City of Corcoran City Council Meeting Minutes September 11, 2014 — 7:00 PM The Corcoran City Council met on September 11, 2014, at City Hall in Corcoran, Minnesota. Present were, Mayor Guenthner, Councilor Asleson, Councilor Cossette, and Councilor Thomas. Councilor Lynch was excused. Also present were City Administrator Martens, City Planner Lindahl, City Engineer Torve, Lieutenant Hamilton, Public Safety Director Gormley and City Clerk Heinecke. Mayor Guenthner called the meeting to order at 7:00 pm 1. Call to Order / Roll Call 2. Pledge of Allegiance 3. Agenda Approval Motion: made by Cossette, seconded by Thomas to approve the agenda as presented. Voting Aye: Guenthner, Asleson, Cossette, and Thomas (Motion carried 4:0) 4. Open Forum 5. Presentations 6. Consent Agenda a. Draft Minutes of August 28, 2014 Council Meeting Motion: made by Cossette, seconded by Thomas to approve the consent agenda with the correction as presented. Ravinia — Amended Phase 1 Grading Plan (14 -003) report by City Planner Lindahl. Council discussed. Motion: made by Thomas, seconded by Asleson to approve recommendation 3 "Approve the amended Phase 1 grading plan as requested by Lennar, except that no grading can occur in the area shown as Phase 5 of the plat. No other changes to the prior approvals is granted and no additional work (including street, utility or building construction) shall be allowed until the conditions of approval have been met" as presented. Motion: made by Thomas, seconded by Cossette to approve Resolution 2014 -50 "Adopting Preliminary Proposed Tax Levy Collectible in 2015" as presented. Council discussed Motion: made by Asleson, seconded by Cossette to amend Resolution 2014 -50 to increase by $35,586 for a mid -year staff hire. Jeanie Heinecke — City Clerk City of Corcoran September 25, 2014 County of Hennepin State of Minnesota RESOLUTION NO. 2014 -56 Motion by: Seconded by: A RESOLUTION AUTHORIZING AN INTERFUND TRANSFER WHEREAS, the City initially recorded interfund loans for project costs financed by the General fund and completed in the Infrastructure Planning and Shannon Lane funds with the expectation of re- paying the interfund loans with future revenue sources in those funds; and WHEREAS, the City does not expect sufficient revenue sources to be received by the Shannon Lane and Infrastructure Planning funds to repay the General fund; and WHEREAS, the City will record a transfer of the interfund loan balance of $177,929.76 between the General fund and Infrastructure Planning fund; and WHEREAS, the City will record a transfer of the interfund loan balance totaling $66,310.65 between the General fund and Shannon Lane fund, with the remaining balance to be repaid with collections of special assessments; NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Corcoran, that the described interfund loan transfers are authorized. The sketch plan and comprehensive plan request was reviewed by Parks Commission on March 18th and Planning Commission on March 6` ". On June 12` ", the City Council approved the Comprehensive Plan amendment. The Met Council completed their review and acted on the request at their August 27tH meeting. The applicant has submitted a voluntary EAW and the City Council ordered the completion and distribution of the EAW at their September 11th meeting. We expect the EAW process to be completed in November. The applicant is also working to complete the development plans for submission of the preliminary plat, preliminary PUD development plan and rezoning to PUD yet this fall. 2. City- Initiated Park Dedication Ordinance Update (City File 14 -007). At the April 10th meeting, the City Council directed staff to prepare a minor update to the park dedication ordinance as outlined in the staff memo. Staff provided a draft to the City Council for review at the June 26th meeting and, based on Council feedback has met with Councilmember Cossette to gather his comments. These comments will require significantly more research and analysis than originally anticipated and will not be ready for a public hearing until this fall. The City Attorney and City Planner agree that since the primary concern in is with the land dedication requirements in the rural areas, we will focus on solutions that are legally defensible and accomplish the City Council goals. We agree that a moratorium (or interim ordinance) is not needed at this time. Should a rural subdivision be submitted, we recommend that the City Council simply take cash in lieu of land while the new ordinance is being developed. There are no current applications in the pipeline that will be affected by the rural area change and we have several full agendas coming up. We are working with the City Administrator to identify a date for an update to the City Council. 3. City- Initiated Ordinance Update for Sketch Plans (City file 14 -009). At the April 10th meeting, the City Council directed staff to prepare an ordinance update to streamline the sketch plan review process and require Council action only. Staff provided a draft to the City Council for review at the June 26th meeting and, based on Council feedback, a public hearing was held at the September 4th Planning Commission meeting. The Planning Commission recommended approval and the item is scheduled for the September 25th Council meeting. 4. Administrative Permit and Site Plan to add antennas and modify ground equipment on an existing tower for AT&T antenna at 20140 CR 30 (PID 11- 119 -23 -12 -0001) (city file 14 -019). This applicant may be administratively approved. The application is currently incomplete. 5. Patnode Farms Preliminary Plat and Final Plat at 22610 County Road 50 (PID 20- 119- 23 -43- 0003) (city file 14 -021). Mike Patnode has submitted a request for plat approval to create one lot for the existing home and one outlot to be sold. The Planning Commission held a public hearing on Landform , SensiblyGreen and Site to Finish® are registered service marks of Landform Professional Services, LLC. 1 September 4, 2014 and voted unanimously to recommend approval. The City Council will consider this request at their September 25th meeting. 6. Topographic and Wetland Waiver Request from Donald Proehl, Jr. at 20630 Larkin Road (PID 26- 119 -23 -23 -0001) (city file 14 -024). Mr. Proehl has requested approval of a topographic survey and wetland delineation waiver to allow him to subdivide his property to split off a lot for the existing home built for a farmhand from the principal farmstead and farm land. If approved, the next step would be to submit an application for preliminary plat, final plat and variance. The item is scheduled for City Council review on September 25, 2014. 7. Administrative Permit for a Sprint Antenna replacement at 23400 CR 10 (PID 07- 119 -23 -43 -0004) (city file 14 -025). An administrative permit was received to upgrade the antennas on this existing tower. The application is currently incomplete. The application may be administratively approved. Also, there are a number of projects that have been approved, but are still not filed and closed out: 1. Corcoran Business Park (city file 06 -005). The City Council granted a one year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. Notably, we met with the land owner in February and may have a new development application for this site later this year. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (city file 12 -002). Hope Ministries submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. The letter of credit for site improvements has been released but we are holding the escrow pending completion of the approved landscaping. The applicant has indicated that they are considering a site plan amendment application to modify the approved plans. 3. Heinz Second Addition Preliminary and Final Plat at 20801 CR 117 (03- 119 -23 -14 -0002) (City file 13 -003). A wetland and topographic waiver was approved on January 24th. This item was approved by the City Council action on April 25th. The applicant is working on complying with approval conditions so that they can get the final plat mylar signed and recorded. The applicant has site work to complete and then the escrow can be refunded. 4. Ess Addition (city files 05 -017, 08 -003 and 12 -024). The City Council granted an after - the -fact extension for this final plat at their November 29, 2012 meeting and a second extension at the November 25, 2013 meeting. The plat has been recorded and staff is working with the applicant to address any outstanding issues and close out the file /refund the escrow after wetland monuments and lot monuments are installed. 5. Lano Equipment at 23580 Highway 55 Site Plan Modifications for Cold Storage Building. (31- 119 -23 -34 -0007) (13 -006). This item was approved by the City Council on July 11 h. The building permit has been issued, but staff has determined that the building was not being built according the approved plans. The applicant submitted revised plans and the City Council approved a site plan modification at the June 12th meeting. City staff is working with them to make the corrections and complete the building and site improvements. 6. Ess Brothers Site Plan Amendment and Conditional Use Permit Amendment for an accessory building at 9350 County Road (PID # 07- 119 -23 -43 -0004) (City File No. 13 -031) The applicant requested approval of a 5,500 square feet detached, accessory building with 20 -foot sidewalls. The City Council approved this item on January 23rd. The applicant must now file the resolution at the County and then staff will close out the file and refund any remaining escrow. The applicant may apply for a building permit after the resolution is recorded. MEMORANDUM 7. Maple Hill Estates 3rd Addition Preliminary and Final Plat (PID 24- 119 -23 -43 -0016 and 24- 119 -23- 43 -0014) (city file 14 -001). A site plan and variance was approved on April 25, 2013 for this project, but it was then determined that the new community center should be located on City property. The plat was required to adjust property lines. The City Council approved the preliminary and final plat on March 27th. The mylars were recorded this month and construction has begun. We will be monitoring this throughout construction and due to the financial relationship between the city and the applicant, we will not close out this file until construction is complete. 8. Lennar Final Plat, Vacation, Development Contract and Final PUD Development Plan for "Ravinia" (City file 14 -003). The applications were approved at the April 24th City Council meeting. Staff is now working through the final plan revisions with the applicant. The development contract has been signed, the financial guarantee submitted and the final details are being addressed. An expanded grading plan was approved by the City Council on September 11th and infrastructure work may be beginning this week if the city planner is able to confirm certain conditions have been met. There are still a number of approval conditions that must be addressed prior to release of the final plat mylar for recording. No building can begin until the mylar is recorded at Hennepin County. 9. Lake Independence Regional Trailhead at 23475 CR 10 Rezoning, Site Plan and Variance (PID 18- 119 -23 -12 -0002) (city file 14 -010). Three Rivers Park District has submitted a request for a temporary trailhead at this location. The City Council approved the request on July 24th. Three Rivers has indicated that they did not receive any bids this summer and will rebid the project the spring for 2015 construction. 10. Fox Ridge 2nd Addition Final Plat at 9495 Trail Haven Road (PID 09- 119 -23 -41 -0011) (City File 14- 006). This final plat application for a final plat of Outlot A, Baumeister 3rd Addition was approved by the City Council on May 22nd. The applicant will prepare mylar for signature and filing. After the documents are filed, the remaining escrow can be released. 11. Hentges Lawn Land Snow Special Home Occupation at 21310 Meadow Lane (City file 14 -012). The application was approved by the City Council on August 28th. Staff will be working to close out the file. 12. Topographic Survey and Wetland Delineation Waiver for Mike Patnode at 22610 CR 50 (city file 14 -014). The applicant has submitted an application and staff has notified them of additional items needed to make this item complete. This request was approved at the July 24th Council meeting. 13. Certificate of Compliance for John Scherber at 9305 Bechtold Road (PID 08- 119 -23 -44 -0001) (city file 14 -023). Administrative approval was granted for a new silo on this property. Finally, there are a few projects that have not yet been started but have been identified as action items or future projects: Sign Ordinance Update. At the April 25th Council meeting, the City reviewed a request for the city to initiate a sign ordinance update. Specifically, they requested that the City review the ordinance standards relating to sign area, sign height and internal illumination and, because this is a city -wide issue, that the ordinance update be completed by the City out of the City funds. The Council discussed the issue and directed staff to bring a proposal back at a later date because the Council felt that this was a significant undertaking that would involve much more than this one issue. We will work with the City Administrator to determine the appropriate meeting to have this considered. 2. Design Guideline Update for Southeast District/Downtown. The Council approved a Landform proposal to update the existing design guidelines for this area. The design guidelines are adopted as part of the Zoning Ordinance and will be enforced as new development is proposed, consequently, the City Council wishes to revisit that planning effort to ensure it is still consistent with the City's goals. The City Council appointed a subcommittee, but the City Council has decided to delay kickoff as we work through some associated issues as part of some new development plans. Council Meeting: Prepared By: September 25, 2014 Brad Martens Topic: Action Required: Financial Performance Report Direction Summary: At the August 28, 2014 City Council meeting staff was directed to eliminate a projected shortfall for 2014 in the amount of $69,523. Staff made adjustments and informed the Council at the September 11, 2014 meeting that the shortfall had been eliminated. Since that time staff has incorporated the financial implications of the payout liability associated with the retirement of the Public Safety Director in the amount of $16,913. The City does not have a fund set aside to fund retirement payouts. Staff would like the City Council to direct staff on whether the unfunded payout liability should also be eliminated by cutting additional funds. Staff has already cut significantly into the 2014 budget. Additional cuts likely require service reductions. In addition, staff would like the City Council to discuss priorities related to engineering work. It is projected that remaining engineering work required to meet our obligations will reach $38,000 out of a budget of $40,000. The additional unanticipated work related to the Foxline Drive /Treeline Drive discussion will take the remaining $2,000. If the City wishes to continue to work on the draft plan to pave gravel collector roads the engineering budget will go over budget by an estimated $2,000. Staff would like the Council to direct staff to either go over the engineering budget to complete the plan to pave gravel collector roads or wait to continue work until 2015. Financial /Budget: A budget shortfall requires funds to be used out of the City's reserves. Eliminating the shortfall eliminates the need to use reserves. Application Request Michael L. Patnode is requesting approval of a preliminary plat and final plat to create a 10.1 -acre lot and a 67.79 -acre outlot. There is an existing house on the proposed lot. 2. Planning Commission Meeting The Planning Commission held a public hearing and reviewed this item at their September 4t" meeting and voted unanimously to recommend approval of the request. No one other than the applicant attended the public hearing. Following the Planning Commission meeting, the applicant revised the plans to provide the right of way dedication requested by Hennepin County, and adjusted the lot and outlot sizes to 10.1 -acres and 67.79- acres, respectively. The applicant also updated the plans to show wetland setbacks, buffers, monuments and easements. 3. Context Background On July 24, 2014, the City approved a topography waiver for the entire site. A wetland delineation waiver was approved for proposed Outlot A. A wetland delineation was required for the wetlands in proposed Lot 1, Block 1. Zoning and Land Use The subject property is guided Rural / Ag Residential in the 2030 Future Land Use Plan and zoned Rural Residential. The surrounding properties are all zoned Rural Residential and guided Rural / Ag Residential. Natural Characteristics of the Site :i`,; a 4 The 2030 Comprehensive Plan shows a wetland in the northeast corner of proposed Outlot A and proposed Lot 1, Block 1. In addition to this wetland, the National Wetlands Survey shows a wetland generally on the western part of the site. No new development is proposed on either parcel. Parks and Trails The Parks and Trails Map from 2030 Comprehensive Plan shows a proposed on -road trail along County Road 50. Access Proposed Lot 1, Block 1 will be accessed by an existing drive. Proposed Outlot A will continue to be used as farmland, and will be accessed by neighboring farm lots. The future owners of the land are planning on enrolling proposed Outlot A in the Agricultural Preserve program. 4. Analysis Staff has reviewed the application for consistency with the Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance, and City Code requirements, as well as City policies. A. Level of City Discretion in Decision - Making The City's discretion in approving a preliminary and final plat is limited to whether or not the proposed plat meets the standards outlined in the City's subdivision ordinance and zoning ordinance. If it meets these standards, the City must approve the final plat. B. Consistency with Ordinance Standards Lot Size The plat would create one 10.1 -acre lot for the existing home and one 67.79 -acre outlot for the existing farmland. These lot sizes exceed the RR district minimum of lot size of 2 acres. The staff report for City file 14 -014 (request for topographic and wetland waiver), notes that the proposed plan shows the outlot wrapping around proposed Lot 1, Block 1. The eastern strip meets the 200 foot minimum width requirement of Section 1040.030 (Standards for Rural Residential districts); however, it is covered by a wetland. This wetland will restrict future access to the site, and provides no benefit to Outlot A. Staff recommended including this strip as part of Lot 1, Block 1, but the applicant chose to keep the existing layout. Staff notes that when Outlot A is developed the City will expect one public street access on the western portion of the lot to serve the homes. Patnode Farms Preliminary Plat (City file 14 -021) September 25, 2014 Well and Septic • • The existing farmstead's well and septic on proposed Lot 1, Block 1 will remain. No well and septic will be required for proposed Outlot A. Streets No new streets are proposed. The revised plat drawings submitted by the applicant shows a 50 -foot '/2 right -of -way for County Road 50, which is sufficient right -of -way for the future pedestrian and bicycle trail shown in Corcoran's 2030 Comprehensive Plan. This was a condition in the Hennepin County Transportation Department review of the proposed plat on August 21, 2014. Hennepin County noted that County Road 50 is designated in the Hennepin County Bicycle System Plan as a future on -road facility. The County notes that any proposed construction requires an approved Hennepin County Permit prior to any construction, however no new construction is proposed. Public Safety Review Plans were sent to the fire department on July 31, 2014. There were no comments from the Fire Chief and Fire Marshal regarding public safety as of the date of this report. Natural Characteristics of the Site The aerial photos show a lightly forested area in and near the wetland on proposed Outlot A. However, there is no development proposed on the proposed lot and outlot. Wetlands The Corcoran Natural Resources Inventory Areas Map shows that Lot 1, Block 1 has wet prairie on the northeast corner of the proposed parcel and the National Wetlands Survey shows a wetland on the western edge of the proposed parcel. A wetland delineation was completed on the wetlands in proposed Lot 1, Block 1. The wetland delineation was submitted to the Elm Creek Watershed Management Commission ( ECWMC) for review and approval. The ECWMC approved the delineation on August 5, 2014. In lieu of a Minnesota Rapid Assessment Method for Evaluating Wetland Functions analysis, the applicant was advised at the Planning Commission meeting that they had the option to simply follow the standards for a medium - quality wetland buffer. The revised Preliminary Plat shows the required 25 -foot wetland buffer and a 15 -foot setback in accordance with 1050.010 of the Zoning Ordinance. Section 1050.010, Subd. 7 states "A permanent wetland buffer monument shall be installed at each lot line where it crosses a wetland buffer, and where needed to indicate the contour of the buffer, with a maximum spacing of 200 feet of wetland edge. If no buffer is required, the monument shall be at the edge of the wetland." Patnode Farms Preliminary Plat (City file 14 -021) September 25, 2014 • • 0 • While the applicant shows sufficient number and placement of wetland buffer monuments for the wetland in the northeast corner of the lot, they will need to install additional wetland buffer monuments around the wetland in the central part of the site. Staff has attached a plan showing where the additional wetland buffer monuments should be placed to indicate the contour of the buffer. This wetland should have a total of five wetland monument buffers. Buffers, setbacks, and monuments will be required to be installed prior to the release of the escrow. Section 1050.10, Subd. 5 requires that buffers around wetlands are planted with vegetation in accordance with Section 1050.10, Subd. 8, Buffer Strip Vegetation Performance Standards. Staff has included a condition that will require the applicant to comply with these standards. Drainage and Utility Easements Section 945.060, Subd. 2 of the Subdivision Ordinance requires 10 -foot drainage and utility easements around the perimeter of the lot and over the wetlands. The plans comply with these requirements. Parks and Trails Staff notes that Section 955.020 of the Subdivision Ordinance states "Park Dedication is only due in cases where additional new parcels are created." The subdivision will create one new lot for the existing home and one vacant outlot. At this time, park dedication is required only for the new 10.1 - acre lot, as no previous park dedication has been provided for this parcel. This is consistent with the ordinance application for Triden Ridge 2nd Addition. Under the current ordinance, park dedication is required at 10% of the net land area. The City may accept cash -in -lieu of land at 10% of the value of the land with a maximum rate of $3,000 per unit for each new unit located outside of the MUSA (Metropolitan Urban Service Area), such as this. Cash in lieu of land would be $3,000 at the current rates (1 x $3,000 per unit). The Parks & Trails Plan in the 2030 Comprehensive Plan shows a future on -road trail in the County Road 50 right -of -way. The trail will be constructed in the County Road 50 right -of -way. No land beyond the required 50 foot half right -of -way as described in the Hennepin County Transportation letter is required for this future trail. C. Conclusions Staff has reviewed the preliminary plat and final plat for consistency with the applicable standards outlined in the Comprehensive Plan, Zoning Ordinance and Subdivision Ordinance. Staff noted in the staff report the outstanding issues that must be addressed and have included conditions in the attached draft resolutions to address these issues. 5. Context The 49.35 -acre parcel is unplatted and has 5 development rights remaining. The existing farmstead is on the southwest corner of the property and has a second home and associated accessory buildings in the south central portion of the site. The applicant is planning to request preliminary plat approval to carve off a one -acre lot for the second home originally built for a farmhand. Zoning and Land Use The property is zoned Urban Reserve and is guided Low Density Residential. The property is located in the MUSA and is in the 2025 -2030 phase of the Sanitary Sewer Service Staging Plan. Surrounding Properties Property to the west, north, east, and southeast are zoned Urban Reserve and guided Low Density Residential. Property to the southwest is zoned Rural Residential and guided Rural / Ag Residential. The National Wetlands inventory also shows a small wetland located adjacent to the eastern side of the barn on the principal farmstead and a wetland located in the northwestern portion of the site. 3. Analysis of Request The applicant is proposing to subdivide the property to create a one -acre lot for the existing farmhand house and a 48.35 acre lot for the farmstead. There is no proposed development on either parcel. The development rights map shows 5 development rights remaining on the primary home's parcel. At the time of platting, the developer should indicate to the city how these rights should be applied to the parcel, but we expect they will be applied to the larger parcel. The 2030 Comprehensive Plan shows a wetland that is generally located in the southeast corner of the site. The National Wetlands inventory also shows a small wetland located adjacent to the eastern side of the barn on the principal farmstead and a wetland located in the northwestern portion of the site. The only time the city can require easements over wetlands and required wetland buffers is at the time of platting. Therefore, staff recommends that a wetland delineation be completed for only for the small lot. A wetland delineation will be required for the larger lot when it is subdivided. • While no new development is proposed for the existing parcels, staff recommends that a wetland delineation be completed on the small parcel in order to provide the required wetland buffers and setbacks. • Staff recommends approval of the topography waiver for the entire site because no new development is proposed. If the exemption is approved, the applicant would proceed with a preliminary and final plat to allow subdivision of the property. The application would require a variance from the minimum lot size. The property is currently zoned Urban Reserve, which requires a 20 acre minimum lot size until sanitary sewer, water, streets, and other public infrastructure is available. The 2030 Comprehensive Plan Sanitary Sewer Service Staging plan shows that infrastructure is planned for the property in the final stage of expansion between the years 2025 -2030. If the applicant chooses to pursue a preliminary and final plat for the farmhand house, a variance for the minimum lot size will be required. This is a unique property because there are two homes on one lot, however, there is sufficient land to create lots that comply with Urban Reserve standards. If the Council were to approve a variance from the minimum lot size, staff recommends that the Council refer to Rural Residential (RR) standards. The applicant would need to show how many accessory buildings will be on the smaller lot and that the buildings meet setback requirements for the Urban Reserve district. Poehl Topographic and Wetland Exemption (14 -024) September 25, 2014 0 a~ Should the applicant decide to proceed with the Preliminary Plat, Final Plat, and Variance application, they must demonstrate to the City Council that the following criteria have been met: 1. That there are practical difficulties in complying with the Zoning Ordinance. 2. That the conditions upon which a petition for a variation is based are unique to the parcel of land for which the variance is sought and were not created by the landowner. 3. That the granting of the variation will not alter the essential character of the locality. 4. The proposed variance would be in harmony with the general purposes and intent of the Ordinance. 5. The variance is consistent with the Comprehensive Plan. The Council may wish to comment on the concept plan and proposed variance, but any comments are advisory only and would be non - binding. 4. Recommendation Move to approve Resolution 2014 -54 allowing for a topographic waiver for proposed lots and a wetland delineation waiver for the larger lot at 20720 Larkin Road. Application Request The City Council directed staff to prepare revisions to the zoning ordinance regarding sketch plans. Specifically, the Council directed staff to simplify the sketch plan process and send them directly to the City Council with minimum submittal requirements to allow council review prior to the applicant investing significant time and money. At the June 26, 2014 City Council meeting, the Council reviewed the draft language and directed staff to hold a public hearing to consider the changes. 2. Planning Commission Review The Planning Commission held a public hearing to consider the amendment at their September 4`h meeting. There was no one present to speak on this item. The Commissioners expressed some concern that the applicant would not get some of the more detailed feedback that the Planning Commission offers but generally agreed that the City Council should provide high level sketch plan feedback. The Commission voted unanimously to recommend approval. 3. Proposed Language The current Corcoran Zoning Ordinance requires a PUD sketch plan to be presented to the Planning Commission and City Council and allows the same process as an option for other applications. The City Council felt that applicants should present these concepts to the City Council first to gather high level feedback on the policy issues rather than some of the more detailed planning issues. Staff was directed to revise the ordinance to send sketch plans to the City Council only. Staff is also recommending some changes for consistency between the Sketch Plan and PUD Sketch Plan processes. This project provides for a new or rehabilitated lift station and a second forcemain, and potential new facilities to serve Loretto, northwest Medina, and southwest Corcoran. The MCES staff is continuing to assess the options and has asked the City of Corcoran if we would expand our Metropolitan Urban Service Area (MUSA) in the southwest portion of the City if additional sewer capacity became available. At a prior City Council meeting, the Council did direct staff to consider an expansion if possible. The MCES team does not yet know how much additional capacity will be available, but we believe it could be 800 -1,000 additional acres of additional capacity for Corcoran. For the purpose of discussion, staff has prepared a map showing a possible MUSA expansion area extending up County Road 19 and encompassing an additional 960.2 acres of land. If additional sewer capacity were to become available and the City of Corcoran wished to expand the MUSA to reflect this larger area, the City would be required to complete a major comprehensive plan amendment to update the land use map and the other chapters of the comprehensive plan to reflect the change. However, at this time, staff is simply seeking Council direction to share this concept with MCES staff to further the discussion. 2. Action The Council should direct staff to continue working with MCES staff to explore potential options for an expansion of the SW Corcoran MUSA area as shown on the attached maps. Attachments a. Cost and Method of Assessment The estimated project cost for Foxline Drive is $398,855. The prior estimate of $366,000 was updated to include an increase in bituminous prices, a 10% assumption of poor soil correction, etc. The estimated project cost for Treeline Drive is $138,195 and again the prior 2012 cost of $126,000 was updated as noted above. Foxline Drive and Treeline Drive are currently gravel roads in a residential development. The proposed work would include verifying the thickness of the existing gravel base material to ensure an adequate amount exists and adding material where required. The road would be shaped and paved to a 28 -foot width (24 foot pavement, 2 foot shoulders) with 3.5" of bituminous. Although there are no known subgrade issues, a percentage of roadway has been estimated for subgrade correction and this will be handled as needed during construction. There is no stormsewer /curb and gutter included in this work. The total estimated project costs for the various improvements identified in this report include indirect project costs such as engineering, legal, administrative, geotechnical testing and other miscellaneous items. 3.2 ASSESSMENT METHOD The proposed method of assessment for the project is on a per parcel basis. Figure 1 identifies the parcels included in the assessment. There are 29 parcels shown on the figure, yet 27 have been communicated in past analysis. The past analysis based the units on a lot equivalent while this analysis is basing the units on a per parcel. There are 29 parcels that have an address on Foxline Drive or Treeline Drive. 3.3 COST APPORTIONMENT Construction costs are shown in Table 1. The benefitting parcels are identified in Figure 1. The amount of project costs assessed should be discussed by the Council. The table shows a 70%/30% split of total project costs to benefiting properties with the balance covered by general funds. The 70% cost ($375,935) would be distributed equally to the 29 parcels. The assessment amount is estimated at $12,963.28. The remaining 30% of the construction cost ($161,115) would be covered by City funds. 3.4 CITIZEN'S PETITION The City of Corcoran received a 'Proposal for Paving Trail Haven (County 10 to County 30), Treeline, and Foxline' from Carolyn Holford which was also supported by other residents. The full response memo from Wenck Associates is included in Appendix A. Treeline /Foxline can be financed through city bonds. • The cost to currently maintain Trail haven, Foxline, and Treeline = $24,840 /year or $687,483 over 20 years. • Instead of paying annual gravel road maintenance; the City could use the maintenance dollars toward the payment of the Foxline /Treeline bond. This appears to be the key point of the proposal. • The Foxline /Treeline costs not covered by the City could be assessed to the benefiting properties. The annual assessment of $144/lot would be less than the annual cost of dust control. We have reviewed the proposal and appreciate the thoughts and effort as documented by Mrs. Holford. There are several assumptions which could be discussed; however, one assumption essentially is at the core of the proposal. It is assumed that the City pays $24,840 /year for maintenance currently and that the City will not pay for maintenance after the roads are paved; therefore "avoiding" maintenance costs. All current maintenance costs can then be put toward the improvement of the road. See the following proposal excerpt. "Given the low traffic counts for Treeline /Foxline, it is not clear that there will be major maintenance costs over the life of the roads (20 years), nor is it possible to estimate those costs." It is possible to estimate future paved road maintenance costs. These costs have been estimated for prior projects and were included in the supporting documentation of the Holford proposal.
