A RESOLUTION TO APPROVE A CONDITIONAL HOME
OCCUPATION LICENSE FOR TOM GARDNER FOR THE OPERATION OF A
STORAGE AND MAINTENANCE OF EXCAVATING EQUIPMENT COMPANY AT
22703 COUNTY ROAD 50
WHEREAS, Tom Gardner at 22703 County Road 50 has applied for a Conditional Home
Occupation License, (CHOL); and
WHEREAS, the ordinance states that the Commission shall consider certain standards and
criteria when reviewing a CHOL; and
WHEREAS, a public hearing was held on July 21, 2005 as required by Ordinance.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that a
CHOL shall be granted to Tom Gardner at 22703 County Road 50 for the purpose of a storage
and maintenance of excavating equipment company based on the following findings and subject
to the identified conditions:
FINDINGS:
1. The current use is presently illegal under the existing zoning ordinance.
2. The site in question consists of approximately 39.10 acres and has driveway access
directly to Fisher Road, which is a no maintenance road.
3. The site is presently zoned Rural- Residential and is guided to remain Rural Residential
in the land use plan.
4. They have no employees.
5. A 2,800 square foot accessory structure is used for the business.
6. Special vehicles used include one tractor- trailer for hauling equipment and one tandem
axle dump truck.
7. There are approximately eight loads of fuel and two loads of lubrication supplies
delivered per year.
8. There is no signage and no customers on site.
9. There is some outside storage of excavating equipment. ( All equipment is screened from
public view ).
10. There was two letters in favor of the business.
CONDITIONS:
1. The CHOL is issued to Tom Gardner, at 22703 County Road 50 and is not transferable.
2. No advertising signage for the business is permitted on site or off site.
3. All equipment shall be screened from public view.

4. The applicant shall abide by and remain in compliance with all applicable Federal, State
and City rules and regulations.
5. This license will be reviewed by the City every three years from the date of issuance for a
determination that the existing Home Occupation stills warrants the issuance of a license.
6. The City may revoke or modify the CHOL upon a finding that conditions have changed to
warrant revocation or modifications of the license.
