RESOLUTION 2002-73

A RESOLUTION TO APPROVE A CONDITIONAL HOME OCCUPATION
LICENSE FOR THE OPERATION OF A BUSINESS PROVIDING
LAWN CARE AND SNOW REMOVAL
WHEREAS, Chuck Dorweiler at 23260 County Road 10, has applied for a Conditional Home
Occupation License, (CHOL); and
WHEREAS, the ordinance states that the Commission shall consider certain standards and
criteria when reviewing a CHOL; and
WHEREAS, a public hearing was held on September 19, 2002 as required by Ordinance.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that a
CHOL shall be granted to Chuck Dorweiler at 23260 County Road 10 for the purpose of
conducting a lawn care and snow removal business based on the following findings and subject
to the identified conditions:
FINDINGS:
• The current use is presently illegal under the existing zoning ordinance.
• The site in question consists of approximately 4.81 acres and has driveway access
directly to County Road 10, which is a collector road.
• The site is presently zoned Rural—Residential and is guided to Rural Service/Commercial
in the draft land use plan.
• Three employees that report to the site for staging purposes.
• Two trailers are stored outside, behind the accessory structure.
• Other equipment, including mowers, vehicles and general equipment is stored in the
accessory structure.
• There is an office in the home.
• There are no deliveries to the site.
• There are no customer visits to the site.
• There are no advertising signs for the business.
• There was no equipment visible on the site and no appearance of a business operation.

CONDITIONS:
1. The CHOL is issued to Chuck Dorweiler, Complete Lawn Salon at 23260 County Road
10 and is not transferable.
2. No advertising signage for this business is permitted on site or off site.
3. Any equipment parked or stored on site shall be contained in the accessory structure, or
screened from public view.
4. Up to three employees for the purpose of staging work to be performed off-site may be
permitted, with verification of employees as of May 24, 2001, approved by the City
Administrator.
5. The applicant shall abide by and remain in compliance with all applicable Federal, State
and City rules and regulations.
6. This license will be reviewed by the City every three years from the date of issuance for a
determination that the existing Home Occupation still warrants the issuance of a license.
7. The City may revoke or modify the CHOL upon a finding that conditions have changed
to warrant revocation or modifications of the license.
