RESOLUTION NO. 2001-79

A RESOLUTION TO APPROVE A CUP TO ALLOW AN ACCESSORY STRUCTURE
CREATING IN EXCESS OF 3,175 SQUARE FEET IN AREA AT 9530 CAIN ROAD
WHEREAS, Dorothy Theis, as applicant, has requested a CUP to allow the construction
of an accessory building; and
WHEREAS, the current ordinance allows over 3,175 square feet of accessory structure
by CUP; and
WHEREAS, the parcel in question is approximately 12.0 acres in size and the total area
of accessory structures requested is 3,928 square feet; and
WHEREAS, The Corcoran Planning Commission held a public hearing on November 1,
2001; and
WHEREAS, the Planning Commission voted 3-3 to recommend the Council approve the
request; and
WHEREAS, The Corcoran City Council considers the recommendation of the Planning
Commission in making a decision.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that CUP
to allow an accessory structure 528 square feet in size to be placed at 9530 Cain Road be and
hereby is approved based on the following findings and subject to the listed conditions:
a) The request is consistent with city plans and the geographical area involved.
b) The use will not depreciate the area in which it is proposed.
c) The use will not adversely impact the character of the surrounding area.
d) The demonstrated need for such use has been provided by the applicant.
e) The proposed use will not cause odors, dust, files, vermin, smoke, gas, noise, or vibration
or impose hazards to life or property in the neighborhood.
f) The use will not inherently lead to or encourage disturbing influences in the
neighborhood.
g) There will be no outdoor storage.
CONDITIONS:
1. No commercial use of the buildings on the property shall be allowed.
2. Any modifications to the use or the facility shall require an amendment to the CUP.
3. A survey and wetland delineation must be completed before a building permit is issued.
4. The structure must be inspected and approved by the Building Inspector before a building
permit is issued.
5. All of the conditions stated above must be met by June 1, 2002.
