Hennepin County Commissioner Jeff Johnson will make a brief presentation. He wants to greet the new council and discuss any matters that the council might have. I sent the council a couple of questions that the mayor and the P & T Commissioners thought might be good to ask of him. 6) Planning and Zoning. a) McHugh CUP Application (10 -013). See report from City Planner b) Patnode Topography and Wetland Exemption (11 -001). See report from City Planner 7) Engineering. None 8) Public Hearing. None 9) Consent Agenda a) Council Draft Minutes of 1/06/11 b) Council Draft Minutes of 1/13/11 c) Appoint Ken Kluck as Elm Creek WMO Representative. The council discussed at the last council meeting making this appointment. Appointed representative Greg Ebert said that he could no longer fulfill his obligations due to a pressing work schedule. The council asked Mr. Kluck, who was at the meeting, if he would consider an appointment to Elm Creek WMO as the city representative. He currently is the appointed Alternate Representative. The motion you should make would be to accept Greg's resignation and appoint Ken. That leaves the alternate position open at this time. Council member Cossette as I understand will remain as the city's representative to the Technical Committee. d) Public Works Purchase of Crack Sealing Unit and accompanying air compressor. The council discussed the Crack Sealing program at the 2011 Budget workshop. At these meetings, the proposal was brought up and the council approved substituting this equipment instead of purchasing an asphalt roller for street repairs. This was budgeted at $35,000. Three bids were received for both pieces of equipment with low bid 10)Staff Reports. a) Ordinance Update Report. In your packet is an updated report on the ordinance costs to date. I will have a further update at the council meeting as I am meeting with Ms. Goodroad and Ms. Lindahl next week prior to the council meeting. I am trying to pin down money left and what is yet to be done. Page 1 b) Planning Projects Update Report. See report from City Planner. 11)Unfinished Business. a) Public Works Facility Update. The mayor and I got together this week and put together all of the documents that have been developed over the last year. I have put them in a three ring binder which you can use for all future documents. If you would rather have them together as electronic documents, I can do that also. As part of the Planning for 2011, the council might want to speak to the tasks to be accomplished during the year. Suggest something like a schedule as laid out in the TIF memo in Agenda Item 12e. 12)New Business a) Planning Commissioner Appointments. Commissioner appointments up this year are Pat Ellinger and Ricky Ravnholdt. Pat has decided not to re -apply and Ricky did apply. At the present time, only one new applicant has applied- Meredith Ellen Wu. Her application is in the packet. Also, Alternate Commissioner Nell Kadlec would like to be considered for a regular appointment to the Planning Commission. If the council appoints two of the three to a regular position and the third as an alternate, then the only opening would be the one alternate position. b) Parks and Trails Commissioner Appointments. The terms of Commissioners Trish Krueger and Joan Parks have expired. Both have re- applied for appointments. Joan Parks however is requesting consideration for an appointment as an Alternate Commissioner. No other citizens have applied for an appointment. Also, the two Alternate Commissioners, Glen Monzo and Joe Mailhot, are both leaving. Glen's term is up and Joe's term runs through 2012. If Trish is reappointed and Joan is appointed to the Alternate, then that leaves one open commissioner spot and one open Alternate spot. Also, our two students. Michelle Hannsmann and Lindsay Jacobs would like to be re- appointed as students. I should have brought this to the council last fall. One last note. The ordinance amendment you passed in the fall of 2009 allows for two students. There is a third student who (I have been told) will be applying. The council can change the ordinance to leave the number open or leave it as is with just two appointments. c) Resolution 2011 -03 Notice to MNSPECT on Contract Termination. This was discussed briefly at the last council meeting. I told you that this would be on this agenda for consideration. In looking at the 2011 Workplan document, I have penciled in a Request for Proposal (RFP) be approved and go out in June. d) Confirmation of 2011 Local Board of Appeal and Equalization Meeting. The county is requesting that we set the date and time for the annual Board of Review. I suggest that it be on a regular council meeting date of April 14. Last year it was held at 6 pm before the regular council meeting. I also looked at who on the council has attended the required training. Councilor Gmach is the only member on the council to have had the training. I suggest that at least one additional council member attend a yet to be announced training session. Conditional Use Permit for accessory building at 7121 Old Settlers Road (City File No. 10 -013) 60 -DAY REVIEW DEADLINE: February 15, 2011 Application Request The applicant has requested approval of a conditional use permit to allow construction of a 5,640 - square foot accessory building where 3,175 square feet is the maximum allowed and metal building materials. The applicant received a building permit in 2010 to begin construction of a new single family home on the 19.75 -acre parcel. 2. Planning Commission Meeting The Planning Commission held a public hearing on this item at their January 6, 2011 meeting. Other than the applicant, there was no one present to speak on this item. Several planning commissioners asked why a conditional use permit was required when there are a number of properties in Corcoran with metal pole barns. Staff noted that the current ordinance does not allow metal building except by conditional use permit, except that Accessory buildings constructed on properties with the Agricultural Preserve Designation or designated as "true farming" on 30 acres or more may be allowed metal buildings if they are used for "the exclusive use of sheltering agricultural machinery, animals and storage of agricultural products ". This property does not meet that qualification but others in the city may. All other buildings may request a conditional use permit to allow metal buildings. Several planning commissioners asked how long this ordinance had been in place. The mayor, serving as the liaison that evening, stated that he believed that the requirement had been in place since about 2000. Commissioner Ravnholdt asked why the city was not requiring the easement requested by Elm Creek Watershed as part of their review. Staff noted that the city can only require dedication of easements as part of a subdivision. The Planning Commission voted unanimously to recommend approval. Landform°, Sensibly&r nn and Si[. Context Zoning and Land Use The property is guided Rural /Ag Residential on the 2020 Land Use Map (and on the Draft 2030 Future Land Use Plan). The property is located outside of the Metropolitan Urban Service Boundary (MUSA) and zoned Rural Residential. The surrounding properties are guided and zoned the same. Natural Characteristics of the Site There is an existing wetland on the western portion of the site and a small wetland in the center of the site. A wetland delineation was reviewed and approved by Elm Creek Watershed Management Commission on June 7, 2010. There is a drain tile outlet on the west side of the property that drains a considerable drainage area from the west. There are trees in the wetland area to the west. 4. Analysis of Request Staff has reviewed the application for consistency with Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and City Code requirements, as well as City policies. The City Engineer's comments are incorporated into this staff report. A. Level of City Discretion in Decision - Making The City's discretion in approving or denying a conditional use permit is limited to whether or not the proposed request meets the standards outlined in the City Code. If it meets these standards, the City must approve the conditional use permit. B. Consistency with Ordinance Standards Conditional Use Permit for Size The applicant is proposing an accessory building with totaling approximately 5,604 square feet. The building would have a footprint of 2,730 square feet (78 x35) plus a 144 - square foot lean -to and a second story hayloft totaling another 2,730 square feet. The ordinance allows a maximum of 3,175 square feet of detached accessory building on this 19.75 -acre lot. The building would have 13' 6" sidewali height as allowed by city code. Section 1030.020, Subd. 2(H) does allow the landowner to request a conditional use permit to exceed these size limitations if the following conditions are met: 1. The proposed use shall be in conformance with all City regulations. Accessory buildings like this are a permitted use, but the conditional use permit is required to address the larger size of the proposed building and the metal building materials. The applicant has indicated that the larger building size is required to house 3 horses, farm equipment and hay. All setback requirements have been met. The building is approximately 125 feet from the east property line, 462 feet from the north property line, 490 feet from the west property line and 430 McHugh CUP (10 -013) January 27, 2011 feet from the south property line. The building is approximately 800 feet from Old Settlers Road. Accessory buildings for agricultural use must be a minimum of 100 feet from property lines. There is no wetland impact proposed. 2. A certificate of survey shall be required that identifies all existing structures on site, including buildings, septic sites and wells. In addition, the survey shall include the proposed structure, flood plain, wetlands, and any recorded easements. A certificate of survey has been provided. However, the dimensions of the proposed barn on the survey do not match the dimensions of the building provided with the application. Staff has included a condition in the approving resolution that the surveyor updates the plans to show the correct building dimensions and setbacks to ensure compliance with the ordinance standards. 3. Applicable criteria as outlined in Section 1070.020 (Conditional Use Permits) of the Corcoran Zoning Ordinance. Staff finds that these general standards have been met. Conditional Use Permit for Materials The applicant is requesting approval to allow the barn to be finished with metal siding and roofing. The plans show Colonial Red siding with Burnished Slate roof and white metal trim. Section 1060.050 of the Zoning Ordinance establishes building standards for the city and limits metal siding to not more than 20% of any wall surface and prohibits metal roofs except for commercial roofs with less than 2:12 pitch. However, exceptions to the provisions of this section may be granted as a conditional use permit provided that the following conditions are met: 1. The proposed building and material maintains the quality, durability and value intended by the Ordinance. The proposed building materials are Premium Pro -Rib which is a factory finished standing steel material with a lifetime paint film integrity warranty and exposed fasteners. These materials have a lifetime paint warranty against cracking or chipping and a 30 year fade /chalking warranty. Metal siding and roofing comes in a wide variety of styles. It is staffs opinion that standing seam metal as proposed is agricultural in nature and is compatible with the types of buildings allowed on nearby agricultural properties with Ag Preserve or "true farming" designations. Staff would generally prefer that residential applications such as this use metal siding and roofing systems with hidden fasteners (such as this manufacturer's Pro -Snap product line) for a cleaner, less industrial look; however, given the nature of the surrounding uses, the Planning Commission found that the exposed fasteners are acceptable. 2. The proposed building is compatible and in harmony with other existing structures within the district and immediate geographic area. The City Code prohibits metal roofing and limits metal siding to 20% of any wall elevation unless otherwise approved by CUP. However, the Code also provides exceptions for land that is enrolled in the Agricultural Preserve program and land that is defined by the City as "true McHugh CUP (10 -013) January 27, 2011 farming" (parcels 30 acres or more in size). If the property is in Ag Preserve or is "true farming" AND buildings are used for the exclusive use of sheltering agricultural machinery, animals and storage of agricultural products, then the buildings are exempt from the city's architectural standards and metal roofs and siding are allowed. This 19.75 -acre property does not meet these exception standards. This property is located in the rural portion of the city and there are a number nearby properties that meet these requirements and that have metal buildings. The applicant has indicated that the building is for the exclusive use of sheltering horse and storage of agricultural products. The proposed building would be compatible with other accessory buildings in the area. 3. The provisions of Section 1070.020 are considered and determined to be satisfied. Staff has reviewed the application for compliance with the general conditional use permit standards in Section 1070.020 and found that those conditions have been met as noted below. The applicant must also show compliance with the conditional use permit standards in Section 1070.020. Specifically: 1. Compliance with and effect upon the Comprehensive Plan, including public facilities and capital improvement plans. 2. The establishment, maintenance or operation of the conditional use will promote and enhance the general public welfare and will not be detrimental to or endanger the public health, safety, morals or comfort. 3. The conditional use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood. 4. The establishment of the conditional use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. 5. Adequate public facilities and services are available or can be reasonably provided to accommodate the proposed use. 6. The conditional use shall, in all other respects, conform to the applicable regulations of the district in which it is located. 7. The conditional use and site conforms to performance standards as specified by this Chapter Staff finds that the proposed accessory building would meet the conditional use permit standards in this section. The building is similar to the size and materials of other accessory buildings in the area. The building and new home will comply with all other ordinance standards and will be compatible with the purpose and intent of the Comprehensive Plan. McHugh CUP (10 -013) January 27, 2011 0 5. Conclusions Staff finds that the standards for a conditional use permit have been met or can be addressed with the changes discussed in the staff report. We have included conditions in the draft resolution to address these issues. 6. Also the North 325 feet of the South 1110 feet of the West Half of the Southeast Quarter of Section 27, Township 119, Range 23, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the conditional use permit at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request for a conditional use permit, subject to the following conditions: 1. Prior to issuance of building permits, the applicant/landowner must: a. Record the approving resolution at Hennepin County and provide proof of recording to the City. 5. The accessory building is for recreational use related to the keeping of horses. No commercial use is allowed. 6. The landowner must comply with the setback back requirements and other restrictions in the city's animal ordinance (Chapter 81 of the City Code as may be amended). 7. No wetland impacts are proposed or approved. A wetland delineation was reviewed and approved by ECWMC on June 7, 2010. 8. Comply with all conditions of ECWMC approval as noted in their December 3, 2010 and December 22, 2010 comments. 9. Silt fence must be installed to protect the wetland prior to beginning construction. 10. I have one additional comment. The wetland boundary approval decision is valid for three years. Since the wetland and the ditch are not included in_a drainage easement, a new wetland boundary determination might be required for any land alteration activity after the wetland boundary decision expires. - No further review is required by the Elm Creek WMC. ECWMC File No. #2010 -009 Dear Ms. Lindahl: Thank you for giving us the opportunity to comment on the subject CUP. The Commission received an application from Bill and Joanne McHugh on May 26, 2010, for a wetland boundary review and approval for this property. Our staff reviewed the application and approved the wetland boundary on June 7, 2010. Although the approval notice was properly distributed to the mandatory agencies, I realized that the City of Corcoran was not in the mailing list. 1 will send you a copy of the wetland boundary approval notice and the supporting documents with this letter. Along with the wetland boundary delineation report, we received a "Building Permit Survey" that showed a draft wetland boundary, locations of the proposed house, driveway, septic systems and a barn. This was sent to us as part of the wetland delineation report. Our staff did not review the site development plan, since there was no request from the City at that time. I have the following comments for this project: 1. The proposed locations of buildings and septic systems shown on the Building Permit Survey dated May 25, 2010, have adequate separation from the wetland edges. 2. There are no designated floodplains on this property. 3. There is a drainage way that runs through this property that receives runoff from the adjacent properties. There is a drain the outlet on the west side of the property that drains a considerable drainage area from the west. We strongly recommend obtaining drainage easement along this drainage way to avoid future drainage conflicts, if possible. 4. The CUP application narrative indicates that the proposed barn would sit back approximately 1,200 feet from the northeast part of the property. This does not seem possible, considering CHAMPLIN ^ CORCORAN , DAYTON � HASSAN • MAPLE GROVE ^ MEDINA , PLYMOUTH ^ ROGERS Ms. Lindahl December 3, 2010 Page 2 of 2 the size of the property. If the barn mentioned in the CLIP application is different from the barn shown on the Building Permit Survey, a detailed location map should be provided to make sure that this barn will not impact any wetlands. 5. Silt fence should be installed where land is disturbed within 50 feet of the existing wetlands. The disturbed areas should be vegetated with an appropriate seed mixture. Dormant seed should be used during the non - growing season. Please call me if you have any questions. Currently we are building a single family home on 19.75 acres that we purchased in May of 2009. We currently own three (3) horses and would like a barn to house them in as well as some farm equipment to crop the land for hay. The barn will be approximately 2,700 square feet on the ground floor as well as approximately the same amount of floor space for hay storage in the attic of the barn that would be used for Hay storage . Our barn will have a gambriel roof and sit back approximately 1,200 feet from the northeast part of the property, not visible from the road. We would also like to put a hay loft in the barn to store hay for the horses year round. We believe this is consistent with the surrounding nature of this rural community. We enclosed photos of buildings directly to the east, south, and north or our property. We believe that our barn will have no negative impact on neighbouring properties. One of our considerations in choosing a metal roof (rather than a wood roof) is that the Federal Government Energy Policy Act of 2005 offers financial incentives for metal buildings. Application Request Brian and Christina Patnode are requesting approval of an exemption from the following survey requirements: a. topographic survey b. wetland delineation The land is currently owned by James and Beverly Patnode. The applicant is planning to request a conditional use permit to develop one new house on the property (which has an existing home that would remain) and then subdivide the property into 2 parcels next year when the land is removed from the Metropolitan Agricultural Preserves Program. Section 930.020, Subd. 6(B)2 of the City Code allows the City Council to waive the topography requirements for lots greater than 3 acres and the City Council has previously granted exemptions from the wetland delineation. 2. Context Zoning and Land Use The property is zoned Rural Residential and is guided Rural / Ag Residential. Surrounding Properties The surrounding properties are all zoned Rural Residential and guided Agricultural Preserve. Natural Characteristics of the Site The draft 2030 Comprehensive Plan shows wetland areas in the northern portion the property. No new development is proposed in those areas. Analysis of Request e It is the applicant's desire to create a new 10 -acre parcel from this 78.84 -acre piece and build a new home this year, but the subdivision is not allowed because the land is enrolled in the Metropolitan Agricultural Preserve Program. MN Statutes 473H.17, Subd. 2 allows subdivision of land in Ag Preserve only if the density restrictions of 1 per 40 are met and the land continues to be used for agricultural uses. Furthermore, the Restrictive Covenants that the landowner signed when entering the Ag Preserve also references this 1 per 40 density requirement. In this case, the 78.84 acre parcel is too small to meet the 1 per 40 density requirements. MN Statutes 473H.04, Subd. 2 also states that "Land shall cease to be eligible for designation as an agricultural preserve when the comprehensive plan and zoning for the land have been amended so that the land is no longer planned for long -term agricultural use and is no longer zoned for long -term agricultural use, evidenced by a maximum residential density permitting more than one unit per 40 acres. When changes have been made, the authority shall certify by resolution and appropriate maps which lands are no longer eligible." This property currently has a single family home surrounded by land that is being farmed. The applicants would like to submit a conditional use permit to allow a second home on the property so that they can build the second home this year while the property is still in Ag Preserve. The development rights map shows development rights remaining on the parcel and one would be used to construct the new home. A topographic survey and wetland delineation could be required at the time new development is proposed. Staff finds that the request for the exemptions is reasonable on the 78.84 acre parcel if a topographic survey and wetland delineation is provided for the area where improvements are planned for the new home. We recommend that a wetland delineation be required for the entire 10 -acre parcel when the property is platted and that wetland buffers and setbacks be provided at that time. If the exemptions are approved, the applicant would proceed with a conditional use permit to allow a second home as allowed by Section 1040.030, Subd. 4(E) which allows living quarters accessory to a principal agricultural use. This section has specific standards for approval and the following conditions must be met: 1. The living quarters are not used as rental property. 2. A maximum of one such accessory dwelling shall be allowed. 3. There is a demonstrated need for such a facility for the permitted agricultural use. 4. The farm includes a minimum of 30 acres. 5. The structure complies with all other Zoning Ordinance requirements. If these conditions are met, the Council could approve the conditional use permit for a second home on the property and could find that since the home is accessory to the principal farm house, the new home is not in conflict with the statutes. When the land comes out of the Ag Preserve program early next year, then the applicant would come in for a subdivision to create a separate 10 -acre parcel for the new home. Pamode Topographic and Wetland Exemption (11 -001) January 27, 2011 0 EIEWI • • While the only request for review by the Council at this time is the exemption from survey requirements, the City Council could comment at this time if they have any concerns about the process that the applicant intends to follow. Such comments are advisory only. Staff notes that as part of the plat review, the City would work with Hennepin County to ensure that adequate right -of -way exists for County Road 50 and would request additional right -of -way if needed. The Draft Parks & Trails Plan also shows an on -road trail on County Road 50 and, as part of a plat review, the City would ensure that adequate right -of -way exists for this trail. 4. Applicant's Concept Graphics Patnode Topographic and Wetland Exemption (11 -001) January 27, 2011 CITY OF CORCORAN RESOLUTION NO. 2011 -05 Motion By: Seconded By: A RESOLUTION TO APPROVE A TOPOGRAPHY AND WETLAND DELINEATION EXEMPTION FOR PROPERTY LOCATED AT 23240 COUNTRY ROAD 50 (PID 19- 119 -23 -41 -0001) WHEREAS, the applicant has requested an exemption from the topography and wetland delineation requirements for a preliminary plat as allowed in Section 930.020, Subd. 6(B)2 and 3 of the Corcoran Subdivision Ordinance and the conditional use permit survey requirements in 1070.020 of the Corcoran Zoning Ordinance; and WHEREAS, the Corcoran City Council reviewed this item at their meeting on January 27. 2011: and NOW THEREFORE BE IT RESOLVED that the Corcoran City Council approves the topography and wetland delineation exemption based on the following findings: 1. The property has 7 building rights remaining. The property has one single family home on the 78.84 -acre parcel and the property is currently farmed. 2. The property is currently enrolled in the Metropolitan Agricultural Preserve program and these restrictive covenants and MN State Statutes prohibit subdivision of this parcel until the property is removed from the Agricultural Preserve program in 2012. 3. A topographic survey and wetland delineation shall be provided for the areas where development is proposed for new home and associated improvements as part of the future conditional use permit application, but the remainder of the site shall be exempted from these requirements. 4. A topographic survey and wetland delineation shall be required prior to subdivision. a. The topographic survey shall be provided for the areas where development is proposed, but the remainder of the site shall be exempted form these requirements. b. The wetland delineation shall be required for the proposed lot for the new home. The existing farm lot shall be exempted from this requirement. Resolution 2011 -05 Page 2 c. The new lot for the new home shall be required to provide wetland buffers, buffer setbacks and buffer monuments as required by Section 1050.010 of the City Code. The existing farm lot shall be exempted from this requirement until further subdivision is proposed. 5. The existing use is consistent with the City's Comprehensive Land Use Plan. 6. The use is generally consistent with the Zoning Ordinance and Subdivision Ordinance. 7. No other exemptions or variances are granted. 8. This property is approximately 80 acres and is currently in the Ag Preserve Program. We hope to obtain the CUP and begin house construction in spring 2011. Our long range plan is to separate 10 acres from the 80 acres in 2012. We cannot subdivide the property until it is out of the Ag Preserve Program which will be in March of 2012. At that time we plan on applying for a plat of the 10 acres and the remainder. We request a waiver of the topography and wetland delineations for both the CUP and platting applications. This request is consistent with prior City actions. The proposed house area is shown on the attached aerial map. From this map you can see we are not infringing on any wetland areas. We also plan to upgrade the existing field road for our driveway. So the impacts for the house construction are only in the immediate house area which we will provide topography for. We also feel it is appropriate to waive these requirements for the platting of the property as we will not be making any physical changes to the property at that time. Armbruster Topography and Wetland Waiver (city file no. 09 -011). An application has been received for a waiver from the topography and wetland requirements and was reviewed by the City Council on November 23, 2009. The City Council expressed concerns about the concept and directed the applicant to revise the concept plan. The applicant submitted a letter extending the review period until January 2012. This will allow the city time to complete the ordinance updates and allow the applicant additional time to explore their options for development/subdivision. 2. Rocks N Blocks Conditional Use Permit (city file no. 10 -012). An incomplete application was received for a Conditional Use Permit and Site Plan Amendment to continue operation of a business with outside storage that is operating at 20010 75`h Avenue North. City staff contacted the landowner as part of a follow up to a code enforcement complaint we received. The applicant was given the option to cease and desist or to apply for an after - the -fact permit. The application is incomplete and cannot be processed without additional information. The applicant was notified in writing of the missing information on November 24'h. The applicant is working to complete the submittal and has indicated that they will submit next month for the April Planning Commission and City Council meetings. 3. McHugh Conditional Use Permit (city file no. 10 -013). An application was received from Bill McHugh for a conditional use permit to allow an approximately 6,000 square foot accessory building where 3,175 square feet is allowed and to allow metal siding on this accessory building. The application was heard at the January 6, 2011 Planning Commission meeting and is scheduled for City Council review at the January 27” City Council meeting. 4. Patnode Topography and Wetland Wavier (city file 11 -011). An application has been received for a waiver from the topography and wetland requirements and will be reviewed by the City Council at the January 27`h meeting. The request is for a waiver from these requirements for construction of a new home the approximately 78 acre parcel at 23240 County Road 50. Also, there are a number of projects that have been approved, but are still not filed and closed out: 1. Ess Addition (05 -017 and 08 -005). The Preliminary Plat and Final Plat were approved by the City Council on February 26, 2009, subject to a number of conditions. The plat is currently under review at Hennepin County. The applicant has 2 years (February 26, 2011) from the final plat approval to submit the mylars for City signature and file the final plat at Hennepin County. 2. Corcoran Business Park (city file 06 -005). The City Council granted a one year extension to the final plat approval, which now expires on April 12, 2011. On August 9, 2007, the preliminary plat was approved by Res. 2007 -54. Res. 2008 -06 granted final plat approval with 7 findings and conditions on January 24, 2008, including a condition requiring vacation of an existing easement. The applicant requested and was granted a one year extension to the approvals. The approvals now expire on January 24, 2011 unless the applicant has complied with all conditions of approval and recorded the final plat at Hennepin County. 4. Savoie Fields (city file 07 -11 Res. 2007 -50 granted a topography and wetland waiver on July 12, 2007. Resolution 2007 -71 granted preliminary plat approval on September 27, 2007 with 9 findings and conditions. On January 24, 2008 the Council voted unanimously to approve final plat Resolution 2008 -07. On December 21, 2009, the City Council approved Res. 2009 -58 extending the final plat one additional year. The final plat will now expire on January 24, 2011 if it has not been recorded. 5. Lions Park (city file 09 -001). The rezoning to PUD, PUD general plan and PUD final plan to formalize the existing land uses and allow seasonal outside motor vehicle storage was approved by the Council on August 27, 2009. The rezoning was effective on the date of approval. However, the applicant must initiate construction of the improvements PUD within one year after the effective date of the PUD rezoning by the City Council. Upon good cause shown, the City Council may extend the time for one additional year. If construction is not commenced within these time periods, any building permits issued for the PUD shall be void and the Planning Commission may initiate proceeding to rezone the subject property. The one year period ended on August 27, 2010. Staff visited the site on November I" and noted that while some improvements have taken place, including permits along CR 101, the outside storage of vehicles was not initiated within the one year period and the approvals have expired for that portion of the project. 6. Northern Natural Gas Administrative Permit (city file 09 -009). An administrative permit for a meter station was approved and is under construction. The city will retain the escrow account until the project is completed to ensure that the project is completed according to the plans. The majority of the improvements and conditions of approval have been met. However, the landscaping has not yet been installed. Northern Natural Gas indicates that there are still connections that need to be made on site and landscaping cannot be installed until completed. They expect to install the landscaping in 2011; therefore, staff has required a financial guarantee to ensure that the required landscaping is installed. We will retain this financial guarantee until the landscaping is installed and inspected. Should they fail to install the landscaping, this financial guarantee could be cashed and the city could install the materials. 7. Gleason Administrative Permit (city file 10 -004). An administrative permit for replacement of a legal, non - conforming structure at 7105 CR 19 was administratively approved. The building is under construction. The city will retain the escrow account until the project is completed. 8. Park Place Storage Conditional Use Permit Amendment and Site Plan Amendment (city file 10- 006). On September 23`d the City Council approved Resolution 2010 -36 approving the request with a number of conditions. The applicant is working to address those conditions. 9. Satellite Industries Site Plan Amendment, Conditional Use Permit Amendment, Lot Consolidation and Easement Vacation (city file 10 -007). On September 23`d the City Council approved Resolutions 2010 -37, 2010 -38 and 2010 -39 approving the request with a number of conditions. The applicant has addressed those conditions and has submitted a building permit application and has begun site work, The city has a financial guarantee in place to ensure completion. 10. Corcoran Wildlife Preserve (city file 10 -009). Preliminary plat (city file 06 -004) was approved on September 27, 2007 (Res. 2007 -72) with 8 findings and conditions. On September 23, 2010, the city council approved Resolution 2010 -40 approving the final plat. The applicant has 1 year to address all conditions of approval and record the final plat.
