The Corcoran City Council met on March 13, 2014, at City Hall in Corcoran, Minnesota. Present were, Mayor Guenthner, Councilor Asleson, Councilor Cossette, Councilor Lynch, and Councilor Thomas. Also present were City Administrator Martens, City Attorney Carson, City Engineer Torve, Director of Public Safety Gormley, and City Clerk Heinecke. Upon further review of the City Clerk job description it became evident that additional adjustments were required to accurately reflect the duties and expectations of the position. Updated City Clerk Job Description CITY CLERK ©City of Corcoran 2013 1 Department: Administration Reports To: City Administrator Points: 267 Grade: 9 FLSA: Non-Exempt Bargaining Unit: NA Revision Date: DecemberMarch, 2013 Job Summary: The City Clerk is responsible to carry out the statutory duties of the City Clerk and to assist with the administration of City services by performing accounting and administrative duties and responding to service requests by the public. The City Clerk processes accounts receivable and utility billing. Scope of Impact: The City Clerk is responsible for billing for utilities and recycling services and for accounting related services that have an impact on the revenue received by the city. The City Clerk needs to alert the Mayor and Council of shortfalls in escrow accounts so that exposure to unpaid services Essential Duties and Responsibilities: • The City Clerk performs technical accounting activities. o Prepares monthly financial performance report for City Council; keeps the Administrator and City Council informed of all financial activities and concerns; o Prepares accounts payable and receivable transactions and posts information to general ledger journal, verifies account information, and generates checks for bill payments; o Inputs payroll information in to accounting system software, and reconciles related accounts; o Prepares Federal, State accounting and tax reports and prepares payments; o Processes billing and special assessments invoicing for dust control, recycling and property maintenance; certifies unpaid special assessments to Hennepin County; o Maintains property address and resident information in Banyon Utility Billing software; o Processes general insurance claims and employees FSA health claims; o Deposits and transfers money between accounts and reconciles accounts; o Manages escrow accounts; alerts the Administrator of shortfalls in escrow accounts so that exposure to unpaid services can be managed; o Maintains Investment payments; o Tracks balances in the memorial park fund, park fund, utility fund and other dedicated funds. • Maintains files and appropriate documentation of bookkeeping and administrative functions in order to satisfy legal requirements. o Coordinates preparation and distribution of agenda information for City Council meetings.and Parks & Trails meeting. A Certified Municipal Clerk of Minnesota is desirable. Desired Qualifications: Additional desired qualifications include experience in a municipal or government setting. Knowledge knowledge of governmental practices and policies, including working with boards and commissions. A Certified Municipal Clerk of Minnesota or progress toward certification is desirable. Physical and Mental Requirements: Physical effort is light, with lifting or carrying up to 25 pounds intermittently. Report preparation and word processing will at times require extended use of a keyboard. Work interruptions are frequent. The City Clerk must be able to use judgment to respond to situations occurring during the absence of the Administrator. Working Conditions: Work is performed in a normal office environment. Attendance at evening meetings is required intermittently. Work may involve dealing with and calming individuals who are emotionally charged over an issue. Some requirements in this job description may exclude individuals who pose a direct threat or significant risk to the health and safety of themselves or other employees. Council Meeting: March 27, 2014 Prepared By: Brad Martens Topic: Amendment No. 2 to Contract No. A120539 – CDBG Agreement Action Required: Approval Summary: The proposed Maple Hill Community Center project is to be funded primarily through a Community Development Block Grant (CDBG) which originally expired at the end of 2013 but was extended until March 31, 2014. In order to allow for the project to continue to move forward an additional extension must be approved which is attached to this report. The project is currently in the building permit approval process in which there is an issue with the occupancy assigned by the architect and the amount of restrooms facilities provided. This item must be resolved prior to moving forward. Financial/Budget: The Community Development Block Grant provides $225,000 towards the proposed Maple Hill Community Center. Options: 1. Rockford School District Site Plan, Variances and Conditional Use Permit for a Baseball Field at 20400 County Road 50 (PID 23-119-23-34-001) (city file no. 13-023). The Parks Commission reviewed this at their meeting on October 15th and a public hearing was held at the Planning Commission on November 7th. On November 25th the City Council tabled this item to allow the applicant to try to address a number of issues. The applicant has been working with City staff, Peachtree Partners, who is proposing development on the Schendel property to the north, and the watershed to address a number of issues. The review period has been extended to May 1, 2014. 2. Corcoran Mini-Storage Comprehensive Plan Amendment, Rezoning, Preliminary PUD Development Plan, Preliminary Plat at 19219 and 19235 County Road 10 (PID 25-119-23-44-0002 and 25-119-23-44-0003) (city file 13-032). A sketch plan was reviewed by the City in August 2013 and comments were provided to the applicant. The applicant has taken those comments and prepared revised plans. This formal application is currently incomplete and the applicant has asked that the City process another round of sketch plan concepts in advance of completing their application submittal. The PUD Sketch Plan (round 2) was reviewed by the Parks and Trails Commission on January 21st, by the Planning Commission on February 6th and by the Council on February 27th. The Council did not support the concept. The applicant still has an active file and will likely submit a written request to withdraw the request and refund any remaining escrow. 3. Maple Hill Estates 3rd Addition Preliminary and Final Plat (PID 24-119-23-43-0016 and 24-119-23- 43-0014) (city file 14-001). A site plan and variance was approved on April 25, 2013 for this project, but it was recently was determined that the new community center should be located on City property. The plat is required to adjust property lines. The preliminary plat was reviewed at a public hearing at the March 6th Planning Commission meeting. The City Council will review the preliminary and final plat on March 27th. 4. Kopperhead Ranch LLC Agriculture Preserve Designation and Initiate Expiration at 20471 Larkin Road (PID 26-119-23-31-0001 and 26-119-23-34-0001) (city file 14-002). Chris and Kristin Smith have requested that two parcels be enrolled in Agriculture Preserve and have also initiated expiration so that they will come out of Agriculture Preserve in 8 years. The property is located in the MUSA, but is not planned to be serviced until after expiration of the Agriculture Preserve designation. The City Council will review the request on March 27th. 5. Lennar Final Plat, Vacation, Development Contract and Final PUD Development Plan for “Ravinia” (City file 14-003). The applications have been submitted, but staff is still reviewing the applications for completeness. The items could be scheduled for April or May Parks Commission, Planning Commission and City Council meetings. Peachtree Partners request for PUD Sketch Plan and Comprehensive Plan Amendment for Schendel property at 20400 County Road 10 (City file 14-005). The application has a number of very significant Comprehensive Plan issues, including triggering the need for the County Road 10 realignment as shown in Comprehensive Plan and extension of municipal sewer and water to this site. The applicant is asking to reguide the 103-acre property from High Density Residential to Low Density Residential, which requires a Comprehensive Plan Amendment. The City Council has informally reviewed this concept at December and January City Council meetings. This was reviewed by Parks Commission on March 18th, Planning Commission public hearing on March 6th and the City Council will review on March 27th. Also, there are a number of projects that have been approved, but are still not filed and closed out: 1. Corcoran Business Park (city file 06-005). The City Council granted a one year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. Notably, we met with the land owner in February and may have a new development application for this site later this year. 2. Park Place Storage After-the-Fact Extension of Approvals (city file no. 10-008). On September 23, 2010, the City Council approved a site plan and conditional use permit amendment for Park Place Storage to construct the 18th and final mini-storage building on that site. The approvals expired on September 23, 2011. The conditions have been met and a building permit was issued in September. The applicant has completed most of the site work with final items to be completed and final inspection this spring. 3. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (city file 12-002). Hope Ministries has submitted a request for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. The letter of credit for site improvements has been released but we are holding the escrow pending completion of the approved landscaping. 7. Heinz Second Addition Preliminary and Final Plat at 20801 CR 117 (03-119-23-14-0002) (City file 13-003). A wetland and topographic waiver was approved on January 24th. This item was approved by the City Council action on April 25th. The applicant is working on complying with approval conditions so that they can get the final plat mylar signed and recorded. The applicant has site work to complete and then the escrow can be refunded. 8. Lano Equipment at 23580 Highway 55 Site Plan Amendment for Cold Storage. (31-119-23-34- 0007) (13-006). This item was approved by the City Council on July 11th. The building permit has been issued, but staff has determined that the building was not being built according the approved plans. The Code Enforcement Official is working to resolve the issue and correct the building defects. 9. Ess Addition (city files 05-017, 08-003 and 12-024). The City Council granted an after-the-fact extension for this final plat at their November 29, 2012 meeting and a second extension at the November 25, 2013 meeting. The plat has been recorded and staff is working with the applicant to address any outstanding issues and close out the file/refund the escrow after wetland monuments and lot monuments are installed this spring. 10. Ess Brothers Site Plan Amendment and Conditional Use Permit Amendment for an accessory building at 9350 County Road (PID # 07-119-23-43-0004) (City File No. 13-031) The applicant is requesting approval for a 5,500 square feet detached, accessory building with 20-foot sidewalls. The City Council approved this item on January 23rd. The applicant must now file the resolution at the County and then staff will close out the file and refund any remaining escrow. The applicant may apply for a building permit after the resolution is recorded. MEMORANDUM 2 Finally, there are a few projects that have not yet been started but have been identified as action items or future projects: 1. Sign Ordinance Update. At the April 25th Council meeting, the City reviewed a request for the city to initiate a sign ordinance update. Specifically, they requested that the City review the ordinance standards relating to sign area, sign height and internal illumination and, because this is a city-wide issue, that the ordinance update be completed by the City out of the City funds. The Council discussed the issue and directed staff to bring a proposal back at a later date because the Council felt that this was a significant undertaking that would involve much more than this one issue. We will work with the City Administrator to determine the appropriate meeting to have this considered. 2. Design Guideline Update for Southeast District/Downtown. The Council approved a Landform proposal to update the existing design guidelines for this area. The design guidelines are adopted as part of the Zoning Ordinance and will be enforced as new development is proposed, consequently, the City Council wishes to revisit that planning effort to ensure it is still consistent with the City’s goals. The City Council appointed a subcommittee, but the City Council has decided to delay kickoff as we work through some associated issues as part of some new development plans. We expect to convene this subcommittee later this year. MEMORANDUM 3 STAFF REPORT / Code Compliance Agenda Item: 8 b. Council Meeting: March 27, 2014 Prepared By: Mike Pritchard Topic: CODE COMPLIANCE REPORT – February 2014 Action Required: Information Only Code Enforcement Issues: Complaint 14-002: Vacant building; Junk/Debris; Possible hazardous condition at 76XX Rolling Hills Road. The home became vacant January 21, 2014. At that time a massive amount of debris was noted all over the exterior of the property as well as inside the home and garage. The property is now bank -owned. Although the owner has taken steps to secure the home, the bank has some legal obligations before a clean-up can take place. We have been working with the property owner to create a plan of action to bring the home in to compliance. We received an update on March 18 from the bank’s representative that they are hoping to have a clean-up date set within the next week. Update to follow. City-Initiated Request for Maple Hill Estates 3rd Addition Preliminary Plat and Final Plat (PID 24-119-23-43-0016 and 24-119-23-43-0014) (city file 14-001) 60-DAY REVIEW DEADLINE: April 20, 2014 1. Application Request The City of Corcoran is requesting approval of preliminary plat and final plat approval to create a new lot for construction of an approximately 3,500-square foot community center. 2. Planning Commission Review The Planning Commission reviewed this item at a public hearing on March 6, 2013. There was no one present to speak on this item. The Planning Commission voted unanimously to recommend approval of the request. 3. Context Background The City of Corcoran applied for and received approval of a Community Development Block Grant (CDGB) in partnership with the landowner and a non-profit community organization to build an approximately 3,500-square foot community center. The site plan and variances for the project were approved by the City Council in 2013. After site plan approval, the City issued a design build RFP for construction of the building based on an approved site plan, but has not yet awarded the project. Under the terms of the CDGB grant, the building would be owned by the City for a minimum of 15 years. As the City has been working with the landowner and non-profit, it has become clear that the building should be located on city-owned property rather than private property. Zoning and Land Use The property is currently located within the Metropolitan Urban Service Boundary (MUSA), guided Low Density Residential and zoned Urban Reserve (UR). The City-owned property to the south is guided Low Density Residential and zoned Urban Reserve. Maple Hill Estates is guided Medium Density Residential and zoned Manufactured Home Park. The property to the north and east is Rush Creek Golf Course, guided Golf Course and zoned PI (public institutional). The property to the west is guided High Density Residential and zoned High Density Residential (RMF-3). Natural Characteristics of the Site There are no trees or significant natural resources in the area of the proposed building. 4. ANALYSIS: Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and City Code requirements, as well as City policies. A. Level of City Discretion in Decision-Making The City’s discretion in approving or denying a preliminary plat and final plat is limited to whether or not the proposed plat meets the standards outlined in the City Code. If it meets these standards, the City must approve the preliminary plat and final plat. B. Consistency with Ordinance Standards Lot Size The plat would create one 1.15-acre lot for the community building and one 14.94-acre lot. The small lot would be owned by the city and the larger lot would be retained by the trust managed by Hay Holding Company LLC. Both lots are legal, non-conforming lots because they are less than the 20-acre minimum lot size in the UR zoning district (which is typically a holding zone until development is proposed). Additionally the proposed Lot 1 is legally, non-conforming due to lot width. It has 30 feet of frontage where 200 feet is required. This plat is essentially a lot line adjustment of the common lot line with no new lots being created. Staff conferred with the City Attorney and agreed that the proposal meets the purpose and intent of the subdivision ordinance and the adjustment can be approved under the non-conforming lot section of the City Code. Setbacks The plat will eliminate the need for the setback variance that was granted in 2013. The new lot lines will allow the flag lot to meet the setback requirements. The parking for the site will be off-site as noted as part of the prior site plan approvals. No changes to the approved site plan are proposed. Drainage and Utility Easements Section 945.060, Subd. 2 of the Subdivision Ordinance requires 10-foot drainage and utility easements around the perimeter of the lot (10-foot adjacent to right-of-way and 5-foot adjacent to shared lot lines). The plans comply with these requirements. All wetlands must be blanketed by a drainage and utility easement. The plans comply. Maple Hill Estates 3rd Addition (14-001) 2 March 27, 2014 An easement is also proposed over the septic lagoon on the east side of Lot 2. This is part of the manufactured home park’s septic system. As part of the Maple Hill Estates 2nd Addition plat approval in 1996, the City required that the next plat would include this easement. Parks and Trails Park dedication is not required f or public land. Park dedication will be required when Lot 2 is developed. 5. Application Request The landowner is requesting City approval to enroll this land into the Metropolitan Agricultural Preserves Program and initiate expiration. This state program requires that land enrolled in this program also be reclassified from Low Density Residential to Agricultural Preserve on the 2030 Future Land Use Plan. Notice of this request was published in the local paper as required by State Statute. The Comprehensive Plan Amendment also requires that surrounding jurisdictions and school districts of such proposals be notified of the request. These jurisdictions have 60 days to provide comments. 2. Background The Kopperhead Ranch LLC includes approximately 118 acres on two separate parcels. These properties are designated as Low Density Residential on the 2030 Future Land Use Map and zoned Urban Reserve. Both parcels are in the final stage (2025-2030) of the 2030 Sanitary Sewer Service Staging Plan of the City’s Comprehensive Plan. The property must be reguided to long-term agricultural (Agricultural Preserve in Corcoran), with a maximum residential density of one house per forty acres. The owner must sign an eight-year perpetual covenant/agreement to leave the property in agricultural use, and farm using acceptable practices. In return, there are number of benefits to a landowner who enters into this program, including the fact that special assessments cannot be levied on Agricultural Preserve property. 3. Analysis The City has discretion when considering designating land as Agricultural Preserve and must determine whether the designation has any negative impact for the City. The Comprehensive Plan states “The City of Corcoran encourages the continuation of agricultural use within the community. This policy expresses the City’s endorsement of the Metropolitan Agricultural Preserves program. All land parcels in the City that meet the requirements for eligibility in the Metropolitan Agricultural Agenda Item ____ LandformSM, SensiblyGreenSM and Site to FinishSM are service marks of Landform Engineering Company. Preserves program according to Minn. Stat. Section 473H may apply to the City for enrollment. This policy is not intended to interfere with agricultural status of any lands prior to adoption of the Comprehensive Plan.” If the City Council wishes to designate this property as Agricultural Preserve, the City must also amend the land use map to reflect this change. If approved, the City would approve the Comprehensive Plan Amendment pending Metropolitan Council review of the amendment. Attachments: N/A TO: Brad Martens, City Administrator FROM: Kent Torve, P.E., City Engineer RE: Sewer Districts Update DATE: March 19, 2014 Council Action Requested · Motion for Item 1.0 regarding a 2015 MCES date for permanent lift station construction · Review and advise staff on projects or other areas of interest 0.0 Summary The City has three sewer and water areas with varying amount of activity, and this memo is to provide an update to Council. 1.0 Sewer—MCES Lift Station and the Southeast District The original MCES timelines for lift station construction are attached and show that MCES would provide sewer service if necessary in 2013, and permanent lift station completion in June 2014. This timeline was placed in the agreement as the Downtown Project was planned for the TIF project. MCES agreed to provide sewer service as of 2013 via “temporary” service of pump and haul if the city had users hooked up to the system. Subsequent work on the TIF expenditure deadlines, has delayed the Downtown Project until 2015/2016. MCES began work this winter on preliminary design for the lift station, and in February, MCES and Wenck held a meeting to discuss the site access through Schommer’s property which included challenges of steep slopes and added costs of retaining walls for the access road. The discussion also included “when was the lift station actually needed” and resulted in a proposal that Lennar could tie into the pipe downstream of the lift station, therefore without a Downtown Project or other users the permanent lift station was not required in 2014. Staff is requesting Council input regarding amending the agreement for a delay in the MCES construction deadline until 2015, which would give additional time for potential development planning on the Schommer parcel to occur. Staff has received a few phone calls on this property since sewer and water are available. Recommendation: Engineer recommends amending the agreement to 2015 for permanent construction. (MCES remains obligated to provide service as of June 2013 (last year) and Lennar will be served via a downstream connection to the MCES forcemain). 2.0 Sewer and Water—Northeast Corner The attached plan shows where MCES will construct a connection to the system, estimated in 2015/2016. The Corcoran Trunk System shows alignment further west in the lower area, however MCES policy typically provides service at the “border” or as near the border as feasible. This connection “opens up” the NE Corcoran area for urban development, although the connection is approximately a mile and a half from the CR 30/CSAH 101 intersection. Development activity to the north in Rogers/I94 area will increase interest in Corcoran. Water would need to be served through a second connection to the Maple Grove system. A meeting will be held with Medina, Independence, Loretto, Greenfield, and Corcoran to review the results. This connection will provide sewer to the Industrial Park previously planned at Pioneer Trail and HWY 55. Staff has met with the original developer who retained ownership of a portion of the land and they have shown interest in restarting the project in a modified (smaller) form. Water will be ultimately served through a Corcoran system, or Joint Water System combining the cities of Loretto, Medina and Corcoran along CR 19 and HWY 55. The water system would be several years from development, however it was presented to the developer that water supply could be private well until municipal supply was available.
