Resolution Amending Liquor Violation Policy
Whereas, the State of Minnesota does authorize cities to impose penalties, suspend and or
•
revoke liquor licenses from license holders when terms of the license are violated; and
Whereas, the Council of the City of Corcoran determined that it was in the best interest and
welfare of the citizens to adopt and enforce such a policy and therefore did adopt the "Corcoran
Liquor Violation Policy" on February 22, 2001; and
Whereas, the Council has determined that the policy should be amended to allow for improved
understanding and enforcement of such a policy;
Therefore, be it resolved, that the Council of the City of Corcoran does hereby amend the
"Corcoran Liquor Violation Policy" as hereto attached as Exhibit A.

CORCORAN LIQUOR VIOLATION POLICY
Minnesota Statute §340.415 authorized the City of Corcoran to impose a penalty of a fine
(up to $2,000) and to suspend or revoke a liquor license upon a finding that a license holder has
violated the terms of the liquor statute.
In cases where such a violation is alleged, the City Council has determined to conduct a
hearing in compliance with the Administrative Procedures Act as a regular City Council meeting
to receive information in support of the allegations and to give the license holder an opportunity
to be heard.
Upon a find that a license holder or a representative of the license holder, has committed
a violation of the liquor statute, the City Council has determined to impose, at a minimum, a
penalty as follows:
First Offense $ 300 fine
Second Offense $ 500 fine plus 2 day suspension
Third Offense $ 900 fine plus 18 day suspension
Fourth Offense $ 1000 fine plus license revocation if within 48 months of a
First Offense.
If any two violations occur within a twelve month period, the Council may impose a
$1,000.00 fine and license revocation.
The City Council may amend this policy from time to time by resolution.
Adopted this 8th day of March, 2001.
