HomeMy WebLinkAboutResolution 2001-33 - Approving CUP and Variances for Kidnation Comercial Daycare Center City of Corcoran County of Hennepin State of Minnesota RESOLUTION NO. 2001-33 Motion By: Thomas Seconded By: Bucher A RESOLUTION TO APPROVE A CUP/SITE PLAN AND VARIANCES FOR KIDNATION COMMERCIAL DAYCARE CENTER WHEREAS, Tim and Kristal Zimmerman, as applicants, have requested a CUP/Site Plan, variances, Rezoning and Text amendment to allow construction of a commercial daycare facility; and WHEREAS, The Corcoran Planning Commission held a public hearing and reviewed the request on May 3, 2001; and WHEREAS, the Planning Commission voted 6-0 to recommend the Council approve the application as requested; and WHEREAS, the variances include allowing two buildings on one lot and a side yard setback of 27 feet and the hardships identified include: the constraints of the site including the existing building, the state regulations regarding mandatory play areas and that the ordinance is not consistent; and WHEREAS, separate ordinances have been provided for Council consideration regarding rezoning and text amendment; and WHEREAS, The Corcoran City Council considers public testimony and the recommendation of the Planning Commission in making a decision. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Corcoran that the variances and CUP/site plan for KidNation be and hereby is approved based upon the following findings and subject to the listed conditions: a) The request is consistent with city plans and the geographical area involved. b) The use will not depreciate the area in which it is proposed. c) The use will not adversely impact the character of the surrounding area. d) The demonstrated need for such use has been provided by the applicant and public testimony. e) The proposed use will not cause odors, dust, files, vermin, smoke, gas, noise, or vibration or impose hazards to life or property in the neighborhood. f) The use will not inherently lead to or encourage disturbing influences in the neighborhood. g) No equipment is proposed to be stored outside. City of Corcoran County of Hennepin State of Minnesota CONDITIONS: 1. The property shall be rezoned to C-1. 2. Security to guarantee the installation of site improvements shall be submitted prior to issuance of the building permit. 3. The site shall comply with the wetland conservation act. 4. The building shall be setback 50' from the westerly property line. 5. The driveway location and design is subject to the review and approval of Hennepin County. 6. A drainage plan shall be submitted and is subject to the review and approval of the City Engineer. 7. Lighting on the property shall be downcast, shoebox style fixtures. The following voted in favor of said resolution: Bucher, Gageby, Guenthner and Thomas The following voted against the same: Whereupon said Resolution was declared carried.
