HomeMy WebLinkAboutResolution 2014-53 - Approve Final Plat 22610 Co Rd 50City of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2014 -53 Motion By: Thomas Seconded By: Lynch September 25, 2014 A RESOLUTION TO APPROVE A FINAL PLAT FOR PROPERTY LOCATED AT 22610 COUNTY ROAD 50 (PID 20- 119 -23 -43 -0003) (CITY FILE NO. 14 -021) WHEREAS, the Michael L. Patnode has requested approval of a final plat to allow for the subdivision of the 78.33 acre property legally described as: The West Half of the Southeast Quarter of Section 20, Township 119, Range 23 except that part commencing at the southwest comer of said SW'% of the SE Y4 thence east along the south line of said SW '% of the SE '% a distance of 215.00 feet to the actual point of beginning; thence continuing east along said south line, a distance of 200.00 feet; thence north deflecting 92 degrees 30 minutes left, a distance of 211.97 feet: thence west deflecting 87 degrees 30 minutes left, a distance of 200.00 feet, thence south deflecting 92 degrees 30 minutes left, a distance of 217.97 feet to the point of beginning. Containing 1.0 acre and subject to the right of way of Hennepin County Highway Number 50 over the south side thereof of Section 20, Township 119, Range 23, Hennepin County, Minnesota. WHEREAS, the Planning Commission reviewed the submitted preliminary plat at a duly called Public Hearing and recommends approval, and; NOW THEREFORE BE IT RESOLVED that the Corcoran City Council approves the request for a final plat subject to the following findings and conditions: A final plat is approved to create 2 lots in accordance with the plans received by the City on July 16, 2014, and revisions received on September 16, 2014 except as amended by this resolution. 2. There are 8 development rights remaining on Outlot A, and zero building rights remaining on Lot 1, Block 1. 3. Approval is contingent upon City Council approval of the preliminary plat. 4. The applicant shall comply with the conditions required by the Hennepin County Transportation Department in their August 21, 2014 letter. FURTHER, that the following conditions be met prior to release of the final plat and associated documents for recording: 5. Park dedication is due for the new Lot 1, Block 1 parcel. Park dedication for Outlot A will be subject to park dedication requirements if and when it is platted. a. Park dedication shall be cash in lieu of land for Lot 1, Block 1 subject to the park dedication requirements in place at the time the plat is released for filing. Park dedication for Lot 1, Block 1 shall be paid prior to release of the final plat for filing. FURTHER, that the following conditions be met prior to release of any remaining escrow balance: 6. Lot monuments shall be installed as required by the Subdivision Ordinance. 7. The applicant must plant the wetland buffers in accordance with Section 1050.10, Subd. 5 of the Zoning Ordinance prior to release of escrow. 8. All permanent wetland buffer monument signs must be erected along the wetland buffer line as required by Section 1050.010, Subd. 7 of the Zoning Ordinance. Staff finds that the central wetland is missing three monuments. a. Wetland signs shall be purchased from the City. b. Wetland buffer signs must be installed at each lot line where it crosses a wetland buffer and where needed to indicate the contour of the buffer, with a maximum spacing of 200 feet of wetland edge. c. The final locations must be inspected and approved by City staff. 9. The applicant shall provide the approved preliminary and final plat drawings to the City in an electronic (AutoCAD) format. 10. The applicant must file the final plat at Hennepin County within 2 years of the date of approval or the approval shall expire. 11. The applicant shall provide proof of recording the final plat, resolutions and driveway easement agreement at Hennepin County.
