HomeMy WebLinkAboutResolution 1999-56 - Approving CUP 9845 Rush Creek Blvd - Swenson RESOLUTION NO. 1999 -56 A RESOLUTION GRANTING A CONDITIONAL USE PERMIT; AND A VARIANCE FROM REAR YARD SETBACK TO RAYMOND SWENSON TO CONSTRUCT A 28 FT. X 48 FT. (1,344 SQ. FT. ) ACCESSORY BUILDING ON A 2.0 ACRE RESIDENTIAL HOMESTEAD FIVE (5) FEET FROM THE REAR LOT LINE, LOCATED AT 9845 RUSH CREEK BOULEVARD, PID #08-119-23 23 0010. WHEREAS, Raymond Swenson has requested a Conditional Use Permit; and a Variance from rear yard setback to construct a 28 ft. x 48 ft. (1,344 sq. ft.) accessory building on a 2.0 acre residential homestead five (5) feet from the rear lot line, located at 9845 Rush Creek Boulevard; and WHEREAS, on August 5, 1999, the Planning Commission considered the Conditional Use Permit and Variance request and moved to recommend approval with conditions. NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Corcoran hereby approves a request by Raymond Swenson for a Conditional Use Permit and a Variance from rear yard setback to construct a 28 ft. x 48 ft. (1,344 sq. ft.) accessory building on a 2.0 acre residential homestead five (5) feet from the rear lot line, located at 9845 Rush Creek Boulevard, and legally described as Lot 1, Block 2, Oak Hollow, Section 08, Township 119, Range 23, Hennepin County, Minnesota, according to the recorded plat thereof, subject to the following conditions: 1. The building shall be used for personal storage only. 2. No commercial activity shall be allowed on this property. 3. Construction would be allowed in the flood fringe if elevated on fill to above the regulatory flood protection elevation of 971.9. A survey identifying this elevation shall be completed by the applicant and shall be reviewed by the City Engineer. 4. Identification of a secondary septic site. 5. Compliance with the Wetland Conservation Act. Moved by member IJ seconded by member Pluthe.r. The following voted in favor of said resolution: Mayor Guenthner, Council members Bucher, Glowacki, Lindsley, and Thomas. The following voted against the same: None.
