 County Road 19 (PID 18- 119 -23 -13 -0001) (city file 15 -006) 1. Application Request The City requesting approval of an after - the -fact site plan amendment and variance to approve the Public Works facility as constructed. It is staff's understanding that the subcommittee approved all of the changes; however, the zoning process does require City Council approval of the changes. This action would formally approve the changes already made and no additional site improvements are planned at this time. 2. Context Background On September 27, 2012, the City Council approved the preliminary plat, final plat and rezoning to Public Institutional (P -1). On February 13, 2013, the City Council approved the site plan for the project. Zoning and Land Use The subject property is guided Rural /Ag Residential on the 2030 Future Land Use Plan and zoned Public- Institutional. The properties to the south, east and west are guided Rural /Ag and zoned Rural Residential. The property to the north is guided Rural Service /Commercial and is zoned Transitional Rural Commission. Natural Characteristics of the Site The 2030 Comprehensive Plan shows wetland areas scattered throughout the property and Rush Creek runs through the property and portions of the property are located in the Shoreland Overlay District. No impact to those areas is proposed. 3. Analysis of Request Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and City Code requirements, as well as City policies. Level of City Discretion in Decision - Making 0 The City's discretion in approving or denying a site plan amendment is limited to whether or not the proposed request meets the standards outlined in the City Code. If it meets these standards, the City must approve the site plan. The City has a higher level of discretion in approving or denying a variance. The burden of proof is on the applicant to show that they comply with the variance standards. If it meets these standards, the City may approve the variance. B. Consistency with Ordinance Standards Site Plan The original approvals were for a 27,395- square foot public works facility with associated outside storage. A number of changes were made during the construction process, specifically: 1. The building grew 2,304 square feet and the cold storage by 1,056 square feet with a 24 -foot extension on the south to both the building and the cold storage building. 2. A future road was added as a gravel drive north of the building. (Requires a variance) 3. The landscaping on the east, which was intended to screen the storage area from the future ball fields was installed on the property line (at a lower elevation) rather than at the edge of the storage area. 4. The fence on the east side of the storage area was shifted east approximately 60 feet to the edge of the property line rather than the edge of the defined storage area. 5. The southern fence for the storage area was shifted south 78 feet. 6. The new expanded storage area is gravel rather than asphalt like the original storage area. (Requires a variance) 7. The fence surrounding the storage area was reduced from the approved 8 -foot height to 6 feet. 8. Storage bins were constructed adjacent to the storage area. 9. The location of the fuel island within the storage yard was modified slightly but in the same vicinity. 10. The salt /sand shed location was shifted south within the storage area 11. A second storage shed was added near the storage. Future Weather Station The City has been talking with Hennepin County about the possibility of installing a weather tower in the public works yard. The modified site plan shows a general location for this tower. At this time we do not have an application but the County had indicated that it would be a 30 -foot high tower. The Police Department is supportive of the tower because of the information gathered in support of the emergency management system. This tower is not proposed as part of this application and would be processed separately at a later date. Public Works Facility Site Plan Amendment and Variance (City File 15 -006) April 2, 2015 0 Landscaping • 0 Section 1060.070 of the Zoning Ordinance provides standards for landscaping. The landscaping required for this project has generally been installed as required by the original approvals, but does not address the expansions. Staff recommends that additional landscaping be installed on the west side of the storage yard as shown on the plans to provide screening from County Road 19. Staff also recommends that the landscape plan on the east side be extended south to screen from the future public park. Section 1060.010 of the Zoning Ordinance requires "All exterior storage ... be screened so as not to be visible from adjoining properties and public streets..." As part of the original approvals, the City did not require screening on the south side of the storage area because future expansion was planned. Because that expansion took place and there is no room to expand to the south without impacting the stormwater pond and wetlands, staff recommends that the City install the required landscaping on the south side of the storage yard at this time. Wetlands The wetland delineation was approved by Elm Creek Watershed Management Commission. No impacts to the wetlands are proposed. This is a medium quality wetland and Section 1050.010 of the zoning ordinance requires an average wetland buffer of 25 feet (10 -foot min /20 -foot max.) and a structure setback of 15 feet from the buffer or a parking setback of 5 feet from the buffer. These buffers are required to be installed when the property is platted. Wetland buffer monuments are typically required to be installed prior to issuance of building permit. Staff is working to get them installed this spring. Additionally, the original approvals required wetland buffer plantings be installed in compliance with Zoning Ordinance Section 1050.010, Subd.8.0 Parts 1 -11 ". Staff will be working to complete these plantings this spring. Variance The constructed plan is not in compliance with ordinance requirements regarding paved access and storage areas. The construction of a gravel storage area on the south end of the yard and a gravel access drive on the north would have required a variance in 2013 when the original approvals were granted. The City is now being asked to consider an after - the -fact variance. The gravel drive to the north is in an area where the City discussed a potential future extension east to the future city park. As part of the 2013 approvals, the City Council noted that this drive should be extended around the drive if it was financially feasible. However, the alternative was for a paved drive, not the gravel drive constructed. Gravel storage lots are allowed only in the CR zoning district, subject to certain standards, and are prohibited in all other districts. Outside storage in all other districts is required to be on an improved surface of asphalt or concrete. Public Works Facility Site Plan Amendment and Variance (City File 15 -006) April 2, 2015 0 • If the Council finds that the gravel storage lot and gravel driveway on the north meet the following variance standards, they should grant the variances: 1. That there are practical difficulties in complying with the Zoning Ordinance. 2. That the conditions upon which a petition for a variation is based are unique to the parcel of land for which the variance is sought and were not created by the landowner. 3. That the granting of the variation will not alter the essential character of the locality. 4. The proposed variance would be in harmony with the general purposes and intent of the Ordinance. 5. The variance is consistent with the Comprehensive Plan. The City may impose conditions on the variance to address the impact of the variance. It is staff's understanding that the public works subcommittee did evaluate these modifications and recommended approval during the project construction. The action now is bringing the site into compliance either by investing public dollars to pave these two areas or by granting the variances. Staff has prepared a staff report with language to approve these variances, but the City Council could modify the draft resolution to require pavement rather than granting the variances. 4. Conclusions Staff finds that the standards for site plan approval have been met or can be addressed with the changes discussed in the staff report. We have included conditions in the draft resolution to address these issues. 5. Recommendation Move to adopt the resolution approving the after - the -fact site plan amendment and variance for the new public works facility. Attachments 1. Wetland and Shoreland buffer monument signs must be installed according to plan. 5. Wetland and Shoreland buffer seeding shall be installed. The application is scheduled for Planning Commission review on April 2nd and City Council action on April 23rd. The applicant has also requested that the City Council hold a public hearing to vacate a small portion of the Gleason Road right -of -way that was erroneously left out of the legal description for the vacation last year. This is simply a clean -up issue that would vacate all of the existing Gleason Road right -of -way and Gleason Road right -of -way is dedicated with the plat. 2. Fehn Sketch Plan Review at 20901 CR 117 (PID 03- 119 -23 -13 -0001) (city file 15 -005). The applicant has submitted a concept plan for a 7 lot subdivision. The item is scheduled for City Council review at the March 26th meeting. 3. Corcoran Public Works Site Plan Amendment and Variance (city file 15 -006). The site plan amendment and variance are to grant after - the -fact approvals for changes to the approved site plan that were made in the field and generally authorized by the subcommittee. The gravel storage area that was added on the south area of the fenced yard requires a variance. The item is scheduled for a public hearing at the April 2nd Planning Commission meeting and Council action at the April 23rd meeting. Also, there are a number of projects that have been approved, but are still not filed and closed out: 1. Corcoran Business Park (City file 06 -005). The City Council granted a one year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. Staff has spoken to the applicant and will schedule a meeting in March when more information is available on the Loretto sewer project. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (City file 12 -002). Hope Ministries submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. The letter of credit for site improvements has been released but we are holding the escrow pending completion of the approved landscaping. The applicant has indicated that they are considering a site plan amendment application to modify the approved plans. Staff met again with Pastor Brian Lother in December to try to finalize this issue and address some other questions or concerns from him. We hope to be able to wrap this up in the near future. 3. Lano Equipment at 23580 Highway 55 Site Plan Modifications for Cold Storage Building. (31- 119 -23 -34 -0007) (13 -006). This item was approved by the City Council on JUly 11 h. The building permit has been issued, but staff has determined that the building was not being built according the Landform , SensiblyGreen and Site to Finish® are registered service marks of Landform Professional Services, LLC. 1 approved plans. The applicant submitted revised plans and the City Council approved a site plan modification at the June 121h meeting. City staff is working with them to make the corrections and complete the building and site improvements. Last week, the applicant indicated that they will not be completing the work until next spring. The City has a letter of credit in place to ensure the work is completed as approved. 4. Ess Brothers Site Plan Amendment and Conditional Use Permit Amendment for an accessory building at 9350 County Road (PID # 07- 119 -23 -43 -0004) (City File No. 13 -031) The applicant requested approval of a 5,500 square feet detached, accessory building with 20 -foot sidewalls. The City Council approved this item on January 23rd. The applicant must comply with all conditions of approval (which require landscaping improvements) and then staff will inspect before refunding any remaining escrow. Staff reached out to the applicant in December to try to close out the remaining issues but did not hear back from the landowner. 5. Lake Independence Regional Trailhead at 23475 CR 10 Rezoning, Site Plan and Variance (PID 18- 119 -23 -12 -0002) (City file 14 -010). Three Rivers Park District has submitted a request for a temporary trailhead at this location. The City Council approved the request on July 24th. Three Rivers has indicated that they did not receive any bids this summer and will rebid the project the spring for 2015 construction. 6. Fox Ridge 2nd Addition Final Plat at 9495 Trail Haven Road (PID 09- 119 -23 -41 -0011) (City File 14- 006). This final plat application for a final plat of Outlot A, Baumeister 3rd Addition was approved by the City Council on May 22 "d. The applicant will prepare mylar for signature and filing. After the documents are filed, the remaining escrow can be released. 7. Hentges Lawn Land Snow Special Home Occupation at 21310 Meadow Lane (City file 14 -012). The application was approved by the City Council on August 28th. Staff will be working to close out the file. 8. Patnode Farms Preliminary Plat and Final Plat at 22610 County Road 50 (PID 20- 119- 23 -43- 0003) (City file 14 -021). Mike Patnode has submitted a request for plat approval to create one lot for the existing home and one outlot to be sold. The Planning Commission held a public hearing on September 4, 2014 and the City Council approved it at the September 25th meeting. The mylar has been released for filing at the County. Upon installation of all required wetland and corner monuments, the City will inspect and release any remaining escrow. 9. Sawgrass Preliminary Plat, Preliminary PUD Development Plan and Rezoning for Peachtree Partners LLC on Schendel property at 20400 County Road 10 (City file 14 -027). The City received the application materials and is currently reviewing for completeness. The Parks and Trails Commission reviewed this request on November 18th and recommended acceptance of a combination of land and cash. The Planning Commission held a Public Hearing on December 4th and the City Council approved the request on December 11th 10. Proehl Preliminary Plat, Final Plat and Variance at 20630 Larkin Road (City file 14 -028). The applicant has requested approval of a variance from the minimum lot size in the UR zoning district to subdivide the existing property to create one lot for the original farmstead and a second lot for the second home on the site. The Planning Commission held a Public Hearing on December 4th and the City Council approved the request on December 11th. The applicant is working through watershed issues and then they may file the plat at Hennepin County. 11. Corcoran Pet Care Center Sign Plan at 7559 CR 116 (26- 119 -23 -11 -0016) (City file 14 -031) - The applicant has requested approval of a master sign plan as required by the sign ordinance and a variance from the sign standards for new signage on the shopping center. The signage would be updated as part of other exterior building improvements. This item was reviewed by the Planning Commission on February 5th and approved by the City Council on February 12th. The applicant will need to apply for sign permits and then staff will begin closing out the file. 12. Donald Tombers Request for Preliminary Plat and Final Plat approval for " Tombers Acres" on property at 9120 Trail Haven Road (PID 15- 119 -23 -21 -0001) (City file no. 14 -032). The City Council approved a topographic survey and wetland delineation waiver on this site in 2014. The MEMORANDUM application will create on 5 +/- acre lot for the existing farmstead and one large outlot that will continue to be farmed. This item was reviewed by the Planning Commission at a public hearing on February 5th and approved by the City Council on February 26t" 13. Vollrath Agricultural Preserve Initiation and Expiration at 22903 Strehler Road (PID 20- 119 -23- 22 -0003) (city file 14 -035). The property is already enrolled in Ag Preserve and the status expires this year. The applicant is requesting approve to reenroll and initiation expiration, which would be 8 years from the approval date. This item was approved by the City Council at the January 22nd Council meeting. 14. The applicant is requesting approval of a wetland and topographic survey for the property. This item was reviewed by the City Council on February 26tH The Council approved the topographic waiver but not the wetland delineation waiver. 16. PUD Amendment for Lions Park Structure at 7205 Brockton Lane (PID 25- 119 -41 -0001) (city file 15 -004). The Corcoran Lions have submitted an application for a PUD amendment for 1,080 square foot concession stand east of the existing bleachers. The proposed addition is consistent with the PUD master plan reviewed by the City Council in 2009. The addition of the building was administratively approved. Finally, there are a few projects that have not yet been started but have been identified as action items or future projects. The City Administrator will be working with the City Council to prioritize 2015 projects: Sign Ordinance Update. At the April 25th Council meeting, the City reviewed a request for the City to initiate a sign ordinance update. Specifically, they requested that the City review the ordinance standards relating to sign area, sign height and internal illumination and, because this is a City -wide issue, that the ordinance update be completed by the City out of the City funds. The Council discussed the issue and directed staff to bring a proposal back at a later date because the Council felt that this was a significant undertaking that would involve much more than this one issue. We will work with the City Administrator to determine the appropriate meeting to have this considered. We have been approached recently by several businesses that like to upgrade their signs but are limited by the sign ordinance. 2. Design Guideline Update for Southeast District /Downtown. The Council approved a Landform proposal to update the existing design guidelines for this area. The design guidelines are adopted as part of the Zoning Ordinance and will be enforced as new development is proposed, consequently, the City Council wishes to revisit that planning effort to ensure it is still consistent with the City's goals. The City Council appointed a subcommittee, but the City Council has decided to delay kickoff as we work through some associated issues as part of some new development plans. February 12, 2014 • Years of Service Recognition — Josh Hunter, 10 years o Recognized Officer Josh Hunter in appreciation for his 10 years of valuable service to citizens of Corcoran and his fellow employees. • Downtown utility and Street Improvement Project Schedule o Discussed the action steps necessary for the project. Staff to bring back an overview of the project at the March 12th meeting. • Corcoran Pet Care Center Sign Plan and Variance at 7559 County Road 116 o Approved a master sign plan and variance to allow proposed improvements to the property. • Commission Ordinance Updates o Approved updates to the Planning Commission and Parks and Trails Commission ordinances related to numbers of members, duties, and terms. Both Commissions will reduce in size over time through attrition. • Hope Center Change Order #4 o Approved a change order for electric hand dryers, tiling, and door widening. 7c. • Hope Center Pay Request #4 o Approved a pay request in the amount of $47,500. • Newsletter Article and Advertising Policy; Website Guidelines o Discussed the draft policy and guidelines. Council directed staff to discontinue paid advertisements and establish a "community bulletin" board of sorts in the newsletter. • Police Squad Purchase o Approved the purchase of a 2015 Chevrolet Traverse to replace the existing 2008 Dodge Durango as the Director of Public Safety's vehicle. The Durango will be repurposed as a Code Compliance vehicle. • Public Works Truck and Trailer Purchase o Approved the purchase of a 2015 GMC Sierra and trailer as requested. • Schedule City Council Goal Setting Session o Discussed priorities to hold a goal setting work session. Council preferred a Saturday, staff to coordinate a date. February 26. 2014 • Planning Commission Report — Chairperson Dean Jacobs o Commissioner Jacobs reviewed 2014 accomplishments and some priorities for 2015. The Council showed support for the priorities of updating the Downtown Design Guidelines and the Sign Ordinance • Parks and Trails Commission Report- Chairperson Tom Anderson o Commissioner Anderson reviewed 2014 accomplishments and some priorities for 2015. The Council showed support for the following: • Annual Events • Hold a tree giveaway again as completed in previous years • Begin a new garden club for Corcoran that could maintain the memorial garden as well as possibly improve City Park. • Annual Reviews • Prioritize a list of items that grant funds could be applied for, specifically the Twins grant funds. • Review park usage fees and make recommendations for 2016. • Long Term projects • Update Park Dedication Fund costs /needs • Continue planning for a future Roehlke park • Resignation and Retirement Notice — Lieutenant John Hamilton o The Mayor accepted the notice on behalf of the Council with regret and gratitude for John's service to Corcoran. • Community Room use Requests o Approved the use of the community room at City hall at no charge to the Corcoran Garden Club and Corcoran Bee Club. • 2015 Open Book Meeting — Local Board of Appeal 7c. o Received an update on the change to an Open Book Meeting for appeals of estimated market value and property classification. The meeting is scheduled for Thursday, April 9th from 5:30 pm — 7:00 pm. • Preliminary and Final Plat approval for "Tombers Acres" on property at 9120 Trail Haven Road o Approved a preliminary and final plat which essentially carves off the home site and creates a large outlot. • Request for Topography Exemption and Wetland Delineation Exemption at 6280 Willow Drive o Approved a topography survey exemption but required the wetland delineation. The property owner is looking to create a 20 acre lot and a 103 acre outlot. • Medina Comprehensive Plan Amendment o Reviewed a proposed comprehensive plan amendment for Medina to slow down their staging and growth plan. Found that it does not affect the City of Corcoran and authorized a letter to that effect. • Water Connection Request — Good Shepherd Lutheran Church o Reviewed a request to hook up the residence on the property to the municipal water system. Council directed staff to proceed with the request and bring back any necessary documents for approval. • Commissioner Appointment — Elm Creek Watershed Commission o Appointed John Bottema to the commission to represent Corcoran with Cindy Patnode as an alternate. • Commissioner Appointment — Planning Commission o Re- appointed Meredith Wu to the Planning Commission • Commissioner Appointment — Parks and Trails Commission o Re- appointed Rachel Tessmer, Judith Strehler, and Val Nybo to the Parks and Trails Commission. • Administration Department Reorganization o Approved the new position of City Clerk /Administrative Services Coordinator and directed staff to proceed with the reorganization as presented. March 12, 2015 • Presentation — Senator Dave Osmek o State Senator Dave Osmek gave a legislative update to the Council. He highlighted his priorities for the $1.867 billion surplus which included additional transportation funds for cities. He also referenced the bills he is sponsoring that include Met Council changes, liquor sales, and funding to Corcoran for a regional recreation amenity. • Volunteer Recognition — Darrell Krueger o Recognized Darrell Krueger for his service on the Planning Commission from May 2007 to February 2015. 7c. • Downtown Utility and Street Improvement Project Update o Provided the Council with an update on the financial status of the project. Staff was directed to refine the TIF fund value, begin surveying affected parties, and to look into a few additional financial options. • 2015 Water and Sanitary Sewer Fee Schedule Update o Approved an amended fee schedule for the utility. • Police Lieutenant Appointment — Ryan Burns o Appointed Ryan Burns to the position of Lieutenant effective March 16, 2015. • Police Officer Hiring Process o Approved a motion directing staff to initiate the hiring process for a new Police Officer.
