RESOLUTION 2005 -36

A RESOLUTION TO APPROVE A CONDITIONAL HOME
OCCUPATION LICENSE FOR JOHN KIPPLEY FOR THE OPERATION OF A
LANDSCAPE DESIGN COMPANY AT 23565 JULIE ANN DRIVE
WHEREAS, John Kippley at 23565 Julie Ann Drive has applied for a Conditional Home
Occupation License, (CHOL); and
WHEREAS, the ordinance states that the Commission shall consider certain standards and
criteria when reviewing a CHOL; and
WHEREAS, a public hearing was held on April 21, 2005 as required by Ordinance.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that a
CHOL shall be granted to John Kippley at 23565 Julie Ann Drive for the purpose of a landscape
design company based on the following findings and subject to the identified conditions:
FINDINGS:
1. The current use is presently illegal under the existing zoning ordinance.
2. The site in question consists of approximately 3.1 acres and has driveway access directly
to Julie Ann Drive, which is a residential road.
3. The site is presently zoned Rural- Residential and is guided to remain Rural Residential
in the land use plan.
4. They have indicated that they have four staging employees
5. They have two pick -ups, two tractors and two trailers.
6. They do have some outside storage.
7. There is an accessory structure consisting of approximately 1475 square feet on the
premises which is utilized for the business along with an office in the house.
8. There are no deliveries, no customers on site, and no signage.
9. There was one e-mail sent against the business.
CONDITIONS:
1. The CHOL is issued to John Kippley, at 23565 Julie Ann Drive and is not transferable.
2. No advertising signage for the business is permitted on site or off site.
3. All equipment and employee vehicles shall be kept within the accessory structure.
4. All loading and unloading of materials to be confined to the property and not in the street.
5. Outside storage be limited to 400 square feet and be screened with landscaping.
6. That the level of equipment that they have today in the application does not increase.

7. Four staging employees may be permitted providing dates of employment are consistent
with Zoning Ordinance 1030.100 Subdivision 9 (05/24/2001) and verified to the
satisfaction of the City Administrator.
8. The applicant shall abide by and remain in compliance with all applicable Federal, State
and City rules and regulations.
9. This license will be reviewed by the City every three years from the date of issuance for a
determination that the existing Home Occupation stills warrants the issuance of a license.
10. The City may revoke or modify the CHOL upon a finding that conditions have changed to
warrant revocation or modifications of the license.
