HomeMy WebLinkAboutResolution 2002-56 - Approving Home Occupation License - Thomas Lithgow 1 ill" City of Corcoran County of Hennepin State of Minnesota RESOLUTION 2002-56 Motion By: —j-t-tOMk4 Seconded By: &-A&-E.19, A RESOLUTION TO APPROVE A CONDITIONAL HOME OCCUPATION LICENSE TO ALLOW THE OPERATION OF AN AUTOMOTIVE REPAIR BUSINESS WHEREAS, Thomas Lithgow, 10025 County Road 116, has applied for a Conditional Home Occupation License, (CHOL); and WHEREAS, the ordinance states that the Commission shall consider certain standards and criteria when reviewing a CHOL; and WHEREAS, a public hearing was held on July 18, 2002 as required by Ordinance. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that a CHOL shall be granted to Thomas Lithgow at 10025 County Road 116 for the purpose of allowing an automotive repair business based on the following findings and subject to the identified conditions: a) This use is currently only permitted under a CHOL. b) County Road 116 will not be adversely impacted by this operation. c) Hours of operation have been identified as 10:00 am to 6:30 pm. d) Parts and Customer traffic are not pertinent because of the location. e) Work being performed must be completed within the accessory structure. f) Screening has been demonstrated and will be maintained. g) Disposal of hazardous wastes must be handled according to State and Federal regulations. h) The demonstrated use complies with the city plans and the geographical area involved. i) The use will not depreciate the area in which it is proposed. j) The use will not inherently lead to or encourage disturbing influences in the neighborhood. k) Eligibility for one employee has been demonstrated per the requirements of the Home Occupation Ordinance. 1) The accessory structure does not comply with the current accessory structure ordinance. m) Consolidation of the two parcels may need to be investigated if setbacks are not being met. CONDITIONS: 1. The CHOL is issued to Thomas Lithgow at 10025 County Road 116,and is not transferable. 2. Equipment for the business shall be stored so it is not visible from the road or adjacent properties. 3. No signage advertising the business is permitted on site. 4. The CHOL shall allow up to one employee. City of Corcoran County of Hennepin State of Minnesota 5. The Licensee shall abide by and remain in compliance with all applicable Federal, State and City rules and regulations. 6. Screening shall be maintained in substantially the same manner as it exists. 7. The two parcels shall be consolidated. 8. This License will be reviewed by the City every three years from the date of issuance for a determination that the existing Home Occupation still warrants the issuance of a license. 9. The City may revoke or modify the CHOL upon a finding that conditions have changes to warrant revocation or modification of the license.
