Rockford School Property Update. The School District has given us their concept plan for the first phase of their park /ball field development. I will bring the plan with me to the meeting and give a verbal update. They have taken both a long view on development of their property and near view which is a first phase plan for the ball field development that must start this year. b. PW and Three Rivers Trailhead Update. The city council has had a lot of discussion of late on the trailhead and how it is to be developed and maintained. The biggest issue is the commitment by Three Rivers for ongoing maintenance of the facility and the ongoing repairs that might be necessary. I will update you on the issues and action plan. 8. New Business a. Schmid's Hidden Valley Preliminary Plat -See Planners Report b. Heinz Second Addition Preliminary Plat -See Planners Report c. Meeting with City Planner Kendra Lindahl. Ms. Lindahl with talk about a variety of topic and answer question on the planning process. The main focus will be on the role of the P & T Commission in the development process. With the coming of at least one and maybe more major projects coming to the city, it is important (and you have recognized this importance) that there be a good understanding of the roles everyone in the city will be assuming. I have included Tom Anderson's "Priorities and Principles" statement that he passed out last year and Kendra can comment on the content. She will also be prepared to address the questions sent to me by commissioners and other question you might have on your mind. Included in your packet is an article that was in the star Tribune paper a week ago on Park Dedication Fees. If you have specific question, you can always email me and I can forward on to Ms. Lindahl prior to the meeting. d. Student Commissioner Application. Armbruster Topography and Wetland Waiver (city file no. 09 -011). An application has been received for a waiver from the topography and wetland requirements and was reviewed by the City Council on November 23, 2009. The City Council expressed concerns about the concept and directed the applicant to revise the concept plan. The applicant submitted a letter extending the review period until January 1, 2014. Staff recommends that no further extensions be provided. 2. Schmid's Hidden Valley 2 "d Addition Topography /Wetland Waiver, Preliminary Plat and Final Plat at 21820 Oakdale Drive (PID 04- 119 -23 -34 -0007, 04- 119 -23 -42 -0002 and 04- 119 -23 -42 -0003) (City File No. 12 -016). The application for topography and wetland delineation waiver was approved at the September 27th Council meetings. This item has been tentatively scheduled for Planning Commission public hearing on April 4t , Parks Commission review on April 23rd and Council action on April 25th 3. Site Plan and Variance for Maple Hill Estates Community Center) (City File 12 -022). The landowner and the City received a CDBG grant to construct a new community center on land north of the manufactured home park that is also owned by the park owner. This new building is in the process of being designed. The building is likely to straddle a lot line or at minimum require a setback variance. The survey has been completed and the site plan is currently being prepared. This item has been schedule for Planning Commission review on April 4tH and City Council action on April 25tH 4. Feasibility Study for Lennar (City File 12 -025). The applicant requested that the City conduct an infrastructure feasibility study regarding property west of CR 101 and north of Hackamore. This is part of the property that was previously proposed as the "Hedgestone" development. The applicant has provided an escrow and the City Engineer has begun work on feasibility study. The study is expected to be presented at the April 25th Council meeting. 5. PUD Sketch Plan and EAW for Lennar (City File 13 -007). The applicant has submitted a PUD sketch plan and requested that the city initiate the completion of the required EAW (environmental review assessment worksheet) at the April 25th Council meeting. The EAW is a process required by the state of Minnesota. Following completion of the EAW, the applicant could request approval of preliminary plat and PUD preliminary development plan and finally a final plat, PUD final development plan and rezoning to PUD. 6. Administrative Permit for Special Home Occupation for Jacob Shoulak at 20475 CR 10 (23 -119- 23 -23 -0007) (City File 12 -026). This application is to allow an in -home recording studio. The application is currently incomplete but when a complete application is received, it will be processed administratively. Heinz Second Addition Preliminary and Final Plat at 20801 CR 117 (03- 119 -23 -14 -0002) (City file 13 -003). A wetland and topographic waiver was approved on January 24th. This item has been tentatively scheduled for Planning Commission public hearing on April 4th, Parks Commission review on April 23rd and Council action on April 25th 8. Kohnen /Kothrade Minor CUP Amendment at 23240 CR 30 (07- 119 -23 -13 -0003) (City File 13 -005). This application has been received to resolve a code violation. Staff is reviewing the application as a minor CUP amendment as discussed at the October 11, 2012 City Council meeting and has tentatively scheduled this item for City Council action on April 25tH 9. Lano Equipment at 23580 Highway 55 Site Plan Amendment for Cold Storage. (31- 119- 23 -34- 0007) (13 -006). Staff is currently reviewing the application for completeness. Also, there are a number of projects that have been approved, but are still not filed and closed out: 1. Ess Addition (city files 05 -017, 08 -003 and 12 -024). The City Council granted an after - the -fact extension for this final plat at their November 29, 2012 meeting. The applicant is now working to file the required documents to close out this file. 2. Corcoran Business Park (city file 06 -005). The City Council granted a one year extension to the final plat approval, which expired on April 12, 2011. Staff has spoken to the applicant and is still working to close out this project. 3. Northern Natural Gas Administrative Permit (city file 09 -009). An administrative permit for a meter station was approved and is under construction. The city will retain the escrow account until the project is completed to ensure that the project is completed according to the plans. The majority of the improvements and conditions of approval have been met. However, the landscaping has not yet been installed. Northern Natural Gas indicates that there are still connections that need to be made on site and landscaping cannot be installed until completed. City staff was notified that the landscaping was installed on site and conducted an inspection June 3, 2011. The landscaping and all other improvements were installed per City requirements. Staff has scheduled a site inspection for May 1St and will begin the project closeout process after the inspection. 4. Satellite Industries Site Plan Amendment, Conditional Use Permit Amendment, Lot Consolidation and Easement Vacation (city file 10 -007). On September 23rd the City Council approved Resolutions 2010 -37, 2010 -38 and 2010 -39 approving the request with a number of conditions. The applicant has addressed those conditions and has submitted a building permit application and has begun site work. Staff inspected the site on October 12th and found that the major site improvements had been made, but there are several items that still have to be addressed. We have discussed these items with the landowner. The city has a financial guarantee in place to ensure completion. 5. Park Place Storage After - the -Fact Extension of Approvals (city file no. 10 -008). On September 23, 2010, the City Council approved a site plan and conditional use permit amendment for Park Place Storage to construct the 18th and final mini - storage building on that site. The approvals expired on September 23, 2011. The applicant contacted the City and requested a one year extension until September 23, 2012. The conditions have been met and a building permit was issued in September. The applicant has completed most of the site work with final items to be completed in the spring. 6. Rocks N Blocks Site Plan Amendment and Conditional Use Permit (city file no. 10 -012). An application was received for a Conditional Use Permit and Site Plan Amendment to continue operation of a business with outside storage at 20010 75th Avenue North. The application was approved by the City Council on June 23rd. This was approved as a way to correct a code enforcement issue. No work has been done on site to correct the code violations. The applicant has not yet complied with the conditions of approval and has asked for a 3 month extension. The approvals expired on September 23, 2012. The applicant is working to complete the site improvements. 7. Hope Ministries Conditional Use Permit for Cemetery and Vacation of Drainage & Utility Easement at 19951 Oswald Farm Road (city file 12 -002). Hope Ministries has submitted a request MEMORANDUM for a conditional use permit to allow a cemetery west of the existing church. The application was approved by the City Council on March 22nd and site work had begun. 10. Site Plan Amendment for setback flexibility for Tech Ung at 6970 Oak Ridge Road (26- 119 -23- 44 -0005) (City File 12 -028). The ordinance allows the City Council to approve a setback of less than the required 100 feet adjacent to major roads when significant landscaping is provided. This item was approved by the City Council on January 24tH 11. Agriculture Preserve Initiation and Expiration for Beverly J. Patnode Trust at 22650 County Road 50 (19- 119 -23 -41 -0002) (City File 13 -001). The landowner was briefly out of the Agricultural Preserve program while a parcel was subdivided for Brian and Christina Patnode as MTP West Acres. The landowner is now reenrolling the farmstead in the Agricultural Preserve Program and initiating expiration (in 8 years). This was approved at the March 28th Council meeting. 12. Sprint Cell Tower Administrative Permit /Site Plan Modification at 23400 CR 10 (07- 119- 23 -43- 0006) (13 -004). This is an administrative approval to swap antennas on an existing tower. This application was withdrawn as it was not required. A building permit has been issued. Application Request Ron Schmid is requesting preliminary plat approval for a replat of 2 existing lots and creation of 2 additional lots and outlots. Lot 1 and 2, Block 2 are a replat of the existing homes for Ronald Schmid and Richard Schmid respectively. Lot 1 and 2, Block 1 are two new lots created from Outlot A, Schmids Hidden Valley and Outlot A and B are remaining parcels that are not planned for development at this time. 2. Context Background On September 27, 2012 the City Council granted a Topography Exemption and Wetland Delineation Exemption for Schmid Property at 21925 Oakdale Drive, 21820 Oakdale Drive and 21800 Oakdale Drive. Zoning and Land Use The property is zoned Rural Residential and is guided Rural / Ag Residential. Surrounding Properties The surrounding properties are all zoned Rural Residential and guided Rural / Ag Residential. Natural Characteristics of the Site The draft 2030 Comprehensive Plan shows shoreland overlay district on the eastern portion of this property along the Rush Creek Corridor and medium quality wetland areas in the southern portion the property. ANALYSIS: Park and Trails The adopted 2030 Parks & Trails Plan shows a Proposed County Bike Trail on Oakdale Drive. The Comprehensive Plan states "County Bike Trail — A proposed 3.6 -mile County Bike Trail would run along Oakdale Drive and be managed by Hennepin County." It appears that the proposed 80 -foot right -of -way on Oakdale would be adequate to accommodate this trail and no additional ROW or easement is required. A search area for a future OSP /Nature is shown on the property north of the Schmid property. Staff finds that this search area is outside of the area of the proposed plat, but the Parks and Trails Commission should comment on whether land may be requested when Outlot A develops in the future. Because no park land is shown on the adopted plan, staff recommends that the City accept cash in lieu of land dedication. Section 955.020 of the Subdivision Ordinance states "Park Dedication is only due in cases where additional new parcels are created." Under the current ordinance, park dedication is required at 10% of the net land area. The City may accept cash -in -lieu of land at 10% of the value of the land with a maximum rate of $3,000 per unit for each new unit located outside of the MUSA (Metropolitan Urban Service Area), such as this. Cash in lieu of land would be $3,000 at the current rates (2 x $3,000 per unit). Staff recommends park dedication be required for the two new lots (Lot 1 and 2, Block 1). Park dedication shall be subject to the park dedication fees in place at the time the final plat is released for recording. 4. RECOMMENDATION: Recommend dedication of park dedication for the two new lots, based on the park dedication requirements in place at the time the final plat is released for filing. Attachments a. Application Request Brent and Melissa Heinz are requesting approval of a preliminary plat to allow the creation of 1 new lot for the existing farmstead, 1 new lot for a new home and an outlot for future addition to the new home lot. 2. Context Background On January 27, 2012, the City Council approved a topography and wetland delineation waiver for the portion of the property that would remain with the existing farmstead. Section 930.020, Subd. 6(B)2 of the City Code allows the City Council to waive the topography requirements for lots greater than 3 acres and the City Council has granted waivers from the wetland delineation. In July 2012, David Heinz received a certificate of compliance for an agricultural building with metal siding and in excess of the allowed size. In 2006, a topography and wetland waiver, preliminary plat and final plat was approved for Brandon Heinz to subdivide a 2.5 acre lot in the northwest corner of the farm. In 2001, a Lot Division was approved to allow a 2 -acre site to be subdivided in the northeast corner of the farm. Zoning and Land Use The property is zoned Rural Residential and is guided Rural / Ag Residential. Surrounding Properties The surrounding properties are all zoned Rural Residential and guided Rural / Ag Residential. The property to the north (across County Road 117) is located in the City of Rogers. Landfori SensiblyGeen and Site to Finish are registered service marks of Landform Professional Services, LLC. 0 0 Natural Characteristics of the Site The southwest corner of the farm (where the proposed new lot would be located) is located within the Shoreland Overlay District from the creek that runs through this portion of the farm. The southwest corner of the property is located in the floodplain. The 2030 Comprehensive Plan shows wetland areas in the center of the property and a medium quality wetland in the southwest corner of the site. 3. Analysis of Request Parks and Trails The applicant is not proposing any private or public park land with this plat. The adopted 2030 Parks & Trails Plan shows an on -road trail on Cain Road and an off -road trail adjacent to Rush Creek. • The existing Cain Road right -of -way would be adequate to accommodate this trail and no additional ROW or easement is required. • The trail adjacent to the creek appears to run on the south side of the creek and it appears that no easement would be required. However, the Parks and Trails Commission should review this item and make a recommendation. Because no park land is shown on the adopted plan, staff recommends that the City accept cash in lieu of land dedication. Section 955.020 of the Subdivision Ordinance states "Park Dedication is only due in cases where additional new parcels are created." The subdivision will create one new lot for the existing home and one lot with the existing farmstead. Park dedication is required only for the new lot. Under the current ordinance, park dedication is required at 10% of the net land area. The City may accept cash -in -lieu of land at 10% of the value of the land with a maximum rate of $3,000 per unit for each new unit located outside of the MUSA (Metropolitan Urban Service Area), such as this. Cash in lieu of land would be $3,000 at the current rates (1 x $3,000 per unit). • Staff recommends park dedication shall be required for the new lots (Lot 1, Block 1). Park dedication shall be subject to the park dedication fees in place at the time the final plat is released for recording. 4. Parks do not need to be developed right away. Land which is secured for Parks and Trails is a valuable asset to the entire City and all its residents when it fits into our master Parks and Trail Plan. When a new development is being planned in Corcoran how do we approach the land vs. cash issue? I. Simple land division, property not near park or trail: We should take the money. 2. Simple land division, property on projected trail: Take trail easement over cash for as much land as is on the trail. 3. Simple land division, property near projected park: A more complex question. Can all or part of the projected park be located on this property? (Good land for a park, reasonable access). If the park land needed is larger than the allocation is the developer interested in a `deal', or is the potential park located on a boundary of the property where development by another land owned is possible? (Can we get part of the land now and the rest later) 4. Land division with `outlots', no park or trail near the developed lots: Take the money for the lots to be developed. When the rest of the property is developed we will do the Park and Trails allocation at that time. 5. Land division with `outlots', park and/or trail near property to be developed: We would like to secure as much land as possible for parks and trails. If developer wants to deal only with property being developed we should proceed the same as 3. If the property owner is agreeable it could be to the advantage of park development to take a property easement for the entire property now. Future development would not require additional land or money to Parks and Trails. 6. Large scale developments: Might well be a combination of public and private parks and trails which should advance the Parks and Trails development plan. One would expect some serious negotiating over details of such a development Some important keys to success: Negotiations with developers are not always easy. Developers are interested in creating a development which they can sell to potential buyers. We need to be strong advocates for the City and for the next several generations of Corcoran residents. We should negotiate hard, and in good faith to develop a plan which will work for both the city and the developer. What developers need from us is a plan which does not require extensive modification by the Planning Commission and the City Council. We need to work for a plan that will work for all concerned. Not so long ago every property had `development rights' associated with it which limited the number of housing units which could be developed on the property. That idea is valid only in ......... We should not count on there being a fixed limit as to the number of housing units a property might have in the future. As we have seen in the last Comprehensive Plan density of development has increased in parts of Corcoran. With that increased density the need for parks and Trails will increase substantially. We should also remember that every park and trail that we develop is an ongoing obligation to the City and we should not create Parks and Trails which are going to cause an unwelcome burden on the City decades from now.
