HomeMy WebLinkAboutResolution 2005-49 - Approving CHOL - 19839 Jackie Lane - SchaloCity of Corcoran County of Hennepin State of Minnesota RESOLUTION 2005 -49 Motion By: Thomas Seconded By: Lymangood A RESOLUTION TO APPROVE A CONDITIONAL HOME OCCUPATION LICENSE FOR JACK SCHALO FOR THE OPERATION OF A SMALL ENGINE REPAIR SHOP AT 19839 JACKIE LANE WHEREAS, John Schalo, at 19839 Jackie Lane has applied for a Conditional Home Occupation License, (CHOL); and WHEREAS, the ordinance states that the Commission shall consider certain standards and criteria when reviewing a CHOL; and WHEREAS, a public hearing was held on May 19, 2005 as required by Ordinance. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that a CHOL shall be granted to John Schalo at 19839 Jackie Lane for the purpose of a small engine repair shop, Jack's Small Engine, Inc., based on the following findings and subject to the identified conditions: FINDINGS: • The use to be is presently illegal under the existing zoning ordinance. • The site in question consists of approximately 1.0 acres and has driveway access directly to Jackie Lane, which is a residential road. • The site is presently zoned Agriculture and is guided to Urban Residential in the land use plan. • They have indicated that they have would have no employees. • An accessory structure is proposed to be built on the premise for the business. This structure shall meet the city's requirements as defined in Ordinance 1030.020. • Equipment includes normal shop equipment like drill press, grinders, metal saw and boring bar. • There are no deliveries other than UPS and Speedy. • There is no signage and possibly 5 — 6 customers per week. • There is no outside storage. • There was letter sent in favor of the business. CONDITIONS: 1. The CHOL is issued to John Schalo, at 19839 Jackie Lane and is not transferable. 2. No advertising signage for the business is permitted on site or off site. 3. All equipment and shall be kept within the accessory structure. 4. Business hours to be limited to 8:00 am to 5:30 pm Monday through Friday. 5. Hours for running engines to be limited to 9:00 am to 4:00 pm Monday through Friday. City of Corcoran County of Hennepin State of Minnesota 6. The applicant shall abide by and remain in compliance with all applicable Federal, State and City rules and regulations. 7. This license will be reviewed by the City every three years from the date of issuance for a determination that the existing Home Occupation still warrants the issuance of a license. 8. The City may revoke or modify the CHOL upon a finding that conditions have changed to warrant revocation or modifications of the license.
