HomeMy WebLinkAboutResolution 2002-87 - Denying CHOL for Donald and Kristi Feltl, 7885 Kalk Road Resolution Failed Not Passed 12/12/02 City of Corcoran County of Hennepin State of Minnesota RESOLUTION 2002-87 Motion By: Gmach Seconded By: Thomas A RESOLUTION TO APPROVE A CONDITIONAL HOME OCCUPATION LICENSE FOR THE OPERATION OF LANDSCAPE,LAWN MOWING AND SNOWPLOWING BUSINESS WHEREAS, Donald and Kristi Feltl, 7885 Kalk Road, have applied for a Conditional Home Occupation License, (CHOL); and WHEREAS, the ordinance states that the Commission shall consider certain standards and criteria when reviewing a CHOL; and WHEREAS, a public hearing was held on August 15, 2002 as required by Ordinance, an additional meeting was held on November 21, 2002 to further clarify the use and activities on the premises. NOW THEREFORE,BE IT RESOLVED by the City Council of the City of Corcoran that a CHOL shall be granted to Donald and Kristi Felt! at 7885 Kalk Road for the purpose of conducting a landscape, lawn mowing and snowplowing business based on the following findings and subject to the identified conditions: FINDINGS: 4. This is currently not a legal operation. 5. It is located within the R1 District. 6. The site consists of 1.5 acres,thus creating a concern with outside storage. 7. The site is located within an area of working farms and lacks urbanized development. 8. The existing accessory structure is 480 square feet; they are limited to 1100 square feet for a detached structure. 9. Location of business is appropriate with street accesses. 10. The application has been modified to include one staging employee. 11. Inside storage is preferred. 12.No environmental concerns raised. CONDITIONS: 1. The CHOL is not transferable. 2. No advertising signage for this business is permitted on site or off site, except that signage is permitted on the equipment. 3. Applicant shall abide by and remain in compliance with all applicable Federal, State and City rules and regulations. 3 ' - City of Corcoran County of Hennepin State of Minnesota 4. One staging employee shall be permitted as proof of employment prior to May 2001 has been verified to the satisfaction of the City Administrator. 5. No outside storage of materials shall be permitted. 6. Trailers shall be screened from public view by fencing. 7. Must maintain orderly parking and storage of vehicles and equipment on the property. 8. The quantity and description of equipment shall remain consistent with that identified and hereto attached as Exhibit A. 9. This License will be reviewed by the City every three years from the date of issuance for a determination that the existing Home Occupation still warrants the issuance of a license. 10. The City may revoke or modify the CHOL upon a finding that conditions have changes to warrant revocation or modification of the license.
