HomeMy WebLinkAboutResolution 2001-37 - Approving CUP - 23400 Country Rd 10 1 .v, ., City of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2001-37 Motion By: Thomas Seconded By: Bucher A RESOLUTION TO APPROVE A CUP/SITE PLAN FOR G & M PROPERTIES/HOFFMAN SALES AND LEASING TO BE LOCATED AT 23400 COUNTY ROAD 10. WHEREAS, Greg Ebert and Greg Hoffman, as applicants, have requested a CUP/Site Plan and Rezoning to allow use of an existing building located on County Road 10 ; and WHEREAS, The Corcoran Planning Commission held a public hearing and reviewed the request on May 3, 2001; and WHEREAS, the Planning Commission voted 5-0 to recommend the Council approve the application as requested; and WHEREAS, the site improvements shall be as outlined in the attached plans; and WHEREAS, a separate ordinance has been provided for Council consideration regarding rezoning; and WHEREAS, The Corcoran City Council considers public testimony and the recommendation of the Planning Commission in making a decision. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that the CUP/site plan for G&M Properties & Hoffman Sales and Leasing be and hereby is approved based on the following findings and subject to the listed conditions: a) The request is consistent with city plans and the geographical area involved. b) The use will not depreciate the area in which it is proposed. c) The use will not adversely impact the character of the surrounding area. d) The demonstrated need for such use has been provided by the applicant. e) The proposed use will not cause odors, dust, files, vermin, smoke, gas, noise, or vibration or impose hazards to life or property in the neighborhood. f) The use will not inherently lead to or encourage disturbing influences in the neighborhood. g) Equipment to be stored on site will be screened within a fenced in area. City of Corcoran County of Hennepin State of Minnesota CONDITIONS: 1. The property shall be rezoned to C-2 consistent with the adjacent land. 2. The site improvements including curb and gutter, fencing changes and landscaping shall be implemented before a Certificate of Occupancy is issued for the site and before any vehicles or equipment is stored on the site. 3. A specific landscape plan shall be submitted for the property prior to City Council review. 4. Display of vehicles for sale shall be limited to the 17 stalls on the south side of the property. 5. Equipment to be stored shall be within the fenced area. 6. The fence to be constructed shall provide screening of the materials to be stored. 7. The City Engineer shall review the drainage needs of the site and shall recommend if adequate facilities exist to accommodate the run-off. If adequate facilities are not available additional storm water storage shall be provided on site. 8. All vehicles outside of the fenced area shall be road-worthy. 9. No banners,pennants, or string lights shall be used on the property. 10. The septic tank shall include an alarm, water meter and reports regarding maintenance and pumping shall be submitted to the City. 11. Any change in ownership or use shall be obligated to the conditions of the CUP and related site plans. The following voted in favor of said resolution: Bucher, Gageby, Guenthner and Thomas The following voted against the same: Whereupon said Resolution was declared carried.
