WHEREAS, Ernie Mayers has requested approval of a conditional use permit to exceed the building size limitations on a 2.5 -acre property legally described as follows: That part of the South % of the Northeast % of Section 27, Township 119, Range 23 West, Hennepin County, Minnesota, described as Commencing at the Southwest corner of said South of the Northeast '4 of Section 17, thence East along the South line of said South % of the Northeast % a distance of 926.75 feet to the actual point of beginning of the land to be described, thence North at a right angle 370.00 feet, thence East at a right angle 300.50 feet, thence South at a right angle 370.00 feet to the South line of said South % of the Northeast %, thence West along said South line 300.50 feet to the point of beginning. WHEREAS, the Planning Commission has reviewed the above listed conditional use permit at a duly called Public Hearing, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Ernie Mayers for the above listed conditional use permit, subject to the following conditions: 1. The conditional use permit to allow a 3,200 square foot accessory building is approved in accordance with the plans and application received by the City on January 19, 2005, based on the following findings: a. The proposed use is in conformance with all City regulations. Agricultural buildings are a permitted use in the RR district. The applicant indicates that the large building is required to accommodate that farm equipment that will be used to farm the adjacent 70 -acre parcel that he owns with his sister. b. The applicant has submitted a survey for the property Resolution 2005 -18 Page 2 c. Applicable criteria as outlined in Section 1070.020 (Conditional Use Permits) of the Corcoran Zoning Ordinance. Specifically: i. Agricultural buildings are permitted in the rural areas of Corcoran and agricultural activities are encouraged to continue. ii. The conditional use permit to allow a 3,200- square foot agricultural building will promote the agricultural character of Corcoran and will not be detrimental to or endanger the public health, safety, morals or comfort. iii. The conditional use permit to allow a 3,200- square foot agricultural will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes permitted, nor substantially diminish and impair property values within the neighborhood. The property that would be most affected by the large building would be the property to the east and north, which is owned by Mr. Mayers and his sister. iv. The conditional use permit for the 3,200- square foot agricultural building will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. v. Adequate public facilities and services are available to accommodate the proposed use. The agricultural building will not require public facilities and services beyond what is currently available to the site via the public street. vi. The conditional use permit for the size of the building will conform to the standards of the RR zoning district. vii. The conditional use permit for the size of the building will conform to the standards of the Zoning Ordinance. 2. The applicant must provide detailed architectural plans for City review prior to issuance of a building permit. 3. A building permit is required prior to construction of the new farm building. 4. The new accessory building shall be used for the exclusive use of sheltering agricultural machinery, animals and storage of agricultural products. No commercial use or home occupation shall be allowed in the accessory building. 5. The City grants a waiver from the electronic survey requirements based on the lack of access to technology on behalf of the applicant's surveyor, Schoborg Land Surveying, Inc.
