A RESOLUTION DECLARING A PUBLIC NUISANCE AND ORDERING IMMEDIATE
ABATEMENT OF THAT NUISANCE BY CITY STAFF AT THE PROPERTY LOCATED AT
10480 HEATHER LANE, CORCORAN, MINNESOTA (PID 05- 119 -23 -32 -0003)
WHEREAS, Brian R. and Holly A. Burns ( "the owners ") are the owners of the property at 10480
Heather Lane, Corcoran, Minnesota ( "the property "); and
WHEREAS, City staff became aware of a multiple public nuisances on "the property ",
specifically the existence of a fence which encroaches upon a public right -of -way and several
animals which are not secured and which have been allowed to run at large in the City; and
WHEREAS, Code Compliance Official Mike Pritchard notified "the owners" of the nuisances via
a letter dated December 1, 2014 and required immediate abatement of the same, ordering that
such abatement be completed or scheduled for correction no later than his re- inspection on
December 22, 2014; and
WHEREAS, Code Compliance Official Mike Pritchard re- inspected the property on December
22, 2014 and found no abatement action had been taken on "the property" and no appeal has
been filed; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORCORAN, MINNESOTA, that the City Council hereby does find that the presence of the
fence on the property at 10480 Heather Lane, Corcoran, Minnesota which encroaches upon
public right -of -way and allows several animals which are not secured and which have been
allowed to run at large in the City, is a public nuisance and must be immediately abated as
follows:
1. City staff is hereby empowered to take immediate action to remove the fence on the
property at 10480 Heather Lane, Corcoran, Minnesota from the public right -of -way
and construct suitable containment for the animals on the property.
2. Staff shall keep a detailed record of all costs associated with this abatement and
assess the same against the real estate as a special assessment to be collected in
the same manner as property taxes.
