HomeMy WebLinkAboutResolution 2001-78 - Approving CUP for 9530 County Rd 116 • City of Corcoran Hennepin County State of Minnesota RESOLUTION NO. 2001-78 Motion By: Gmach Seconded By: cagebv A RESOLUTION TO APPROVE A CUP TO ALLOW AN ACCESSORY STRUCTURE CREATING IN EXCESS OF 3,062.5 SQUARE FEET IN AREA AT 9530 COUNTY ROAD 116 WHEREAS, Donald Hastings, as applicant, has requested a CUP to allow the construction of an accessory building; and WHEREAS, the current ordinance allows over 3,062.50 square feet of accessory structure by CUP; and WHEREAS, the parcel in question is approximately 9.5 acres in size and the total area of accessory structures requested is 4,200 square feet; and WHEREAS, The Corcoran Planning Commission held a public hearing on November 1, 2001; and WHEREAS, the Planning Commission voted 5-2 to recommend the Council approve the request; and WHEREAS, The Corcoran City Council considers the recommendation of the Planning Commission in making a decision. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that CUP to allow an accessory structure 3,150 square feet in size to be built at 9530 County Road 116 be and hereby is approved based on the following findings and subject to the listed conditions: a) The request is consistent with city plans and the geographical area involved. b) The use will not depreciate the area in which it is proposed. c) The use will not adversely impact the character of the surrounding area. d) The demonstrated need for such use has been provided by the applicant. e) The proposed use will not cause odors, dust, files, vermin, smoke, gas, noise, or vibration or impose hazards to life or property in the neighborhood. f) The use will not inherently lead to or encourage disturbing influences in the neighborhood. g) There will be no outdoor storage. • CONDITIONS: 1. No commercial use of the buildings on the property shall be allowed without administrative approval/ license of the Home Occupation. 2. Any modifications to the use or the facility shall require an amendment to the CUP. 3. The exterior finish should be complimentary to the existing structures on the property. 4. A survey and wetland delineation must be completed before a building permit is issued. 5. All existing accessory buildings (besides the two indicated to remain) must be removed by August 1, 2002. 6. Nine (9) six-foot conifers must be planted along the west side of the building facing County Road 116.
