WHEREAS, Ken Doboszenski has requested approval of a final plat to create four lots on the property legally described as follows: That part of the Northwest Quarter of the Southwest Quarter of Section 32, Township 119, Range 23, Hennepin County, Minnesota, described as follows: Commencing at the northwest corner of said Northwest Quarter of the Southwest Quarter; thence on an assumed bearing of South 00 degrees 00 minutes 00 seconds West along the west line of said Northwest Quarter of the Southwest Quarter a distance of 186.29 feet; thence South 58 degrees 19 minutes 00 seconds East a distance of 511.08 feet to the point of beginning; thence continue South 58 degrees 19 minutes 00 seconds East a distance of 202.36 feet; thence North 22 degrees 55 minutes 30 seconds East to the north line of said Northwest Quarter of the Southwest Quarter; thence west along said north line to a line which bears North 22 degrees 55 minutes 30 seconds East from the point of beginning; thence South 22 degrees 55 minutes 30 seconds West to the point of beginning. The East 1/2 of the East 1/2 of the Southwest 1/4 of the Northwest 1/4; The Northeast 1/4 of the Southwest 1/4, EXCEPT that part of the Northeast 1/4 of the Southwest 1/4 which lies within the following described tract of land. Commencing at the intersection of the South line of the Northwest 1/4 of the Southwest 1/4 and the centerline of the road called Pioneer Trail; thence East along the South line of the Northwest 1/4 of the Southwest 1/4 a distance of 264 feet; thence North and parallel with the East line of the Northwest quarter of the Southwest quarter a distance of 165 feet; thence West and parallel with the South Tine of said Northwest Quarter of the Southwest Quarter to the Centerline of Pioneer Trail; thence Southeasterly along the centerline of said Pioneer Trail to point of beginning: That part of the Northwest 1/4 of the Southwest 1/4 described as follows: Commencing at the Northwest corner of said Northwest 1/4 of the Southwest 1/4; thence South along the West line thereof 188.58 feet to the centerline of the road now called Pioneer Trail; thence Southeasterly along the centerline of said Pioneer Trail a distance of 511.08 feet; thence deflect left 98 degrees 45 minutes 30 seconds a distance of 510.22 feet to the North line of said Northwest 1/4 of the Southwest 1/4; thence East along said North line 360 feet to the actual point of beginning; thence deflect right 69 degrees 47 minutes 30 seconds a distance of 842.60 feet; thence deflect right 99 degrees 58 minutes 30 seconds to the centerline of said Pioneer Trail; thence Southeasterly along the centerline of said Pioneer Trail to the South line of said Northwest 1/4 of the Southeast 1/4; thence East along said South line to the Southeast comer of said Northwest 1/4 of the Southwest 1/4; thence West along the North line thereof to the actual point of beginning, EXCEPT that part of the Northwest 1/4 of the Southwest 1/4 which lies within the following described tract of land: Commencing at the intersection of the South line of the Northwest 1/4 of the Southwest 1/4 and the centerline of the road called Pioneer Trail; thence East along the South line of the Northwest 1/4 of the Southwest 1/4 a distance of 264 feet; thence North and parallel with the East line of the Northwest 1/4 of the Southwest 1/4 distance of 165 feet; thence West and parallel with South line of said Northwest 1/4 of the Southwest 1/4 to the centerline of Pioneer Trial: thence Southeasterly along the centerline of said Pioneer Trail to point of beginning: All in Section 32, Township 119, Range 23. Resolution 2005 -59 Page 3 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF ;ORCORAN, MINNESOTA, that it should and hereby does approve the request by Ken Doboszenski for a final plat, subject to the following conditions: 1. A final plat is approved to allow the creation of four lots in accordance with the plans and application received by the City on May 23, 2005, except as amended by this resolution. 2. All conditions of preliminary plat approval must be met. 3. The septic sites must be individually fenced with steel posts and snow fencing, which must be left in place until issuance of a Certificate of Occupancy. 4. The Final Plat title sheet must be corrected to replace "Doboszenski Addition" with "Hales Corner" as the plat name. 5. The Final Plat title sheet must be corrected to provide a signature block for Hales Corner LLC, the owner of the property to be replatted as Lot 4. 6. The applicant must file the final plat at Hennepin County. 7. Final plat approval shall expire two years from the date of approval unless the plat has been filed at Hennepin County. ADOPTED by the City Council this 28th day of July 2005.
