HomeMy WebLinkAboutResolution 2005-12 - Amending Building Rights Map - 10725 Bechtold RDCity of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2005 -12 Motion By: Grabowski Seconded By: Thomas AMENDING BUILDING RIGHTS MAP FOR 10725 Bechtold Road, PID #05- 119 -23 -11 -0003 WHEREAS, Christopher Hudok has requested a building rights map amendment on behalf of the George and Eileen Hudok regarding the property legally described as follows: Unplatted Section 5, Township 119, Range 23, that part of the NE i/4 of the NE 1/4 lying south of the north 67109/100 feet thereof except road (19.968 acres) WHEREAS, the City Council found on February 10, 2005 that the property met the requirements of Chapter 473H.03s4 (the 20 acre exemption) and qualified as Agricultural Preserve; and WHEREAS, the City Council has determined that the property does meet the density requirements based on qualifying as eligible for Agricultural Preserve as identified in the Corcoran Zoning Ordinance 1040.030 Subd 7.c. "The existing farmstead or residence on properties accessing onto gravel roads and eligible for Agricultural Preserve (40 acres, more or less) that existed prior to July 1, 1981 are exempt from the density calculations in rural areas." THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Christopher Hudok and George and Eileen Hudok to amend the building rights map, subject to the following findings and conditions: 1. An amendment to the building rights map is approved to allow one additional building right on the parcel identified as PID # 05- 119 -23 -11 -0003. The additional building right will allow subdivision of this lot for one additional home. 2. No subdivision is approved at this time. 3. Approval of the building rights appeal does not imply approval of the subdivision. The applicant will be required to apply for one of the following before issuance of a building permit: a. A variance and lot division application to allow conveyance of the property by Metes and Bounds without platting. The variance is required because the resulting parcels will not meet the requirements of Section 920.020. (Resulting parcels are less than 10 acres in size); or b. A subdivision, which will require both a preliminary and final plat. 4. No building permits will be granted for this parcel until such time as the property is divided in manner approved by the City of Corcoran. 5. The City finds in favor of the landowner and does hereby grant one additional building right.
