Place North Peterson Variance RESOLUTION 2001-58 MOTION BY: Gmach SECONDED BY: Bucher A RESOLUTION TO APPROVE A VARIANCE FOR 19140 - 81st PLACE NORTH WHEREAS, Jeffrey Peterson, as applicant, has requested a variance to allow expansion of an attached garage; and WHEREAS, the ordinance requires a 20 foot side yard setback; and WHEREAS, the request is to construct the attached garage with a 13.7 foot setback which requires a variance; and WHEREAS, the house as it exists is non— conforming because the front yard setback is 60' and the house is setback 33.9 feet; and WHEREAS, The Corcoran Planning Commission held a public hearing and reviewed the request on August 2, 2001; and WHEREAS, the Planning Commission voted 7-0 to recommend the Council deny the variance because there is no hardship related to the site, there are alternative locations for a detached structure, and the building is currently non-conforming; and WHEREAS, The Corcoran City Council considers public testimony and the recommendation of the Planning Commission and other factors in making a decision. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that the variance is approved based on the following findings: 1. The property cannot be used consistent with allowed uses of all surrounding properties. 2. The property is unique in that it is completely surrounded by Maple Grove. 3. Steepness of the lot limits ability to locate elsewhere. 4. Septic and well locations limits the location of accessory structures.
