A RESOLUTION TO APPROVE A LOT CONSOLIDATION OF A 4.38 ACRE
PARCEL AND A 7.79 ACRE PARCEL AND A CONDITIONAL USE PERMIT
(CUP) TO ALLOW ACCESSORY STRUCTURES TOTALING 5,690 SQUARE
FEET IN SIZE ON PROPERTY LOCATED AT 9103 CAIN ROAD

WHEREAS, Tom Spiczka, as applicant, has requested a lot consolidation to join a
4.38 acre parcel and a 7.79 acre parcel for a new parcel of 12.17 acres; and
WHEREAS, accessory buildings totaling over 3,175 square feet are allowed by
CUP on parcels over 10 acres in size; and
WHEREAS, following consolidation, the parcel in question is 12.17 acres in size
and the total area of accessory structures requested is 5,690 square feet; and
WHEREAS,The Corcoran Planning Commission held a public hearing on
August 1, 2002; and
WHEREAS, the Planning Commission voted 6-0 to recommend the Council
approve the request for consolidation and CUP; and
WHEREAS, The Corcoran City Council considers the recommendation of the
Planning Commission in making a decision.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran
that the parcels be consolidated as requested and a CUP to allow 5,690 square feet of
accessory structure be and hereby is approved based on the following findings and
subject to the listed conditions:
FINDINGS:
a) The request is consistent with city plans and the geographical area involved.
b) The use will not depreciate the area in which it is proposed.
c) The use will not adversely impact the character of the surrounding area.
d) The demonstrated need for such use has been provided by the applicant.
e) The proposed use will not cause odors, dust, files, vermin, smoke, gas,noise, or
vibration or impose hazards to life or property in the neighborhood.
f) The use will not inherently lead to or encourage disturbing influences in the
neighborhood.
g) The building is for personal use only and no commercial use is proposed.

CONDITIONS:
1. The buildings shall be used only for personal use. No commercial use of the
buildings on the property shall be allowed.
2. Buildings shall not be located in the right-of-way or utility and drainage
easements.
