RESOLUTION 2005 -81

APPROVING A LOT DIVISION FOR PROPERTY LOCATED EAST OF
COUNTY ROAD 19 AND SOUTH OF COUNTY ROAD 30 (PIN 07- 119 - 23-42-
0006).
WHEREAS, Doboszenski & Sons, Inc. has requested approval of a lot division
for the property legally described as follows:
That part of the Southeast Quarter of Section 7, Township 119,
Range 23, described as follows:
Beginning at a point on the West line of said Southeast Quarter
distant 629.00 feet North from the Southwest Corner of said
Southeast Quarter; thence East, parallel with the South line of said
Southeast Quarter, 1155.00 feet, thence North, parallel with said
West line 251.00 feet; thence East parallel with said South line to
the intersection with the hereinafter described "Line A "; thence
northerly, along said Line A, to the intersection with the South line
of the North 563.00 feet of said Southeast Quarter; thence West,
along said South line of the North 563.00 feet, to the West line of
said Southeast Quarter; thence South, along the West line of said
Southeast Quarter, to the point of beginning;
Line A is described as follows:
Commencing at a point on the North line of said Southeast quarter
distant 990.00 feet West from the Northeast Corner of said
Southeast Quarter, thence South, parallel with the East line of said
Southeast Quarter, 879.95 feet to the point hereinafter referred to
as "Point A ", thence continue South, parallel with said East line, to
the South line of said Southeast Quarter and the point of beginning
of said Line A; thence Northerly to a point distant 6.29 feet East
from said point A, as measured along a line which passes through
said Point A and which is parallel with said North line; thence
Northerly to the point of commencement and there terminating.
WHEREAS, the proposed legal descriptions are attached as Appendix A; and

WHEREAS, the Planning Commission has reviewed the lot division at a duly
called public meeting and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does
approve the lot division requested by Doboszenski & Sons, Inc., subject to the
following conditions:
1. The lot division is approved in accordance with the plans received on
October 5, 2005, except as amended by this resolution.
2. The applicant shall submit a copy of the drainage and utility easement
documents for review and approval by the City Attorney prior to filing the
easement documents with the lot division at Hennepin County. The
developer shall provide 5 -foot wide easements along side and rear lot
lines and 10 -foot easements along the front lot line.
3. The applicant shall submit a copy of the driveway easement documents
for review and approval by the City Attorney prior to filing the easement
document with the lot division at Hennepin County.
4. The Building Inspector must approve the soil percolation tests and septic
system designs prior to issuance of building permits. A primary and
secondary septic site must be staked and fenced prior to beginning any
construction on site.
5. The septic sites must be individually fenced with steel posts and snow
fencing, which must be left in place until issuance of a Certificate of
Occupancy. However, the fencing must be retained around the alternate
septic site on Parcel A within the Great River Energy easement to protect
the site from unintentional damage from equipment until the alternate
septic site is needed.
6. The alternate septic site in Parcel A is located in the Great River Energy
power line easement. The alternate septic site should be rotated 90
degrees if possible to minimize the potential for damage within the power
line easement.
7. The wetland delineation must be approved by the Elm Creek Watershed
District.
8. Approval of the lot division is subject to review and approval by the
Watershed District. The applicant shall comply with any conditions of
approval from the Watershed District.

9. No wetland mitigation plan has be submitted or reviewed. If the applicant
proposes wetland impacts, they will be required to submit a wetland
mitigation plan for review and approval by both the City and the
watershed.
10. Prior to release of the lot division for filing at Hennepin County, the
applicant must provide the City with proof of Great River Energy's
approval of the septic sites within the Great River Energy easement.
11. Prior to approval of the site plan for development, the applicant must
provide the City with proof of Great River Energy's approval of any
wetland mitigation or other impact to land within their power line
easement.
12. Prior to release of the lot division for filing, the applicant shall submit
revised plans which address the following:
a. Show the additional County Road 19 right -of -way on both the
survey and site plan.
b. Show the County bike trail easement along County Road 19 on
both site survey and site pan.
c. Relocate the secondary septic site for Parcel B, so that it meets the
wetland setback requirements.
d. Provide a financial guarantee to ensure that drainage and utility
easements will be provided over all ponds and wetlands as
required by the City. City staff shall determine the amount and
method of the financial guarantee. The applicant shall provide
easement documents and amend the certificate of survey to reflect
the wetland mitigation plan approved by the Elm Creek Watershed
District and the final site plan approved by the City of Corcoran.
i. The easements documents shall be submitted for review and
approval by the City Attorney.
ii. The applicant may request release of the financial guarantee
after providing the City with proof of filing these approved
documents at Hennepin County.
13. Prior to approval of the required site plan and conditional use permit, the
application must modify the "possible building location" area identified on
Parcel A so that it does not encroach upon the 50 -foot setback from the
future road.

14. The applicant should identify any drain tile locations and identify them on
the survey.
15. Park dedication for each parcel shall be cash -in -lieu of land due at the
time of building permit application.
16. The applicant must file the lot division and approving resolution at
Hennepin County.
17. The applicant shall comply with all requirements of the City Engineer's
memo, dated October 7, 2005.
