A RESOLUTION ORDERING ABATEMENT OF NUISANCES AND AUTHORIZING
ABATEMENT BY THE CITY ON THE PROPERTY AT 7695 ROLLING HILLS ROAD
WHEREAS, Fannie Mae ( "the Owner ") is the owner of the property at 7695 Rolling
Hills Road, Corcoran, Minnesota ( "the Property ")
WHEREAS, Mike Pritchard, City Code Compliance Official, noted extensive garbage
and debris on the Property, which was not deposited at places designated and provided for that
purpose, a compromised exterior of the residence on the Property, and foul odors emanating
from the Property during inspections of the property on January 24, 2014, January 31, 2014,
March 6, 2014, and March 26, 2014, and;
WHEREAS, Mr. Pritchard notified the Owner of the nuisance conditions via a letter,
dated January 24, 2014 and subsequently sent an abatement order, dated February 3, 2014,
requiring abatement of all nuisances on the Property or the filing of an appeal of the order by
February 20, 2014, and;
WHEREAS, Mr. Pritchard sent a second abatement order, flagged as a "final notice ", to
the Owner on March 21, 2014 and informing the Owner the Property would be re- inspected on
March 31. 2014, and;
WHEREAS, the Owner has not abated the nuisances on the Property and has not filed
notice of an appeal of the February 3, 2014 abatement order, and;
WHEREAS, Corcoran City Ordinance 82.06 empowers the City to abate such nuisances,
under these circumstances, and provides for certification of all costs of the abatement to be
charged against the real estate as a special assessment to be collected in the same manner as
property taxes.
NOW, THEREFORE, the Corcoran City Council RESOLVES as follows:
1. That the Owner shall abate all of the nuisances on the Property, outlined in the February
3, 2014 order, by April 3, 2014.
2. That if the nuisances on the Property are not abated by that date, the City shall be
authorized to abate the nuisances, and the Owner shall be liable for the expenses incurred
in doing so, based upon the City's fee schedule and applicable ordinances.
3. That those expenses incurred shall be charged against the Property as a special
assessment to be collected with the 2015 property taxes.

4. That the city attorney confirm legally sufficient description of the owner.
