HomeMy WebLinkAboutResolution 2005-01 - Approving CHOL - SpiczkaCity of Corcoran County of Hennepin State of Minnesota RESOLUTION 2005 -01 Motion By: Thomas Seconded By: Grabowski A RESOLUTION TO APPROVE A CONDITIONAL HOME OCCUPATION LICENSE FOR TOM AND MICHELLE SPICZKA FOR THE OPERATION OF A SEASONAL SHOP KNOWN AS VINO SISTERS AT 9103 CAIN ROAD WHEREAS, Tom and Michelle Spiczka at 9103 Cain Road, have applied for a Conditional Home Occupation License, (CHOL); and WHEREAS, the ordinance states that the Commission shall consider certain standards and criteria when reviewing a CHOL; and WHEREAS, a public hearing was held on September 16, 2004 as required by Ordinance. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that a CHOL shall be granted to Tom and Michelle Spiczka at 9103 Cain Road for the purpose of a seasonal shop selling unique home accessories, jewelry, and antiques based on the following findings and subject to the identified conditions: FINDINGS: • The current use is presently illegal under the existing zoning ordinance. • The site in question consists of approximately 13.17 acres and has driveway access directly to Cain Road, which is a residential road. • The site is presently zoned Rural- Residential and is guided to remain Rural Residential in the land use plan. • They have no employees other than the two sisters, Michelle Spiczka and Carol Hollands. • They have six signs located at various intersections, 2' x 2'. • The home occupation occupies a 600 square foot accessory building. • There is no outside storage. • There are one to two deliveries per year. • The business averages 20 tO 40 customers a day, over the thirty two days the business is open. CONDITIONS: 1. The CHOL is issued to Tom and Michelle Spiczka at 9103 Cain Road and is not transferable. 2. One temporary sing on the property is allowed, to be located at the end of the driveway for directional purposes. Temporary off premise signage is allowed according to the sign ordinance for seasonal type home occupations. 3. All merchandise shall be kept within the accessory structure or screened from public view. 4. The applicant shall abide by and remain in compliance with all applicable Federal, State and City rules and regulations. • City of Corcoran County of Hennepin State of Minnesota 5. This license will be reviewed by the City every three years from the date of issuance for a determination that the existing Home Occupation still warrants the issuance of a license. 6. The City may revoke or modify the CHOL upon a finding that conditions have changed to wan-ant revocation or modifications of the license. 7. The business is limited to four, 4 day weekends in the Spring; and four, 4 day weekends in the Fall. (Those days will consist of Thursday through Sunday).
