RESOLUTION NO. 2005 -09

A RESOLUTION APPROVING A SETBACK VARIANCE FOR TODD HENDRIES
PROPERTY LOCATED AT 6800 OLDE STURBRIDGE DRIVE.
WHEREAS, Todd Hendries has requested approval of a variance from: building setback from a
drain field on the 1.06 -acre property legally described as follows:
Lot 1, Block 2, Woodland Acres
WHEREAS, the Wastewater Commission has reviewed the requested variance at a duly called
meeting;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORCORAN, MINNESOTA, that it should and hereby does approve the request by Todd
Hendries for the setback variance subject to the following findings and conditions:
1. The variance from the building setback from the drain field is approved in accordance with
the plans and application received by the City on January 18, 2005.
2. The variance is approved based upon the following findings:
a. That because of the particular physical surroundings, shape, or topographical conditions
of the specific parcel of land involved, if the variance were not granted, the applicant
would bear the burden of decreased acoustic responsiveness, decreased energy efficiency
and increased construction costs, as well as the possible loss of tree canopy.
b. The granting of the variation will not be detrimental to the public welfare or injurious to
other land or improvements in the neighborhood in which the parcel of land is located.
c. The granting of the variation will not impair an adequate supply of light and air to the
adjacent property, or substantially increase the congestion of the purblind streets, or
increase the danger of fire, or endanger the public safety or substantially diminish or
impair property values within the neighborhood.
d. That the clay soil conditions in the area create very tight percolation, and all drainage
appears to slope away from the structure.
3. The wall closest to the drain line must be back filled with clay soil except for the top 12
inches which cover the drain tile.
